Regular Meeting
PRESENT :
Supervisor Edward Inman

Supervisor Edward Inman called the meeting to order at 7 : 05 p .m . and led all present to the Pledge
of Allegiance to the American flag .
ADDITIONS OR DELETIONS TO THE AGENDA :
1 ) Appointments to the Planning Board and the Board of Zoning Appeals was deleted .
2) An addition to the agenda under new business - appointment of a Highway Liason .
3 ) An addition requesting hours be included on billing for legal services .
4) An addition of Clerk' s request for permission to dispose of records that have reached their
IP
retention schedule .
5 ) Approval for comprehensive planning intern
6) Flood Mitigation Program Project - possible resolution
7) Request for re-zoning of five (5 ) acres on Town Line Road .
PRIVILEGE OF THE FLOOR:
William Farrell reported that money has been raised for a community building through fund raising
activities and placed in a building and land purchase fund . The money raised through these fund
raisers was specifically for a building fund and for the purchase of land. The money is in an account
held by Danby Community Council . The Town of Danby has established an account for a community
center and asked the Board to transfer the funds into that account. The funds should be placed into
a savings account instead of held in a checking account .
Supervisor Inman will see if the Town can accept the funds before the Parks Commission has been
established .
Ames Brown - reported that he is unhappy with special meetings of the Board scheduled . We
continue to have a problem with residents not aware of when there are special meetings held . He
suggested a message board be placed at the Town Hall listing meetings . The Community Council
Bulletin Board often does not list Town Board Meetings .
Karen Jamarusty - asked the status of Benjamin' s One Stop and asked if it was possible for
volunteers from the community or the fire department to remove the building. She said that somebody
is responsible for that building and it should be removed .
Supervisor Inman said that the Board is going to schedule a special meeting with the Town Attorney
to discuss the status of Benjamin' s One Stop .
County Representative Report :
Representative Frank Proto reported the County Board has had one meeting this year. He reported

on the following items :
Board of Health meeting how to avoid the problem with the flu vaccine distribution will be
discussed . The regulations for the new sanitary and septic code revisions have been approved .
Committee Assignments for 2001 - Frank reported his committee assignments for 2001 as the
Budget Committee, Vice Chair of the Health Committee , Economic Development Committee and
a special committee Space on Location to look at the County ' s space needs .
Open Space Planning - Frank reported that Mayor Cohen has met with all the Town Supervisors
in the County to discuss open space planning and creating an urban core in the City .
Vital Community/Open Space - The second phase of the Vital Community/Open Space Planning
session will include elected officials .
Proposed Room Tax Increase - is not in favor of the proposal is to increase the room tax from 3 %
to 5 % in Tompkins County .
REPORTS :
Code Enforcement Office Report - December 2000 received .
Highway Department Report - December 2000 received .
Dog Control - SPCA Report - November 2000 - received .
Planning Board Report :
Susan Beeners reported that the Planning Board will hold a forum entitled " Sensible Land Use in
Rural Towns" , on Thursday, February 1 , 2001 at 7 : 00 p . m .
Water Resources Council :
Linda Dorn reported that she feels she is treated as a yo -yo . She thought she was seated but now
finds out she is a guest on the council . She is miffed about the whole situation .
Frank Proto said that Linda was approved by the Water Resources Council and the issue brought to
Mike Lanes Planning Committee. Action for her appointment has been tabled until all the potential
individuals resumes have been reviewed . Mr. Proto has submitted all the information regarding a
designated seat for the Town of Danby to the County Board .
Community Council :
Councilperson Strichartz reported that the Danby Community Council has applied for and received
a grant for $2 ,000 for concert series for 2001 . This is the third year they have been awarded a grant .
There is a Chamber Concert to be held here at the Town Hall on Sunday, January 28 , 2001 at 3 : 00
p . m. The annual meeting and election of officers of Community Council is on January 24 , 2001 , at
the Town Hall .
The Clerk reported that Community Council schedules meetings and events and fail to notify her so
that they can be placed on the Town Hall Calendar. January meetings were p published in the Danby
Area News without a request to use the building or notification that events were scheduled before
publication
Danby Senior Citizens
The Senior Citizens held their monthly meeting on January 4 , 2001 at 12 : 30 p . m. Entertainment was
provided by John Smith who played the bagpipes . An agreement between the Danby Senior Citizens
and the Town of Danby was approved and the election of officers for 2001 are as follows :
President - Gerald Catlin, Sr. , Vice President - Ruth Colburt, Treasurer - Nancy Weitzel, Secretary -
Carol Sczepanski . The next meeting will be on February 1 , 2001 at 12 : 30 p . m .
OLD BUSINESS :
Appointment to Planning Board Deferred
Appointment to the Planning Board has been deferred until a later date to allow interested persons
to respond to the advertisement for applicants .
Proposed Local Laws Amending the Zoning Ordinance
Code Enforcement Officer reported that immediately after the meeting December 12 , 2001 she
started to gather mapping information for the SEQR. The County may not be able to provide all the

