TOWN BOARD MINUTES
NOVEMBER 13 , 2006

Supervisor Fredric Dietrich called the meeting to order at 6 : 50 p .m. and led all present to the Pledge
of Allegiance to the American flag.
ADDITIONS TO THE AGENDA:
1 ) Councilperson Beavers asked computer lap top computer for be added to the agenda.
2) Report from the Fire Department.
3 ) Possible additional funding for the aquifer study.
4) Motion to refer the draft of a proposed local law.
5) TCAD (Tompkins County Area Development)
No Board Member objected.
PRIVILEGE OF THE FLOOR
The Town Clerk reported that she participated in the MDA lock-up last week and raised $407 in bail
funds.
Members of the Public :
David Noteboon (a Town of Danby highway department employee) reported that this year has been
a very trying time for himself and the highway department and there are a a lot of issues that must
be resolved. These issues between the highway department and the highway superintendent that the
Town Board can resolve should be resolved as soon as possible so that they can serve the Town of
Danby.
Supervisor Dietrich said that the Town Board is in agreement. A meeting will be scheduled for
Thursday, November 16, 2006 to address the issue of the highway department and the highway
superintendent.
REPORTS :
Fire District Report - Pat Caveny a member of the Danby Board of Fire Commissioners reported
that there are new requirements regarding the operation of fire districts .
1 ) . requires mandatory training for all newly elected commissioners .
2) a mandatory budget hearing must be held on the third Tuesday of October every year
starting with the next years budget. The budget for the Fire District will be submitted in
November instead of October.
3 ) External Audits for Fire Districts will be required for budgets over $2. 00,000 .
4) Funds will be needed for radios for the E-911 system.
Pat Caveny reported that there is a committee working with an architect on preliminary plans for an
addition to the Danby Fire Department. The department needs some better facilities as they now
house four (4) vehicles in the bay that is build for three(3 ) .

Andy Dunnick - reported that Danby should hear whether they have been awarded a Federal Grant
that was submitted for a new engine for the first responding engines for all emergency calls . The
towers for E-911 system have been completed . Once all the equipment has been installed the County
will be doing tests . It will be at least six(6) months before the change-over to the new radio system
is completed .
Johathan Zisk - reported that he supports the Penneyroth proposal for the Cayuga Lake Watershed
Quality Monitoring Project that was presented to the Town and he thinks it would be to our
advantage to enter into this watershed study. He briefly explained the proposal and what it would
provide to our Town.
County Representative Frank Proto said that an engineers from an organization did the M and N
study for the County of Six Mile Creek and are now studying Salmon Creek. What Pennyroth is
proposing for Danby is something similar. He said that it might be helpful to run that proposal
through Kate Hackett.
County Representative Report
County Representative Frank Proto reported on the following:
1 . Tompkins County Budget hearing will be Tuesday November 14, 2006 at 7 : 00 p .m. The tax
rate between $ 6 -$ 7 per thousand with an increase of $ . 17 seventeen cents per thousand
dollars per $ 1 ,000 assessed value.
2 . County is considering a program to save money through the proposed low maintenance
roads program. They are looking at roads that have fewer than 300-400 vehicles per day.
3 . The Water Resources Council are going to address the concerns about the lake source
cooling monitoring.
4 . The Town of Lansing is asking the County for borrowing authority to borrow money.
5 . Bike Paths - are reviewing a map of roads in the County to describe levels of safety for
bicycles .
6 . Agriculture and Farmland review - deadline for residents to place lands in the County
Agricultural District is November 30, 2006
EMC - No report.
Zoning - Code Enforcement Office Monthly Report - October 2006 received.
Susan Beeners reported that the demolition at the Old Town Barns on Hornbrook Road has been
completed.
Planning Board Report :
A public hearing has been scheduled for November 2006 at 7 : 00 for the Waldorf School of the
Finger Lakes subdivision for four(4) lots on the school property.
Beautification Committee :
The daffodil bulbs have arrived and will be distributed this week-end to residents along the highway.
Some of the bulbs will be planted here at the Town Hall.
Recreation Partnership
Supervisor Dietrich reported that the Town is waiting for a copy of an extension of the agreement.
Senior Citizens
Carol Sczepanski reported that the monthly luncheon of the Danby Senior Citizens was held on
Thursday, November 2 , 2006 at noon. It was attended by 44 seniors and there was a presentation
by the Resolution Dispute Center. December Christmas luncheon will held on December 7 at the
church and will be catered.

for the West Danby Water District from November 1 , 2005 thru October 31 , 2006 in the amount of

AUTHORIZATION FOR TOWN SUPERVISOR TO SIGN SNOW AND ICE AGREEMENT
AMENDMENT

RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor and
Highway Superintendent to sign the Snow and Ice Agreement Amendment between the County of
Tompkins and the Town of Danby with the term of this agreement to be extended through June 30,
2008 .

RESOLUTION NO. 98 OF 2006
SNOW REMOVAL AGREEMENT FOR TOWN HALL
By Councilperson Varona-Lacey: Seconded by Councilperson Salino
RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to sign
an agreement with Rice Landscaping for the removal of snow and the salting of the sidewalks at the
Town Hall for the 2006-2007 season.

