Public Hearing Declared Open
Supervisor Fredric Dietrich declared the public hearing open at 6 : 30 p .m . and the following Notice
of Publication was read to the public . PLEASE TAKE NOTICE, that the following public hearing
will be held by the Town Board of the Town of Danby on Monday, January 10, 2005 at 1830 Danby
Road, Ithaca, New York :
6 : 30 p .m. Appeal of the one hundred-eighty day prohibition of subdivisions set forth in the
Town of Danby Local Law No . 2 of 2004, adopted by the Town Board on September
14, 2004 and effective on September 28 , 2004, requesting review, under current
regulations, ordinances, and laws, of the proposed subdivision of Tax Parcel 7 . - 1 -
94. 2 , 64 Hornbrook Road, 5 . 72+/- acres total, into a 2 . 34+/- acre lot with 239+/- ft.
of frontage containing an existing house, and a 3 . 38+/- acre lot with 23 +/- of
frontage. Under Section 600 Para. 4 of the current Zoning Ordinance of the Town
of Danby, the proposed subdivision would not conform to the minimum 20-foot
frontage required, and would need to be appealed to the Board of Zoning Appeals .
Variance of the minimum 50-foot side yard depth (Sec . 600, Para. 5 of Zoning
Ordinance) would also need to be appealed in order to permit a side yard depth of
36+/- ft. from a new lot line to the existing house. The current Subdivision
Regulations of the Town of Danby would also require application to the Planning
Board for subdivision approval, and for a waiver of Section 607 of these regulations
which requires that utility lines be placed underground. Kevin and Rebecca Coons,
owners/applicants .
All interested persons will be given the opportunity to be heard . either in person or in writing.
A regular meeting of the Town Board will follow the public hearings .

Applicant Kevin Coons and his contractor explained the his request for subdivision and the proposed
placement of the house and that it is for his mother-in-law. Kevin presented pictures of the
surrounding area and where they were proposing to build a residence.
The contractor for the project described the area and that they had moved the building site back
further in response to the objection of the Lopers . They have placed plantings to help with the
privacy of the neighbors .
No public addressed the Board .
Public Hearing Declared Closed
Supervisor Dietrich declared the public hearing closed at 6 : 55 p .m .

of the Town of Danby on Monday, January 10, 2005 at 1830 Danby Road, Ithaca, New York:
Appeal of the one hundred eighty day prohibition of subdivisions set forth in Town of Danby

proposed subdivision of Tax Parcel 2 . - 1 -22 . 3 , 1329 Danby Road, 3 . 31 +/- acres total , into two
lots of 1 . 65 +/- acres each, with one containing an existing house, and where each lot would have
165 +/- feet of frontage . Under Section 600 , Para. 4 of the current Zoning Ordinance of the Town
of Danby, the proposed subdivision would not conform to the minimum 2 -acre lot size and
minimum 200- foot frontage required, and would need to be appealed to the Board of Zoning
Appeals . The current Subdivision Regulations of the Town of Danby would also require
application to the Planning Board for subdivision approval . Dennis Wang, owner/applicant.

Letter from Neighbors, Brock, Dennison, House and Wright regarding concern of future water
problems in the neighborhood .
Dennis Wang explained that the request for variance is to build a home for his mother so that she
can move near the family after she sells her Bed and Breakfast.
Public Comments
Joanne Denison - 1321 Danby Road - asked if an additional house would be built on the property
and is concerned about the availability of water in the area.
Donna Brock - 1341 Danby Road - has concerns about available water as additional wells affect

neighborhood water. It appears the rules keep changing.
Rhonda Roaring - 571 South Danby Road - doesn ' t matter who owns the property and thinks that
something could be made within the existing single family dwelling .
