Supervisor Edward Inman called the meeting to order at 7 : 07 p .m. and led all present to the Pledge
of Allegiance to the American flag.
ADDITIONS TO THE AGENDA: '
1 ) Supervisor Inman added advertisement of vacancies on the Board of Zoning Appeals ,
Planning Board and Tompkins County Hillview Road Citizen ' s Advisory Committee
2) Re-appointment of Patricia VanDeBogart to the Tompkins County Youth Board .
3 ) Request from Highway Superintendent for permission to place out to bid specifications for
a new plow truck .
REPORTS ;
Planning Board - The Planning Board will hold a public hearing on Thursday , November 15 , 2001
to hear a request for special permit for an addition at the First Baptist Church of West Danby . A
regular meeting of the Planning Board will follow the public hearing .
Recreation Partnership - Councilperson Strichartz reported that the Recreation Partnership and are
discussing the name of the partnership . The next meeting focus will be on possible cut backs in
funding from the State for programs .
Danby Community Council - Eileen Wright reported that the Sunday concert was well attended
and how well the acoustics are in the meeting room . There will be a concert at 2 : 00 p . m . December
9, 2001 at the Town Hall . The Halloween Party was successful . They received donations for in food
and money for the party and the total cost to Community Council was $34 .00 . The Council is going
to join the Council of Community Services of New York State (a non-profit council) which helps
non-profit organizations . The next meeting is December 13 , 2001 .
Senior Citizens - Carol Sczepanski reported that the Senior Citizens had their annual turkey dinner
on November 1 at noon. Esther Dotson presented an overview of the proposed Danby Community
Park project. A Christmas dinner will be on December 6, 2001 at noon at the Common Ground . All
senior ' s are invited .
County Representative Report :
Representative Proto reported on the following items :
Purchase and Development Rights - There were three public meetings on Purchase and Development
Rights for persons who own large tracts of land and want to keep their land in farming .
Towers Project - The County is going to proceed with the consultant to examine the need for the
towers project . The next phase will identify where the sites will be .

Flu Clinics - the Tompkins County Health Department are scheduling the flu clinics . Supplies of the
vaccine is in short supply . Confirmation of the flu clinics are scheduled two weeks in advance as
there is a shortage of vaccine .
COMMUNICATIONS :
1 . Supervisor Inman reported that he has received permission from the owners of Benjamin ' s One
Stop for a full demolition of the burned structure located at 1860 Danby Road . Contracts for the
demolition have been sent to Diversified Developers, Inc . of 18A Cherry Street Phoenix, NY .
2 . Tompkins County notice of vacancies on boards and committees
OLD BUSINESS :
Site Work - Town Hall - Susan Beeners reported that the site work on the front of the Town Hall
will be delayed due to the weather. The supervisor has approved temporary patch work on the front
portico for the winter. The supervisor has approved of temporary patch work on the front portico
and sealing of the sidewalks on the side of the building.

CREATION OF NEW POSITIONS :
RESOLUTION NO. 85 OF 2001
CREATION OF NEW POSITION ENTITLED " ZONING/CODE/FIRE ENFORCEMENT
OFFICER"

RESOLVED, that the Town Board of the Town of Danby hereby establishes the position of
"Zoning/Code/Fire Enforcement Officer", and makes such establishment retroactive to January 13 ,
1992 , with said position reading as follows :
Distinguishing Features of the Class :
An incumbent in this class is responsible for administering and enforcing the New York State Uniform
Fire Prevention and Building Code and the inspection of construction and building use for compliance
and applicable town or village zoning laws . This employee will coordinate and supervise the work
activities of Building Inspectors, Zoning Compliance Officers and/or clerical personnel to ensure
compliance with the appropriate laws, codes, rules and regulations . The work is performed under
the general policy direction of a Town or Village Board of Trustees . Supervision will be exercised
over a small number of Building Inspectors, Zoning Compliance and/or Clerical personnel as
necessary. The incumbent will perform all related duties as required .
Typical Work Activities :
Supervises the work of Building Inspectors , Zoning Compliance and/or Clerical personnel as
appropriate ;
Administers and enforces all provisions of New York State Uniform Fire Prevention and Building
Code and any applicable Town or Village Zoning Laws, Sign Laws , and other codes , laws ,
rules and regulations pertaining to the construction or alteration of buildings and structures ;
Prepares rules and regulations, application forms, building permits and certificates of occupancy for
the approval of the local governing body to be used for the administration and enforcement
of various codes, laws, etc . ;
Inspects building use for compliance with Zoning Laws ;
Supervises , coordinates and participates in the inspection of various stages of construction for
compliance with Zoning Laws and upon completion of construction of buildings and
structures ;
Issues, denies or revokes building permits, zoning permits and certificates of occupancy as required ;
Explains and interprets the requirements of the Zoning Laws to contractors and the general public ;
Issues written notices to correct unsafe , illegal or dangerous conditions in existing structures ;
Inspects, as necessary, buildings and structures for compliance with the fire prevention provisions of
the State Uniform Fire Prevention and Building Code ;
Issues a certificate of occupancy for a building constructed or altered in compliance with the
provisions of the Uniform Code and Zoning Law;
Maintains accurate record on all transactions and activities including all applications received, permits
and certificates issued, fees charged and collected, inspection reports and notice and orders
issued ;
Prepares a variety of reports relevant to Code Enforcement activities for the municipal government ;
Cites violations and initiates civil and/or criminal complaints for continued non-compliance with the
Uniform Fire Protection and Building Code;
Provides clarification and interpretation of existing Zoning, Sign, and NYS Uniform Fire Prevention

