Supervisor Dietrich called the Special Meeting of the Town Board to Order at 9 : 00 p .m. Purpose
of the Special Meeting is to fill the vacancy on the Planning Board and the following resolution
was presented for consideration.
RESOLUTION NO. 71 OF 2006
APPOINTMENT TO PLANNING BOARD
By Councilperson Beavers : Seconded by Councilperson Salino
WHEREAS, there is a vacancy on Planning Board of the Town of Danby, and
WHEREAS, the Town Board of the Town of Danby has held interviews with persons who are
interested in filling the vacancy; now be it
RESOLVED, that the Town Board of the Town of Danby appoints Ed Melchen to fill the
vacancy on the Planning Board of the Town of Danby for a term that begins immediately and
expires on December 31 , 2008 .

Supervisor Dietrich called the meeting to order at 6 : 40 p .m. and led all present to the Pledge of
Allegiance to the American flag.
ADDITIONS TO THE AGENDA
1 . Transfer of Funds from Capitol Reserve Building Fund to the General Fund Fund.
2 . West Danby Water District Personnel - Reimbursement for expenses incurred for training.
3 . Presentation by Steve Penneygroth - Cayuga Inlet Water Quality Monitoring Project.
PRIVILEGE OF THE FLOOR
Bill Keokosky - quoted a line from Resolution No . 70 (representing the people of Danby) and said
he is a person in Danby and this resolution does not represent him .
T.J. Hart - supports Mr. Keokosky and respectfully asked the Board to re-vote on this issue with
a full slate of members after consideration at their next meeting.
Naomi Strichartz - clearly many people have organized their rebuttal of Resolution No . 70 . The
people who support the resolution were not informed of this protest and are not here. She said that
sixty-seven percent of this country disagrees with our current government in Washington. The Town
Board voted a vote of conscience . She understands that this issue is difficult and divisive. She
suggested that the Town have a system where residents can be told in advance of important issues .
George Blanchard - This issue is not an issue of Danby. He asked the Board to act on this quickly
as you did the last time as you can pass a resolution to rescind this resolution and to get to work on
issues that most residents are concerned about and mentioned our current subdivision regulations
that many residents are unhappy with. He thanked Councilpersons Beavers and Salino for not votine
on this resolution.
Gay Huddle - agrees with Naomi Strichartz. She said that it is not appropriate for the Town Board
to send this kind of letter. People should have the right to know these kind of issues when they come
up . The Board should start with a clean slate.
Ray Mayo - does not think that the Town of Danby Town Board has done a good job of running the