information requested . Susan said she has requested maps showing how many lots are in the medium
density zones and the low density zones that would conform to the proposed changes .
NEW BUSINESS :
Motion to Set Special Meeting of the Board
A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey that
the Town Board of the Town of Danby schedule a Special Meeting of the Board for Thursday,
January 25 , 2001 at 7 : 00 p . m. to seek information from the Town Attorney with respect to a matter
in violation of the Town of Danby Damaged Building Local Law.

Senior and Disabled Exempt Income Limits
Supervisor Inman would like to see the Senior and Disabled Tax Exempt income limits extended to
be consistent with the Tompkins County limits .
The Board discussed the possible amendments and viewed comparisons from other municipalities .
Motion to Amend the Exempt Limits for Seniors and the Disabled
A motion was made by Supervisor Inman and seconded by Councilperson Strichartz that the Town
Board of the Town of Danby amend the Town Senior Citizen Exempt and the Disabled Exempt
Income limits by extending them to be consistent with income limits for Tompkins County
Exemptions .
Councilperson Gagnon said that he would like to know the number of persons who receive this
benefit and the effect on our budget .
After discussion Supervisor Inman withdrew his motion pending further information.
Amendment to the Code Enforcement Officer Job Description
The Code Enforcement Officer Job Description was amended to correct gender description from him
to him/her throughout the description as appropriate .

APPROVAL OF AMENDED CODE ENFORCEMENT JOB DESCRIPTION OF JANUARY

WHEREAS, the Town Board of the Town of Danby at a special meeting held on January 3 , 2001 ,
considered for adoption the revised job description of the Code Enforcement Officer ' s position
relating to work activities , time requirements and minimum qualifications necessary, and
WHEREAS, these revisions were reviewed by the Town Board and after discussion were approved
for adoption, now therefore be it
RESOLVED , that these revisions, a copy of which is attached hereto and made a part of this
resolution, be adopted as the Town of Danby ' s official job description of the Code enforcement
Officer' s position, and be it further
RESOLVED, that this description supersedes all other descriptions of the Code enforcement Officer
position for the Town of Danby previously enacted .

Discussion :
Councilperson Nolte said that the Code Enforcement Officer should not be required to attend the
entire Board Meetings as part of hours worked .
Supervisor Inman said that the Code Enforcement Officer would be required to attend meetings only
where it was applicable .
Councilperson Strichartz said we should have the business and reports that require department heads
attendance earlier in the meeting .

CODE ENFORCEMENT OFFICER
TOWN OF DANBY
DISTINGUISHING FEATURES OF THE CLASS :
The work involves responsibility for administering and enforcing the New York State Uniform Fire
Prevention and Building Code (hereinafter called the 'Uniform Code '), and other laws, codes , rules
and regulations pertaining to the construction or alteration of buildings and structures, and to land
use, development, and subdivision.
The Town Supervisor is the immediate supervisor for this position. The work is performed under
general policy of the town boards, and is performed independent of daily immediate supervision.
The position provides for the coordination of all activities relevant to ensuring compliance with the
appropriate laws, codes, rules , and regulations . The Officer may supervise a small number of
Building Inspectors, Zoning Compliance personnel , and/or clerical personnel .
The Officer does related work as required .
TIME REQUIREMENT :
This is a Full-time position requiring an average of 40 hours per week. That time allotment includes
attendance at meetings of the Town Board, Planning Board, and Board of Appeals, upon request of
the respective board chairperson, and upon approval by the Town Supervisor.
TYPICAL WORK ACTIVITIES :
Administers, enforces, and coordinates compliance with all provisions of the Uniform Code and with
other laws, codes, rules and regulations including, but not limited to, the following :
New York State Energy Conservation Construction Code
Town of Danby Electrical Code (in coordination with the Town's Electrical Inspector)
Town of Danby Real Property Maintenance Law
Town of Danby Zoning Ordinance
Town of Danby Subdivision Regulations
Fees for Building Code, Zoning Ordinance, Subdivision Regulation, and Other
Enforcement Activities
Local Law Providing for Environmental Review of Actions in the Town of Danby
Local Law Relating to Flood Damage Protection;

