9. Business
9.1.Resolution 165 of 2022 To Partner on Federal Safe Streets and Roads for All
Planning Grant Opportunity

WHEREAS, in 2022, the Bipartisan Infrastructure Law established the new Safe
Streets and Roads for All (SS4A) federal grant program, with up to one billion
dollars appropriated in FY22, and with a local match of 20% of the project cost;
and
WHEREAS, local municipalities are eligible to apply for funding to create a

detailed transportation safety “Action Plan”, either individually or in collaboration
with other municipalities; and
WHEREAS, the FY22 Notice of Funding Opportunity (NOFO, available here:
https://www.grants.gov/web/grants/view-opportunity.html?oppId=340385), states
that applications with multiple municipalities partnering to create a plan will be
more competitive for funding than applications from a single municipality; and
WHEREAS, successful creation of an Action Plan in this grant cycle would make
the partnering municipalities eligible to apply for implementation grants in future
years of this grant program, either individually or in collaboration; and
WHEREAS, the City of Ithaca has agreed to be the “Lead Applicant” on this
planning grant application, with multiple neighboring municipalities expressing
interest in applying as “Joint Applicants”, including the following in alphabetical
order (note: the list may be inaccurate/incomplete as of 8/8/2022):

∙Town of Ithaca
∙Town of Lansing
∙Village of Cayuga Heights
∙Village of Lansing
WHEREAS, the role of the City of Ithaca as Lead Applicant will be to complete the
online application on behalf of all partnering municipalities for FY22 funding, with
an application due date of September 15, 2022; and
WHEREAS, the various partners have agreed to base an equitable share of the
funding match on the relative population of each municipality; and
WHEREAS, the City of Ithaca is presenting a resolution to its Common Council,
requesting a budget to fund the study in whole at $750,000, to be eventually
reimbursed 80% by the grant, with individual municipalities reimbursing the City
of Ithaca for its share of the 20% local match. The Town of Danby share of the

local match will not exceed $6,018; then be it
RESOLVED, that Tompkins County agrees to partner with the City of Ithaca and
other neighboring municipalities to jointly apply for the SS4A planning grant
opportunity to create an Action Plan that uncovers both regional and
municipality-specific transportation safety problems, as well as presents detailed
regional and municipality-specific solutions; and
RESOLVED, that Town of Danby agrees to reimburse the City of Ithaca for its share
of the 20% local match ($150,000 total local match for a $750,000 total project
cost) in an amount not to exceed $6,018.

9.2.Resolution 166 of 2022 for CDBG Housing Rehabilitation Program

WHEREAS, the Town of Danby intends to file a Community Development Block Grant
application for funding consideration with the Office of Community Renewal to fund a
Housing Rehabilitation Program; and
WHEREAS, funds for the program will be requested from the Office of Community
Renewal in the form of a grant; therefore,
BE IT RESOLVED, that Joel Gagnon, as Super visor; Town of Danby, is hereby authorized

and directed to file an application for funds from the New York State Office of
Community Renewal in an amount not to exceed $500,000, and upon approval of said
request to enter into and execute a project agreement with the State for financial
assistance to the Town of Danby for the Housing Rehabilitation Program, and, if
appropriate, take actions necessary to implement the proposed Program/Grant upon
approval from the State

9.3.Resolution 167 of 2022 To Approve Request 6 of 2022 Agreement to Spend Town
Highway Funds

Pursuant to the provisions of Section 284 of the Highway Law, we agree moneys
levied and collected for the repair and improvements of highways, and received
from the state for repair and improvement of highways shall be expended as
follows:
General Repairs
1.A sum not to exceed $190,000 shall be spent to reconstruct Troy Road.
Drainage will be addressed on the road and the road will be profiled and
shimmed. New shoulders will be put in along with 4” of compressed cold
mix pave with chip seal. Funding for this project will come from the CHIPS
amount that has been allotted to the Town of Danby.
2.A sum not to exceed $14,000 shall be spent to surface treat Yaple Road.
Funding for this project will come from the Road Repair Contractual Line,

A5110.400.
3.A sum not to exceed $24,000 shall be spent to surface treat West King
Road. Funding for this project will come from the CHIPS amount that has
been allotted to the Town of Danby.
4.A sum not to exceed $25,000 shall be spent to chip seal the road and
reconstruct the shoulders on Comfort Road. Funding for this project will
come from the CHIPS amount that has been allotted to the Town of Danby.
5.A sum not to exceed $13,000 shall be spent to replace the culvert on Bruce
Hill Road. Funding for this project will come from the CHIPS amount that
has been allotted to the Town of Danby.

9.4. Next Steps in Addressing Broadband Issues Including Possible Committee
Creation to Include Zachar y Lind and Jeff Lang
9.4.1.Recommendation from Councilperson Connors, and supported by
Councilpersons Hunter and Woodworth, was to have Lind and Lang
meet, prepare a proposal on what they would like to do, how they could
pursue options, and come back to the Board with a report at the next
board meeting.

9.5. Charge and Membership of Noise Committee Potentially Chaired by Warren Cross
9.5.1.Discussion from Warren about what he would like to do and how he will
do research over the next month or two and report back. At this stage it
is not necessary to create an official committee. Meanwhile, comments
and reports that continue to come in to the Town Clerk will be collated
and available for review
9.6. Revisit Policy on Correspondence and Privilege of the Floor -
9.6.1. Gagnon moved to table this item; seconded by Connors
9.7. Look at Commercial Zones to Gauge their Appropriateness for Cannabis
Sales/Consumption sites
9.7.1.Discussion involved questions on limiting to the hamlet core; limiting
to 2000 sq ft of space; smells; whether this is considered smoking,
something that is banned in public places.
9.7.2.The Board will provide guidance to Planner West to work on an
amendment
9.8. Update on the Budget Process
9.8.1.Bookkeeper Shawley presented ideas on the timeline to have Finance
Committee meetings to discuss line item modifications
9.8.2.Shawley will have budget packets ready for distribution to Board and
various departments by Friday 19 August.
9.8.3.Requests to have packets back by 9 September
9.8.4.Have versions to Town Clerk by 16 September and present it to Board at
second September meeting
9.9. Proposed Revision of Credit Card Policy

9.9.1.Discussion on provision that requires keeping credit cards in the vault.
9.9.2.Staff recommendation is to delete this provision and allow those with
cards to carry them on their person. Gagnon proposed doing so.
Woodworth suggested that the card with the $60,000 credit limit have
stricter security measures.
9.9.3.Connors proposed several additional changes to add consistency with
the proposed change. In the Section cardholder and dept head
