Supervisor Dietrich called the meeting to order at 6 : 35 p . m . and led all present to the Pledge of
Allegiance to the American flag.
Additions to the Agenda :
Correspondence Received :
The Town Clerk read a letter to the Town Board from Mary Oltz regarding the Capital Funds that
were set aside for the Salt Shed and West Danby Water District Funds that were for upgrading their
water system.
Roy Casterline said that item No . 8 on the Agenda the West Danby Water District request is to
rebuild the water pump that they took out.
Councilperson Varona-Lacey asked the Board to take up the issue of roads in new developments .
Supervisor Dietrich reported that the Town Attorney said for a temporary fix that the Town could
change some wording in the legislation that would allow the Town to keep reserve funds for roads
in developments for three (3 ) years in future development. He will place a proposal on the April
Agenda.
Susan Beeners asked that a letter from the EPA letter be placed on the agenda for discussion.
Privilege of the Floor :
Ames Brown - the County is gradually taking over more and more Town administration functions .
The Town should help the Highway Department do the maximum they can do . He asked if the Town
could put up a salt shed for a similar amount that is proposed for the Town of Lansing.
Ronda Roaring - the Board talked about a long term employee to write grants proposals or whether
to contract out. She suggested that the Town contract out individually rather than a long term person
and it should seek someone with expertise in that particular area that the grant proposal is for.
REPORTS :
Environmental Management Council (EMC)
Robert Roe reported that the EMC held its monthly meeting and had available the distributed the
NYS Natural Gas Outlook pamphlet that talked about the price of gas and what residents can do to
cut your gas usage . Cornell Development Administration reported that there are 27 projects
underway for a five(5 ) year plans . Completion dates range from 2005 -2010. One that should be
interesting to Danby is the combined heat and power renovation as they are going to switch to natural
gas . Bob described some of the items on the list of projects . The EMC received the County' s

Natural Features Focus Plan and a summary document of where they are right now.
Highway Report:
The Highway Superintendent, Andrew Thurnheer reported that some of the roads are really bad due
to the weather.
Zoning Report - Monthly report for February received. Susan Beeners distributed Round 2-B
material, Article VI revisions and a draft copy of a Right to Farm Law to be reviewed with the Task
force at the April 5 , 2006 joint meeting of the Board and Task Force. She said that the Planning
Board recommended that the Town develop legislation for wind towers .
Planning Board Report :
Robert Roe reported that the Planning Board held two(2) public hearings in February. They passed
a resolution recommending that the Town Board not approve the Bailey Homes Planned
Development District proposal on Muzzy Road .
Revitalization Committee :
Councilperson Varona-Lacey reported that the Revitalization Committee identified places for
beautification on the north and south entrances of the Town. They are going to contact some of the
businesses in the Town. They have one commitment that will allow them to place planters and they
will be talking with other property owners . They plan to plant some trees . The Bi-Centennial
Committee has agreed to work with them on the staining of the gazebo and the planters at the Town
Hall . She said that it is important to have representation from West Danby on the Committee.
Recreation Partnership :
Supervisor Dietrich reported that the Tompkins County Municipal Officers will receive an update
at their March meeting. Representative Proto attended the last meeting Recreation Partnership
Danby. They are going to try to come up with a refinancing plan. Danby uses the recreation portion
of that program fairly extensively. We have one of the highest rates . Students who are interactive
with the Ithaca City School District, Caroline, Enfield, Danby, parts of Ulysses and Dryden all want
to go with their friends . Other Towns that have their own schools are trying to develop their own
programs and are less energetic about using the partnership .
Community Council :
Councilperson Varona-Lacey reported that Community Council set aside $4000 to be used for Danby
Fun Day, to pay Danby Youth for employment . The Community Council Agreement is on the
Agenda for Town Board approval . Danby Community Council approved the request from the Town
Clerk for $405 for a youth intern in her office .
Dog Control - no report received for February.
Danby Senior Citizens
The Town Clerk reported that 20 seniors attended the March dish-to-pass meeting even though the
weather was not favorable for travel. The afternoon was spent playing board games and card games .
The April dish-to-pass luncheon will be the traditional ham dinner.
Correction to February 27, 2006 Minutes
There was an error in the February 27 ,2006 Special Meeting Minutes as published. The vote on the
Planning Board Appointment was amended: Councilperson Beavers and Councilperson Salino voted
- Nay.
A motion was made by Councilperson Beavers and seconded by Councilperson Varona-Lacey that
the minutes be corrected.

