Severalmonthsago,WarrenCrossvolunteeredto
researchnoiselaws.Heevaluatedhundredsof
existingnoiselawsforvariousmunicipalities
similartoDanbyinNewYorkandneighboring
states.Basedonhisresearch,hecreatedasample
lawthatcontainsitemsthatoccurredrepeatedlyin
thoseotherlaws.WewanttothankWarrenfor
thatmassiveamountofwork.
OnApril19 th,weheldapublicinputsessiononthe
noiseissue,withthesamplelawcreatedby
Warrenasabasisforapossiblelocallaw.Many
residentssentcommentspriortothesessionand
manyresidentsprovidedinputduringthesession.
Thatinputisveryimportant.Oneresident,whoisa
retiredpoliceofficer,notedthatthedisorderly
conductsection240.2oftheNYPenalLaw applies
tonoisecomplaintsonneighboringproperties.
Thatsectionreads“Apersonisguiltyofdisorderly
conductwhen,withintenttocausepublic
inconvenience,annoyanceoralarm,orrecklessly
creatingariskthereof…hemakesan
unreasonablenoise.”Thetownhasreceived
complaintsaboutnoise.Wewillre-investigate
whenandtowhatdegreethatlawcan provide
reliefandwhenandtowhatdegreeitcannot.We
willalsospeakdirectlytolawenforcement
officialsaboutenforcingthatlawwhenitis
applicable.Wewillsharethatinformationwith
townresidents .
BruceHillRoadConservationEasement
(JoelGagnon)
DanHoffmanhasownedaround100acrestoward
thebottomofBruceHillforover40years.TheCAC
hasbeeninnegotiationforaconservation
easementonthispropertyforseveralyears.Itisa
spectacularproperty,animportantpartofthe
viewfromthevalleybelowandofthevalleybelow
fromit.Itshillsidelocationmakesitoneofthebest
potentialorchardsitesintheTownofDanby.No
orchardsarecurrentlyplannedbyeitherthe
currentorfutureowner,butthepossibilityofone
inthefuturewillbesecuredbythiseasement.
Conservationeasementsareavoluntarygiftof
someorallofthedevelopmentrightstoaproperty
toaqualifiedconservationorganization.
Municipalitiescanberecipientsofsuchdonations
andtheConservationAdvisoryCouncilinDanby
wascreatedinparttohelptheTownBoardcreate
andadministeraconservationeasementprogram
inDanby.Wehave6easementsintotalsofar,with
severalmoreinthepipeline,withthisoneatthe
finalstage,whichisTownBoardReviewand
approval.Wehaveheldpublichearingsforallour
conservationeasementsandwilldosoforthisone
aswell.ThathearingwillbeattheMay17Town
Boardmeetingat6P.M.Ifyouwouldliketotakea

ComputerSecurityfortown (KatharineHunter)
TheTownhascontractedwithandbegun
onboardingwithTripleCitiesNetworkSolutions
(TCNS)forITservices,particularlyforincreased
security.Wewelcometherelationshipthatwill
allowustomoveforwardwithinternal
communicationsandsecurity.Thisprocesswill
takeabitoftimeandtherewillbevisitswithstaff
andboardstohelpwithtransitions.

CannabisRevisedZoningPassed (JoelGagon)
Therewasverylittlecommentatthepublichearingonthecannabislaw,andtheTownBoardpassedit
asproposedattheApril4meeting.BothretailsalesandconsumptionsitesareallowedinDanby;this
lawjustaddedacoupleofrestrictionsspecifictothesetypesofbusinesses,aimedatthepotential
issuesofodorandsignage.Thismightwellendupbeingsomethingofatheoreticalexercise,sincethe
likelihoodofgettingsuchbusinessestolocatehereissmall.Wearereadyandwilling,though,should
anyonewanttogiveitatry!
Short-termRentalSurvey (PatWoodworth)
Asurveyregardingshort-termrentalswasmailedtoallresidentsrecently.Youcanfilloutthepaper
copyofthesurveyandeithermailitorbringittotheTownHall.IftheTownHallisclosedwhenyouwant
toreturnit,youcanplaceitinthedropboxoutsidethemaindoors.Alternately,youcanfilloutanonline
versionofthesurvey.ThelinkisavailableontheTownwebsite.Theattachmenttothesurveyprovides
backgroundinformationabouttheissueandwhythetownisinterestedinyourinput.

