Public Hearing Declared Open :
Chairperson Sarah Newman declared the public hearing open at 7 : 10 p . m. and read the following
Notice of Publication : "PLEASE TAKE NOTICE that a public hearing will be held by the
Planning Board of the Town of Danby on Wednesday , December 18 , 2002 at 7 : 00 p . m . at 1830
Danby Road, Ithaca, New York to consider approval of the proposed subdivision of Town of Danby
Tax Parcel No . 2 . - 1 -43 . 3 , located at 40 Muzzy Road, into a 2-acre lot with 200 feet of frontage, and
a 13 . 66 acre lot with approximately 80 feet of frontage . A variance from the minimum 200 foot
frontage requirement was granted by the Board of Zoning Appeals on October 28 , 2002 for this
proposed subdivision, as was a variance from the minimum 50-foot front yard depth requirement,
in order to have a 20-foot yard depth between three (3 ) existing outbuildings and a proposed lot line.

Affidavit of Neighbor Notification
Comments of the Public :
Tony Serviente -owns property across from the proposed variance . He asked for explanation of what
this proposal is addressing. He is concerned that adjacent properties may also be developed at a
future date .
John Shepardson - thinks that this subdivision is a good use of the property .
Michael Palmer addressed the public and said that his intentions is to build a house on the back lot
and are not considering further development .
Jeannette Palmer said that a new house is being built across from 44 Muzzy Road .
Susan Beeners said that subdivision approval by the Planning Board is necessary as the lot is less
than five (5 ) acres .

Communications :
A letter sent to the Planning Board dated October 24 , 2002 and received by the Code Enforcement
Office on October 29 , 2002 from Lamar Herrin was read by Chairperson Newman . He objects to
houses built on less that two(2) acres and less than 200 feet of road frontage .
Board of Zoning Appeals "Notice of Decision" .
Chairperson Sarah Newman called the meeting to order at 7 : 25 P . M .
Following a public hearing for the Palmer Subdivision Proposal at 44 Muzzy Road the Planning
Board reviewed the SEQR for this minor action .
RESOLUTION NO. 15 OF 2002
SEQR, PALMER SUBDIVISION- APPROVAL
By Robert Roe : Seconded by Laurene Gilbert
WHEREAS, this action is to consider approval of the proposed subdivision of Town of Danby Tax
Parcel No . 2 . - 1 -43 . 3 , located at 40 Muzzy Road, into a 2 -acre lot with 200 feet of frontage, and a
13 . 66 acre lot with approximately 80 feet of frontage ; and
WHEREAS, a variance from the minimum 200 foot frontage requirement of Section 600, Paragraph
4, of the Town of Danby Zoning Ordinance was granted by the Board of Zoning Appeals on October
28 , 2002 for this proposed subdivision, as was a variance from the minimum 50-foot front yard depth
requirement of Section 600 , Paragraph 5 , in order to have a 20-foot yard depth between 3 existing
outbuildings and a proposed lot line ; and
WHEREAS, the Town of Danby Planning Board is acting as Lead Agency in environmental review
of the proposed subdivision, an Unlisted Action ; and
WHEREAS , the Planning Board has reviewed the recommendation of the Code Enforcement
Officer that a negative determination of environmental significance be made for this action , NOW,
THEREFORE, IT IS
RESOLVED , that the Town of Danby Planning Board, acting as Lead Agency in environmental
review of this Unlisted Action, makes a negative determination of environmental significance .

RESOLUTION NO. 16 of 2002
APPROVAL , PALMER SUBDIVISION
By Laurene Gilbert : Seconded by Robert Roe
WHEREAS, this action is to consider approval of the proposed subdivision of Town of Danby Tax
Parcel No . 2 . - 1 -43 . 3 , located at 40 Muzzy Road, into a 2 -acre lot with 200 feet of frontage, and a
13 . 66 acre lot with approximately 80 feet of frontage; and
WHEREAS, a variance from the minimum 200 foot frontage requirement of Section 600, Paragraph

of the proposed subdivision , an Unlisted Action has on December 18 , 2002 made a negative
determination of environmental significance ; and
WHEREAS, the Planning Board has held a public hearing on this matter on December 18 , 2002 ;
NOW, THEREFORE, IT IS
RESOLVED, that the Town of Danby Planning Board grants final subdivision approval to the
subdivision as shown on " Sketch Plan , Michael Palmer, Jeannette Palmer, Property is 40 Muzzy
Road" dated November 8 , 2002 , conditional on submission of a final survey map, suitable for filing,
for signature by the Planning Board Chairperson; and it is
FURTHER RESOLVED, that the Planning Board acknowledges that Michael and Jeannette
Palmer, in the letter dated September 18 , 2002 which accompanies their application for variance and
for subdivision approval , have stated that the ` Stony Acres Trading Post ' Planned Development Zone
(PD14) will no longer be active ; and it is
FURTHER RESOLVED, that the Planning Board recommends to the Town Board that Planned
Development Zone 14 be removed from the Town of Danby Zoning Map at such time that various
changes are made to said map .

Laurene Gilbert left the meeting at 7 : 30 p .m .
Announcements :
Chairperson Newman reported to the members present that she is working on making all revisions
on the Comprehensive Plan that were what the Board considered minor wording changes and other
somewhat substantive issues around which there was general agreement in our joint meetings with
the Town Board . Her goal is to complete all those small revisions and then distribute the revised
version to both boards with a list of the major issues that were not resolved. There will be another
joint meeting to revisit the Land Use Chapter and the unresolved issues that are still outstanding and

to look at the revised version of the rest of the Comprehensive Plan. The revised version should be
ready for the Planning Board January meeting .