Town for a couple thousand people. He does not think that the Town should tell the Federal
Government how to run a country.
Robert Howe - his impression is that elected town officials of the township are responsible for town
business regarding the welfare and well being of that township . He said that his many neighbors and
friends that have served this country. He does not object to the petition with 157 signers but does
object to the town officials spending valuable time on an issue that is not representative of the people
of the Town of Danby. He has a sign in his yard that states "The Danby Town Board does not speak
for this Veteran".
Bill Halton - he said that he is the person who circulated the petition and who wrote Resolution No .
70 . He tried to make the resolution uncontroversial. He explained that the war is costing the United
States a lot of money and lives and doing a lot of things we cannot be proud of in the Middle East.
He said that he would be very to participate in a forum with the people of Danby on this issue.
Supervisor said there is a question as to whether the Board had a right to say what it said, and the
way it read made it sound as if was inclusive as the whole Town of Danby.
Bill Halton said that it was inclusive only in that the Town Board is our elective representative and
they do speak for the Town of Danby.
Jon Mosher - he said he does not disagree with the letter but the Town has wasted time on a letter
and our tax dollars pays their salaries, roads and everything else. I believe that ` s what that Board
is up there for not speaking for everybody else.
Lynn Shields - I don ' t worry about people ' s view points . You have your right to view points and
I have mine . The problem I have is when you decided to do this resolution, nobody ever asked
everybody in Danby. Nobody every called me or asked me . You did something that you are not
supposed to be doing as a Town Board . Then you don ' t let anybody know you ' re going to do it.
Then all of a sudden I read this resolution and they can ' t speak for me . That ' s my problem.
Rick Dobson - Came to hear what this is all about. It seems that everybody is upset about a small
amount of people speaking for the rest of people.
Jonathan Zisk - the Board are your elected representatives . When they voted last meeting they
thought they had some input. He would like to see the opinion of the whole Town instead of 157
people. It is just as unfair for the group here to try to railroad a rescinding of that vote on the part
of your elected representatives right now .
Nesvesky(?) - Mr. Beavers with his no answer was badgered for why he had no answer. At the end
he had something to do and had to leave the meeting. As soon as he departed immediately a vote
was called. My problem is that all the members were not present and prior to Mr. Beavers leaving
there was no vote on the table .
Ames Brown - This is the third resolution of this type. All three of them were after the meeting was
virtually closed and nobody around to hear that these things had occurred. We are in a position to
end a war of over 1 ,000 years . If we are patient this will happen.
Asher Hockett - I agree with the Board' s handling of this resolution. He feels that the process for
communicating with the public by the Board needs to be refurbished totally. You cannot depend on
people coming to monthly meetings to be your only give and take. You have to have mechanisms
for longer drawn out exchanges of longer than three minutes and a chance for people to not feel that
they are in a hurry. What I' m hearing is that people are very upset about the war and upset about the
Board ' s handling of issues . I would not ask the Board to rescind it ' s resolution but I would ask that
there be serious consideration of refurbishing the process and open up the community about the
dialog about issues that are contentious like this . We can ' t stay away from the Board meetings . If
you care you really have to come.

Gary Huddle - Our town officials are elected to do local town duties . County, State and Federal
officials are elected the same . Since this is a Federal Government issue, our Town Board does not
represent everybody in this town (did or didn ' t) they should not be interfering with the Federal
Government. He said he would like to see this resolution rescinded.
Supervisor Dietrich asked ifpeople would like to address the Board an any subject besides this issue.
Newfield Resident - You respect your President, you respect your Congress and your State Board.
The time to protest war is before hand not afterwards . This whole thing seems to be over Iraq. He
thinks the Town Boards supercedes their decisions to tell the Federal Government, who is a
collection of very intelligent people who made the choice, as our leaders to go to war.
Kathy Halton - this to oppose policies that are destructive and that are wrong.
Pat McLean - his understanding that 157 people who decided to support this resolution. His
problem is that he has some rights and his rights were taken away. A lot of us did not have a say
because we didn ' t know about the resolution.
Olympia McFall - submitted a letter because of the severe conceptive condition of dust on Danby' s
gravel roads, specifically Fisher Settlement Road. The Highway Superintendent refuses to put any
brine on any brine on gravel roads because he does not believe in chemicals . She said it isn ' t safe
for walkers, bikers or motorists and that she is not asking for paving or stone and oil but brine to be
put on her road as it has been every year for thirty-four years to cut down on the dust. She cited other
issues regarding personal use of Town equipment. She asked that the Board request an audit of the
Town Highway Books by a State Comptroller. She asked the Board to request an audit of the
Town' s Highway Department Books by the State Controller.
Susan Beeners - reported that she was asked by the Town Supervisor at the Tuesday, August 8 ,
2006 staff meeting to arrange for Steve Penneygroth of Community Science Institute to come and
speak at 6 : 30 .
Scott Richards - concurs with McFall ' s report on the conditions of the road. He said he does pay
taxes to the County and the Town of Danby. The road has deteriorated beyond normal . Our tax
money should be put to better use . Tioga County section of Fisher Road is in much better condition.
The Town of Danby section needs to have something done.
Supervisor Dietrich closed the privilege of the floor.
Comments from the Board
Councilperson Nolte - for the record this is not the first time that we as a Board have adopted non-
binding resolutions . They are just our point of view. We needed to do it anyway.
Councilperson Beavers - He said that he was opposed when we first addressed it and still opposed
to it for all the same reasons I stated before . This is not a local government issue.
Community Science Institute Representative
Steve Penneygroth - from the Community Science Institute addressed the Board and said he was
here to ask the Board and the Town of Danby to support the Volunteer Water Quality Monitoring
Commission. The idea is for people in the Cayuga Inlet Water Shed to spend two hours per month
collecting water samples throughout the water shed and to transport those samples to a certified lab
operated by the Community Science Institute . Those samples will be analyzed for water quality.
There are several such programs in existence in Tompkins County. He is asking municipalities to
contribute to the program to spread the costs for the program .
The Board has received a budget for the monitoring Water quality in the Cayuga Inlet and the
proposed cost to the Town of Danby. The proposal will be addressed at the September Agenda
Meeting.

