TOWN BOARD MINUTES
JUNE 13 , 2005

Supervisor Dietrich opened the meeting at 7 : 05 P .M . and led all present to the Pledge of Allegiance
to the American flag.
Privilege of the Floor :
Councilperson Strichartz asked for an addition to the minutes of April 11 , 2005 - under the Eyes
Wide Open Program - The exhibit of a pile of boots are in memory of the American solders and there
will be a commemorative wall commemorating everyone else who died .
The Town Clerk announced that beginning on July 1 her office will be open from 9 : 00 a.m. to 3 : 00
p .m. Tuesday - Friday until August 15 , 2005 . There will be no Saturday hours until mid August . The
Clerks Office will be open on Monday August 15 , 2005 for the first day to issue sporting license .
Members of the Public :
Bob Spaulding - Ellis Hollow Road - interested in how the Board handles minimum maintenance
highways . He was very involved in getting minimum maintenance regulations in the Town of
Caroline.
ADDITIONS TO THE AGENDA :
1 - Councilperson Gagnon asked permission to report on where the Task Force is on the strategic
planning progress for the hamlets .
2 - Councilperson Nolte asked for a general discussion on the relevance of the Task Force.
No Board Member objected .
Members of the Public :
Bob Spaulding said that he is here to see how the Town Board handles minimum maintenance
highways .
Ames Brown - Crystal discussed at great length the two(2) acre lots but she did not make clear the
five(5 ) acre lots . He asked what the logic was for five(5 ) acre lots and feels that the farmers were
not particularly represented.
Councilperson Gagnon said that there were not five(5 ) acre lots but five acre density.
REPORTS :
Highway Report - Highway Superintendent Bill Hall reported that the department had spent the
month of May doing regular summer maintenance from winter damage .

Zoning Report - Monthly report for May 2005 has been submitted to the Board . Susan reported on
the June Task Force Meeting. The Planning Board at their last meeting reviewed a Draft NYS ATV
Policy for access to State Forest Lands .
Recreation Partnership Report - There was a report at the Municipal Officials Meeting in May.
Some of the townships in Tompkins County may not be willing to put monies into the partnership .
Community Council - have not filed an agreement with the town for 2005 at this time.
Senior Citizens - No report.
Dog Control - SPCA report for April 2005 received.
West Danby Water District Report :
Roy Casterline reported that there is a problem with the pump at the West Danby water facility. The
pump has been rebuilt and it is not working properly. The purchase of a new pump is necessary
for the system . The existing pump will be used as a reserve .
Communications to Board
1 ) Response from Senator James L. Seward concerning the Community Preservation Fund Act .
2) Petition to change a portion of the Minimum Maintenance Road Designation on Deputron
Hollow Road - from Robert and Denise Pratt
3 ) Memo from Sue Beeners - notification of a Pork BBQ at the Common Ground for the Danby
Community Park Association
NEW BUSINESS
Time Warner Cable Public Hearing Set
A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the
Town Board of the Town of Danby schedule a public hearing for 7 : 00 p .m. on Monday, July 11 ,
2005 for the Time Warner Cable Franchise Agreement .

Petition for Minimum Maintenance Low Volume Road Designation - Deputron Hollow
A petition from Robert & Denise Pratt has been submitted on June 13 , 2005 to consider elimination
of the Minimum Maintenance Low Volume Road Designation for a 400 ft. section on Deputron
Hollow Road. The road needs to be widened along the addition to make it accessible for emergency
equipment.
Highway Superintendent William Hall explained the process and his recommendation for widening
that section of the road to the Board .
The Board reviewed the application and process with the applicants .
Motion to Set Public Hearing for Minimum Maintenance Low Volume Road Designation on
Deputron Hollow - Partt Petition
A motion was made by Councilperson Strichartz and seconded by Councilperson Nolte that the
Town Board of the Town of Danby schedule a public hearing at 7 : 30 p .m . on Monday, July 11 , 2005
for the Minimum Maintenance Low Volume Road Designation on a portion of Deputron Hollow
Road.

