Meeting Called to Order at 19:04 by Supervisor Gagnon 2. Additions/Deletions to Agenda 2.1. COVID Vaccination and Testing Policy - new business 2.2. Schedule Public Hearing for Norbut Solar PDZ Application October 11 - added as item 9.4 2.3. Agreement to spend Highway Funds - bottom of new business as item 9.6 3. Privilege of the Floor 3.1. Garry Huddle asked who is in charge when something goes wrong at town hall? The Court was without office, fax, credit card phone lines. The library was also without phones, and the alarm system was without phones. Laura, Garry, and Diane were all on the phone for many hours trying to get something done. 3.1.1. Council person Ulinski stated that many people lost service because a phone line was severed. Also noted that they haven't figured out who is in charge at town hall yet. 3.2. Huddle also made another comment about weeding around the court entrance and other areas around the building asking if there is anyone who does that? 3.2.1. There isn't a beautification committee anymore. 3.2.2. Katharine Hunter will volunteer to do this if someone will tell her what Town of Danby Board Meeting + Pubfic Hearing should stay and what should go. 3.3. Ronda Roaring commented about a letter she sent to the Town Board two months ago to lower the speed limit on S Danby Rd. She stated that nothing has been done and motorcycles recently "went whizzing by at high speeds". She asked what she can do to get the Board moving on this? 3.3.1. Recommendation was to refer this to the Transportation Committee that Leslie chairs. 4. Correspondence 4.1. Greg Nelson re Norbut Solar Farm proposal 4.2. Cassie Conley re Norbut Solar Farm proposal 4.3. Holly Hutchinson re Norbut Solar Farm proposal 5. Announcements 6. Reports & Presentations 6.1. Town Planner 6.1.1. Last month continued trying to pull together comments around zoning and answer questions around it. This will go up on the new website planning page very soon. 6.1.2. No BZA meeting last month. 6.1.3. Planning Board meeting went forward discussing the solar farm. 6.1.4. Many people have been calling and wanting to get projects started before the end of the year. 6.1.5. Trying to pursue NYS HCR housing rehab grant for low-income (80% of median income) homeowner options. 6.1.6. We are not seeing the waiver request due to the power outage meeting cancellation it did not leave enough time to post notification. 6.1.7. Joel asked to put on a "crack the code" event to bring people together to see what are the worst scenarios people could come up with in the proposed zoning changes. To be held on the first Monday in October. 6.2. Code Enforcement Officer 6.3. Town Clerk 6.4. County Legislator, Dan Klein 6.4.1. County is well into budget season. Making projections about tax revenues; looking at last 5 months sales tax revenue, the numbers are good — matching the numbers we saw in 2019 pre -pandemic. However, the numbers look to match too precisely to those numbers in 2019. 6.4.2. Recovery fund: took ARPA money and applied it to particularly allowable categories. Setting up a fund of $7 million dollars where people (businesses?) can apply for funding. More specific details forthcoming. Klein voted against the proposal because he felt the number was too large to take out of the fund balance. Page 2 of 8 Town of Danby Board Meeting + Public Hearing 6.4.3. Danby Conservation Easement passed by State Legislature has not been signed by the Governor. A discussion with Tompkins County will be held on Thurs 10/7 at noon. If people would like to attend, check with Klein or the county website. If you'd like to speak, contact the clerk of legislature at least one day in advance. One thing to note is whether this should be something for other towns to adopt. 6.4.4. Broadband study is still ongoing. The Town of Danby contributed $5k toward the study. Subsequently, a number of towns became dissatisfied with the process the county is using. The best thing to do is to return the donated money; the County Legislature is yet to decide on this prospect. Technically, the county has not billed any towns yet, so there is no need to return the money. 6.4.5. Gagnon asked Klein about mandatory COVID testing. 6.4.6. Resident Ronda Roaring asked if the county Legislature has taken a position on state-wide redistricting. Klein responded that the Legislature has not taken a position on it. 7. Consent Agenda 7.1. Workplace Violence Prevention Resolutions 8.4.1. Nothing new on WPV -waiting on estimates. Tabled until next meeting. 8.5. Vaccination & Testing Policy re Soft Mandate. 8.5.1. If vaccinated, you can voluntarily participate in testing; testing is required for those who are unvaccinated. The County pays for the testing; the town pays for cost to take kits to site for analysis. The County is doing 2x/week; towns are thinking 1x/week. The Town has the option to decide how often. 8.5.2. Shawley will reach out to the union rep for Highway re HIPAA around test results. Highway personnel are unsettled about this wondering if they're unvaccinated translates to losing their job. The others who are vaccinated are wondering about the non -vaccinated being tested regularly. 8.5.3. Councilpersons Ulinski, Connors, and Holahan were in favor of following up on this. 8.5.4. Questions about this process and implementation should be directed to Amie Hendrix (ahendrix@tompkins-co.org) at the County. New Business 9.1. Water District Advisory Committee Request to Authorize Leak Detection Contract 9.1.1. System is losing 16-20% of water being pumped suggesting an unknown leak. Industry standard that 20% of unaccounted water is not unusual. However, when nothing is happening still showing up to 20% unaccounted. 9.1.2. The advisory committee believes it is worth running; estimated Page 5 of 8 Town of Danby Board Meeting + Public Hearing costs $1-2k 9.1.3. Don't think a check has ever been done; it seems worth doing. Request to Contribute Toward Tree Removal at West Danby Cemetery 9.2.1. A tree is close to a fire hydrant; the Water District ADvisory Committee (includes 2 members on the W Danby Cemetery Board) 9.2.2. After some discussion, the Board noted that it was the first time hearing about this issue and would like to wait until next month to make a decision. 9.3. Schedule Public Hearing for Norbut Solar PDZ Application October 11 Resolution from Planning Board Sending PDZ for TB Review The Town Board has the authority to change the zoning; PB has discussed this application over 3 separate meetings, including the Planned Development Zone language. Once TB takes up the application, SEAR is the first thing to do as well as a public hearing. The main reason for them seeking a PDZ is that the parcel is weird and want to subdivide it; currently subdividing is not allowed for this parcel. PB sent list of 6 things that they would like to see done, including in the zone language and in the site plan. Part of approving this is approving the general site plan. This power falls to the board. The only thing to do tonight is schedule public hearing. All application materials and related documents Gagnon asked why do public hearing now instead of toward the end. PB had public hearing before approving this resolution to send to you. PB has a timeline for how fast to review and forward app to TB. TB does not have a timeline. This is a discretionary action, do not have to change zoning when asked to do so. There is a timeline for SEAR once we have all the document. JG thought it might be good to go through the environmental review before a public hearing because if we substantively alter the Town Board members have no objections to having multiple public hearings on this.