OLD BUSINESS
Bailey Homes Request for Planned Development District
The Town Board received the Planning Board Resolution No . 4 . The Planning Board
recommendation to the Town Board is that the Bailey Homes Request for a Planned Development
District on Muzzy Road be denied . Michael Hovanec has requested that the project be placed on
hold at this time until he makes application on another site .
Round 2-A Subdivision Regulations Revisions
Susan Beeners reported that the Board received material at an executive meeting as to weather the
Board wanted the land issued by permit . There are two(2) options . 1 ) is as proposed by the Task
Force and recommended by the Planning Board any lots fifteen ( 15) acres or more be exempt by
permit . The Board suggested that the fifteen ( 15 ) acres, and 2) lots less than that size be one in any
five(5) years .
Motion to Approve Round 2-A Subdivision Regulations
A motion was made by Councilperson Nolte and seconded by Supervisor Dietrich that the Town
Board of the Town ofDanby accepts the advising on the draft for Round 2 -A Subdivision regulations
being prepared for public hearing and accepts the Planning Boards recommendation that Option # 1 ,
in land division by permit be fifteen( 15 ) acres or more and that Option #2 be five(5 ) years .
Discussion :
Councilperson Varona-Lacey reported to the Board that she attended the Planning Board meeting
and Ray VanDeBogart said that the Task Force would like the Town Board to consider the proposal
made by the Task Force .
Susan Beeners said that subdivision by permit properties would have to meet the minimum road
frontage requirements .
Councilperson Beavers said his personal view is that he would like to see less but would agree with
the Task Force decision.
Councilperson Salino said that he agrees with the general consensus of the Task Force .

RESOLUTION NO. 34 OF 2006
ADOPTION OF THE TOMPKINS COUNTY MULTI-JURISDICTIONAL ALL-HAZARDS
MITIGATION PLAN
By Councilperson Nolte : Seconded by Councilperson Beavers
WHEREAS, Tompkins County and the municipalities therein have identified a history of damages
resulting from flooding, severe storms, winter storms, and other weather-related phenomena, and
have recognized the potential for future damages resulting from natural , human-caused, and
technological disasters, and
WHEREAS, an all-hazards mitigation plan can provide recommendations to help prevent and
minimize the damages resulting from such events, and
WHEREAS, the adoption of an all-hazards mitigation plan is required to be eligible to receive State
and Federal funding for hazard mitigation initiatives, and

WHEREAS, the County of Tompkins and the towns of Caroline, Danby, Enfield, Groton, Ithaca,
Lansing and Ulysses (Partners) executed a Memorandum of Understanding in 2003 to develop a
Multi-Jurisdictional All-Hazards Mitigation Plan (Plan) , and
WHEREAS, the Plan has been drafted in accordance with the requirements of the New York State
Emergency Management Office (SEMO), Federal Emergency Management Agency (FEMA), and
Disaster Mitigation Act of 2000, and
WHEREAS, the Plan includes jurisdiction-specific recommendations to minimize the damages
associated with natural, human-caused, and technological disasters , and
WHEREAS , the Plan has been made available for public review online at the Tompkins County
Planning Department Hazard Mitigation website and by placement in municipal offices, the
Tompkins County Planning office, and the Tompkins County Public Library, with notices published
in the Ithaca Journal, the local paper of record, inviting public comment, and
WHEREAS, public meetings were hosted by Partners throughout the development of the Plan to
discuss the contents of the Plan with members of the public , and
WHEREAS, comments from the public and partners have been incorporated into th Plan, and
WHEREAS, the Plan is wholly supported by its reviewers, and
WHEREAS , the Town Board of the Town of Danby has reviewed the Plan and affirms that the Plan
will be updated no less than every five years ; now therefore be it
RESOLVED, that the Town Board of the Town of Danby adopts the Tompkins County Multi -
Jurisdictional A11=Hazards Mitigation Plan as its all-hazards mitigation plan, and resolves to execute
the actions in the Plan.

RESOLUTION NO. 35 OF 2006
SALT STORAGE FACILITY PROJECT - CONTRACT TERMINATION
By Supervisor Dietrich: Seconded by Councilperson Beavers
WHEREAS, the Town of Danby engaged the services of T . G. Miller, P . C . , by contract signed by
the Engineer on May 20, 2005 and by the Town Supervisor on July 19 , 2005 , for professional
engineering, architectural, and surveying services in connection with the proposed Highway
Department Expansion Project, which included designs for the proposed Salt Storage Building and
stormwater management facilities ;
NOW, THEREFORE IT IS
RESOLVED, that the current Town Board and Town Highway Superintendent have appreciated the
services provided, but have not found a need for the project at this time ; and it is
FURTHER RESOLVED, that the Town Board of the Town of Danby hereby terminates the
contract referenced herein.

