PLANNING BOARD MINUTES
AUGUST 21 , 2002

Chairperson Sarah Newman called the meeting of the Planning Board to order at 7 : 07 p . m .
Miscellaneous Business
Vice Chairperson of the Planning Board
Chairperson Newman said that she is the newly appointed Chairperson of the Planning Board and
would like the Board to approve a permanent Vice-Chairperson of the Planning Board to serve in
her absence. She said that she would like to nominate Bob Roe to serve as Vice-Chairperson of the
Planning Board.
Bob Roe accepted the nomination as Vice-Chairperson of the Planning Board .
Danby Community Park Association - Update
Esther Dotson reported that the Danby Community Park Association has received a grant in the
amount of $ 109,000 . They now have approximately half of the matching funds for the grant. It is
the Associations understanding that they are allowed to improve the drainage without a special
permit. They are working on possible access north of the Danby Federated Church. The Association
may be coming before the Planning Board for a Special Permit this fall . Esther said that the
$ 109 ,000 from the State and $ 109 , 000 from matching funds and grants will provide the essential
parts of the park, including access roads, a maintenance barn, parking lots , the grading and refined
grading for the playing fields, comfort station and utilities (well and septic) .
Attendance of the Board
Susan Beeners said that there is concern that no procedure exists for Board members to report when
they are unable to attend a meeting.
Chairperson Newman said that a quorum is necessary at meetings and we need to know in advance
of meetings whether a quorum will be present to conduct business . Guidelines for notification to be
excused from a meeting will be placed on the September Agenda.
Spencer VanEtten Snowmobile Club - Preliminary Discussion
Susan Beeners reported that she has received some information from our Town Attorney and from
the Association of Towns . She reported that almost all of the trail is in New York State Forest lands
or on seasonal roads within State lands . The parts of the trail that are within the State Forest or on
seasonal roads are exempt from Town regulation . There is a small portion of the trail that ' s on a
seasonal road outside of the Danby State Forest on Heisey Road . NYS Parks and Recreation Law
supersedes Town review on that part of the seasonal road. The only parts of the snowmobile trail
that are subject to permit are a few hundred yards on a year-around road (where the snowmobiles run
on the shoulder of the road) and on the abandoned part of Eastman Hill Road.

Sean Morris, President of the Spencer VanEtten Snowmobile Club presented information on the trail
system and said it was State wide . Any registered snowmobile can use the State system . He
presented a copy of the State Corridor System for the Board to review . The State provides funding
for maintenance and improvements of the corridor system that can be applied to private lands . The
club can receive up to $ 1 ,040 annually to maintain and operate that trail system.
Chairperson Newman said that when the application is complete and has been reviewed by the Board
we can set a public hearing. Setting a public hearing date will be placed on the September Agenda.
Modification of Casterline Subdivision Plan
Chairperson Newman reported that the consideration for modification of the subdivision plan is a
modification of the subdivision plan which was previously presented to the Board as a proposal by
Roger Casterline. His long term plan was to put three houses on the remaining parcel # 17 . - 1 - 1 . 12 .
He would like to modify the plan and is asking for permission to sell that property for one dwelling.
Susan Beeners said that there was never a final subdivision plat filed for the extra lots . She asked
the Board to consider approving the modification of the plans reviewed by the Planning Board at
public hearing and that the plan is acceptable as one lot.
The Board reviewed the plan and discussed the request for conveyance of an easement on Short
Road for a turn-around for the Town Highway Department.
RESOLUTION NO. 11 . 2002
MODIFICATION TO THE SUBDIVISION PLAN FOR PART OF TOWN OF DANBY TAX
PARCEL 17.- 1-1 .12 ON SHORT ROAD

WHEREAS, the Planning Board has reviewed a request for permission to build a single-family
dwelling on a 5 .4 acre portion of Town of Danby Tax parcel No . 17 . - 1 - 1 . 12 with access from the
year-round portion of Short Road ; and
WHEREAS, said request would be a modification of plans reviewed by the Planning Board at
public hearing on January 23 , 2002 , after which hearing the Planning Board approved the
subdivision of one lot at the west end of the parent parcel , subject to various conditions ; and
WHEREAS, the Planning Board finds that the action requested, a Type II action, is not substantial
in nature, scope of extent and does not materially affect to the subdivision plat approved on January
23 , 2002 ; NOW THEREFORE, IT IS
RESOLVED, that the Planning Board approves the proposed 5 .4- acre lot, being a portion of Town
of Danby Tax Parcel No . 17 . - 1 - 1 . 12 , with access from the year-round portion of Short Road; and
finds that the lot has adequate frontage and access for construction of a single-family dwelling as
proposed, subject to the following conditions :
1 . Conveyance of an easement to the Town of Danby for the gravel turnaround at the
northeast corner of the subject parcel, with such easement to be described on the final
survey map as well as in deed/easement text documents , and to be subject to review
by the Town Attorney and approval by the Town Board.
2 . No use of the preexisting water main extension to serve the 5 .4-acre parcel shall be
permitted until the preexisting water main extension from Brown Road to the hydrant
in the northeast corner of the parcel is approved by the Town Board and the
Tompkins County Division of Environmental Health .
3 . The proposed 5 .4- acre lot may not be further subdivided into additional lots until
further approval by the Planning Board is applied for the granted, and until adequate
access approved by the Town is provided for such lots .
Discussion:
Olivia Vent proposed an amendment under item three (3 ) that the word parcel be changed to 5 .4 acre

lot for clarification and under one ( 1 ) to add easement to the Town .
The amendments to the resolution were accepted as friendly amendments .

Comprehensive Plan Update
Chairperson Newman reported to the Planning Board that we now have an updated draft of the
comprehensive plan as revised at the last Planning Board meeting. It has been revised to include the
comments from Bob Roe and Olivia Vent and other members of the Board .
The Town Board has received a copy of the latest draft of the comprehensive plan. A meeting of the
Planning Board and Town Board is scheduled for Wednesday, August 28 , 2002 at 7 : 00 p .m . . The
meeting is a preliminary review of the plan (a work session of the two (2) boards) to receive
comments, questions and concerns related to the plan . The Town Board was asked to provide feed
back to her or Susan Beeners on the plan ahead of time . The meeting will be structured around the
concerns from feed back received from the Board .
Susan Beeners said that it may be necessary to have a second joint meeting .
