Resolution ill to Declare an Emergency Situation On the Failing Culvert Head Walls on Peter Road Moved By: Connors Seconded By: Hunter WHEREAS the headwalls on the culvert on Peter Road on both the inlet and outlet ends are tipping over and creating a situation where the road could collapse, possibly plugging the culvert as well, THEREFORE BE IT RESOLVED that the Town Board declares this an emergency situation. Resolution 113 of 2023 To Authorize the Highway Department to Replace the Peter Road Culvert Head Walls as Part of the Agreement to Spend Funds for 2023 4 of 8 Town of Danby, New York Town Board Meeting Minutes ig April 2023 Moved By: Gagnon Seconded By: Connors Pursuant to the provisions of Section 284 of the Highway Law, we agree moneys levied and collected for the repair and improvements of highways and received from the state for repair and improvement of highways shall be expended in part as follows: General Repairs 1. A sum not to exceed $9,500 shall be spent to replace the inlet and outlet headwalls on the Peters Road culvert. This will be paid out of the Extreme Winter Recovery funding provided to the Town of Danby from the Department of Transportation. Resolution 112 to Authorize an Emergency Award of Contract to JB Excavation to Replace the Peter Road Culvert Head Walls Moved By: Gagnon Seconded By: Connors WHEREAS the Town Board has declared an emergency situation on Peter Road per Resolution 111 of 2023, and WHEREAS a contractor who has been working on a project for the town is still in the area and is available to fix the culvert. The contractor is JB Excavation, and the price that he quoted is more than reasonable for the project. Now therefore, be it 5 of 8 Town of Danby, New York Town Board Meeting Minutes 19 April 2023 RESOLVED that the Town Board declares this an emergency situation and therefore awards the project to JB Excavation for the amount of $9,500.00. The amount of the transaction will be paid for out of the Extreme Winter Recovery funds that have been allotted to the Town of Danby from the Department of Transportation.
