Inlate2021,GovernorHochulsignedintolawlegislationgrantingDanbytheabilitytoimplementa
programofpropertytaxabatementforconservationeasementprotectedland whenitisbeneficialto
thepublic .Auniquefeatureofthisauthorizationisthattemporaryeasementscanbeincluded.After
severalfalsestarts,alocallawtoenableimplementationhasfinallybeenpreparedfortheTown
Board’sconsideration.Itcloselymirrorsthelanguageinthestatelaw,aswehavebeenadviseditmust
bytheTownAttorney.ThedraftlocallawwasreviewedbytheConservationAdvisoryCouncilanda
resolutionofsupportforitspassagewassentontotheTownBoard.TheTownBoardhasscheduleda
publichearingonJuly19.TheCACwoulddevelopcriteriaforparticipationintheprogram.OncetheCAC
determinesthataspecificeasementmeetsthecriteria,thetownboardwillthanmakeafinal
determinationonwhethertogranttheabatement.Expecttohearagreatdealmoreaboutthisifand

ThediscussionleadinguptothedecisiontoproposebringingthismattertothevotersinNovember
wasextensive.Isthistherighttime?Dowethinkthebenefitsoutweightheadvantagesofthecurrent
electedclerkposition?TheBoardwentfromfirstthinkingthatthecurrentpolarizedclimateistoo
fraughttobringthisforwardnowtoconcludingthatthereislittlereasontobelievetheclimatewillbe
anybettersomeothertime.BoardmemberPatWoodworthindicatedthatshewouldnotsupport
makingthechangewithoutputtinginplacearobustprocessformakingtheappointmentshouldthe
votersapprove.Othersagreedthatdevelopingsuchaprocessisbothimportantandwouldbegoodto
includewithmaterialsmakingthecaseforpassage.Accordingly,Pathasundertakentoresearchthe
matterandbringforthsomethingfortheBoardtoconsider.
Thenextstepistoconsiderpassingalocallawmakingthechange.ThatisaTownBoardactionsubject
tomandatoryreferendum,givingthevotersthefinalsay.TheBoardhasscheduledapublichearingon
thelocallawfortheJuly19TownBoardmeeting.Youarewelcometocommentonwhetherweshould
putthechoicebeforethevoters.ShouldtheBoarddecidetomoveforwardbypassingthelocallaw,we
willcertainlypresenttheargumentsbothforandagainstthechangeinthesepagesbetweennowand
November.Aninformedelectorateiscriticaltowisedecision-making.
Noiseissueupdate (SteveWeissberg)
Inresponsetoageneralrequestforgreaterinputfromcommunitymembers,anoiselawworkgroup
wasformedandmetonJune12todiscussgeneralconcernsrelatingtothisproposedlaw.Katharine
HunterandSteveWeissburgfacilitatedthemeeting,whichwasattendedbyKevinFeeney,Peter
Moore,RoganMoore,SteveSelin,RichCurtissandWarrenCross.Arobustandhonestconversation
tookplaceandparticipantssharedpersonalperspectives.Someoftheconcernsexpressedincluded:
overlybroadscopeofthelaw,potentialforabuseandconcernsthatcitizens'rightswouldbecurtailed.
Ontheotherhandsomeinformationwassharedoftrulyegregiousviolations-whichthelocalsheriff's
officehasbeenunabletoaddresswithexistinglaws.Therewasalsoasubstantialdiscussionofa
preferenceforneighborstotryto"workthingsout,"beforethesheriff'sdepartmentisinvolved,perhaps
throughcreationofaDanbymediationcouncil,butalsorecognitionthatinsomeinstanceseffortsat

dialoguehavebeenmetwithhostilityandintimidation.Theworkofthisgroupcontinues.Theboard
benefitsgreatlywhencitizensarewillingtoengageopenlyandfairlyinchallengingconversations.

HamletsMeetings -
ThePlanningDepartmenthosted2communitymeetingstobrainstormhamletimprovementprojects
thatcommunitymemberswereinterestedinworkingtogetheronandprojectsthatwecouldseek
fundingfor,usinggrant-writersfundedbyTompkinsCounty.Weusedbothfirehallsforthemeetings
andhadsomeproductiveconversations.InWestDanbywedidn'tfindanyconsensusonworkthatfolks
wantedtodo,butratherheardaboutthingstheywouldliketoseelessofandafairamountoffeedback
onthebasicconceptofencouraginghamlettypedevelopment.Residentsrequestedlessplowingand
saltingonValleyViewRd.andlessregulations/requirementsgearedtowardmakingW.DanbyRd.
(34/96)amorepeoplefriendlyplaceinthefuture.InCentralDanbytherewasconsiderablymore
energyforpositivechange,wehadagreatturnoutandhadtosetupmoretablesandchairsasmore
peopleshowedup.ResidentsattendingtheCentralDanbymeetingwereinterestedinworking
togethertosupportsmallbusinessesthatareintheplanningstages,doingcommunityclean-upwork
includingplantingsalong96B,addressingabandonedhomesandimprovingrentalproperties,aswell
asdoingasmuchaspossibletoslowtraffic,improveinfrastructure,andbuildcommunitygathering
opportunitiesbothphysicallyandsocially.Ofcoursetherearealwayssomenaysayers,onefrequent
townmeetingattendeeshoweduptosharetheiropinionthatnodevelopmentshouldeverhappen
anyplaceinDanby,buttherewasaclearpluralityofthecommunityinterestednotjustinseeingthings
changeforthebetterbutalsoreadytoactivelyparticipateinthatprocess.
Followinguponthesemeetings,thePlanningDepartmentisdraftingsomerecommendationstothe
TownBoardtorollbacksomeoftheHamletzoningrestrictionsthathavebeenproblematicforsomeof
thefirstsmallhomedevelopmentprojects,includingremovingthemaximumsetbacklimitandmoving
somedesignstandardsintoadesignguidelinesdocumentforresidentialdevelopmentthatwill
supplementtheTown'sCommercialDesignGuidelines.Inaddition,Iamworkingwithourgrantwriting
consultant,ChoiceWords,tonarrowdownthepotentialgrantswecouldpursuethisyeartoimprove
housingaffordabilityandavailabilityinCentralDanbyaswellassupportingsomenewamenities.
HamletWastewaterStudy -
ThePlanningDepartmentcontinuestoworkwithHuntEASonawastewaterstudyexaminingthe
feasibilityofwastewaterinfrastructureoptionsforhamletscaledevelopment.Theprojectisrunninga
bitbehindschedulebutwearehopingtohavemoreinformationtosharethisseason,hopefullysooner
ratherthanlater!
ShortTermRental(STR)Committee -
FollowingthesubstantialresponsetotheTown'sShortTermRentalSurvey(resultsavailableonthe
Town'swebsite https://danby.ny.gov/view-the-results-of-the-short-term-rental-survey/),the

