Supervisor Edward Inman declared the Public Hearing Open at 7 : 00 p .m . and the Town Clerk read
the following notice of publication: "PLEASE TAKE NOTICE, that the following public hearing
will be held by the Town Board of the Town of Danby on Wednesday May 14 , 2001 at 1830 Danby
Road, Ithaca, New York at 7 : 00 p .m. to consider a proposed local law entitled: "A Local Law
Amending the Zoning Ordinance and Zoning Map to Remove Provisions That Presently Reduce Lot
Sizes, Frontage Dimensions, and Setbacks in Medium and Low Density Residential Zones Along
Existing Roads Shown as a Solid Line on the Zoning Map and to Modify Certain Provisions Related
to Pre-Existing Lots and Nonconforming Lots of Record", and a local law entitled "A Local Law
Amending the Zoning Ordinance to Eliminate Medium Density Residential Zones From the
Commercial Target Area" . Copies of the proposed Local Laws may be viewed at the Town Clerk' s
Office, Monday thru Friday from 9 : 00a.m. to 4 : 00 p .m . and Saturday mornings from 9 : 00 to noon .
All interested persons will be given the opportunity to be heard either in person or in writing .

Supervisor Inman reported that due to a clerical error that a second public hearing would be held on
May 30 , 2001 and tonight' s public comment would be entered as record.
Supervisor Inman reported to the public that the proposed local law A Local Law Amending the
Zoning Ordinance and Zoning Map to Remove Provisions That Presently Reduce Lot Sizes, Frontage
Dimensions , and Setbacks in Medium and Low Density Residential Zones Along Existing Roads

Shown as a Solid Line on the Zoning Map and to Modify Certain Provisions Related to Pre-Existing
Lots and Nonconforming Lots of Record referred to as the 400' strip is first on the Agenda.
Susan Beeners presented a map to the public that outlined the areas that are medium density and low
density areas and explained the changes in the lot sizes along the roadways are intended to reflect
medium and low density. The high density along roadways in medium and low density zones would
be removed . She said that the lots that conform to the present one acre along the roadway would be
grand fathered . Those lots would be considered a buildable lot as long as they can comply with the
new yard setbacks that will be in place . She reported that Tompkins County Assessment office has
determined that the assessment property values would be minimal .
Comments from the public :
William Farrell - objects to changing ordinance and increase in frontage to 200'
Robert Roe - agrees with W. Farrell and objects to changing ordinance and thinks it may drive the
cost of building here unaffordable to many .
Sarah Newman - strongly in favor of the proposal .
Elizabeth Owens-Roe - apposed to change in lot sizes and cost of maintenance of roadways in
possible cluster development
Ames Brown - all details of this change are not included in the proposed local laws . He suggested
that all the residents of Danby should be notified .
Jennene Boehme-is definately in favor of this amendment and has concerns about environmental
changes that come with development.
Pat Woodworth - favors change and thinks that ordinance should reflect stated density .
Pam Arsenault - objects to change as there is a big difference in lots of one and two acres . It limits
usage of land .
George Arsenalult - agrees with his wife and even though they have land they will lack frontage for
his children to build along the road without land locking the back lands .
Walter Sczepanski - thinks the ordinance should stand as it is now and does not see it as a benefit
but a loss to owners of smaller lots and once you start making nonconforming lots .
Linda Dorn - objects to amendments to the zoning ordinance and does not think it helps a
community .
Olivia Vent - approves of the change particularily in the low density areas . It is important that
people attending this meeting understand that the Planning Board is working on a comprehensive plan
and that making changes is an interim measure until it has been approved and guidelines for looking
for zoning changes at a later date are in place .
Debbie Benson - would like to know how this proposed change has come about .
Bob Strichartz - in favor this change and thinks that they are reasonable and eliminate a loop hole
that people didn' t know about. Danby is growing at a reasonable rate .
Willard Daetsch - approves of the change and agrees with B . Strichartz and O . Vent .
Eileen Wright - approves of the change and has concerns about septic systems .
Gerillermo Metz- approves of the change as there appears to be a loop hole in our present
ordinance .
D an Klein - thinks this is a good proposal and it is important that the average resident of Danby can
understand it .
Sarah Ruebenstein - approves of the change in the ordinance and thinks that the language should
be as clear as possible .
E ric Miller - in support of change .
Faith Chase - agrees with the change
Robert Chase - agrees with the change .
B ridgid Cooper - concerned for land use and is in support of the zoning change .
Charley Tilton - favors change and thinks we should have some consistency in the ordinance .
Martin Sternstein - favors change in ordinance as he is concerned with changes in his neighborhood
and the buindings in his neighborhood.
Lamar Herrin - approves of amendment
Ken Horst - he understands that the comprehensive plan is coming along well and asked why there
is urgency of passing this ordinance prior to the completion.
U nidentified Resident - asked what is the estimated time for completion of the comprehensive plan