Prepares and maintains rules and regulations, application forms, permits , and certificates , approved
by the Town Board or other pertinent board, for use in administration and enforcement of such laws,
codes , rules and regulations ;
Supervises, coordinates, and participates in review and inspection of the various stages of, and the
completion of, building construction, land development, and land subdivision;
Issues, denies, or revokes building permits and certificates of occupancy as required in compliance
with the Uniform Code ;
Issues written notices to correct unsafe , illegal , or dangerous conditions in unsafe structures and to
correct use violations ;
Inspects, as necessary, buildings and structures for compliance with the fire prevention provisions of
the Uniform Code, including, but not limited to , places of public assembly and multiple residences ;
Maintains accurate records of all transactions and activities including all applications received, permits
and certificates issued, fees charged and collected, inspection reports , and notices and orders issued ;
Prepares various reports relevant to Code Enforcement activities for the Town and for other agencies
as required or requested, following any necessary approvals by the Town Board;
Initiates civil and/or criminal complaints, in coordination with the Town Attorney and Town Justice,
for continued non-compliance with the Uniform Code or other regulations pertinent to this position.
FULL PERFORMANCE KNOWLEDGE , SKILLS, ABILITIES , AND PROFESSIONAL
CHARACTERISTICS :
Thorough knowledge of modern practices , principles , materials, and tools used in building
construction; good knowledge of building trades ; good knowledge of the Uniform Code and other
laws, codes, rules, and regulations pertinent to this position; good knowledge of the principles of fire
prevention; ability to write clear and concise reports and to maintain records in an orderly manner;
ability to establish and maintain cooperative relationships with other public officials, building
contractors, and the general public ; ability to read and interpret plans and specifications ; ability to be
firm thoroughness ; good judgment; physical condition

commensurate with the demands of the job .
MINIMUM QUALIFICATIONS :
Graduation from high school or possession of a high school equivalency diploma and EITHER:
(a) Possession of an Associate Degree with specialization in Civil Engineering, Construction
Technology or a related field AND one year of full time paid (or the equivalent part-time
and/or volunteer) experience in building construction work of a firefighting organization; OR
(b) Satisfactory completion of 60 semester hours at a regionally accredited or New York State
registered four year college or university in a program leading to a Bachelors degree in Civil
Engineering, Construction Technology, or a related field AND one year of full-time paid (or
the equivalent part-time and/or volunteer) experience in building construction work or a
firefighting organization; OR
(c ) Three years of satisfactory experience in building construction work or in a building trade
such as carpentry, plumbing, electrical or related trades or firefighting organization; OR
(d) An equivalent combination of training and experience as defined by the limits of (a) , (b) or
(c ) above .

NOTE 1 : Experience as a qualified building inspector can be substituted for an equivalent
combination amount of the above required experience .
NOTE 2 : Related experience in a governmental zoning/planning office may be considered in
determining an equivalent combination amount of the above required experience .
NOTE 3 : Candidates for appointment in this class will be required to complete any mandated
training as established by the Department of State
TOWN OF DANBY - CODE ENFORCEMENT OFFICER - SPECIFIC DUTIES
Note : This document is intended to supplement, and not replace, work activities and duties described
in the official job description filed with the Tompkins County Commissioner of Personnel, and with
the Town of Danby Town Clerk, in Town of Danby Local Law No . 3 , 1984 , and in other pertinent
regulations .
HOURS OF WORK:
The Code Enforcement Officer will work an average of forty (40) hours per week. Hours of
availability will be posted in the office of the Town Clerk . The Officer will attend meetings of the
Town Board, Planning Board, and Board of Appeals when appropriate and with the permission of
the chairperson of the involved board . The Officer will maintain a log showing how time each month
was spent .
TOWNWIDE INSPECTIONS :
In addition to conducting routine construction inspections, the Officer will make time available to
drive the roads of the Town, in order to have a good working knowledge of conditions of all housing
stock, and in order to survey the Town for possible noncompliant structures or land uses .
FIRE INSPECTIONS :
The Officer will inspect all chimney fires within forty-eight (48) hours of the report of such fires to
the Officer. Other duties related to the inspection of reported fires will be in agreement with the Fire
Department and the Town Board . In the case of major fire inspections , the Officer may, upon
approval of the Town Board, arrange for inspection by an independent agent .
STREET ADDRESSING :
The Officer is responsible for assigning, or supervising the assigning, of all street address numbers
in the Town, and for reporting such assignments to involved agencies as required .
RESPONSE TO INQUIRIES AND APPLICATIONS :
The Officer will respond to all calls and letters within 48 hours of receipt of the call or letter, except
that where inquiries require research, or consultation with other Town personnel, the initial response
to the inquiry may indicate that additional time is reasonably required for a complete or final response .
Applications for building permits, certificates of occupancy, appeals, subdivisions , and other zoning
matters will normally be processed by the Code Enforcement Officer in one week, except that if the
Officer requests additional information from the applicant, if research is necessary, or if the Officer
is already involved in other application reviews , the processing time may be reasonably extended .
In the case of construction projects for which a building permit has been granted, the Officer will
make every attempt to conduct the necessary construction inspections within 48 hours of receipt of
the inspection request.
RECORDS :
The Officer shall keep permanent, official records of all transactions and activities conducted by
him/her including all applications received, plans approved, permits and certificates issued, fees
charged and collected, inspection reports, rules and regulations promulgated by him with the consent
of the Town Board, and notices and orders issued. One set of such records shall be kept in the Town
Zoning Office as public record open for public inspection during normal business hours . A second

