3.1.Heather Crosby, resident.
Attended the meeting of the Danby Youth Commission and announced that they
have an online survey for Danby youth ages 11–17 to complete.
3.2.Ted Crane, resident.
Asked that since Paul Hansen was not in attendance, could the camera be
moved slightly to show anyone speaking at the mic. Crane also commented
about a non-licensed stock photo used on the Planning Department’s web page
within the Town of Danby website stating that “content on the website should
represent Danby, not some village on a Caribbean island or wherever that
picture belongs.”

6.2.1.Shipman was not in attendance; Laura Shawley noted that the highway
department is working on budget preparations in addition to paving,
shoulder work, and preparing for the upcoming winter.

9.Business
9.1.Reboot Short-term Rental Working Group
9.1.1.The Board tasked new Planner Greg Hutnik and Board members Katharine
Hunter and Leslie Connors with reviving this group.
9.2.Revisit BBQ VII Prosecution
9.2.1. Gagnon noted that Paul Hansen swayed the Board that it might not be that
expensive to prosecute; Hansen and Hutnik put together an appearance
ticket and an accusator y instrument; shared their work with Attorney Guy
Krogh
9.2.2. Gagnon noted that the town has already spent over $1500 in attorneys fees
on this matter; continuing to pursue this with Krogh will increase the cost
substantially. With that, Gagnon asked the Board again if this was the way
to go.
9.2.3.Hunter asked what the alternative would be.
9.2.4. Gagnon offered two options:
9.2.4.1. Use Hutnik and Hansen without attorney representation until the
matter goes to court and seek out alternative representation
which in the grand scheme of things might still cost as much as
Krogh if the new attorneys need to spend time reviewing the case
and being brought up to speed.
9.2.4.2. Skip the prosecution and go to changing the laws by beefing up
the enforcement section of the zoning law with either adding the
possibility of such events being an allowed use with special permit
and site plan review by the Planning Board, or drafting a free-
standing law to address special events.
9.2.5.Woodworth suggested prospecting other attorneys
9.2.6.Hunter suggested checking with AOT for guidance
9.2.7.Connors is hesitant to spend a lot of money with an uncertain outcome
9.2.8.Gagnon noted that Krogh would have the highest likelihood of winning a
case for the town

9.2.9.The board consensus was to explore options.
9.3.Organize Budget Review Process
9.3.1.Woodworth suggested having a separate budget meeting next week to start
the initial budget process to have a list of the people that are requesting
money and the various departments.

Resolution 197 of 2023 to Schedule a Budget Meeting for Friday 29 September 2023 at 6pm

Clerk Adelman noted that she would not be available at that time despite the
Board not asking while throwing out times and days.
Gagnon suggested the deputy clerk fill in; however the deputy clerk is not
available either.
The Board stated that the meeting would be recorded and that it would not be a
big deal to not have a clerk present to record the minutes. They then stated that
they would find a clerk to fill in since both the Clerk and Deputy were
unavailable, rather than rescheduling to a time when all required participants
would be able to attend the meeting.

9.4.Resolution 198 of 2023 for Approval To Increase the Approved Amount of
$60,000 for the Additional Cost of Plow Equipment

WHEREAS the Town Board approved in a previous resolution a sum not to
exceed $60,000 to purchase a pickup truck and add the additional plow
equipment, and
WHEREAS the Highway Department has gathered three quotes for the
additional equipment, and the lowest quote is larger than the previous approval
of $60,000 in total, now therefore be it
RESOLVED that the Town Board gives the Highway Superintendent permission
to spend an additional amount not to exceed $3,500 to add the additional winter
equipment. This would entail a plow, spreader, and backup lights. The funding
for this additional amount would come from the Machinery Contractual Line,
DA5130.400.

Resolution 199 of 2023 To Approve Adding Additional Plow Equipment to New Pickup Truck

WHEREAS the Highway Superintendent would like to have plow equipment installed on
the newest pickup truck in the Highway Department. The pickups are used in small
developments for the maintenance of the roads, and
WHEREAS the Highway Department gathered three quotes for the additional
equipment and selected the company that gave the lowest quote,
Now therefore be it RESOLVED that the Town Board gives the Highway Superintendent
permission to spend an amount not to exceed $13,000 to add the additional winter
equipment. This would entail a plow, spreader, and backup lights. The funding for this
additional amount would come from the Machinery Contractual Line, DA5130.400 in
the amount of $3,000, part of the amount left in the Workers Comp line, DA9040.800 in
the amount of $5,000, and part of the amount left in the Retirement line, DA9010.800
in the amount of $5,000.