and Building Code Laws to the general public and Town or Village Boards ;
In consultation with Planning Board Chaiunan prepares legal notices for Planning Board and Board
of Zoning Appeals and the agenda for "Business Sessions" ;
May be required to attend meetings (when necessary) and provides information and to Planning
Board, Board of Zoning Appeals and Board of Trustees concerning action involving permits
or appeals .
Full Performance Knowledge, Skills , Abilities and Personal Characteristics :
Thorough knowledge of the modern practices, principles , materials and tools used in the building
construction trades ;
Good Knowledge of the State Uniform Fire Prevention and Building Code , local building code and
zoning laws ;
Good knowledge of the applicable Town or Village Zoning Laws ;
Good knowledge of the principles of fire prevention ;
Good knowledge of basic building inspection techniques ;
Good knowledge of the principles and practices governing the storage and distribution of combu
stibles ;
Good knowledge of how to operate a personal computer and spreadsheet, word processing and
database software ;
Good knowledge of the principles and practices of supervision;
Ability to write clear and concise reports and to maintain records in an orderly manner;
Ability to establish and maintain cooperative relationships with other public officials , building
contractors and the general public ;
Ability to read and interpret plans and specifications ;
Ability to communicate effectively both orally and in writing;
Ability to be firm but courteous ;
Willingness to attend all necessary schooling ;
Honesty, integrity, thoroughness, tact, and good judgment are required ;
Physical condition commensurate with the demands of the position.
Minimum Qualifications :
(a) Possession of a Bachelors Degree from a regionally accredited or NYS registered college or
university in Civil Engineering, Construction Technology or related field AND one year of
full -time paid (or the equivalent part-time and/or volunteer) experience as a building
inspector, independent contractor, skilled building construction trades worker, or working
with a fire fighting organization; OR
(b) Possession of an Associates Degree or 60 semester hours of study at a regionally accredited
college or university with a focus on Civil Engineering, Construction Technology or a related
field AND five years of full-time paid (or the equivalent part-time and/or volunteer)
experience as a building inspector, independent contractor, skilled building construction
trades worker, or working with a fire fighting organization; OR
( c) Graduation from high school or possession of a high school equivalency diploma AND five
years of full-time paid (or the equivalent part-time and/or volunteer) experience as a building
inspector, independent contractor, skilled building construction trades worker, or working
with a fire fighting organization; OR
(d) Any combination of training and experience equal to or greater than that defined by the limits
of (a) , (b) , and ( c) above .
SPECIAL REQUIREMENT :
The successful candidate must be willing and able to participate in the NYS Code Enforcement
Training (NYCRR-9b) and obtain certification within a reasonable time frame (as determined by the
Town or Village , based upon the frequency of classes) .

RESOLUTION NO . 86 OF 2001

Distinguishing Features of the Class : The work involves responsibility for administering and
enforcing the New York State Uniform Fire Prevention and Building Code or a local fire and/or
building code if approved by the State Fire Prevention and Building Code Council . Under general
supervision, provides for the coordination of all activities relevant to ensuring compliance with the
appropriate laws, codes, rules and regulations . A Code Enforcement Officer may supervise a small
number of Building Inspectors, Zoning Compliance personnel and/or clerical personnel . Does related
work as required .
Typical Work Activities :

registered four year college or university in a program leading to a Bachelors Degree in Civil
Engineering, Construction Technology, or a related field AND one year of full-time paid (or
the equivalent part-time and/or volunteer) experience in building construction work or a fire
fighting organization ; OR
( c) Three years of satisfactory experience in building construction work or in a building trade
such as carpentry, plumbing, electrical or related trades or fire fighting organization ; OR
(d) An equivalent combination of training and experience as defined by the limits of (a) , (b) or
( c) above .
NOTE 1 : Experience as a qualified building inspector can be substituted for an equivalent
combination amount of the above required experience .
NOTE 2 : Candidates for appointment in this class will be required to complete any mandated
training as established by the Department of State .

