TOWN OF DANBY
TOWN BOARD MINUTES
September 7 , 1967
The regular meeting of the Town Board of the Town of Danby
was held at the Town Hall , Thursday , 8 : 00 P . M . , September 7 , 1967 .
Board members present : Supervisor James H . Cortright , Councilmen
Donald Makie and Donald Barber , Justices
Moses Peter and Floyd Dorn .
Other present : Zoning Officer Hatfield , Highway Superintendent
Chaffee , Mr . and Mrs . Ted Merritt , Mr . and Mrs .
Peter Sundquist , Beatrice Hogben , Francis Wright ,
Lucretia Bowles , Alida Burch , Dorothy Everhart ,
Esther Eckert , Carol Benjamin ; Mr . and Mrs . Kenneth

Supervisor Cortright called the meeting to order . Minutes of the
COMMUNICATIONS August meeting were read and approved .
1 . Permission from Department of Audit and Control to establish
the West Danby Water District .
2 . From Attorney Clune re : Zoning Ordinance .
3 . State Board of Equalization and Assessment - Revised list of
preassessment of taxable state - owned land for the Town .
4 . Notice served by Zoning Officer Hatfield re : Junk Cars .
50 State Traffic Commission re : signs installed .
6 . Reply from Tompkins County Highway Superintendent re : Signs .
PRIVILEGE OF FLOORrc - None from the Board
Several persons present discussed the busing situation- - can
Town Board do anything regarding children walking to school within
the 1 . 2 mile limit ? Supervisor stated " he does not know , but will
look into it . " Mrs . Benjamin asked if sidewalks can be put in .
Supervisor said , " probably can be done a different way , " and
regarding bus situation , " Town Board could go to Board of Education
which has been cooperative in the past . "
Peter said " situation requires drastic action - - town ' s
responsibility , mentioned hiring a bus - - even at this ridiculous
expense " . Proposed that the Town Board meet with Board of Education .
Makie supported forming a sidewalk district . " It would take
a . .group of epople who want it . "
Donald Carroll a member of the Transit Advisory Committee
for the Ithaca City School District announced that Dr . Bardwell
will meet with people at Danby School September 8th and to ask
questions and let feelings known .
Ted Merritt gave 'a report on labor and materials which would
be donated if the Youth Committee of the Danby Community Council
may have the exclusive use of the Town Hall for a youth center. .
Supervisor suggested a meeting between Town Board and a spokesman
or group representing the Community Council and will. obtain legal
advice . Meeting set for Tuesday , September 12 in the Town Hall .
Mrs . Marge Epp asked about open outside day fires and Urban
Renewal for Danby . Supervisor answered burning outside fires is
incorporated in part of Dumping Ordinance - Ospecifically included ,
and to his knowledge , there is no clause or statement which applies
to rural areas , regarding urban renewal .
REPORTS OF COMMITTEES
Highway - none
Zoning - Makie reported zoning atp will be presented in rough draft
form as soon as possible . Supervisor said he had talked
with Jim Lee . All Town Board and Planning Board to meet
to see map .
Fire - none
Cemeteries - Dorn reported work still going on at Town Barn Cemetery ,
and stones set back in at Peter Cemetery , some hand
work to be done .

Insurance - Peter reported coverage for trees removed in West
Danby .
Youth - Barber reported this had been covered under Privilege of ,
Floor .
OLD BUSINESS
- Highway Superintendent reported trees cut down in West Danby .
Need a resolution on transfer in Highway Fund . Signs - report
from County - need about 40 on Town Highwasy , need to be purchased
to be installed January 1st . Bucket Loader - delivered and had
demonstration , all that they expected and alleviates manpower
situation rebuilding roads , and eliminates most of brush cutting .
Will need ' a resolution - on rental of - Bucket Loader and Crane .

