Town of Danby Planner, David West and Town Supervisor, Joel Gagnon will host an informal discussion on plans to set up a Stormwater District to maintain the stormwater infrastructure related to the Beardsley Ln. Subdivision (including parcels on Loomis Ct. and Comfort Rd.)
Time Line
•Development and subdivision was approved in 2004
•Approval required all sales to include notice that the Town could set up a Stormwater District in the future
•Developer (CMC) was required to maintain stormwater infrastructure until a District was created
•Set up escrow account to pay for maintenance and legal fees if developer didn’t do what they were supposed to
•2006 District creation process started but was not completed
•2019 Town was notified by County that Stormwater Parcels were going to be foreclosed on due to 3 years of unpaid taxes
•2021 Town took ownership of Stormwater Parcels & Restart District Formation
What is a Stormwater District?
•Taxing boundary to pay for local stormwater infrastructure
•Set up by Town
•Residents within boundary pay for maintenance of neighborhood
infrastructure
Process for Forming District
•Map Plan Report (MPR) –Draft has been completed by Town
Engineer
•Town Board adopts final MPR
•Notice of Hearing
•Conduct Public Hearing, Make Findings
•Issue Conditional Approval
•Issue Final Order forming District
What’s Next Once District is Formed
•Town will maintain stormwater facilities starting with deferred
maintenance
•Maintenance may be done by Town Highway staff or a contractor
•Annual costs will be assessed per house lot within the District
SWM 1
1. Remove fallen trees and limbs from within the pond.
2. Mow the embankments in-board of the pond twice per year.
3. Fill the void spaces between the HDPE outlet pipe and the concrete control structure with nonshrink grout.
4. Replace stone fill (rip-rap) on the main channel leading into the permanent pool basin. It is noticeable where the
underlying filter fabric is exposed.
5. Additional earth fill may be needed behind the concrete outlet control structure in order to establish the correct top
elevation of the surrounding berm. This will become more apparent after mowing has been completed.
SWM 2
1. Mow the embankments in-board of the pond twice per year including the removal of trees and invasive shrubs.
2. Fill the void spaces between the HDPE outlet pipe and the concrete outlet control structure with non-shrink grout.
Swale
1. Cut and remove trees and brush smaller than 3-inch diameter within the limits of the 30-foot-wide easement the full
length of the easement area. Trees larger than 3-inch diameter can remain unless dead or known to be an invasive species.
2. Perform excavation and soil stabilization restoration from the northeast corner of parcel 2-1-9.7 to SWM 2 to conform
with the Developers original grading plan. The alignment of the swale can be adjusted to avoid removing trees over 3-inch
diameter that are determined desirable to remain.
Deferred Maintenance
Why does this maintenance need to be done?
•Required by DEC Stormwater Permit
•Protects the watershed from excess runoff and erosion due to
development
•Protects neighborhood from internal flooding, erosion, and
maintenance issues
What if a district is not formed?
•Town would have to decide whether or not to perform maintenance
using general fund tax dollars
•Liability if DEC stormwater permit requirements aren’t met
•Increased legal costs and liability for the Town
•Further delay in addressing deferred maintenance
•Risk of damage to the environment or private property
What’s it going to cost?
•Town will use developer escrow account first to cover District Setup
Fees (current escrow account balance is around $10k)
•The per lot cost to landowners after exhausting the escrow account
will be approximately $420 in year 1 assuming work listed is
completed
•Subsequent years cost will be the total maintenance and
administrative costs (estimated to be $3,070/year) divided evenly
between 22 lots, anticipated to be approximately $150/year
•Cost will be added to Town Property Tax bills