TownSupervisorappointedacommitteeofLeslieConnors,SteveWeisburg,andarotating
representativefromthePlanningBoard,tomeetwithme(theTownPlanner)toreviewthefeedback
fromthecommunityanddecidewheretogonext.Whileit'searlyintheprocess,thegroupmetonce
andafterdiscussingtheresponses,decidedthataverylighthandedapproachwaswarrantedgiventhe
feedbackfromthecommunitythatwasextremelysupportiveofSTRoptions.Thefirstactionsproposed
forconsiderationinclude:legalizeSTRofaccessorystructuresincludingtents,treehouses,tinyhouses.
etc.allowing2suchrentalsonapropertyofatleast2acresbyrightwitharequired200ftsetbackfrom
propertylinesandproposingasetofrulesandreviewproceduresforthosewhowouldliketodomore
togothroughaprocesswiththePlanningBoard;allowrentalofroomsinahousewithafulltime
residentwithoutrequiringsiteplanreview(currentlyyoucanSTRawholehousewithnoreview,but
rentingoutaroominyourhouserequiresasubstantialprocesswhichmostpeopleagreedoesn'tmake
sense);requireSTRoperatorstoregisterwiththeTownandprovideemergencyandcomplaintcontact
informationthatwillbeavailabletoneighbors.Anyofthesechangeswillrequireafairamountof
communitydiscussionandprocessincludingapublichearingforeachpotentiallaworchange,a
feedbackloopwiththePlanningBoard,andmultipleTownBoardmeetings.Youcankeepaneyeon

Wehadarareno-meetingmonthforbothofthesekeyboardsaswedidn'thaveanyapplicationsto
review.Thatdoesn'thappenveryoftenandwon'tbethecaseinJuly,wealreadyhaveanapplicationon
theboardsforSitePlanReviewofaseconddwellingandhomeoccupationworkshopat520W.King
Rd.andthereareatleastafewotherapplicationsbrewingbutnotyetsubmitted.

TheCountybudgetprocesstakesupalargepartoftheyear,andisthesinglebiggestitemthat
influenceswhatservicestheCountywillprovideandwhattheimpactwillbeonpropertytaxes.Wehave
begunthefirstpartofthe2024budgetprocessalready.TheCountyLegislaturewillmostactivelywork
onthebudgetinSeptemberandOctober,andittakeseffectonJanuary1.
Thefirststepisthatwesetagoalforourselves.Thegoalwehavesetisa2%increaseinthetaxlevy.
Thetaxlevyisthetotalamountoftaxeswetakein.Forthepast2years,theCountyhaskeptthetaxlevy
increasetozero.Thisisaremarkablefeat,andyouwillnotfindmanylocalgovernmentswhohave
achievedanythinglikethat.
Thisyear’sbudgetisgoingtobeharder.Inflationhasbeenraging,andCountygovernment
operationsarenotimmune.Forexample,theCounty’selectricandgasbillisexpectedtobe
approximatelyhalfamilliondollarshigherin2024.
Youmayhaveheardtheterm“unfundedmandates”.ThisiswhenNYStateshiftsexpensesfromthem
totheCounty.Theproblemofunfundedmandatesisveryreal.Unfortunately,itrequiresunderstanding
alevelofdetailthatthegeneralpublic,rightfullyso,isnotinterestedin.Thatishowthestategetsaway
withshiftingcoststothecountieswithoutgettingblamedforit.NYStatehasshifted2largeexpensesto
countiesthisyear,andthebilltouswillbeinthemillionsofdollars.
Therearemanymovingpartstothebudget,andthingscanshiftonewayortheotherinarelatively

shorttime.Wearestaringoutwiththeideaofa2%increaseinthetaxlevy.Wemayendupsomewhere
different.IpromisethatIwillbelookingforwaystobringthelevydown,andwillreportbackonhow
thingsaregoinglaterintheyear.