(Supervisor Inman reported that the Board hopes the plan is completed by the end of this year. )
Elizabeth Roe - reiterated that if you widen frontage and you have residents and land owners who
are not at this meeting that you have the tendancy to force subdivisions behind front property . It is
not a formula for lower density and will not keep lower density . She asked the Board to keep this
on the table until the comprehensive plan is in place.
Nancy Weitzel - Low density is the whole chunk of land not what' s along the road.
Olivia Vent - reported that the Planning Board has had a discussion on this issue of why address this
now when the comprehensive plan is supposed to be finished. The general feeling after discussion was
that the comprehensive plan will be some time to completion and it still has to go through approval
of the Town Board. It may be six months before the Planning Board could look at specific zoning
changes . She thinks that this change is an appropriate measure at this time .
Robert Roe - At the Planning Board there was some discussion about whether changes to zoning are
ever interums .
Sue Howe - asked if any thought was given to roads now in the low density zones that are close to
the higher density zones so that those particular sections are addressed verses the more rural areas
where you definately want lower density such as where half of Town Line Road is in Newfield and
half in Danby.
Pamela Arsenault - what happens to those non-conforming lots .
( Supervisor Inman responded that those are simply grandfathered.)
Ames Brown - thinks we do not have all the facts especially about the hydrology. There is not
enough information about land.
Robert Roe - he was going to come to the Board tonight to ask the Board to adopt a resolution
tonight to urge the County Board to reinstate the $ 10,000 for seed money to start the acquifer study .
PROPOSED LOCAL LAW TO ELIMINATE MEDIUM DENSITY RESIDENTIAL ZONES
FROM THE COMERCIAL TARGET AREA
Supevisor Inman asked the Code Enforcement Officer to explain the present ordinance and the
proposed local law.
The Code Enforcement Officer used maps of the Town to show where the medium density residential
zones are located . She explained that the proposed change is to make it so that new commercial
zones could only be established in the high density areas and not in the medium areas . The only way
with this new law that you could establish new commercial in low density or medium zones would
be if those zones were zoned high density first and then to commercial or perhaps a Planned
Development Zone .
SEQR things related to this proposed local law are that in West Danby the medium density zones
are quite limited by topography and It would be difficult to determine where a commercial zone could
be established . In central Danby there is virtually no development in the medium density zone now
as it is mostly old field and some limited farm land. There are no real environmental constraints and
a portion of the medium density zone on Comfort Zone is in an Ag District as set up by Tompkins
County .
Tompkins County Planning Department recommended that there are no impacts related to County
interests but did point out that the Town might consider an area along the east side of 96B where
this area was part of the designated commercial center in the Commercial Center Revitilazation Plan.
Supervisor Inman said that the Planning Board has submitted a Resolution to the Board . The
recorded vote from the Planning Board was inacurate and corrected .

