TOWN BOARD MINUTES
OCTOBER 10, 2005

Robert Roe, George Blanchard, Dorise Baptiste, John VanDeMark, Dan Clements, Ted Merritt,
Ames Brown, Mike Hovanec, Heidi Bennett, Ronda Roaring
Auditors Gerry Mickelson and Leslie Spurgin presented the Board with a preliminary report of the
audit of Town of Danby Records for the Fiscal Year 2004 . Gerry Mickelson gave a brief review of
the process of the audit . The primary focus is to look at financial report that is submitted to the State
each year and to validate the financial statements . A full report will be made at a later date .
Supervisor Dietrich called the meeting to order at 7 : 25 p .m . and led all present to the Pledge of
Allegiance to the American Flag.
PRIVILEGE OF THE FLOOR
Ames Brown - when information meetings are held some attempt should be made to have opposition
views addressed .
Ted Merritt is concerned about the minimum maintenance on the top of Bruce Hill Roads and that
the Board does not go on road tours with the Highway Superintendent. He requested that the sound
system be turned on so that persons attending the meetings can hear in the back of the room . Objects
to $ 100,000 for an aquifer study as it is putting the cart before the horse and it will not benefit
everybody as we have a lot of water through this valley.
Supervisor Dietrich said that he feels that it is necessary as we have two major auto salvage yards
and they are sitting on our aquifers . If the Town is going to grow it needs to answer the question of
if there is adequate water and needs information it can draw on.
Bob Roe said that it would be poor policy to wait until wells go bad.
Mike Hovanec does not understand this big study as he is unaware that people are selling their land
for development . There is no developing in downtown Danby.
John VanDeMark said he things an aquifer study is a waste of our money and asked how would the
water be distributed and who is going to pay for running water lines .
REPORTS
EMC Report - Bob Roe reported on - 1 ) that the EMC energy committee passed a developmental
model ordinance to be sent to municipalities on alternative energy. 2) there is data from the lake
source cooling project is available for 2004 .
County Representative Report
Representative Frank Proto reported that the County will hold its sixth budget review and there are
four more scheduled on the County budget. T- Cat contract has been settled and Sundays have been

discontinued. The Public Library have requested additional funding for books and additional staff.
Highway Report - Written Report for September received.
The Highway Department Secretary reported that there are major repairs needed on the grader and
the roller and expenses for replacement equipment for next year.
Zoning Report - Written report for September received.
Community Council Report
Naomi Strichartzz reported that one of the discussions at the Community Council Meeting had to do
with hiring policy. They want to ensure that job opportunities are advertized .
Senior Citizen Report
The Town Clerk reported that the candidates running for local office in the Town of Danby were
guests at the October luncheon. The luncheon was attended by 44 seniors and guests .
Dog Control - September report received.
OLD BUSINESS
Upper Buttermilk Creek/Danby Creek Surficial Aquifer
RESOLUTION NO. 68 OF 2005
APPROVAL OF THE PARTICIPATION IN STUDY OF THE STUDY OF THE UPPER
BUTTERMILK CREEK/DANBY CREEK SURFICIAL AQUIFER

WHEREAS, the Town Board of the Town of Danby is considering participating with the U . S .
Geological Survey and with Tompkins County in a study of the Upper Buttermilk Creek/Danby
Creek Surficial Aquifer, NOW, THEREFORE, IT IS
RESOLVED, that the Town Board of the Town of Danby finds that said study would help the Town
understand the water resources along these creeks and within the Central Danby Hamlet area, so that
the Town can better plan for land use in these areas; and it is
FURTHER RESOLVED, that the Town Board of the Town of Danby intends to participate in said
study and to expend funds for the Town share of said study, in the amount of $ 105 , 919 over a four
year period beginning in 2006, notwithstanding subsequent requirements of the budget process
related to designating funds for said expenditure .

Motion to Extend the Board Meeting
A motion was made by Councilperson Strichartz and seconded by Councilperson Nolte that the
Town Board of the Town of Danby extend the meeting to 10 : 00 p .m .