County Representative Report
Representative Frank Proto reported that Tompkins County is considering combining Public Works
with Planning. Debbie Teeter and Cooperative Extension are revising the County Agriculture
Protection Plan. Danby and Caroline Libraries will be asked for funding to support various programs .
There will be a public hearing on increasing the veterans exemption. The County is proposing to
add three additional sheriffs deputies .
RESOLUTION NO. 52 OF 2005
AUTHORIZATION FOR HIGHWAY SUPERINTENDENT TO ADVERTIZE FOR BIDS
FOR A ONE AND ONE HALF TON 4 X 4 TRUCK
By Councilperson Gagnon; seconded by Supervisor Dietrich
RESOLVED, that the Town Board of the Town of Danby has given authorization for the Town of
Danby Highway Superintendent to advertise for sealed bids for the purchase of a " 1 1/2 ton 4 x 4 truck
with plow equipment and combination dump spreader box" and submitted to the Town Clerk, and
FURTHER RESOLVED, that bidding for said truck will close at 3 : 30 p .m . on Wednesday, July
6 , 2005 and that bids will be opened on Wednesday, July 6 , 2005 at 4 : 00 p . m . and that the bid may
be awarded at the Regular Town Board meeting on Monday, July 11 , 2005 at 7 : 00 p .m .

Motion to Rescind Resolution Numbers 48, 49 and 50 of 2005
A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the
Town Board of the Town of Danby rescinds Resolution Numbers 48 , 49, and 50 of 2005 .

RESOLUTION NO. 53 OF 2005
AUTHORIZING APPLICATION FOR SMALL CITIES STRATEGIC PLANNING
TECHNICAL ASSISTANCE GRANT
By Councilperson Gagnon : Seconded by Councilperson Nolte
WHEREAS, the Town of Danby needs to begin the second stage of implementing the Town
comprehensive Plan, by developing a strategic plan for the Central and West Danby Hamlets ; and
WHEREAS, funding through the Small cities Strategic Planning Technical Assistance Grant is
needed so that the Town can develop the plan in a timely and effective manner;
NOW, THEREFORE, IT IS
RESOLVED, that the Town Board of the Town of Danby authorizes Town Supervisor Fredric
Dietrich to submit an application for a Small Cities Strategic Planning Technical Assistance Grant,
to act as the official representative of the Town in acting in connection with the submission of the
grant application, and to provide such additional information as may be required, with Susan
Beeners, Zoning/Code enforcement Officer, to act as primary contact person; and it is

FURTHER RESOLVED, that the Town board of the Town of Danby authorizes the Town
Supervisor to transmit a letter with the grant application, indicating the intent of the Town Board to
participate in the strategic planning process, to provide the required matching funds and resources,
and to officially adopt the strategic plan.

RESOLUTION NO. 54 OF 2005
CLOSING OF N.Y. STATE ROUTE 96B FOR PARADE ON JULY 16, 2005
By Supervisor Dietrich : Seconded by Councilperson Nolte
RESOLVED, that the Town Board of the Town of Danby, in compliance with Section 1604,
paragraph 2 of the Vehicle and Traffic Law, which authorizes a town to close a road for a parade,
is officially closing New York State Route 96B on Saturday, July 16 , 2005 , from 11 : 00 a.m. until
12 : 00 Noon, from the intersection of East Miller and West Miller Roads to the intersection of Bald
Hill Road; and it is
FURTHER RESOLVED, that the Town Board approves the ext4ension of this period of closure
to not more than 10 : 30 a.m. to 12 : 30 p .m. if the Danby fire Department personnel deem such
necessary to facilitate the safe movement of the parade participants ; and it is
FURTHER RESOLVED, that there will be a detour route from the West Miller road intersection
with Route 96B to Comfort Road, to Lieb Road, to the Bald Hill Road intersection with Route 96B .

A motion was made by Councilperson Gagnon and seconded by Supervisor Dietrich that the Town
Board of the Town of Danby approves the Town Clerk ' s June 2005 report as submitted.

APPROVAL OF WARRANTS
Approval of General Fund Warrant No. 6 of 2005
A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte that the Town
Board of the Town of Danby approves the General Fund Warrant Nol . 6 of 2005 voucher numbers
245 - 300 in the amount of $20,442 . 13 .

A motion was made by Supervisor Dietrich and seconded by Councilperson Gagnon that the Town
Board of the Town of Danby approves the Highway Department Fund Warrant No . 6 of 2005
voucher numbers 68 - 81 in the amount of $26 ,438 . 74 .

voucher number 20 - 24 in the amount of $ 1 ,055 . 78 .

A motion was made by Supervisor Dietrich and seconded by Councilperson Gagnon that the Town
Board of the Town of Danby approve payment from the CD7668 . 400 in the amount of $244 . 83 for
reimbursement to Susan Beeners . Expense is for the Danby Fund Day.

legal services . ( Simkin Escrow. )