WHEREAS, the Town Board of the Town of Danby has transmitted to the Planning Board for its
recommendation a Proposed Local Law Amending the Zoning Ordinance and Zoning Map to

Eliminated Medium Density Residential Zones from the Commercial Target Area; and
WHEREAS, Section 1200 of the Town of Danby Zoning Ordinance provides that proposed
amendments of changes to the Zoning Ordinance be referred to the Planning Board for a report
thereon; and
WHEREAS, the proposed local law is a Type I Action for which the Town Board is legislatively
determined to act as Lead Agency in environmental review; and for which the Planning Board is an
involved agency in making a report to the Town Board; and the Tompkins County Department of
Planning is an involved agency with respect to General Municipal Law 239-m review; and
WHEREAS , the Planning Board has reviewed the proposed local law and has also reviewed the
Long Environmental Assessment Forms and review prepared by the Code Enforcement Officer ;
NOW, THEREFORE, IT IS
RESOLVED , that the Planning Board reports to the Town Board that it cannot make a favorable
recommendation at this time as it is not consistent with current planning concepts encouraging density
in or near traditional population centers .

Comments From the Public :
Robert Roe - What this resolution is that by precluding commercial development in the medium
density areas you basically end commercial development in central Danby. There won' t be any shops
or businesses because there are not any high density lots available for this any more . You are saying
that there will be no shopping or services in Danby.
Councilperson Strichartz said she thinks this is reasonable to do it now and the reason for doing it
now is that that things can happen that cannot be reversed . Unless we have some safeguards for
people in residential neighborhoods . It may be possible with this to arrange some sort of resistant
things so that residential neighborhoods are protected against commercial development.
Olivia Vent - Reported that there wasn ' t enough information presented to the Planning Board
available to make it clear as to what type of activity would be allowed.
Lamar Herrin - When a business was allowed in his low density neighborhood his property value
declined twenty-five percent.
Pat Woodworth - there are concerns about making the medium density commercial target areas .
Commercial development is physically not possible in the West Danby area so why say it is a target
area? The problem with having a commetrcial target zone without knowing what the commercial
targets means you could get something you don ' t like . If you want to allow for certain commercial
targets then you should make the ordinance specify that in advance . The problem is not knowing
what the commercial targets could be.
Bob Strichartz - Supports what Pat Woodworth said . Clearly this is something that has to be
discussed carefully by the Planning Board in the future . In the meantime we would be a lot better if
Target Zone were elimated.
Dan Klein - The area from 96B to Comfort Road to Lieb Road is what we are talking about and

most people would agree that this is not a place for development. He thinks that along 96B is where
development probably should occur.

Supervisor Inman called the meeting to order at 8 : 20 p . m . and led all present to the Pledge of
Allegiance to the American flag .
Supervisor Inman reported that our American Flag was removed as it was torn . A new flag has been
ordered .
ADDITIONS TO THE AGENDA :
Under New Business - EMC Resolutions to recommend to Tompkins County to continue with. the
acquifer study for the County .
PRIVILEGE OF THE FLOOR
Supervisor Inman said that all the paperwork for the playground on Gunderman Road has been
completed and submitted for the $ 10, 000 Grant .
Benjamin ' s One- Stop
Supervisor Inman reported that test reports received from the DEC for well at No . 2 Bald Hill Road
has been received and are well within tolerable limits . The DEC will be moving equipment in to
remove the gasoline tanks and the contaminated soil this week .
Councilperson Strichartz said that she realizes that zoning is a hot topic and she thinks the civility of
the public hearing was impressive and she is proud to live in Danby .
Town Clerk Carol Sczepanski reported that at the New York State Town Clerk ' s Association Annual
Conference she was elected by the Association to serve as a Region 6 Director of the Association .
Ames Brown - referred to a letter to the Town Board regarding a response to the signage at the
intersection of East and West Miller Road on 96B from Senator Kuhl to Genevive Sanford, Town
Clerk and Town Board . He suggested that maybe we may now want to send a request to have the
yellow (suggested speed) signs changed to white .
Walter Sczepanski - concerned that at many Planning Board Meetings the Board has discussed
where and how to attract commercial business to the Town and possible sites where business may
be located. Now it appears that the Town does not want to see commercial business sites in Danby.
Councilperson Strichartz responded that we must define what is meant by commercial . She said she
would love to see some downtown stores for example, a hotel , restaurants , a laundromat and a post
office . She would hate to see what happened to Comfort Road with two(2) big factories and a lot

of traffic . What your noticing is a population shift . Many people report that they moved here because
we have zoning and we do not want a lot of commercial .
Nancy Weitzel - said that if we have enough vision because gas prices keep rising, we are not going
to run downtown for every little thing that we need . She said she thinks that we have to look to the
future as she reported at the Planning Board Meeting . We have no businesses on this end of the
Town, outlying areas, and not even the Town of Ithaca.
Councilperson Varona-Lacey said that commercial can improve the quality of life or it can hinder the ual
ty of our lives like