Susan Beeners reported that the DEC grant applications that we have submitted before for the salt
shed project are due on March 31 , 2006 . One might expect that they would be an annual
occurrence . The number of salt barns that are actually assigned is less because the State is looking
at the worse cases . She urged that the Board keep this in mind for next year to develop an
application.
County Representative Report
Representative Frank Proto reported on the following:
1 . County the Board approved the Multi-Jurisdictional All Hazard Mitigation Plan.
2 . Asian Flue - There is concern of the Asian Flu and lack of understanding. A plan must be
developed and approved by the State .
3) Agriculture forms for Ag assessments are due by April 1 .
4 . Youth Recognition Awards - Criteria is on the County Web site.
5 ) NYSEG Bills - the amounts estimated on the new bills is higher than last years . We should
question how they came up with the estimates .
6 . Emergency Communication Plan - it is important that they get the part done for additional
problems . There is a question about road access to the two(2) proposed towers in Danby.
7 . County Ag Districts - this year they will be working on the eastern part of the County
Agriculture District.
NEW BUSINESS
Assessment Board of Review
A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers that the Town
of Danby sets the date for the Assessment Board of Review for May 9, 2006 from 3 -6 p .m . at the
Town of Danby Town Hall and have approved Al Becker and Randolph Brown and County
Representative Frank Proto will be representatives for the Town of Danby.

RESOLUTION NO. 36 OF 2006
2006 WORK PLAN UNDER TOMPKINS COUNTY GENERAL PLANNING SERVICES
CONTRACT
By Councilperson Nolte : seconded by Supervisor Dietrich
RESOLVED, that the Town Board of the Town of Danby hereby approves the 2006 Work Plan
showing work that will be completed by the Tompkins County Planning Department for the Town
of Danby as part of the General Planning Services Contract, as recommended to be modified on
March 8 , by the Task Force .
Discussion :
Susan Beeners reported that the Task Force made a recommendation to make a change to the
County' s work plan. There is not a detailed work plan . She described what the work plan might
include. The County is asking that we have a work plan in place .
Councilperson Nolte said that he understands what we need but it is not what we are going to get.
It is a question of whether or not we need it or not.

Councilperson Beavers said that what we need is help with writing the legal legislation.

APPROVAL OF A JOINT TOWN BOARD/TASK FORCE MEETING

RESOLVED, that the Town Board of the Town of Danby agrees to schedule a joint Town Board/
Task force Meeting on Wednesday. April 5 , 2006, at 6 : 30 p .m . for further discussion of proposed
Task Force work in 2006 .

RESOLUTION NO 38 OF 2006
APPROVAL OF THE 2006 AGREEMENT BETWEEN THE TOWN OF DANBY AND
DANBY COMMUNITY COUNCIL

RESOLVED, that the Town Board of the Town of Danby approves the agreement between the
Town of Danby and Danby Community Council for fiscal year 2006 and authorizes the Supervisor
to sign the agreement.

Possible Conceptual Approval of Task Force Recommendations
Susan Beeners submitted the Town Board with recommendations from the Comprehensive Plan

preservation. The Board deferred discussion and consideration.
RESOLUTION NO . 39 OF 2006
APPROVAL OF A JOB DESCRIPTION - SECRETARY TO THE TOWN HIGHWAY
SUPERINTENDENT

RESOLVED, that the Town Board of the Town of Danby approves the creation of a job description
entitled "Secretary to the Town Highway Superintendent" .

