TOWN BOARD MINUTES
SPECIAL MEETING - JANUARY 25, 2001
PRESENT :
Supervisor Edward Inman
Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz, Gladys Varona-Lacey
Others Present :

Susan Beeners - Code Enforcement Officer
John Barney - Town Attorney
Supervisor Edward Inman called the special meeting of the board to order at 7 : 07 p .m .
Motion to Enter Into Executive Session
A motion was made by Supervisor Inman and seconded by Councilperson Strichartz at 7 : 08 p . m . that
the Town Board of the Town of Danby enter into an Executive Session to receive legal advise
regarding pending litigation on the Benjamin' s One Stop property.
A roll call vote on the motion resulted as follows :

Inman Aye Carried Unanimously
Reconvened Board Meeting
The Board reconvened at 8 : 45 p.m.
Tompkins County Communication Towers
Councilperson Gagnon said that Tompkins County Board of Representatives have passed a resolution
and declared themselves lead agency to prepare an EIS without notification to the Towns or asking
for concurrence in their declaration. He suggested that the Town Board request that they be included
as involved parties in the process .
RESOLUTION NO . 21 OF 2001 - Resolution re-numbered to No. 22 of 2001
AUTHORIZE TOWN SUPERVISOR TO APPROACH TOMPKINS COUNTY
REQUESTING THAT THEY RESCIND RESOLUTION NO . 307 OF 2000 .
By Councilperson Gagnon : Seconded by Councilperson Strichartz
WHEREAS , Tompkins County has passed a resolution No . 307 of 2000 - Initiation of the SEQR
Process for the Public Safety Communications System, Positive Declaration and Lead Agency
Designation , and
WHEREAS , the Town of Danby was not included as involved parties in the Tompkins County
Telecommunications Towers networking proposals process , now be it
RESOLVED , that the Town Board of the Town of Danby authorizes the Town Supervisor to
request the County to rescind its declaration as lead agency and to follow the process for concurrence
for lead agency, and
FURTHER RESOLVED , that the Town of Danby requests to be included as involved parties in the
networking proposal process for the telecommunications towers project .
Discussion :
Susan Beeners suggested that the letter to Tompkins County make reference to the fact that the

Town has a Telecommunications Ordinance .
Suggested was that the letter should ask the County to clarify why there was not concurrence with
other townships before the declaration for lead agency for the EIS .

RESOLUTION NO . 23 OF 2001
Reestablishing - Encumbrance of FEMA Funds of December 27 , 2000
By Councilperson Gagnon : Seconded by Councilperson Nolte
WHEREAS , the motion for encumbrance of FEMA Funds of December 27, 2000 stated an amount
not to exceed $ 19 , 603 , and
WHEREAS, the actual amount for the encumbrance of FEMA Funds is $ 10 ,450 . 00 , now be it
RESOLVED , that the Town Board of the Town of Danby re-establishes the encumbrance of FEMA
Funds in the amount of $ 10 ,450 . 00 .

RESOLUTION NO . 24 OF 2001
TRANSFER OF FUNDS - HIGHWAY DEPARTMENT - AMENDMENT TO
ENCUMBRANCES FOR 2000 OF DECEMBER 27,2000
By Councilperson Nolte : Seconded by Councilperson Varona-Lacey
RESOLVED , that the Town Board of the Town of Danby amends the encumbrances for the year
2000 and transfers the accounts as follows .
$ 5 , 515 . 10 from DA2680 to DA5130. 400 ;
$ 5 ,472 . 66 from DA3501 to DA5130 . 400 ;
$ 2 , 735 . 40 from A1989 . 400 to A5132 .400