Storm-waterDistrict#1 -
ThesubdivisionactionthatcreatedtheBeardsleyLanedevelopmentcamewitharequirementthat
certainstorm-waterinfrastructurebebuilttoprotecttheenvironmentfromthenegativeimpactsof
addingasignificantamountofnewimpervioussurface,includingtheroads,driveways,androofsofthe
newneighborhood.Itwasalwaystheplanthatthedeveloperwouldsetupadistricttocover
maintenancecostsdowntheroad,oncethelastlotwasdeveloped,toavoidputtingaburdenonthe
restoftheTown.Unfortunately,thatinfrastructurewasnotproperlycaredfor,thelastlothasnotbeen
developed,andthedeveloperstoppedpayingtaxesontheparcelssetasideforstorm-waterponds.
ThisledtoforeclosurebyTompkinsCounty,whoturnedthelotsovertotheTown.TheTownisnow
settingupaSpecialDistrictthatincludesallofthehomesandlotsbenefitingfromthatoriginal
subdivisiontoensurethatthoseresidentscanpayfortheupkeepoftheinfrastructurethatallowedtheir
neighborhood.Thisisalongoverdueprocess,butwehopetoclearthebureaucratichurdlesthisyearso
thattheinfrastructurecanbeproperlymaintainedtoprotecttheenvironmentandproperty.
FEMAFloodMaps -
FEMAhasreleaseddraftfloodmapsthatwilladjustexistingfloodhazardareasinWestDanbyalong
theCayugaInlet,MichiganHollow,andDanbyCreek,andwilladdnewfloodhazardareasalong
ButtermilkCreek,impactinghomesinCentralDanby.Whenfinalized,themapswillresultina
requirementthathomesinthefloodplanepurchaseFloodInsuranceiftheyaresubjecttoafederally
insuredmortgage.TheTownisapartoftheNationalFloodInsuranceprogramandassuchwillneedto
updateourFloodDamageProtectionlawinordertoensurethatfloodinsuranceremainsavailableto
residents.

TheDanbyHighwayDepartmentwouldliketobringtotheTown'sattentionthatinthelastfewmonths
orsosignshavebeenstolen,especiallySTOPsigns.Iwouldliketoremindeveryoneofhowdangerous
thisis.UnderNYSlawthisisafelonythatcouldputyouinstateprison,aswellasleavingyoupaying
largefinesandrestitution.
Wearestrategicallysettingupafewhiddencamerasaroundthetownthatwillonlyrecordfootage
uponoursignage,andnotpeople'spersonalproperty,withhopesofcatchingtheculprit(s).

TheDanbyConservationAdvisoryCouncil(CAC)metatTownHallonTuesday,April12at7pm.Hereare
thehighlights:
WevotedtosendanotherconservationeasementontotheTownBoardforapprovalanddiscussedour
progressindevelopingseveralneweasements.Wearealwaysinterestedintalkingtopropertyowners
whomightbeinterested.Theprogramisveryflexibleandwedoourbesttoaccommodatetheconcerns
ofthedonors.
ItshouldalsobeofinteresttoyouthattheCouncilvotedtorecommendthattheTownpursue
completingtheprocessofenablingTowntaxreductionsforeasementdonors.Thiswasbasedonmore
thanayear’sworkbytheTaxAbatementCommittee.Moredetailstocomeonthisprocess.
TheCouncilagreedtoparticipateinconversationswiththeNYDEContheproposedTimberHarvest
Law.WealsohadanexcellentdiscussiononthehistoryoftheCAC,withcriticalinputfromcofounder
JoelGagnon.

ThewaterdistrictwillbeflushingthewaterlinesduringthedayonMay8thand9th.Thisisdonetwicea
yeartohelpmaintainwaterqualityandremoveanysedimentthathascollectedinthewaterlines.There
maybesomediscoloredwaterforashorttimeduringthisprocess.Ifthishappens,letyourtaprunfora
minuteorsoanditshouldclearup.

Flapjackfanaticshelpedusraise$1347!Thatputsusata$7,284total
towardsour$26,000goal.
Whyarewefundraising?Weneedbattery-operatedextricationtools.
Wearereplacingasetoftoolsthatarecurrentlyhydraulically
operated,whichmeanstheycannotgobeyondacertaindistancefrom
ourengine,401.Theyalsocost$30,000backin1999.Throughcareful
maintenanceandproperuse,wehavemadesuretheyhaveremained
inworkingorderfor20+years,butcarshavechanged,andour
hydraulicextricationtoolsarenotratedfornewsafetystructuresin
moderncars,whichcostsustimeduringrescueandthereforedrives
ourneedfornewextricationtools.