REPORTS :
County Representative Report
Representative Proto reported on the following :
- Review of the County Budget for 2007 is in progress . They are looking at keeping the rate at "0" .
- The Judges decision on Bolton Points Fee - ruled against the County on the fee. Eighty per cent
is paid by the taxpayers and twenty per cent is passed on as a fee. All of us as taxpayers will be
paying part of the fee.
- Well monitoring program will help to determine water quality and availability when a subdivision
is being developed.
- Veterans Cemetery - the Senate has approved $ 500,000 but not passed as yet by the Assembly.
- Real Estate Transfer Tax - he voted against the proposed transfer tax .
- Appointments to County Advisory Committees - no longer have to be a County Resident after new
by-laws were adopted .
The Town Board recessed for ten( 10) minutes.
Motion to Extend Meeting :
A motion was made by Supervisor Dietrich and seconded by Councilperson Nolte at 8 : 20 p .m. that
the Town Board of the Town of Danby extend the meeting to 9 : 00 p .m.

EMC - no report
Highway - written report received. The department had a short month in July and are repairing
drainage problems from the heavy rains . They are requesting FEMA aid. Work on Miller Road has
been stalled due to the cell tower construction. The Highway Department and the Town are working
toward certification for NIMS to comply with State and Federal Requirements . A training session
with the Fire District is scheduled for the third Monday (August 21 , 2006) at the West Danby Fire
Station and for the NIMS Committee on Wednesday, August 16`''
Highway Superintendent Andrew Thurnheer reported that in regard to a residents letter - he did
deliver some top soil to a friend on his own time and did charge a delivery fee.
Susan Beeners reported for the record that top soil from the Town of Danby Highway Department
was delivered to her brother in Mr. Thurnheer' s own truck and was charged a very high fee for
delivery.
Zoning - Susan Beeners reported that she has received some figures for the remediation project at
the Highway Barns and she explained how wastes and waste water will be handled.
Task Force Update - Susan Beeners reported that she has submitted a draft of the Proposed Right
to Farm law that has been referred to both the Town Board and the Planning Board . She asked that
it be placed on the September Agenda. The Task Force is also working on simplified language for
flag lots.
NIMS Training and Committee Meetings
NIMS training for disaster planning is on Wednesday, August 16 at 3 : 30 here at the Town Hall and
the NIMS Training at the West Danby Fire Hall for the Fire Departments and Town Officials will
be on Monday, August 21 , 2006 at 7 : 00 at the West Danby Fire Department.
COMMUNICATIONS :
Community Science Institute - Cayuga Inlet Water Quality Monitoring Project Proposal . The
Proposal was tabled to the September Agenda Meeting.

