PUBLIC HEARING to consider a request a variance of the minimum 50 ft. side yard setback required in Section 600, paragraph 6a, and Section 512, paragraph 2 of the town of Danby Zoning Ordinance in order to construct an 8' x 12' firewood storage shed southeast of their existing home, approx. 38' from the southeast property line at 862 Steam Mill Road, tax parcel no.11.-1-6.171: M. Fowler & B. Behrmann, Owners. PUBLIC COMMENT Mark Fowler explained his need for the variance to place a wood shed near his driveway and provided a picture to represent the type of shed he was looking to build. Fowler explained that there was no room to place the shed on the north (left) side, or it would block access to the back of the house, and the south (right) side is less then 50 ft from the neighboring property. Both sides of the driveway have a drop off, and the south (right) side is the only option to keep the shed close to the driveway, where the wood delivery is easiest to unload. Schwartz clarified that the distance was actually 38'. Becker questioned if the wood shed was a permanent structure, or if it was on skids. Fowler confirmed that the shed would be placed into the ground with footers, and that it would be a permanent structure. Fowler provided written statements from three (3) neighbors, all of whom had no objections. VARIANCE DISCUSSION Schwartz commented that he didn't see any undesirable or adverse changes being made to the neighborhood, and that the only way to achieve this was through the variance, which was minimal. Hall recommended to keep the neighboring ravine wild and vegetative, in case the neighbors choose to build in the future. The hearing was closed at 7:08 pm. The request for variance was approved. MOTION TO GRANT VARIANCE: The Board of Zoning Appeals of the Town of Danby approves the variance of the minimum 50 ft. side yard setback required in Section 600, paragraph 6a, and Section 512, paragraph 2 of the town of Danby Zoning Ordinance in order to construct an 8' x 12' firewood storage shed southeast of their existing home, approx. 38' from the southeast property line at 862 Steam Mill Road, tax parcel no.11.-1-6.171: M. Fowler & B. Behrmann, Owners.