Supervisor Inman reported that the Town Supervisors are meeting tomorrow night at 5 : 00 p . m . The
County Board of Representatives have received a letter from the Supervisors regarding the

RESOLUTION NO. 53 OF 2001
AUTHORIZATION FOR TOWN SUPERVISOR TO SIGN INTO AN AGREEMENT FOR
THE INTERMUNICIPAL COOPERATIVE RECREATION PARTNERSHIP .

RESOLUTION NO . 55 OF 2001
ENDORSEMENT FOR SUBMISSION OF A GRANT PROPOSAL TO TOMPKINS
COUNTY COMMERCIAL CENTER REVITALIZATION PROGRAM

WHEREAS, The Town of Danby Building Committee has submitted a plan to the Town Board for
repair of the Town Hall portico and front walk, construction and alterations to the driveway and
parking areas , painting and lighting on the Town Hall for the their consideration and approval to
prepare a grant application to be submitted to Tompkins County Commercial Center Revitalization
Program, and
WHEREAS , the Town Board reviewed the draft sketches of the work plan for alterations to the
Town Hall facility and parking areas as prepared by the Building Committee, now be it
RESOLVED, that the Town Board of the Town of Danby endorses the plan submitted by the Town
Building Committee and authorizes the submission of a grant application as reviewed and approved
by the Board on May 14 , 2001 to Tompkins County Planning for the Tompkins County Commercial
Center Revitalization Program .

Councilperson Gagnon reported that the Building Committee has been working on a scope of work
for the Town Hall building . The painting of the building, flood lighting of the facade the portico
floor, sidewalk and parking spaces are a possibility .
The Board reviewed two plans of design for the parking area, driveway and sites for handicapped
Councilperson Gagnon said he would suggest that the scope include the parking spaces on the north

side, the walks across the front of the building connecting, the portico floor, the painting and maybe
flood lighting if we can agree to what that would include .
Motion to Sign Agreement to Spend Town Highway Funds
A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the
Town Board of the Town of Danby sign the Highway Department Agreement to Spend Town
Highway Funds .

The agreement was signed by the Board .
County Representative Report:
Representative Proto submitted a set maps showing options for redristricting in Tompkins County
to the Board . Most of the concern about the redistricting is in the City of Ithaca as they have lost
population. The Board is looking at map numbers 15D and 15E . Aquifer Study Presentation - An
aquifer study is not cheap and not a one year solution . The reason the County should fund a study
is for health, development, utility reasons . Many County legislators are not supporting of the aquifer
study . Flood Mitigation Program - there is concern about the deadlines this year . The Water
Resources Council will be helping review applications . West Nile Virus - Advertising is being
increased this year. Rabies - Clinics will be held this Spring and again in the Fall . Commercial
Revitalization Grant Program - Guidelines permit the purchase of property .
Open House for Town Hall
Councilperson Strichartz reported that she is not ready to set a date for the Open House . It would
be great if we could do a band concert with the Bi - Centennial Committee for the Open House this
summer .

APPROVAL FOR THE TOWN CLERK/TAX COLLECTOR TO ATTEND A TAX
SEMINAR IN JUNE .

Community Council Report :
Councilperson Strichartz reported that Danby Community Council is working very hard on the Danby
Firemen Field Day and youth programing .
Senior Citizens Report :
Nancy Weitzel reported that the Senior ' s held their monthly meeting on Thursday , May 3 , 2001 at
the Danby Federated Church. George Clarkson presented the seniors with slides from Wales . The
public will be invited to the June meeting on June 7 for a presentation by a representative from the
New York State Troopers who will address how to identify SCAMS and where to report
questionable offers .
