HomeMy WebLinkAbout2021 Local Law #1, Deputy Highway SuperintendentTOWN OF DANBYLOCAL LAW NO. 1 OF 2021 EXPANDING RESIDENCY REQUIREMENTS OF DEPUTY HIGHWAYSUPERINTENDENT OF THE TOWN OF DANBY BeitenactedbythetownboardoftheTownofDanby,intheCountyofTompkins,asfollows: Section 1 TITLE Thislocallawshallbeknownas“ExpandingResidencyRequirementsoftheDeputyHighwaySuperintendent of the Town of Danby”. Section 2 PURPOSE & SUPERSESSION Local Law # 1 of 2021 is a local law to supersede certain requirements of the Public OfficersLaw §3, Town Law § 23(1), and other laws of the State of New York as respects residencyrequirements of the Deputy Highway Superintendent of the Town of Danby. Section 3 AUTHORITY This local law is adopted pursuant to Municipal Home Rule Law (“MHRL”) §10[1][ii][a][1]thatgrantstolocalgovernmentstheauthoritytoenactlocallawsregardingthequalificationsof local officers. Furthermore, this local law recognizes that the State Legislature amendedPublicOfficersLaw,§3convertingthesamefromageneraltoaspeciallaw,therebyallowingtowns to set reasonable residence qualifications for public officers, in accordance with therequirements of the MHRL. Section 4 RESIDENCY REQUIREMENTS FOR TOWN OF DANBY DEPUTY HIGHWAYSUPERINTENDENT The Deputy Highway Superintendent need not be a resident or elector of the Town of Danbyprovided, however, that such person (or candidate), if not a resident of the Town of Danby,shall reside within an adjoining municipality, whether or not such municipality is locatedwithin Tompkins County. Section 5 INCONSISTENCY All other local laws and ordinances of the Town of Danby that are inconsistent with theprovisions of this local law are hereby repealed; provided however, that such repeal shallonly be to the extent of such inconsistency, and in all other respects this local law shall be inaddition to such other local laws or ordinances regulating and governing the subject mattercovered by this local law. Section 6 SAVINGS Town of Danby Local Law No 1 of the Year 2021 Deputy Highway Superintendent ResidencyPage 2 of 2 If any clause, sentence, paragraph, word, section, or part of this local law shall be adjudgedby any court of competent jurisdiction to be unconstitutional, illegal, or invalid, suchjudgment shall not affect, impair, or invalidate the remainder, thereof, but shall be confinedin its operation of the clause, sentence, paragraph, worked section or part thereof directlyinvolved in the controversy in which such judgement shall have been rendered.
