MEMO REGARDING OCTOBER 15 2024
NOTE: A meeting of the Planning Board was scheduled for October 15 2024. However, the
requirement for quorum was not met, and therefore an official meeting could not be held.

The Planning Board and Planner were unsure of the procedure without a quorum present. At
the time, they believed they could hold a meeting and they could open the public hearing, but
not take any actions. During the evening:
• They discussed the minor subdivision proposed for 201 Jersey Hill Road, attempted to
open the public hearing, and responded to questions from the audience present.
• They discussed scheduling a Planning Board meeting on October 29 th to take the actions
planned for the October 15 meeting.
• They discussed the 202 Jersey Hill Road minor subdivision application.
• A presentation of the Draft City of Ithaca Drinking Water Source Protection Plan
Stormwater Build-out Analysis - Findings and Recommendations for Danby was given
by Rebecca Minas, Roxa nne Johnston & Grace Desantis.
o Recommendations for the Town of Danby
1. Comprehensive Plan
• Recommendation: Consider including protection of neighbor’s
drinking water supply in next update
2. Clustered Subdivision Regulations
• Recommendation: Update to encourage the siting of clustered
structures away from streams
• Recommendation: Update to consider potential impacts to
subsurface flows and drinking water source area as a review
consideration
3. Riparian Overlay District
• Recommendation: Apply same regulations for perennial streams
to intermittent streams
• Recommendation: Expand prohibition of addition of “impervious
surface” to restrict “disturbance of land” and clearing of trees
• Recommendation: Require/incentivize planting within stream
setback in site plan and/or facilitate tree planting programs in
setback
4. Solar Energy Systems
• Recommendation: Update to support water quality-conscious site
planning per Model Local Solar Law
5. Steep Slopes Law
• Recommendation: Establish a steep slopes law or overlay
protection district that: I. Regulates certain activities (excavation,
stormwater discharge, etc.) II. Includes standards for construction
of erosion protection structures III. Includes additional per mit
review compliance items
• Recommendation: Reference NYS Department of State’s model
local law for steep slopes
6. Critical Source Water Area Overlay District
• Recommendation: Expand Aquifer High Vulnerability Overlay
District to include the City of Ithaca’s critical source water area
It was later determined through consult with the town lawyer that meetings cannot be held
without a quorum present. Therefore, a special Planning Board meeting was scheduled for
October 29 th with development review for the minor subdivision proposals at 201 and 202 Jersey
Hill Road on the agenda. The Public Hearing for 201 Jersey Hill Road will occur at that time.
Notice in the Ithaca Journal and to the neighbors will be given as required by law.
