Home My WebLink About2005-08-08 Town Board Minutes August 8 , 2005 TOWN OF DANBY TOWN BOARD MINUTES AUGUST 8, 2005 PRESENT : Supervisor Dietrich Councilpersons : Joel Gagnon, Naomi Strichartz, Gladys Varona Lacey ABSENT : Councilperson Norbert Nolte (excused) Others Present : Code Enforcement Officer - Susan Beeners Town Clerk - Carol Sczepanski Time Warner Cable Representative - Tom Doheny Members of the Public : Ronda Roaring, George E . Blanchard , Robert Roe, Roy Casterline, Ames Brown Supervisor Dietrich called the meeting to order at 7 : 05 p . m . and led all present to the Pledge of Allegiance to the American Flag. ADDITIONS & DELETIONS TO AGENDA 1 ) Councilperson Strichartz presented a resolution regarding acknowledgment of persons responsible for the Danby Fun Day to be added to the Agenda. 2) Councilperson Gagnon asked that discussion be added for the Task Force proposed Round II for open space preservation . CORRESPONDENCE : 1 ) The balloon test for the proposed telecommunications will be between August 8 and the end of August. 2) Water Resources Council is seeking applications for municipal representatives for a term that expires at the end of December 2007 . PRIVILEGE OF THE FLOOR Town Clerk - Tompkins County Town Clerks Association have scheduled a meeting with Assemblywoman Barbara Liften and the Tompkins County Board of Elections Commissioners to get an update on where the new election regulations stand including type of voting machines . Councilperson Varona-Lacey reported that she has a copy of plans for a beautification grant proposal and would like to share it with the Board. She would like a committee established to help with the grant proposal . The Code Enforcement Officer asked the Board to consider a meeting with the Planning Board on August 18 , 2005 . Members of the Public : Ames Brown - 1840 Danby Road - deferred his comments in reference to Time Warner Cable Franchise Agreement information. OLD BUSINESS ; Time Warner Cable Franchise Agreement Tom Doheny of Time Warner Cable addressed the Board and said that the residents are basically being charged a 1 % fee on their basic service . Included in this document is a definition of gross revenue . There will be an increase that would change for most common level of services from 17-50 cents . Tom explained what the Town ' s options were to the Board . Ames Brown - 1840 Danby Road asked what would be the objection to having a shorter term agreement than the 10- 15 years . t c 2 Town Board Minutes August 8 , 2005 REPORTS : EMC (Environmental Management Council) Report Robert Roe reported on the New York State Recreational Region 7 Master Plan. Danby was number two(2) on their list . There will be no progress on that plan for our region due to the Chronic Wasting Disease . Code Enforcement Office Report Susan Beeners reported that there would be balloon tests at the proposed telecommunication towers for Tompkins County Emergency Response Micro Management System. Planning Board Report There will be a joint meeting of the Town Board and Planning Board on Thursday, August 18 , 2005 at 7 : 00 p .m . Community Council The Town Clerk reported that she has again submitted an agreement between Community Council and the Town of Danby to Community Council for the fiscal year of 2005 . Councilperson Strichartz reported that Community Council has scheduled three classical concerts . Dog Control The Town Clerk reported that the dog enumeration is in progress . The SPCA has not submitted a report for the month of July. OLD BUSINESS : Time Warner Cable Franchise Agreement A resolution of approval of the Time Cable Franchise Agreement was presented to the Board to review . Councilperson Gagnon asked that the Board consider approval with 0% and the option to increase it in the future. The Board discussed the agreement and the number of years of the agreement . No decision was made at this time and a Special Meeting of the Board may be scheduled . Deputron Hollow Road Upgrade Susan Beeners submitted a map to the Board for that shows the proposed upgrade for Deputron Hollow Road. A letter was presented from Dave Herrick with recommendations for the proposed road upgrade . Motion for Conceptual Approval of the Proposed Plan for Upgrade of Deputron Hollow Road A motion was made by Supervisor Dietrich and seconded by Councilperson Gagnon that the Town Board of the Town of Danby grants conceptual approval and authorization to the Code Enforcement Officer to prepare additional design for engineer review . Gagnon Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Motion Related to Ratification of the Abandonment of Olsfeski Road and Hilltop Road A motion was made by Supervisor Dietrich and seconded by Councilperson Strichartz that the Town Board of the Town of Danby authorizes Town of Danby staff to prepare draft materials with respect to ratifying the abandonment of a portion of the Olsfeski Road and a portion of Hilltop Road. 3 Town Board Minutes August 8 , 2005 A roll call vote on the motion resulted as follows : Councilperson Nolte absent . Gagnon Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Possible Aquifer Study The Code Enforcement Officer presented the Town Board with information on an Aquifer Study for the Town of Danby Board to consider. She explained why she thinks how the Town could benefit from the study. Comprehensive Plan Task Force Update Councilperson Gagnon gave a quick update for the framework for revising the regulations that were passed in May 2005 . The purpose was to update the Board on where the Task Force is in creating a round II package of intentions and changes and what they have been doing since January. Councilperson Strichartz said that she would like this item to be deferred to the joint meeting with the Planning Board. Supervisor Dietrich said that he has an issue related to many people who feel they were left out of the process and that needs to be addressed . Motion to Schedule a Special Meeting A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey to schedule a joint meeting of the Town Board and the Planning Board for Thursday, August 18 , 2005 at 7 : 45 p .m . Gagnon Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried NEW BUSINESS Authorization for Supervisor to Sign the Snow & Ice Agreement Extension with Tompkins County A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby authorizes the Town Supervisor to sign the Snow and Ice Agreement Extension with Tompkins County Highway through December 31 , 2006 . Gagnon Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried RESOLUTION NO. 58 OF 2005 VARIOUS FEE RATES FOR THE REVIEW OF CERTAIN DEVELOPMENT APPLICATIONS By Councilperson Gagnon : Seconded by Councilperson Varona-Lacey WHEREAS, Resolution No . 72 of 1991 , "Establishing Fees for Building Code, Zoning Ordinance, Subdivision Regulation, and Other Enforcement Activities", provides that certain fees may be charged by the Town to cover part of the cost of professional services, including, but not limited to , � l { � 4 Town Board Minutes August 8 , 2005 engineering, planning, legal, and other expenses incurred by the Town in its review of application materials for various development proposals and for its inspection of various development projects if those projects are approved; and WHEREAS, said resolution also provides that the hourly rates to be charged for Town staff may be determined from time to time by the Town Board; now, therefore it is RESOLVED , that the Town Board of the Town of Danby hereby determines the following : 1 . that the current hourly rate for the Town Code Enforcement Officer is $21 . 63 ; and 2 . that the current hourly rate for the Town Highway Superintendent is $ 30 . 68 . Special thanks goes to Amy Cusimano , Susan Beeners, Andrea Hazzard, the Danby Community Council for coordinating the activities of the fair, and the entire Danby Fire Department and the Danby Fire Department volunteers for a fine BBQ and their fine hospitality.