Zoning Officer no report . '
Planning Board - Dry Bryce reported that the Planning Board took 0
no action on the Sanitary Landfill location as
there was no report from a committee from
Hornbrook Road ;
Appeals Board - no one present .
Board of Assessors - no one present .
Jennings Pond - Supervisor reported there had been no estimate
received from Neil Nelson for a fence at end :
- of dike .
Sanitary Landfill - Supervisor reported no alternative site pro -
posed from group opposed . He mentioned the
possibility of contracting with Landstrom
Gravel Co . to operate a landfill site ° south
of the present dump on Hillview Road . Landstrom
has expressed tentative interest in operating
a sanitary landfill for more than one community
in Tompkins and Tioga Counties . Cortright r ;
said cost may be prohibitive but Would like '
to explore all possibilities since dissatis -
faction from residents on Hornbrook Road .
Peter convinced ' Hornbrook Rd . site is the
best possibility to people ' s needs and is
in center of Town .
Peter made the motion to purchase the Hornbrook
Road site and immediately put plans in motion .
No second . Motion lost .
Peter made the motion the Town Board take
immediate steps to purchase the Hornbrook
Road site and put it in operation as a Sanitary
Landfill on an experimental basis for two years
hence this date to determine whether an asset
or detrimental to the Town at a public hearing .
Seconded by Makie .
Supervisor Cortright offered an amendment
that the Town purchase the property as agreed
but not to establish a Sanitary Landfill at

this time reasoning cost may be prohibitive ,
therefore , suggest to continue use of present
open- face dump and investigate Landstrom site .

West Danby Water District - Department of Audit & Control has
kiven permission to establish the
West Danby Water District .
Recreation Land - WeSley Locke ' s attorney quoted Supervisor a
- price of $ 10 , 000 for land north of Jennings
Pond . Discussion followed . Peter suggested
a price of $ 6 , 000 , but to obtain . a professional
appraisal . Peter was asked to look into matter .
Speed sign to Jennings Pond - Supervisor has not contacted Bob
Simpkins .
NEW BUSINESS
Governor ' s proclamation declaring Citizenship Day - September 17 ,
1967 and Constitution Week - September 17 - 23 , read by Clerk ,
Dog Enumerator - Supervisor asked if Firemen would like the task ,
will decide at the September 11th meeting and let
Supervisor know .
°Letter from Attorney Clune re : Zoning Ordinance - Peter said to
go along with trailer sales on east side of Rte 96B and to
enforce the zoning ordinance on the west side .
Planning Board Resignation - Pe'ter made the motion to appoint
Mrs . Marge Epp a member of the Danby Planning Board. due to
the resignation of Darwin Geuther which term expires
, June 30-, 1972 . Seconded by Makie . 5 ayes , 0 noes , carried .
Bus Transportation - Supervisor will ask lawyer what authority
does Town have in providing bus transportation to school .
Sidewalk District - Supervisor will alert lawyer what steps are
necessary in forming district . Will report to the Board .
RESOLUTION # 7 ( 1967 ) ' TRANSFER OF FUNDS
WHEREAS , at the regular Town Board meeting held at the Town Hall ,
Town of Danby , Tompkins County , New York , September 7 , 1967 , it was
RESOLVED , that the sum of $ 811 . 99 be transferred from Item I to
Item IA of the Highway Fund .

RESOLUTION # 8 RENTAL OF BUCKET LOADER
411 WHEREAS , at the regular Town Board meeting held at the Town Hall ,
Town of Danby , Tompkins County , New York , September 7 , 1967 , it
was
RESOLVED , the the Highway Superintendent be authorized to rent a
Bucket Loader for a period of three months at a minimum rental of
$ 1100 . 00 per month .

RESOLUTION # 9 ( 1967 ) RENTAL OF CRANE
WHEREAS , at the regular Town Board meeting held at the Town Hall ,
Town of Danby , Tompkins County , New York , September 7 , 1967 , it was
RESOLVED , that the Highway Superintendent be authorized to rent
a Crane at a rate of $ 30 . 002per hour from H . D . Besemer , Inc . and
be it further
RESOLVED , that said authorization be retroactive to 8/28/67 .