Letter from McFall ' s - Regarding Fisher Settlement Road conditions tabled to September Agenda
Meeting.
,Memo - Ronda Roaring - Regarding dog licencing - requests that the Danby Dog Law be published
in it ' s entirety in the Danby Area News . The Town Clerk will put a summary in the Danby Area
News ( if space permits) in the September issue. The entire Dog Law can be put on the Danby Web
site .
Right-to-Farm Law - Councilperson Beavers said that this also needs to be considered for the
September Agenda.
Funding Contribution for Aquifer Study-information transmitted to the board as a For Your
Information only item . The Bookkeeper is requesting that the Board create a line to pay for the
Aquifer Study Contribution.
RESOLUTION NO. 72 OF 2006
CREATION OF ACCOUNT A1446.400AND TRANSFER OF FUNDS

RESOLVED, that the Town Board of the Town of Danby creates the account entitled Aquifer Study
Project and is an account A1446 .400 and that funds not to exceed $ 10, 000 be transferred from the
Fund Balance Fund to account A1446 .400 for payment of the Aquifer Study. .

CSEA - Update
Supervisor Dietrich said that the CSEA Negotiations are ongoing.
Councilperson Beavers suggested that the Board meet in executive session to review proposed
contract and to receive updated information following the business meeting.
Time Warner Update
Supervisor Dietrich reported that in regard to the Time Warner Agreement proposal that we need
time to discuss this . Time Warner Agreement was tabled to the September Agenda

CAMELOT SUBDIVISION
RESOLUTION NO 74 OF 2006
CAMELOT SUBDIVISION CONSIDERATION OF FURTHER ACCEPTANCE OF
PROPOSED ROAD , PROPOSED WATER SYSTEM , AND PROPOSED
DRAINAGE/STORMWATER MANAGEMENT EASEMENTS

WHEREAS, this action is to Consider Further Acceptance of the Proposed Road, Proposed Water
System, and Proposed Drainage/Stormwater Management Easements at Camelot Subdivision,
located on the northeast corner of Hillview Road and Route 34/96 ; and
WHEREAS, the Town of Danby Town Board on June 12 , 1995 accepted the proposed dedication
of the road and the water main, subject to various conditions ; and
WHEREAS, the Town of Danby Planning Board on June 21 , 1995 granted Final Subdivision
Approval to Camelot Subdivision, subject to various conditions ; and
WHEREAS, the Town Board on August 8 , 2005 approved renaming the proposed road, "King
Arthur' s Court" to "Patchen Court", and
WHEREAS, the Town Board on May 8 , 2006 waived certain requirements of the town of Danby
Highway Specifications and Subdivision Regulations in order to permit a portion of Patchen Court
to have a maximum road gradient of 12 percent; and
WHEREAS, Kevin P . Jacobs, Owner/Developer, has submitted updated subdivision plans including
a boundary and topographic survey, grading and drainage plan, utility plan, and related
specifications, dated December 15 , 2005 revised through July 31 , 2006 ; and a Stormwater Pollution
Prevention Plan dated February 7 , 2006 ; and
WHEREAS , the Town' s staff, including the code Enforcement Officer, Deputy Highway
Superintendent, Water System Operator, and the Town ' s consulting engineer have reviewed said
plans and have substantially approved said plans subject to the provision of various minor technical
revisions ;
NOW, THEREFORE, IT IS
RESOLVED, that the Town board of the Town of Danby further accepts the Proposed road,
Proposed Water System, and Proposed Drainage/Stormwater Management Easements at Camelot
Subdivision, located on the northeast corner of Hillview Road and Route 34/96 ; as shown on the
updated subdivision plans dated December 15 , 2005 notwithstanding subsequent requirements of
project approval, and subject to the following conditions :
1 . Final approval by the Town' s consulting engineer and the Town Highway

