SECTION 1 - PURPOSE
The purpose of this local law is to designate certain low volume roads or sections of roads
hereinafter specified in Section 2 following to be minimum maintenance roads pursuant to Local
Law No. 2 of 2002 of the Town of Danby.
SECTION 2 - SPECIFIC ROADS OR SECTIONS OF ROADS AFFECTED
a. All that r_action of Eastman I Till Road commencing at a point 800 feet north of the Town of
Danby/Town of Candor To\'•n Line, running northerly 2377 /- feet to the intersection of
Eastman Hill Road and Heisey Road and thence running northerly 125 +/- feet from the
center of said intersection, for a total distance of 2502 +/- feet, being the section of Eastman
Hill Road presently designated as `seasonal maintenance'.
b.. . All that section of Heisey Road commencing at a point 1975 feet from the intersection of
Heisey Road with Danby Road (N.Y.S. route 96B), running easterly 2556 +/- feet to the
intersection of Heisey Road with Eastman Hill Road, and thence cunm,rig easterly 12) +/- feet
from the center of said inn rsection, for a total distance of 2681 +/- fu.t, being the se.tion of
Heisey Road presently designated as `seasonal maintenance'.
SECTION 3 - MINIMUM MAINTENANCE PRACTICES
Minimum maintenance roads shall be maintained in a manner determined by the Town of Danby
Highway Superintendent to be consistent with the volume and type of traffic traveling on such roads.
Maintenance practices are set forth in Section 10 of Local Law No. 2 of 2002 of the Town of Danby.
SECTION 4 - DISCONTINUANCE OF MINIMUM MAINTENANCE DESIGNATION
a. Any person or persons owning or occupying real property abutting a road or portion thereof
which has been designated a minimum maintenance road may petition the Town Board to
discontinue the designation of such road or portion thereof as a minimum maintenance road
pursuant to Section 8 of local law No. 2 of 2002 of the Town of Danby.
b. The Town Board may adopt a local law discontinuing such minimum maintenance road
designation in the event it determines such discontinuance to be in the public interest.

SECTION 5 - SEPARABILITY
In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the
remaining portions shall not be affected by such declaration of invalidity.
SECTION 6 - EFFECTIVE PATE
This local law shall take effect immediately upon the posting of appropriate signage conforming to
the Manual of Uniform Traffic Control Devices pursuant to Sections 4 and 6 of Town of Danby
Local Law No. 2 of 2002, and upon its filing in the Office of the Secretary of the State of New York.

WHEREAS, notice of said public hearing was duly advertised in the Ithaca Journal on December 19, 2002, and
WHEREAS,said public hearing was duly held on said date and time at the Town Hall at 1830 Danby Road, Ithaca,
New York, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said
proposed local law, or any part thereof, and
WHEREAS,pursuant to Part 617 of the Implementing Regulations pertaining to Article 8 (State Environmental

SECTION 1 - PURPOSE
The purpose of this local law is to designate certain low volume roads or sections of roads
hereinafter specified in Section 2. following to be minimum maintenance roads pursuant to Local
Law No. 2 of 2002 of the Town of Danby.
SECTION 2 - SPECIFIC ROADS OR SECTIONS OF ROADS AFFECTED
a. All that s:ction of Eastman Hill Road commencing at a point 800 feet north of the Town of
Danby/Town of Candor Tor.-n Line, running northerly 2377 +/- feet to the intersection of
Eastman Hill Road and Heisey Road and thence running northerly 125 +/- feet fi'om the
center of said intersection, for a total distance of 2502 +/- feet, being the section of Eastman
Hill Road presently designated as `seasonal maintenance'.
b. . All that section of Heisey Road commencing at a point 1975 feet from the intersection of
Heisey Road with Danby Road (N.Y.S. route 96B), running easterly 2556 +/- feet to the
intersection of Heisey Road with Eastman Hill Road, and thence running easterly 125 +/- feet
from the center of said intersection, for a total distance of 2681 +/- fee.t, being the section of
Heisey Road presently designated as `seasonal maintenance'.
SECTION 3 - MINIMUM MAINTENANCE PRACTICES
Minimum maintenance roads shall be maintained in a manner determined by the Town of Danby
Highway Superintendent to be consistent with the volume and type of traffic traveling on such roads.
Maintenance practices are set forth in Section 10 of Local Law No. 2 of 2002 of the Town of Danby.
SECTION 4 - DISCONTINUANCE OF MINIMUM MAINTENANCE DESIGNATION
a. Any person or persons owning or occupying real property abutting a road or portion thereof
which has been designated a minimum maintenance road may petition the Town Board to
discontinue the designation of such road or portion thereof as a minimum maintenance road
pursuant to Section 8 of local law No. 2 of 2002 of the Town of Danby.
b. The Town Board may adopt a local law discontinuing such minimum maintenance road
designation in the event it determines such discontinuance to be in the public interest.
•
SECTION 5 - SEPARABILITY •
In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the
remaining portions shall not be affected by such declaration of invalidity.
SECTION 6 - EFFECTIVE LATE
This local law.shall take effect immediately upon the posting of appropriate signage conforming to
the Manual of Uniform Traffic Control Devices pursuant to Sections 4 and 6 of Town of Danby
Local Law No. 2 of 2002, and upon its filing in the Office of the Secretary of the State of New York.