set of such records as relevant to a construction project shall be transmitted to the applicant and
displayed at the work site .
REPORTS :
The Officer shall prepare various reports relevant to Code Enforcement and zoning activities
including the following :
- Monthly and annual reports for the Town Board with information on building permits and
certificates of occupancy issued for various types of construction, fees collected, orders and
notices issued, inspections and tests made , and, as appropriate, a summary of litigation
pending or concluded .
- Monthly and annual reports on development activity as required by the Tompkins County
Commissioner of Planning with information on building permits for initial construction, new
dwelling units, new non-residential construction, certificates of occupancy, and new approved
subdivisions .
- Other reports as required or requested by other agencies .
LEGISLATIVE MODIFICATIONS , SPECIAL PROJECTS :
When modifications are proposed or required of Town regulations or ordinances, including text and
related maps, the Officer will consult with the Town Board as to the scope of work, in order to obtain
authorization to either prepare such modifications, or to arrange such preparation. The Officer shall
also obtain approval from the Town Board prior to engaging in any special projects that may be
requested by the various Town boards .
FUNDING :
The Officer will submit, on an annual basis, a Dept. of State funding application for code enforcement
activities , following approval of a draft by the Town Board .
The Officer will submit a draft budget for zoning and related activities if such funding is available to
the Town Supervisor for consideration in each annual Town budget.
CONDUCT :
The Officer will conduct himself/herself in a proper and prudent mariner as a Town official and shall
not engage in any activity inconsistent with his/her duties within the Town of Danby .
Where the Officer might be involved in any activity for personal gain which is in conflict with the
Officer' s duties , such matter shall be reported to the Town Supervisor who, upon consent of the
Town Board, may enlist the services of an independent agent .
Proposed Local Law for Bingo
The Clerk has received information from the Town Attorney on how to proceed with a Local Law
for Bingo and has an estimate of the cost for publications . It was suggested by the attorney that we
might consider scheduling the mandatory referendum for next November. To have a special election
the cost would be approximately $ 600 .
Councilperson Gagnon said that if we approve a proposed local law for bingo it is possible that a
petition may be submitted that would require us to have a special election. His concern is how long
it would take to gain the expense back.

WHEREAS, officers of the American Legion Post 221 have approached the Town of Danby Town
Board with a request to consider passing a local law for Bingo , now be it
RESOLVED, that the Town Board of the Town of Danby sets the date of March 7 , 2001 at 7 : 00
p . m . for a public hearing for consideration of a local law for Bingo .