highly confidential clerical and account-keeping practices in support of the Town Highway
Superintendent . The essential nature of th work is such that a substantial degree of personal
confidence exists between an incumbent in this position and the elected Town Highway
Superintendent. Internal and external contacts about occur on a regular basis . There is frequent
interaction between this position and the staff of other Town departments and various external
R agencies . Unusual problems or situations are discussed with the Town Highway Superintendent in
order to determine the appropriate course of action to take. The work is performed under the general
direction of the Town Highway Superintendent in accordance with defined policy and procedures .
The Secretary to the Town Highway Superintendent may on occasion be called upon to perform
Laborer duties such as flagging, shoveling, and acting as a snowplow wing person. Supervision of
other' s is not a function of this class . The incumbent will perform all related duties as required.
TYPICAL WORK ACTIVITIES : (includes but not limited to)
The ability to write grants ;
Gathers data and prepares detailed vouchers for all accounts payable and invoices ;
Ensures that appropriate supporting documentation is in place ;
Sets up and maintains organized files of voucher copies for reference;
Posts voucher figures to budget accounts to maintain current budget balances ;
Coordinates, maintains , and prepares a wide variety of reports, records, forms, and documentation
related to road maintenance and improvement activities ;
Maintains department time cards and employee benefit records :
Prepares bi-weekly time sheets for department personnel ;
May assist in preparation of figures and reports for use in budget preparation;
Tracks revenue and expense activities and maintains appropriate records and reports ;
Collects, compiles , designs and produces contractual and other worksheets in various activities
categories ;
Maintains records and produces worksheets and reports related to labor costs ;
Records the inventory of traffic control signs , maintains a database on such signs and produces
related reports as needed ;
Performs receptionist duties such as answering the phone and taking messages, and acts as the point
of contact for department employees ;

Assists town residents, contractors, etc . with inquiries and/or complaints ;

The employee ' s physical condition shall be commensurate with the demands of the position.
SUGGESTED MINIMUM QUALIFICATIONS :
(a) Graduation from a regionally accredited or New York State registered two year college or
university with an associates degree in secretarial sciences or closely related field and two
years of clerical experience in an office setting; OR
(b) Graduation from high school or possession of a high school equivalency diploma and four
years of clerical experience in an office setting computer; OR
(c ) Any combination of training and experience equal to or greater than that specified in (a) and
(b) above .

Motion for West Danby Water District - to Rebuild Water Pump
A motion was made by Councilperson Nolte and seconded by Councilperson Salino that the Town
Board of the Town of Danby authorizes the West Danby Water District Superintendent to have a
water pump rebuilt for the water district .

RESOLUTION . NO. 40 OF 2006
AUTHORIZATION ASBESTOS SURVEY, OLD TOWN HIGHWAY BARN AND SHED,
BALD HILL ROAD
By Supervisor Dietrich : Seconded by Councilperson Salino
WHEREAS, the Town Supervisor and Town Highway Superintendent are investigating opinions
for disposition of the Old Town Highway Barn and • Shed, located on Bald Hill road, including
potential building demolition, and
WHEREAS, the Labor Law of New York State, Code Rule 56, requires that an abestos survey be
conducted by a qualified agency prior to such demolition, NOW THEREFORE, IT IS
RESOLVED, that the Town Board of the Town of Danby hereby authorizes the Town Supervisor
to contract for the professional services of a qualified agency for the performance of an asbestos
survey, with the maximum cost of such survey not to exceed $2 ,000 without further Town approval
and with the source of such funding to be from Account A1989 . 400 .

Proposed Highway Department Facility Addition
Supervisor Dietrich asked the Board to table the equipment storage addition at the Town Highway
Facility. He said that we should continue with the plan and obtain architectural blue prints for the
proposed project.
United States Environmental Protection Agency - Notice of Violation
Supervisor Dietrich reported that the Highway Superintendent has received a "Notice of Violation"
based on an inspection of the Highway Facility at 93 Hornbrook Road .
Susan Beeners said that the Board should consider authorizing the Highway Superintendent with
assistance from the Code Enforcement Officer in retaining professional services for the development
of the remediation plan, closure of the existing drains and development of the process .
RESOLUTION NO. 41 OF 2006
AUTHORIZATION FOR TOWN HIGHWAY SUPERINTENDENT WITH ASSISTANTCE
FROM THE CODE ENFORCEMENT OFFICER TO ENGAGE PROFESSIONAL
SERVICES
By Councilperson Salino : Seconded by Councilperson Varona-Lacey
RESOLVED, that the Town Board of the Town of Danby authorized the Town Highway
Superintendent with the assistance of the Code Enforcement Officer to engage professional services
from T . G. Miller and Associates to respond to the EPA ' s February 22 , 2006 Order of Compliance
with respect to rejection wells, including closure of the existing floor drains and submission of a
remediation plan per the order, and further to obtain a cost estimate for potential remediation.
Discussion :
Councilperson Beavers reported that we were not the only municipality that has received notice from
the EPA.

from 3 : 00 p .m . - 4 : 30 p .m. for an Eagle Scout Award Ceremony for Jon Green .

Highway Department Fund Warrant No. 3 of 2006
A motion was made by Councilperson Varona-Lacey and seconded by Councilperson Beavers that