The purpose of this local law is to designate certain low volume roads or sections of roads
hereinafter specified in Section 2 following to be minimum maintenance roads pursuant to Local
Law No. 2 of 2002 of the Town of Danby.
SECTION 2 - SPECIFIC ROADS OR SECTIONS OF ROADS AFFECTED
a. All that section of Eastman Hill Road commencing at a point 800 feet north of the Town of
Danby/Town of Candor Town Line, running northerly 2377 +/- feet to the intersection of
Eastman Hill Road dnd Heisey Road and thence running northerly 125 /- feet from the
center of said intersection, for a total distance of 2502 +/- feet, being the section of Eastman
Hill Road presently designated as `seasonal maintenance'.
b. All that section of Heisey Road commencing at a point 1975 feet from the intersection of
Heisey Road with Danby Road (N.Y.S. route 96B), running easterly 2556 +/- feet to the
intersection of Heisey Road with Eastman Hill Road, and thence running easterly 125 +/- feet
from the center of said intersection, for a total distance of 2681 +/- feet, being the section of
Heisey Road presently designated as `seasonal maintenance.
SECTION 3 - MINIMUM MAINTENANCE PRACTICES
Minimum maintenance roads shall be maintained in a manner determined by the Town of Danby
Highway Superintendent to be consistent with the volume and type of traffic traveling on such roads.
Maintenance practices are set forth in Section 10 of Local Law No. 2 of 2002 of the Town of Danby.
SECTION 4 - DISCONTINUANCE OF MINIMUM MAINTENANCE DESIGNATION
a. Any person or persons owning or occupying real property abutting a road or portion thereof
which has been designated a minimum maintenance road may petition the Town Board to
discontinue the designation of such road or portion thereof as a minimum maintenance road
pursuant to Section 8 of local law No. 2 of 2002 of the Town of Danby.
b. The Town Board may adopt a local law discontinuing such minimum maintenance road
designation in the event it determines such discontinuance to be in the public interest.

SECTION 5 - SEPARABILITY
In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the
remaining portions shall not be affected by such declaration of invalidity.
SECTION 6 - EFFECTIVE DATE
This local law shall take effect immediately upon the posting of appropriate signage conforming to
the Manual of Uniform Traffic Control Devices pursuant to Sections 4 and 6 of Town of Danby
Local Law No. 2 of 2002, and upon its filing in the Office of the Secretary of the State of New York.

Steven Babcock of 137 Heisey_Road- had questions related to the proposed local law.
What mated this`change._in classification?
Wilt the road-be improved?
He said he purchased his property for the seclusion and would like the-seasonal-sign-to-stay where
it is.
Supervisor Dietrich responded that the proposed local law was an economic-one.
Highway-Superintendent-William Hall said that there-would be no change-from-what the highway
does now. The road would be graded and maintained with minimum maintenance.
Charles Banker-of 1927 Carmichael Road, Owego; NY -owns property on Eastman Hill and has
no problem with this change and has seasonal usage. When you change designation to-minimum
maintenance and-should I want to-put-a-permanent dwelling--on-that property I would have to
come to the Town to get it approved-and-the-Board could refuse the request. The-change does
affect thevalue-of the property. He requested a copy of the resolutions if the local law is
approved to take to his assessor.

recommendations of the School Board prior to any vote upon the proposed local law.

WHEREAS, notice of said public hearing was duly advertised in the Ithaca Journal on
December 19, 2002, and
WHEREAS, said public hearing was duly held on said date and time at the Town Hall at
1830 Danby Road, Ithaca,New York, and all parties in attendance were permitted an
opportunniity to speak on behalf-of or in opposition to said proposed local law, or any part
thereof, and
WHEREAS,pursuant to Part 617 of the Implementing Regulations pertaining to Article
8 (State Environmental Quality Review Act),the Town Board acting as Lead Agency in
environmental review of the Unlisted Action has made a negative determination of
environmental significance, and

WHEREAS,the Tompkins County Department of Planning on November 13, 2002 has
indicated pursuant to General Municipal Law ss239 that the mater has no negative inter-
community or county-wide impacts,
NOW,THEREFORE, BE IT
RESOLVED,that the Town Board of the Town of Danby hereby adopts said local law
entitled: "A Local Law Classifying Particular Roads or Portions Thereof as Minimum
Maintenance Roads".
a copy of which is attached hereto and made part of this resolution, and it is further
RESOLVED,that the Town Clerk is hereby authorized and directed to file said local law
with the Secretary of State as required by law.
