TOWN OF DANBY
TOWN BOARD MINUTES
OCTOBER 13, 2008
PRESENT:
Supervisor Fredric Dietrich
Councilpersons: Eugene Beavers, Leslie Connors, Daniel Klein, Joseph Salino
Others Present:

Susan Beeners - Code Enforcement Officer

Supervisor Dietrich called the meeting to order at 6:30 p.m. and led all present to the Pledge of
Allegiance to the American flag.
Additions to the Agenda:
Resolution to set date for Budget 2009 Public Hearing
Resolution to the DoT requesting speed reduction on 96B
REPORTS:
EMC - Supervisor Dietrich reported that the EMC Representative e-mailed him a report today.
He will send copies to the board. He reported on some of the issues around gas drilling in
Tompkins County.
Highway Department Report - Received
Zoning Report- Received
Susan Beeners reported that her Assistant, Donna Inman has retired.
Dog Control Report - Received.
Senior Citizens
Carol Sczepanski said the monthly meetings will be held at noon for the winter months. Many
of the seniors will be heading to a warmer climate for the Winter. This month they will be
going to Clements Theater to see "Mama Mia", Thanksgiving dinner will be the first Thursday in
November. Christmas luncheon will be held at Royal Court.
Communications:
Acknowledgment of receipt of resolution#58 from Governor Paterson.
Letter from Senator James Seward - response regarding our resolution regulating natural gas
drilling.
Discussion followed regarding where water would come from should drilling occur in our area

and the effect it could have on our aquifer.
Vehicle Towing -Proposed Local Law
Supervisor Dietrich reported that he has researched the process that towing companies use for
towing of vehicles. The sheriff generates RFP (requests for proposals) every year and
companies who want to tow vehicles puts their name on the list. If towing of a vehicle is
necessary, the sheriff goes down the list until they find one that is available.
OLD BUSINESS:
SPCA Report -No Update
Health Insurance (TCCOG) -No Update
Supervisor Dietrich reported that there will be minutes available from the TCCOG that he will
make available to the board.
Hamlet Planning:
Susan Beeners reported that the Planning Board and Steering Committee are doing the logistics
and food for the all day hamlet public information meetings on October 24 and 25th. Invitations
have been sent to the public, highway superintendent and water district superintendent for them
to participate in the day long sessions.
Set Date for Public Hearing- Budget for Fiscal Year 2009

RESOLVED, that the Town Board of the Town of Danby sets the date of Monday,November 3,
2008 at 6:30 p.m. for the Preliminary Budget for Fiscal Year 2009

Set Date for Public Hearing- Proposed Local Law#3
Emergency Towing of Vehicles
RESOLUTION NO. 73 OF 2008
By Supervisor Dietrich: Seconded by Councilperson Beavers
RESOLVED, that the Town Board of the Town of Danby sets the date of Monday,November 3,
2008 at 6:25 p.m. for a public hearing on the Proposed Local Law #3 - Emergency Towing of
Vehicles.

RESOLUTION NO. 74 OF 2008
SPEED LIMIT REDUCTION REQUEST
By Supervisor Dietrich: Seconded by Councilperson Beavers
WHEREAS, the Town of Danby Town Board has received many requests from the Planning
Board and many residents in the town to have the speed limit reduced to 35 miles per hour on
NYS Rte. 96B through the Town of Danby between the intersections of East and West Miller
Road and Michigan Hollow Road, and
WHEREAS, the Town of Danby has development projects such as the Danby Community Park
and Eco-Village on NYS Rte. 96B, and
WHEREAS, NYS Rte. 96B has increased speeding traffic through the Town of Danby
generated by vehicles from many commuters from outlying areas and residents on their way to
the City of Ithaca, Cornell University and Ithaca College as well as local traffic, now,be it
RESOLVED, that the Town Board of the Town of Danby requests that the New York State
Department of Transportation reduce the speed limit on N.Y.S. Rte. 96B from 45 miles per hour
to 35 miles per hour through the hamlet of Danby from Michigan Hollow Road to the East Miller
Road and West Miller intersection.

Approval of Supervisor's August 2008 Report
Motion to Approve Supervisor's Report
A motion was made by Councilperson Salino and seconded by Councilperson Beavers that the
Town Board of the Town of Danby approves the Town Supervisor's August 2008 report as
submitted.

APPROVAL OF WARRANTS
General Fund Warrant No. 10 of 2008
A motion was made by Councilperson Beavers and seconded by Councilperson Salino that the
Town Board approves the General Fund Warrant No 10 of 2008 in the amount of $52, 274.49
vouchers numbered 373 -422.

Highway Fund Warrant No. 10 of 2008
A motion was made by Councilperson Beavers and seconded by Supervisor Dietrich that the
Town Board of the Town of Danby approves the Highway Fund Warrant No. 10 of 2008 in the
amount of$60,687.75 vouchers numbered 134-154.

West Danby Water District Fund Warrant No. 10 of 2008
A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers that the
Town Board of the Town of Danby approves the West Danby Water District Fund Warrant No.
10 of 2008 in the Amount of$1,360.27.
A roll call vote on the motion resulted as follows:

ADJOURNMENT:
On a motion the meeting adjourned at 7:45 p.m. and entered into a Budget Work Session to
review the Code Enforcement Officer's 2009 Budget Proposal.