Proposal for Olsefski Road - Abandoned Section
Motion to Defer
A motion was made by Councilperson Gagnon and Seconded by Councilperson Nolte that the Town
Board of the Town of Danby defers the request for permission to put up a residential building on a
section of Olsefski Road that has been abandoned to the November meeting.

NEW BUSINESS
Bailey Homes Request for Re-zoning
The Town Board has received a request from Michael Hovanec for the Re-zoning of Tax Parcel No .
2 . - 1 -48 . 4 to a Planned Development Zone to build an equipment storage barn with attached lean-to
and a two family residential home to be used as a model home and to accomodate Bailey Homes
business & real estate office. The parcel was approved as a residential building lot by the Planning
Board on May 19, 2004 and it is in a Low Density residential zone and is immediately adjacent to
a commercial zone .
The Board discussed the proposal with Mike Hovanec .
Recreation Partnership By- laws Amendments
A motion was made by Councilperson Gagnon and seconded by Supervisor Dietrich that the Town
Board of the Town of Danby approves the amendments to the Recreation Partnership By-laws as
presented.

Motion to Refer the Bailey Homes Proposal to the Planning Board
A motion was made by Supervisor Dietrich and seconded by Councilperson Strichartz that the Town
Board of the Town of Danby refers the Bailey Homes Proposal for a Planned Development Zone to
the Planning Board for a review of the proposal and a recommendation to the Town Board.

RESOLUTION NO. 69 OF 2005
TRANSFER OF FUNDS FROM REVENUE TO DA5000.400
RESOLVED that the Town Board of the Town of Danby deposits a check for $ 3 , 500 from
Tompkins County Soil and Water for reimbursement of expenses for the Fisher Settlement Road
Project into a revenue account and transfers the amount of $ 3 , 500 from the revenue account to
DA5110. 400.
RESOLUTION NO. 70 OF 2005
TRANSFER OF FUNDS - HIGHWAY DEPARTMENT
RESOLVED, that the Town Board of the Town of Danby transfers $ 3 , 702 . 67 from DA5130. 200
(Machinery Repair Inventory) to DA5130 .400 (Machinery Repair) to offset excess repair expenses .
RESOLUTION NO. 71 OF 2005
TRANSFER OF FUNDS - HIGHWAY DEPARTMENT
RESOLVED, that the Town Board of the Town of Danby transfers $ 3 ,000 from DA5120 .400
(Bridge Repair) to DA5110 . 400 (Road Maintenance & Repair) .
RESOLUTION NO . 72 OF 2005
TRANSFER OF FUNDS - HIGHWAY DEPARTMENT
WHEREAS, the Town of Danby received a refund check for return of propane from Suburban
Propane due to award of bid price from New York State to Amerigas, and
WHEREAS, the refund check was received by the Town, now be it
RESOLVED, that the Town Board of the Town of Danby returns the amount refunded to account
A5132 .400 to cover the purchase of propane from Amerigas .
RESOLUTION NO. 73 OF 2005
TRANSFER OF FUNDS - HIGHWAY DEPARTMENT
RESOLVED, that the Town Board of the Town of Danby transfers $200 from account A5010 .200
(Superintendent ' s Equipment) to A5010 . 400 (Superintendent ' s Contractual) to cover expenses in
office supplies .
RESOLUTION NO. 74 OF 2005
TRANSFER OF EXPENSES - HIGHWAY DEPARTMENT
RESOLVED , that the Town Board of the Town of Danby transfers expenses charged to
DA5110 .400 ($ 31 ,000) to DA5112 .400 to cover transfer work to be charged to Capital Projects
instead of maintenance projects .

for use of their vehicles for Town of Danby related business, and
WHEREAS, the Federal Government has increased their rates to $ .485 cents per mile as of September 1 ,

WHEREAS, the Town Board of the Town of Danby approved a $20 . 00 (twenty dollar) monthly stipend
toward his cell phone charges, and
WHEREAS, the telephone charges for phone calls far exceeds the $20 . 00 (twenty dollar)allotment, now

RESOLVED, that the Town Board of the Town of Danby approves a monthly stipend in the amount of
$40 . 00 (forty dollars) per month payable to the Town Supervisor for his cell phone charge reimbursement
retroactive from April 1 , 2005 .
