Supervisor Dietrich reported that this information meeting is to give the public information on the
new proposed subdivision regulations .
Crystal Buck gave a brief overview of the Town of Danby Draft Subdivision Regulations . The
proposed sixty(60) per cent conservation area and the land survey requirements were described in
detail .
Public Comments and Concerns :
John Shepardson - sixty(60) percent conservation area is stealing of land .
Ted Merritt - said that the five(5 ) acres requirement will not allow for affordable housing in Danby.
He has lost two(2) lots already by the Town making low density requirement of 200 foot road
frontage on his property.
Ames Brown - does not want to see huge major developments . The worst problem will be the
five(5 ) acre requirement.
Barry Craddock - walkways cannot go through private properties . People cannot just walk through
private properties without permission .
Bob Lieberman - seems to him that having two (2) acre lots or five(5 ) acre lots we would be moving
toward urban sprawl .
John VanDeMark - asked who was going to pay the landowners for the land in the conservation areas
that they cannot use. Assessments in Tompkins County are out of line.
Ted Merritt - people on his hill may not want to sell their land but may be forced into selling because
of the raising taxes . If we restrict building in the area we want to keep it into natural environment
many people will be forced to leave .
Bill Farrell - asked what other towns have this sixty acre conservation regulation . He would like to
see the sixty/forty conservation requirement rejected. He said that he thinks that people who are
paying taxes on their land all these years should be able to use it for what they want to .

Many residents asked where in New York State there were sixty(60) acre conservation areas
required.
Crystal said that she knew that the question has been asked before and that they probably could come
up with something that have similar requirements .
Ten Merritt - said that he has been listening to Joel Gagnon for years pushing for ten( 10) acre lots .
Allen Becker - wonders how much land the members of the Town Board represents . We don ' t need
anymore deed restrictions here . We have a Town Board and a Planning Board you can do something
about it . Crystal is getting paid to do this . Sue cannot even do her own job as she has to do the rest
of the stuff He does not want the Town to control what we have and that he isn ' t getting any
representation here.
Elaine Cortright asked for a show of hands of the persons in attendance in favor of these regulations .
Barry Craddock would like to see a vote here tonight of how many people would like to see these
regulations go away. He said that it does not make any difference as you have already made your
mind up .
In summation Susan Beeners said that all the comments and questions will be considered . The
Planning Board is meeting this week to make a report to the Town board . No date has been set for
the public hearing for the Draft Subdivision Regulations and changes to the zoning.
There are no known plans for the development of the medium density areas .

Supervisor Dietrich called the meeting to order at 8 : 30 p . m . and led all present to the Pledge of
Allegiance to the American flag.

Recreation Partnership - Supervisor Dietrich has received a survey to be completed .
Senior Citizens - Carol Sczepanski reported that the Director of the Senior Citizens Council
addressed the group .
Dog Control - Report from SPCA received .
Whyte Appeal
A public hearing was held on Monday March 7 , 2005 for the Whyte Appeal requesting a subdivision
of their property and that it be excluded from the moratorium .
Councilperson Gagnon asked if the Whyte Appeal had been withdrawn .
Susan Beeners reported that there has been no further communication from the Whyte ' s and it has
not been withdrawn.
Mel Westmiller said he understood that they wanted to develop two(2) additional lots . Some of this
is in a conservation area. There is a pile of tires that needs to be investigated.
NEW BUSINESS :
Legislative Decisions
Proposed Subdivision Regulations
Susan Beeners reported that Valaria Cogin responded to her letter requesting information on property
values for assessment related to conservation areas proposed in the subdivision regulation . She said
that she thinks that she did not understand the information. Al Fulkerson is interested in looking at
the recording requirement for conservation areas . She said that the Town Board needs to have the
final draft of the proposed subdivision regulations in hand before a public hearing can be scheduled.
Councilperson Strichartz said she is concerned with contiguous land as she loves trails and does not
know anybody who has a trail through their land. She is also concerned with the fact that there are

a lot of people who are not going to be able to afford their property if land values go up .
Motion for Special Meeting of the Board
A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte that the Town
Board schedule a Special Meeting of the Board on April 4 , 2005 following the Agenda Meeting of
the Board.