Supervisor Inman reported that the Town Board should appoint a Liason to the Highway
Department.
Motion to Appoint a Liason to the Highway Department
A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey to
appoint Supervisor Inman as Liason to the Highway Department for the year 2001 .
Discussion :
Highway Superintendent questions the need for a Liason . He said he has been Highway
Superintendent for (ten) 10 years and managed the first seven (7) years without one . There has not
been a problem with communication between his department and the Town Board and/or Supervisor.
Councilperson Nolte said that maybe a more detailed report on highway activities would be helpful
such as hours spent on specific tasks .
Councilperson Gagnon said that the reports we receive from the Highway are better than in the past.
Motion to Appoint a Highway Department Liason Withdrawn
Councilperson Strichartz withdrew the her motion to appoint a Highway Department Liason and the
second did not object.
Motion Withdrawn .
Public Access to Records Policy.
The Town Clerk submitted the existing Public Access to Records of the Town of Danby and
suggested a change in the Fees section of the document .
Councilperson Gagnon said that there are several areas in the document that he has questions about
and would like to review the document with the Clerk .
Supervisor Inman asked the Clerk to review the document with Councilperson Gagnon.
Records Disposal
The Town Clerk has asked the Board for permission to dispose of records that have reached their
retention dates according to the State Archives Retention Schedule . The records to be disposed of
have no further value to the Town .
Motion for Approval to Dispose of Records
A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey to
approve the disposal of Records that are obsolete and have reached the disposal dates as listed in the
State Archives Retention Schedule adopted by the Town in 1988 .

Flood Mitigation Grant Program
Sue How reported that she has talked with the proposal from the Curtis Road/Danby Rural Cemetery
Association for assistance through the Flood Hazard Mitigation Program is acceptable for a proposal .
There has been several instances of flooding in the area that causes erosion to the subsurface on
Curtis Road from water rushing down the cemetery drive . The Highway Department has consulted
our Code Enforcement Officer and the Cemetery Association so that they can submit two proposals
for assistance in funding for the projects . She said what they would like is an endorsement from the
Board for support of the project. Susan Beeners submitted the following resolution for the Board
to consider.
RESOLUTION NO. 20 of 2001
CURTIS ROAD/DANBY RURAL CEMETERY FLOOD HAZARD MITIGATION GRANT
APPLICATION
By Councilperson Gagnon : Seconded by Councilperson Strichartz
WHEREAS, the Town Board of the Town of Danby has been advised that flooding in the vicinity
of the Danby Rural Cemetery on Curtis Road is severely eroding the base material of Curtis Road,
and that there is an opportunity for a cooperative work effort including drainage improvements by
the Town of Danby and the Danby rural Cemetery Association to minimize this flood damage ; now
therefore , it is
RESOLVED , that the Town Board of the Town of Danby directs the Town Highway
Superintendent, with planning assistance from the Town Code Enforcement Officer, to work with
representatives of the Danby Rural Cemetery in submitting an application to the Tompkins County
Flood Hazard Mitigation Program for funding assistance , with the Town ' s share of funding not to
exceed $ 5 ,000 ; and it is further
RESOLVED, that the Town board authorizes the Town Supervisor to submit a letter on behalf of
the Town Board indicating Town support of the project.

Intern for Comprehensive Plan
Susan Beeners reported that Hallie Salem was recommended by the Planning Board Chair as an intern
for the comprehensive plan for the spring semester. She asked the Board to consider retaining Hallie
Salem as comprehensive planning intern at a rate of $ 15 . 00 per hour for a total cost not to exceed
$2 , 000 .

RESOLVED , that the Town Board of the Town of Danby approves hiring Hallie Salem as an
internship working on the comprehensive plan for Spring semester at $ 15 . 00 per hour and for a total
cost not to exceed $2 ,000 .

submitted .

A motion was made by Councilperson Strichartz and seconded by Councilperson Varona Lacey that
the Town Board of the Town of Danby approves the General Fund Warrant No . 1 of 2001 voucher
numbers 1 - 19 in the amount of $ 6, 798 . 65 .

Approval of Highway Fund Warrant No. 1 of 2001
A motion was made by Councilperson Gagnon and seconded by Councilperson Varona-Lacey that
the Town Board of the Town of Danby approves the Highway Department Fund Warrant voucher
numbers 1 - 6 in the amount of $ 1 ,209 . 27 .

Board of the Town of Danby approves the West Danby Water District Fund Warrant No . 1 of 2001
voucher numbers 1 - 4 in the amount of $421 . 88 .

Billing for Legal Services
A motion was made by Councilperson Gagnon and Seconded by Councilperson Strichartz that the
Town Board of the Town of Danby requests that the bills for legal service from the Town Attorney
be itemized regarding the time allocations .

Application for Planned Development
The Code Enforcement Officer submitted an application for a Planned Development District to build
an apartment complex and to subdivide property near the corner of Town Line Road and Blakesley
Hill Road . She suggested that the Board request the applicant to attend the February Board meeting
to discuss his proposal .
