HomeMy WebLinkAbout2023-08-15 Planning Board Minutes (Final)Town of Danby Planning Board Minutes of Regular Meeting August 15th 2023 PRESENT: Ed Bergman Colleen Cowan Kelly Maher Jody Scriber Jamie Vanucchi ABSENT: Scott Davis Jacob Colbert Town Planner: David West This meeting was conducted in person with virtual access on the Zoom platform. Due to the absence of recording secretary Cindy Katz in -person and on Zoom, these minutes were put together by Cindy Katz using the audio recording. Parts in red indicate either that they are unknown/inaudible or that the secretary is unsure of the accuracy of the notation. (1) CALL TO ORDER/AGENDA REVIEW There were no additions or deletions to the agenda. (2) PRIVILEGE OF THE FLOOR Ted Crane will see David West in Geneva for the total eclipse (3) APPROVAL OF MINUTES MOTION: Approve the July 18th meeting minutes Moved by , seconded by XXXX The motion passed, all in favor (4) TOWN BOARD LIAISON REPORT Town Board member Leslie Conners gave a report to the Planning Board. (5) DEVELOPMENT REVIEW SUB 2023-03 548 Troy Road Parcel: 4.-1-41 Applicant: John Augustine Anticipated Board action(s) this month: Public Hearing, SEAR, Preliminary and final subdivision approval Zone: Rural 2 SEQR Type: Unlisted Proposal: Applicant proposes a cluster subdivision creating one 6.5acre lot around existing house to sell while retaining remaining land 35.6 acres. This subdivision previously received a variance for frontage and was approved by the Planning Board under the old zoning with Sue Beeners. Unfortunately it was not correctly filed with the county and became void after 1 year. Planner West gave a summary of the application. Public Hearing The Public Hearing was opened at 17:28 into the Zoom audio. Jess Sczepanski: Lives next door and curious to see a map, location of driveways, and what the purpose of this subdivision is -- is he selling, moving etc? Planner West put the map up and replied that he understands the applicant does not currently plan on putting a house on the smaller lot, and seeks to leave it as a hunting/open space. However, a house could be put up there in the future. Ted Crane: Asked if a twelve acre lot divided into two six acre lots would have the right to build? Planner West responded that a variance would be needed because the lots were less than ten acres. If the variance was received, than yes. Crane asked if there was a lot that was 16.5 acres, and a ten acre lot was subdivided out. Would the leftover lot have a right to build? Planner West responded that the creation of the lot comes with the right to build. Public Hearing was closed at 21:50 into the Zoom audio. Board Discussion SEQR Planner West put up SEQR on the large monitor. Part 1 of the SEAF was already filled out by the Applicant. Planner West reviewed it and noted that there is a body of water on the site but the proposed subdivision does not effect it. Nothing was triggered in the SEQR regarding the body of water. The Planning Board pointed out that question 12b related to archaeological preservation sites to had been checked "yes." They looked into why that was and determined the very back of the parcel fell into the buffer of some sort of structure that was categorized as a preservation site. They reviewed Part 11 of the SEAF and it was agreed that the answer was "no or small impact may occur" to all questions, deciding that this small project's impact would not result in significant environmental impacts. A Planning Board member asked about what the "material conflict" mentioned in question 1 referred to and Planner West explained. MOTION: Motion to pass Resolution 9 of 2023 that the proposed action will not result in any significant adverse environmental impacts. Maher moved, seconded by XXX The motion passed. All in favor. MOTION: To pass Resolution 10 of 2023 granting final approval to the cluster subdivision. Moved by Cowan, seconded by Scriber The motion passed. All in favor. The Planning Board did not set any conditions on this approval. The Applicant asked if this is the same approval as he first received and Planner West said yes. The Applicant also sought to clarify the acreage of the remaining parcel and Planner West replied that they went with what was on the survey. (6) PLANNER REPORT Planner West gave his report. (7) ADJOURNMENT The meeting was adjourned at XXX
