Resolved that the Danby conservation easement template article II section 2.02 A
is replaced by the following:

A. Structures and Improvements – The construction or emplacement of new
buildings and permanent improvements to existing ones in this zone is allowed,
as long as such improvements or emplacements are subservient to the principal
residential use, do not degrade any Conservation Values, are allowed by other
applicable regulations, and do not add dwelling units.
Despite the foregoing limitations on construction and emplacement, in the
event the Landowner can demonstrate a reasonable unforeseen change of
circumstances or an unreasonable hardship, the Town may agree to waive or
relax such improvement or expansion limitations, provided that the
conservation values protected by this easement are not unreasonably
diminished. Without defining what could be an unforeseen circumstance or
hardship, examples might include the need of a parent or relative to have a
“Mother-in-Law” apartment or cottage space due to the death of a spouse or
medical need, an increase in family size, or a need for more usable space due to
obsolescence or damage by wind or fire.

9.4.Resolution 138 of 2022 To Agree to Spend Town Highway Funds

Pursuant to the provisions of Section 284 of the Highway Law, we agree moneys
levied and collected for the repair and improvements of highways, and received
from the state for repair and improvement of highways shall be expended as
follows:

General Repairs
1. A sum not to exceed $12,000 shall be spent to purchase a 10 gauge, aluminized,
96”x 50’ pipe with two bands that will be used to replace the culvert crossing the
road at the Brown Road and Bruce Hill intersection. The pipe will be purchased
from the Town of Cortlandville from their over-stock supplies. The funds for this
purchase will come from the CHIPS funds allotted to the Town of Danby from the
State of New York.

SECTION 1 TITLE - A Local Law Amending the Zoning Law, LL#1 of 2022,
Regarding Definitions of Industrial Establishments and Light Industry in the
Commercial C Zone
§2 ENACTMENT - Be it enacted by the town board of the Town of Danby as
follows:
§3 - The TOWN OF DANBY hereby amends Local Law #1 of 2022 Section 606-3.c
PERMITTED PRINCIPAL USES IN A COMMERCIAL ZONE "C" UPON APPROVAL
OF THE SITE PLAN to add:
