Memorial Service and Taps Across America - May 30
The Sons of Union Veterans of the Civil War Sydney Camp #41 will hold a memorial service followed by
the sounding of Taps at 3 p.m. in conjunction with Taps Across America. The service will start at 2:15 at
the Danby Monument in front of Danby Town Hall.
The monument has always been a center point in Danby. The residents before us held picnics and
dances and bid on picnic baskets to raise the money to build it. Some of these people could have been
members of your family.
In the future we are looking for a volunteer with a cherry picker to help us clean the monument; if
interested, please email or call Commander Danny L. Wheeler at (607) 272-7314.
Hope to see everyone at the monument for this important service
and taps across America.
Veterans should never be forgotten. Following this service, there
will be another service at the Grand Army of the Republic monument
at the Ithaca Cemetery.

Noise Law Proposed
A committee established last year to look into whether current avenues of recourse are adequate in the
face of unreasonable noise submitted their report recently. Their conclusion was that a local law is
needed to bolster the available options. Based on the recommendations in the report, the Town Board
asked the committee to go ahead and draft a proposed local law, which they did and presented to the
Board in March. The Town Board agreed to consider passing that law and has scheduled a public
hearing for 6 P.M. on May 18. The date was chosen to allow ample time for public review and comment
on the draft local law. This is an important issue for many in the town; your thoughts carry significant
weight and the Board wants to hear them. If you want to comment and cannot make the meeting,
comments in writing are also welcome and can be emailed to townboard@danby.ny.gov or sent by
regular mail to 1830 Danby Road Ithaca, NY 14850.
Energy Conservation Stretch Building Code
Danby has qualified to be included in the Clean Energy Communities program, a state initiative to
promote energy conservation. We have already profited from participation by securing a grant to
upgrade our highway facility with improved air sealing, better insulation (including insulated garage
doors), heat pumps for heating, and more efficient lighting. That work was completed last year, as was
the conversion of our street lights to LEDs. Now what?
Jim Holahan, recently retired Town Board member, agreed to stay on in an advisory capacity to
spearhead town energy conservation and sustainability efforts. He outlined for the board at the 5 April
meeting what some of the options are for us. There is a point system in place whereby getting more
points qualifies us to get more grant money. One option is to adopt the the NYStretch Energy Code. It is
called stretch because it goes beyond the minimum requirements of the state’s energy code to add
components that further enhance the energy performance of new construction. The extra provisions of
the stretch code are often included in the next revision of the energy code, so the effect is to accelerate
adoption by a few years. The result is improved energy performance and comfort, but at increased cost.
The increased cost is recouped within a few years, but it nonetheless raises the up-front cost of
construction. The Board was briefed on the features of the stretch code at the 20 April meeting. Expect
to hear more about this if the board decides to move forward with it.
Wet Land and Solar Panels
The Town Board decided to recommend to the Planning Board that they use the Conservation Advisory
Council’s report on when it might be reasonable to locate solar arrays in wet areas and under what
mitigated conditions as a guidance document in their site plan reviews of proposed large-scale solar PV
installations. The Planning Board has the authority to waive requirements of our solar siting law if doing
so is judged to be reasonable. This report will assist the members in making those judgments. This
avenue was chosen in lieu of modifying the solar siting law itself.

Town Hall Improvements
The conversion of all exterior lights at the town hall to LEDs has now been completed. The Town Board
awarded a contract to repair the tower and repaint it and the north side of the building.
Change to Town Board Meeting Start Times
Finally, the town board recently voted to begin all Town Board meetings going forward at 6:00 pm
rather then 7:00 pm. Please check the Danby Town calendar for the most up-to-date information.
Tompkins County Legislature News from Dan Klein
New Emergency Notifications
Tompkins County is shifting from SWIFT – 911 to a new system called Siren (Safety & Incident Real-Time
Emergency Notifications)
Tompkins County SIREN is the official emergency notification system used by Tompkins County, the City
of Ithaca, and other local towns and villages to communicate with community residents during
emergencies.
Sign up now to receive alerts from SIREN via text message, email, and/or voice message.

Board of Assessment Review
If you wish to challenge the tax assessment on your property in Danby, you still have several
opportunities. Our local Board of Assessment Review will meet on Tuesday May 10, 3:00 to 6:00, at the
Danby Town Hall. This is walk-in only. No appointments will be taken.
Another opportunity will be on May 24 at the Assessment Department in downtown Ithaca. They will
have both walk-in and pre-scheduled appointments. Check Tompkins County Assessment's website, or
call 607-274-5517 for more details.
After July 1, any challenges to your assessment must go through the courts.
Plant Exchange
The 30th Annual Plant Exchange happens on Sunday May 15, 2022, from 1:00 to 3:00, outside the Danby
Fire Station on Route 96B. This free event is an opportunity to swap, donate, and try new perennials,
houseplants, seeds, annual seedlings, and anything else garden related. It is not necessary to bring a
plant in order to get a plant, nor is it necessary to stay the whole time.

Note that it's much better to divide plants in advance so
they don't suffer in the heat on the day of the Plant
Exchange. Label what you bring if you can.
Also, make sure there are no earthworms in what
you bring. There is an invasive non-beneficial
earthworm in our area that we don’t want to spread.

Notes From The Planning Office, David West
The April 19 Planning Board meeting was one of the longest in recent history with site plan approval
granted to two single family homes in the Rural 1 Zone (121 Durfee Hill Rd. and 158 Peter Rd.) and the
subdivision review process starting for two cluster subdivisions (108 Marsh Rd. and 256 Bruce Hill Rd.).

As the Town implements several of the new provisions of the Zoning Code it is a learning experience for
the Boards and the community. I'd like to thank everyone who has devoted time, effort, and care to
learning about and participating in the Town's processes. The new Zoning Law requires significantly
more review for new buildings in the Rural 1 Zone with more opportunities for input from neighbors than
in the past. That said, it is important that everyone involved understand what is included in the review
and what the limits are so that they can participate in effective and constructive ways. It may help
neighbors engaged in the new Site Plan Review process to understand that inclusion of a permitted use
in a zoning law (including permitted by site plan review) is a “legislative finding [by the Town Board] that
the permitted use is in harmony with the general zoning plan and will not adversely affect the local
community.” This is well-established in case law and recently reaffirmed by the highest court in the
state, specifically in Hart v Town of Guilderland, NY.
Site Plan Review is not an opportunity for a referendum on whether or not a particular use is allowed on
a particular parcel—in fact that is outside the Planning Board's jurisdiction. The Planning Board and
community are tasked with understanding the potential impacts of a particular allowed use to guide the
"imposing such reasonable conditions and restrictions as are directly related to AND INCIDENTAL TO a
proposed site plan." Town Law 274-a-4
When this is not understood it can be frustrating for community members who take the time to show up
to request that the Planning Board deny a site plan to prevent a use they are opposed to. It is
understandable that folks feel like they're not being heard when a decision doesn't go the way most in
the room would like. It can be similarly frustrating for applicants to put together a plan for an allowed

use and then feel like they are on trial by public opinion for proposing something specifically allowed by
law, and it is certainly frustrating for the Planning Board volunteers who work through long meetings
listening to strong opinions that may not be particularly useful for the decision at hand - what
reasonable and incidental conditions could best minimize impacts of a proposed site plan for the
allowed use.
While SPR is not a referendum on allowing a use, it is an opportunity for neighbors as local experts to
provide useful information to the board about how an allowed use can best sit on a particular site.
Constructive feedback that neighbors can provide includes documentation of specific impacts or
suggested conditions that the Planning Board can use to guide the imposition of reasonable and
incidental conditions allowed by state law and supported by the courts. Hopefully, with better
understanding of these powers and processes the Town can have more productive and less
contentious site plan reviews in the months ahead.
Conservation Advisory Council (CAC) News, Margaret Corbit
The Conservation Advisory Council (CAC) met on Tuesday, April 12 via
Zoom.
During the privilege of the floor, Ronda Roaring pointed out the value
of the book, Native Plants for Native Birds: A Guide to Planting for
Birds in and Around Ithaca New York. This is a paperback book by Joel
Baines, an emeritus Cornell professor. We agreed it would be good to
have this book in the Danby Town Library and, while the book is
currently out of print, Clare Fewtrell offered to donate her copy. Look
for it soon at the Town Hall.
As a follow-up to this discussion, we talked about offering a second
educational session on gardening with native plants, focusing on
trees and shrubs.We learned that the Tax Abatement Subcommittee
has plans to reach out to the school districts associated with the Town
of Danby to find out if they are interested in supporting tax
abatement.
The Town of Orchard Park, NY is just coming up on 15 years for their
tax abatement program.
Town Planner David West is reaching out to them to learn more about how this has worked.
We are pleased to be nearing the completion of an easement on 14 acres adjacent to the Eastman Hill
UNA (Unique Natural Area) and the Danby State Forest. We hope to send this easement to the Town
Board this spring. Also, the committee is making progress on an easement for 14 acres on South Danby
Road. Finally, Clare Fewtrell has begun discussing an easement for a property with more than 200
acres off Brown Road, close to the Danby State Forest.

Joel Gagnon gave us an update on the proposed solar farm. Two of the wetland survey teams are going
to combine their efforts and present a final map for the Town Board to use in their review of the
application.

Danby Seniors Luncheons Return
The Danby Seniors plan to resume monthly gatherings in May! Always on the first Thursday of the

Danby Rural Cemetery Update
Do you know that Danby has a beautiful, historic cemetery that is open to all –
for burials or cremations, or for local walks?
Located at 14 Curtis Road, the Danby Rural Cemetery is a quiet place of beauty
with a long history. The site was originally a family burial plot owned by Lewis
Beers, who came to the Danby area in 1792. The original one-acre plot passed to
E.L.B. Curtis, who donated it to the newly-formed Danby Cemetery Association
incorporated under New York State law in 1871. Since then the cemetery has
expanded to eight acres, with ample space for new plots.
The Cemetery is open to all, for both full burials and cremations, as well as for
those who are interested in its natural beauty and many historical
gravestones. Governance is led by the Danby Rural Cemetery Association,
which holds a public meeting each Spring. All lot sales and activities are
conducted according to the provisions of the laws of the State of New York.
The cemetery is maintained by community volunteers,
coordinated and led by Richard (“Dick”) Hautala (607-272-3287).

Back by very popular request! Youth can choose between making a Muppet-style hand puppet or a
marionette creature. The marionettes are more advanced, so it’s suggested that if you didn’t enroll in
the first program you stick with the hand puppet, but if you’re ambitious you are free to try whichever
model you’d like. The first four meetings will be dedicated to making the puppets, and the next two will
be for practice only. Weather permitting, practice will be outside.
Dungeons and Dragons, Magic: the Gathering, and Board Games
(grades 6-8)

Time for Round 2 of games! This program has been very popular,
so we are continuing it through the end of the school year. Youth
can choose between participating in (or possibly running) a
Dungeons and Dragons campaign, bringing their Magic deck, or
trying out an assortment of board games. Exploding Kittens and
Tsuro have been favorites so far. Youth can also try making their
own human-size board game using props and giant dice.

Meet at the Boynton Library, then set out to explore. Youth being dropped off from other locations may
go straight to Stewart Park depending on timing. Adults can email Heidi to coordinate details. We could
walk along the lake, cook a snack at the grill, play games, watch the wildlife, or try out some
photography. In case of heavy rain, we’ll bring indoor activities to choose from and stick to the library.
Puppet Making (grades 6-8)

These are not your average sock puppets! Choose between a
Muppet-style hand puppet and a furry, floppy marionette
creature. We’ve got just two weeks to finish our creations, so
this is basically puppet-making bootcamp. This program will
focus entirely on making puppets. If you’d like to learn about
using them, sign up for the short puppetry program listed
below.

Parade Note:
Up for discussion: marching with our puppets in the Ithaca Days Parade on Thursday, June 2. This activity
will be optional. Whether there will be transportation available to and from the parade is TBD. But youth
who don’t come to the parade are still welcome in the program.

Danby Library News
May is upon us and spring has finally arrived! Come see all our gardening
books on display now for reference.
Another display includes some of our local authors.
We recently attended the Friends of the Library sale and were able to get
some nice items. And our selection of LT books from TCPL has been changed
so these will be new as well. For any history buffs there are a few new items
on World War I and II.
For any Marvel fans we actually have quite a few of the movies on DVD and
will be adding to the list soon.