Supervisor Dietrich asked if there was any other information other than e-mails this afternoon.
Susan Beeners reported that she has received a response from one of the applicants today. He is
requesting an eight foot fence . The Town has sixty-two days to set a public hearing on the Appeal
of the Planning Board Resolution. Susan will bring updated information to the April Board Meeting.
The Board discussed the appeal with the applicants and some of the neighbors to the Common
Ground.
Supervisor Dietrich moved to table the decision on the Appeal of Randall F . Ingell and James S .
Reagan regarding the Planning Board Resolution until a public hearing date has been set.
Motion to Schedule Public Hearing - for Appeal of Randall F. Ingell and James S . Reagan
A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon that the
Town Board of the Town of Danby schedule a public hearing for Monday, April 11 , 2005 at 7 : 00
p .m . to hear the appeal of Randall F . Ingell and James S . Reagan and that the Town Board waives
the fee of $ 100 for the appeal .

Approval of Senior Citizens Agreement For 2005
A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon that the
Town Board of the Town of Danby approves the Danby Senior Citizens Agreement for 2005 and
authorizes the Supervisor to sign the agreement.

Approval for Town Clerk to Attend NYSCA Annual Meeting
A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon that the
Town Board approves the request of the Town Clerk to Attend the NYSCA Annual Conference .

3 Approval for Bookkeeper to Seek Independent Audit
A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey that
the Town Board of the Town of Danby authorizes the bookkeeper to seek proposals for an
independent audit for the Town of Danby that is not to exceed $ 5 , 000 .

RESOLUTION NO . 35 OF 2005
RESOLUTION OF SUPPORT FOR ` FOREST LANDS FOCUS AREA PROTECTION AND
MANAGEMENT PLAN ' QUALITY COMMUNITIES GRANT APPLICATION
By Councilperson Strichartz : Seconded by Councilperson Gagnon
WHEREAS, the Town of Danby has applied, along with the Tompkins County and the Towns of
Caroline and Dryden, for Quality Communities Program Grant funds for the joint ` Forest Lands
Focus Area Protection and Management Plan; and
WHEREAS, the Town Board of the Town of Danby finds that such project is consistent with the
Town Comprehensive Plan and its implementation strategies ;
NOW, THEREFORE , IT IS
RESOLVED, that the Town Board of the Town of Danby is committed to participating with
Tompkins County, and with the Towns of Caroline and Dryden in this planning project if grant funds
are awarded ; and it is
FURTHER RESOLVED, that the Town Board designates Town of Danby Town Supervisor,
Fredric Dietrich as the representative authorized to act on behalf of the Town Board in all matters
related to the financial assistance of this grant.

APPROVAL OF WARRANTS
Approval of General Fund Warrant No. 3 of 2005
A motion was made by Councilperson Nolte and seconded by Councilperson Gagnon that the Town
Board of the Town of Danby approves the General Fund Warrant No . 3 of 2005 in the amount of
$ 10, 511 . 04 voucher numbers 104 - 151 .

Other Business
Approval for Clerk to Order Copy Machine
The Town Clerk has submitted three (3 ) price proposals for the purchase of a copy machine for the
Town of Danby. The proposals are all NYS Contract prices .
EBE offered staff members of the Town of Danby the opportunity for Sharp to demonstrate a copy
machine and the staff found that the Sharp copy machine meets their copy needs .
Motion to Authorize the Town Clerk to Order a Copy Machine
A motion was made by Councilperson Gagnon and seconded by Councilperson Varona-Lacey that
the Town Board of the Town of Danby authorizes the Town Clerk to order a Sharp copy machine
