Public Hearing Declared Open
Acting Chairperson Robert Roe declared the public hearing open at 7 : 10 p . m . and read the following
public hearing notice of publication :
PLEASE TAKE NOTICE, that the Planning Board of the Town of Danby will hold a public
hearing on Thursday, May 2 , 2002 at 7 : 00 p . m . , 1830 Danby Road, Ithaca, New York to Consider
Approval of the proposed subdivision of a lot of 1 . 07 acres with 187 feet of depth from Town of
Danby Tax Parcel 15 ,- 1 - 15 , 22 , 126 . 7 acres total , located at 297 Bald Hill Road, Low Density
Residential Zone . The matter also involves a request for variance by the Board of Zoning Appeals
of the minimum 2 -acre lot size and 300-foot lot depth required in Section 600, Para . 4 of the Town
of Danby Zoning Ordinance . Debbra Davis , Owner.
All persons will be heard in writing or in person .

Following a public hearing, Acting Chairperson Robert Roe opened the Special Meeting of the
Planning Board to discuss the proposal of Jim and Debbra Davis for the proposed subdivision of a
lot of 1 . 07 acres with 187 feet of depth from a property located at 297 Bald Hill Road.
Jim Davis explained to the Board that the subdivision of the larger lot is necessary because there is
a mobile home located on the larger lot. The mobile home that was located on the property to be
subdivided has been removed and they would like to place a double wide manufactured home there.
Only one dwelling is allowed on the larger commercial lot.

WHEREAS, this action is the Consideration of Approval of the proposed subdivision of a lot of
1 . 07 acres with 187 feet of depth from Town of Danby Tax Parcel 15 . - 1 - 15 . 22 , 126 . 7 acres total,
located at 297 Bald Hill Road, Low Density Residential Zone, Debbra Davis, Owner, and
WHEREAS, this is an Unlisted action for which the Town of Danby Board of Zoning Appeals on
April 29, 2002 , in reviewing the applicant ' s Request for Variance of the minimum 2-acre lot size and
minimum 300- foot lot depth required in Section 600 , Paragraph 4 of the Town of Danby Zoning
Ordinance, in order to subdivide said lot of 1 . 07 acres with 187 feet of depth from Tax Parcel 15 . - 1 -
15 .22 made a negative determination of environmental significance for the action and approved the
Request for Variance, and
WHEREAS, the Planning Board of the Town of Danby on May 2 , 2002 has reviewed the
application and the recommendation of the Town Code Enforcement Officer that a negative
determination of environmental significance be made for the proposed subdivision, NOW,
THEREFORE, IT IS
RESOLVED, that the Planning Board of the Town of Danby, acting as Lead Agency in review of
the proposed subdivision, an Unlisted Action , makes a negative determination of environmental
significance

WHEREAS, the Planning Board has held a public hearing on the matter on April 29, 2002 ; now
therefore, it is
RESOLVED, that the Planning Board of the Town of Danby hereby grants preliminary and final
subdivision to the action as proposed, conditional upon submission of a final survey map, suitable
for filing, for approval by the Chairperson of the Planning Board prior to the issuance of any
Certificate of Occupancy for construction on the subject 1 . 07 acre lot.

Summer Intern
Susan Beeners reported that it is possible that the Town may hire Megan Morris as a summer intern
for the comprehensive plan . She would be a Cornell University Intern from the Cornell Traditions
Program.
Holt Request for Special Permit :
The Planning Board scheduled a public hearing for the Holt Request for a Special Permit to allow
a single wide mobile home to remain on her property . The request if for a maintenance person for
the property and a farm worker. The additional information has not been received and application
is not complete at this time .
ADJOURNMENT :
On a motion the meeting adjourned at 7 : 35 p . m .