DANBY COMMUNITY PARK
Esther Dotson presented the Board with the amended proposed resolution for an agreement for
acquisition by the Town of Danby of Tax parcels 10 . - 1 - 77 . 2 and 10 . - 1 -76 for a Danby Community
Park and possible other uses , and on administration of said community park.
Supervisor Inman said that there were several things that the Board is concerned with such as stating
that the Town would purchase the land and the Town ' s obligation to purchase . His understanding
was that this would be given to the Town with no cost to the taxpayers other than being removed
from the tax rolls .
Esther Dotson said that this is a modification of the resolution that the Town Attorney approved. The
Community Park Association has three (3 ) directors as required and non-profit status has been filed
properly as a corporation under NYS non-for-profit law. This resolution has been slightly re-written
and it now says "until that amount can be raised in grants and donations to enable the Town of Danby
to purchase it for a community park" . A referendum would be required if tax money were involved .
Esther said that no tax money is involved in the actual acquisition of the land . The amount of Town
tax that would be sacrificed has been looked up and it ' s $465 . 00 . The Town has already applied as
a Town as a prospective owner to the State for a grant . The assumption in applying for the grant was
that the land would belong to the Town. If the grant is awarded the money would be granted to the
Town and the Town is not committed to anything unless the money appears . They are committed
to reject the idea if the money is not raised within five years . If the grant is received the land can never
be developed . It will be an 82 acre park . The eight acres held out are at the discretion of the Town
to decide what they want to do with it .
No action was taken on the proposed resolution.
RESOLUTION NO. 89 OF 2001
TRANSFER OF FUNDS - HIGHWAY DEPARTMENT

RESOLUTION NO. 90 OF 2001
A RESOLUTION OF THE TOWN OF DANBY, PROVIDING FOR EXECUTIONS OF AN
AGREEMENT FOR NATURAL GAS SUPPLY BY MUNICIPAL ELECTRIC AND GAS
ALLIANCE AS THE CONSULTANT OF THE TOWN OF DANBY

The Town Board of the Town of Danby hereby resolves as follows :
1 . The Supervisor, Edward Inman is hereby authorized and directed to execute and deliver to
the Municipal Electric and Gas Alliance an Agreement for natural gas supply service , a copy
of which is attached hereto and made a part hereof.

2 . The conditions , price , duration and term, purpose and objective, manner and extent of
payments, organized structure and manner in which personal property shall be acquired,
managed and disposed of, are set forth in the attached Agreement .
3 . That the Town of Danby may participate in the cooperative agreements to procure services
and products described in such Agreement, and that the Town Supervisor, Edward Inman is
hereby authorized and directed to execute such agreements whenever necessary and
appropriate .

RESOLUTION NO 91 OF 2001
RESOLUTION ADOPTING ANNUAL TOWN OF DANBY BUDGET FOR FISCAL YEAR
2002 .

WHEREAS , the Town of Danby Town Board having, on November 8 , 2001 held a public hearing
on the preliminary budget approved by this Board and filed with the Town Clerk for the fiscal year
commencing January 1 , 2002 , and having heard all persons desiring to be heard in the matter, and the
matter of the budget for this Town for such fiscal year having been fully discussed and considered,
it is
RESOLVED , that said preliminary budget as amended and revised and as hereinafter set forth is
hereby adopted and that the several amounts stated in the column titled "Adopted" in Schedule Al ,
Schedule D1 , and SW1 and they hereby are appropriated for the objects and purposes specified and
the salaries and wages stated in Schedule 5 of such budget shall be and are hereby fixed at the
amounts shown therein effective January 1 , 2002 , and be it further
RESOLVED, that the Town Clerk of the Town of Danby shall prepare and certify as provided by
law, duplicate copies of the said annual budget hereby adopted, and deliver one of such copies to the
Supervisor of the Town, and that she shall present such copy to the Board of Legislators of Tompkins
County as required by law.

Vacancies
A motion was made by Councilperson Gagnon and seconded by Councilperson Varona- Lacey that
the Town Board of the Town of Danby authorizes the Town Clerk to advertise and solicit interest
in appointments to the Board of Zoning Appeals, Planning Board, Hillview Road Landfill Citizen' s
Advisory Committee, Board of Water Commissioners and Fire, Disaster, and EMS Advisory Board.

Appointment to Tompkins County Youth Board
A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey that
the Town Board of the Town of Danby recommends the reappointment of Patricia Van de Bogart
to the Tompkins County Youth Board for a term that begins on January 1 , 2002 and expires on
December 31 , 2004 .

RESOLUTION NO. 92 OF 2001
AUTHORIZATION TO BID FOR NEW PLOW TRUCK

RESOLVED, that the Town Board of the Town of Danby authorizes the Town of Danby Highway
Superintendent to advertize for bids for the purchase of a new plow truck for the highway
department .

Board of the Town of Danby approve the Town Clerk ' s October 2001 Report as submitted .

numbers 429-490 in the amount of $ 12 ,059 . 98 .
