Crane asked to see Pat Woodworth on camera. He also reported that in Nov/Dec
a change in the town’s website software (Zoho) began to allow third-party
cookies. He suggested that due to security concerns third-party cookies are
often disabled and hopes that we will report this to Zoho with the strongest
disapproval and a request to disable them.

4.2.Ronda Roaring
Roaring echoed what Ted said and added that she feels violated. She noted that
we shouldn’t be being tracked at all on the town website and isn’t sure that it’s
legal. She then noted that she wanted to talk about the structure that has gone
up on South Danby Road that wasn’t addressed when she mentioned it back in
November. Number two was the Standard Work Day Resolution and reporting in
which she visited the state Comptroller’s website and found pages and pages of
directions for how to complete the forms and she hasn’t seen any of it being
presented; she noted that it needs to be displayed on the town website for 30
days, along with having a record of activities calculation over a 3-month period.
She was concerned that either Janice or the Board, or both, are not following
instructions and stated that everyone needs to follow the instructions on the
OSC website.

9.1.Resolution 004 of 2023 Approval to Order A New Pickup Truck

WHEREAS: the Highway Department is in need of a new pickup truck. The old truck
that is used for plowing developments is beginning to deteriorate and the electrical
functions are beginning to fail and need replacement.
WHEREAS: the Highway Department has gathered three quotes for pickups that would
meet the needs of the town.
WHEREAS: the dealers are still honoring the old manufacturers price until January
13th. After that date the OGS price will increase and orders will not be able to be made
until November of 2023.
RESOLVED: the Town Board gives the Highway Superintendent permission to place an
order for a new pickup truck that will meet the needs of the town’s plowing obligations.
The price shall not exceed $60,000. The funds for this purchase will come from the
Fund Balance of the Highway Fund.

9.2.Resolution 005 of 2023: Support for Replacement of the Bridge on Town Line
Road over Lick Brook Stream

WHEREAS the bridge located in the Town of Ithaca at the North end of Town Line Road
over Lick Brook Stream has become a major public safety concern to the Town of Danby
Highway Department and our employees, and
WHEREAS the Highway Superintendent of the Town of Danby has personally inspected
the bridge and the reports and documents received from the Town of Ithaca regarding
it, and
WHEREAS the bridge is not located within our town’s jurisdiction, but is a major
connector to the central and west districts of the town. Upon the inspection, the
Highway Superintendent agrees that the core infrastructure is failing rapidly and is in
need of replacement, now therefor be it resolved
RESOLVED that the Town of Danby supports the efforts to replace this bridge as soon
as possible.

10.Organizational Resolutions
10.1.Supervisor Gagnon read the following into the record:
10.1.1.Rules of Order adopted by the Town Board as Resolution 61 of 2020 and
subsequently amended by Resolution 46 of 2021 will be followed at all
Town Board Meetings.
10.1.2. The orderly conduct of all meetings is imperative. Accordingly, there can
be only one speaker at a time and whoever is chairing a meeting should
insist on controlling the order of speakers to ensure that. The following
statement of policy will be added to the posted agenda for all Town
Board meetings: The public has a right to attend and observe all public
meetings. This right does not include the right to comment, except at
public hearings. It is, however, the policy of the Town Board to allow for
participation by the public at all Town Board meetings, primarily during
time set aside for it, called privilege of the floor. Each speaker may be
limited to 3 minutes. Comments may be allowed at other times during the
meeting, but only if a person wishing to speak is recognized by the chair.
10.1.3. Method of claims for payment of all bills will be by voucher.
10.1.4. The Town Board will audit all bills.

Resolved, that in lieu of any individual undertaking as required, the Town
Board of the Town of Danby approves the procurement of a blanket

Resolution No. 010 of 2023: Payment of Bills
Resolved, that the Town Board of the Town of Danby approves a blanket
resolution to authorize the Town Supervisor to pay utility bills, freight,
postage, and to execute contracts (except for bid awards and other
requirements from the procurement policy, which shall be executed by
the Town Board), and to conduct other normal proceedings, such as
payroll in advance of audit in order to keep affairs moving on a timely
basis.
Resolution No. 011 of 2023: 2022 Financial Report
Resolved, that the Town of Danby Town Supervisor, in lieu of preparing a
financial report under NYS Town Law Article 3, §29.10, shall submit to the
Town Clerk a copy of the report submitted to the State Comptroller

Resolved, that the Town Board of the Town of Danby names the Ithaca
Journal as its official Newspaper and Key Bank and Tompkins Trust Co. as
depositories for Town Funds.
Resolution No. 013 of 2023: Danby Attorneys
Resolved, that the Town Board of the Town of Danby names the law firms
of Miller Mayer, LLP and Thaler and Thaler to represent the Town of
Danby in all Zoning, Planning Board, and General Town of Danby
business. The Town Board reserves the right to seek other legal aid if it
deems it necessary.

Resolution No. 014 of 2023: Mileage Reimbursement For Town Mileage
Resolved, that the Town Board of the Town of Danby authorizes
reimbursements for private automobile mileage incurred on Town
Business to be paid at the rate of sixty-two and a half cents ($0.625)
per mile.

Resolution No. 015 of 2023: Town Board Meetings
Resolved, that the Town Board of the Town of Danby regular monthly
board meetings be scheduled at 6:00pm, with the first meeting on
the first Tuesday of the month and the second meeting on the third
Wednesday thereafter.
Resolution No. 016 of 2023: Highway Improvements Reimbursement
Resolved, that the Town Board of the Town of Danby will sign an
agreement that monies collected for repairs and improvements of
Town Highways (State Aid DA3501, Consolidated Highway
Improvement) be expended upon 70.2 miles of Town of Danby
highways.
Resolution No. 017 of 2023: Agreement To Spend Town Highway Funds -
2023
Resolved, that pursuant to the provisions of Section 284 of the
Highway Law, the Town Board of the Town of Danby agrees that
money levied and collected for the repair and improvement of
highways, and received from the state for repair and improvement of
highways, shall be expended as follows:
- General Repairs. The sum of $317,776 may be expended for
general repairs upon 70.2 miles of town highways, including roads,
culverts, and bridges.
- Improvements. The allocation of CHIPS money to be spent on
town highway improvement projects will be determined by the
Highway Superintendent, with the concurrence of the Town Board,
at a later date.
No money set aside for such improvements shall be expended, nor
shall any work be undertaken on such improvements, until the Town
Board approves the specifications and estimates for such
construction.

establishes six (6) hours per day as a standard work day for the Town Clerk who

10.15.Resolution 046 of 2023 to Authorize the Labor Contract Execution

Whereas the contractual agreement between the Civil Ser vice Employees
Association and the Town of Danby covering the years 2019-2021 and then
extended to cover 2022 has expired, and
Whereas both parties to that agreement have negotiated in good faith to
develop a contract to apply for the next 4 years and have reached a tentative
agreement, and
Whereas said tentative agreement is subject to ratification by both parties, now
therefore be it
Resolved that the Town Board of the Town Of Danby authorizes the Town
Super visor and Council member Pat Woodworth, who negotiated the agreement,
to sign and execute the contract on behalf of the Town, subject to concurrence
and counter-signing by the Union Committee members.