Superintendent of the plans and specifications for the site grading, road
improvements , and stormwater management; and
2 . Final approval by the West Danby Water District Water System Operator of the plans
and specifications for the water system; and
3 . Submission of a Letter of Credit or other financial guarantee, in form and substance
satisfactory to the Town Supervisor and the Town Attorney in an amount estimated
by them to be sufficient to secure the cost of constructing the Project in accordance
with the Town ' s Highway Specifications and Subdivision Regulations; of completing
the Project and conveying the proposed public improvements and easements to the
Town and of any proceedings brought to compel such conveyance; and
4 . Submission to and approval by the Town Supervisor, Town Highway Superintendent,
and Town Attorney of an Agreement implementing the foregoing, and submission
of such other documents, plans, certifications, or other materials that any of them
may reasonably require, in order to assure to the Town that access to any dwellings
under construction shall be maintained so that it is adequate for the passage of
emergency vehicles ; and in order to assure to the Town that the Project and
associated public improvements and easements will be constructed and conveyed to
the Town in accordance with Town requirements ; and it is
FURTHER RESOLVED, that the Town Board of the town of Danby intends to hold a public
hearing in the future to consider establishing a Special District for the purpose of assessing the cost
of maintenance and repair of the stormwater management areas and related drainage improvements
to all owners of real property within the benefitted area; and hereby directs the Town ' s consulting
engineer to develop the study required for considering such Special District.
RESOLUTION NO. 75 OF 2006
AUTHORIZATION OF APPLICATION FOR SMALL CITIES STRATEGIC PLANNING
TECHNICAL ASSISTANCE GRANT
By councilperson Nolte : Seconded by Councilperson Beavers
WHEREAS, the Town of Danby needs to begin the second stage of implementing the Town
Comprehensive Plan, by developing a strategic plan for the Central and West Danby Hamlets ; and
WHEREAS, funding through the Small cities Strategic Planning Technical Assistance Grant is
needed so that the town Can develop the plan in a timely and efective manner;
NOW, THEREFORE, IT IS
RESOLVED, that the Town board of the Town of Danby authorizes Town Supervisor Fredric
Dietrich to submit an application for a Small Cities Strategic Planning Technical Assistance Grant,
to act as the official representative of the Town in acting in connection with the submission f the
grant application, and to provide such additional information as maybe required, with Susan Beeners
Zoning/Code Enforcement Officer, to act as primary contact person; and it is
FURTHER RESOLVED, that the Town Board authorizes the Town Supervisor to transmit a letter
with the grant application, indicating the intent of the Town board to participate in the strategic
planning process, to provide the required matching funds and resources, and to officially adopt the
strategic plan.

Water District to install a generator hookup .

RENAMING OF EMERY ROAD AS COLTSFOOT LANE

WHEREAS, Town of Danby staff has advised that Emery Road in West Danby is in need of a name
change due to the presence of another Emery Road in Spencer; and
WHEREAS, a resident on Emery Road has suggested that the road be renamed as Coltsfoot Lane,
NOW, THEREFORE, IT IS
RESOLVED, that the Town Board of the Town of Danby hereby changes the name of Emery Road
to Coltsfoot Lane.

APPOINTMENT OF TEMPORARY PART TIME LABORERS FOR THE TOWN OF

RESOLUTION NO. 81 OF 2006
TRANSFER OF FUNDS FROM CAPITOL RESERVE FUND

RESOLVED, that the Town of Danby Town Board authorizes the Town Supervisor and the Town
Bookkeeper to transfer (Eighty-two Thousand Dollars) $ 82 ,000 from the Capitol Reserve Building

REIMBURSEMENT FOR WEST DANBY WATER DISTRICT TRAINING COURSES
By Supervisor Dietrich : Seconded by Councilperson Nolte
WHEREAS, it is necessary for West Danby Water District Commissioners to attend training courses
related to the operation and maintenance of the West Danby Water District, and
WHEREAS, training courses are mandatory and held during regular the Commissioners regular
working hours, and
WHEREAS, the Commissioners have requested reimbursement for their loss of wages from their
regular employment and expenses incurred for the training sessions ; now be it
RESOLVED, that the Town Board of the Town of Danby authorizes the reimbursement to Water
District Commissioners for wages and expenses incurred related to the Water District Training