RESOLUTION NO. 99 OF 2006
ESTABLISHMENT OF DANBY EMERGENCY MANAGEMENT PLANNING
COMMITTEE
By Councilperson Beavers : Seconded by Councilperson Varona-Lacey
WHEREAS, the Town Board of the Town of Danby finds that there is a need to supplement the
Tompkins County Comprehensive Emergency Management Plan with a Danby Comprehensive
Emergency Management Plan; and to implement various activities within the Town on an interim
basis while such a local plan is developed;
NOW, THEREFORE IT IS
RESOLVED, that the Town board of the Town of Danby hereby established the Danby Emergency
Committee ("DEMPC") ; and it is
FURTHER RESOLVED AS FOLLOWS :
1 . The Town Board appoints John Smith and Eugene Beavers as Co-
Chairpersons for the Committee .
2 . The Co-Chairpersons may designate the membership of the Committee at its
discretion.
3 . The charge to the Committee is to :
a. Develop a draft Danby Comprehensive Emergency Management Plan for
consideration of approval by the Town Board.
b . Implement various activities related to emergency management and disaster
preparedness as interim measures while such a plan is developed.
4 . The Committee shall report on a monthly basis to the Town Board.

RESOLUTION NO. 100 OF 2006
HIGHWAY GARAGE REMEDIATION PROJECT-AUTHORIZE TOWN SUPERVISOR
TO EXECUTE AN AGREEMENT FOR WASTEWATER AND SLUDGE DISPOSAL AND
TREATMENT BETWEEN THE TOWN OF DANBY AND THE CITY OF ITHACA

RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to
execute an Agreement for Wastewater and Sludge Disposal and Treatment between the Town of
Danby and the City of Ithaca, following approval of said Agreeement by the Attorneys for the Town.

related provisions as required by law .

an amendment for an extension for a County Planning Agreement for planning services from
December 31 , 2006 to February 28 , 2007 .

RECREATION PARTNERSHIP PROPOSED AGREEMENT

WHEREAS, Intermunicipal Recreation Partnership has successfully served thousands of young
people throughout Tompkins County operating under a five year agreement that expires December
2006, and

WHEREAS, the Recreation Partnership ' s governing board has begun but not yet concluded its
internal reflection and process of seeking input from all municipal partners to evaluate and update
the partnership agreement for the next five year period, and
WHEREAS, Tompkins County, upon recommendation f the Health and Human Services
Committee agree to extend the current Intermunicipal Recreation Partnership Agreement through
December 31 , 2007, and
WHEREAS, all terms, conditions and financial commitments related to the Agreement remain in
force through December, and
WHEREAS, Tompkins County will take prompt action on the proposed agreement for the period
2008-2012 to be prepared by the Recreation Partnership ' s governing board by May 2007 , now
therefore be it
RESOLVED, that the Town Board of the Town of Danby approves the extension of the Recreation
Partnership Proposed Agreement through December 2007 .

CSEA - TENTATIVE AGREEMENT
The CSEA Tentative Agreement was prepared for the board to review and sign their approval.
After review the CSEA Tentative Agreement was tabled to the December meeting.
Motion of Approval for the Highway Secretary to Purchase a Lap Top Computer
A motion was made by Councilperson Beavers and seconded by Councilperson Salino that the
Town Board of the Town of Danby approves the purchase of a Dell Lap Top Computer for the
Highway Department for an amount not to exceed $ 1 , 100 .

PROPOSED LOCAL LAW RELATED TO BUILDING PERMITS
The Code Enforcement Officer submitted a Proposed Local Law related to building permits and
includes issues related to the Planning Board . She recommended that the board refer the
information to the Planning Board. A section was included that training for the Planning Board
be included in an amendment to the Danby Zoning Ordinance.
Motion to Refer Proposed Local Law Related to Building Amending the Zoning Ordinance
and Planning Board to the Planning Board For Review.
A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers that the Town
Board of the Town of Danby refers the Proposed Local Law Amending the Zoning Ordinance
related to permits to build and Planning Board to the Planning Board for its recommendation as
submitted by the Code Enforcement Officer.

Funding for TCAD of $250 Requested
Supervisor Dietrich explained that TCAD is an area development group that oversee block grants,
Empire State Zone issues and are a big advocate of jobs in the area.
Motion to Fund TCAD $250 to Continue Planning Process
A motion was made by Supervisor Dietrich and seconded by Councilperson Salino to fund TCAD
(an area development group) $250 to continue their process .

Motion to Fund Cayuga Lake Water Quality Monitoring Project $350 to Continue Planning
Project

Board of the Town of Danby approves to fund $350 to the Cayuga Lake Water Quality Monitoring
Project under Community Science Institute.

Approval of Town Clerk' s October 2006 Report

Town Board of the Town of Danby approves the Town Clerk ' s October 2006 report as submitted.
The Town Clerk reported that there was an error on the DECALS withdrawal reported in September
and that she has added $ 1 . 12 to the October report.

Approval of the General Fund Warrant No. 10 of 2006
A motion was made by Councilperson Salino and seconded by Councilperson Beavers that the
Town Board of the Town of Danby approves the General Fund Warrant No . 10 in the amount of
$ ; 19, 537 .45 voucher numbers 440 - 494.

Approval of Highway Fund Warrant No. 10 of 2006
A motion was made by Councilperson Beavers and seconded by Councilperson Salino that the
Town Board of the Town of Danby approves the Highway Fund Warrant No . 10 of 2006 in the
amount of $27 , 104. 82 voucher numbers 141 - 146 and 148 - 157 . (Voucher No . 147 was not
approved.)

Councilperson Beavers asked that voucher No . 147 be forwarded to the Town Attorney to ensure
that the billing was done following a correct procedure and in an appropriate manner. He also
questioned No . 151 as it is a reimbursement for a cash transaction when there is an existing account
at the place of business.
Approval of West Danby Water District No. 10 of 2006
A motion was made by Councilperson Beavers and seconded by Councilperson Varona-Lacey that
the Town Board of the Town of Danby approves the West Danby Water District Warrant No . 10
in the amount of $ 641 . 20 voucher numbers 54 - 59 .

Board of the Town of Danby schedules a Special Meeting for Thursday, November 16 , 2006 at 3 : 30
p .m.
