Public Hearing Declared Open :
Chairperson Laurene Gilbert declared the public hearing open at 7 : 04 p . m . and read the following
"Notice of Publication" :
PLEASE TAKE NOTICE, that a public hearing will be held by the Danby Planning Board of the
Town of Danby on Wednesday, November 29 , 2000 at 7 : 00 P . M . , 1830 Danby Road, Ithaca, New
York to consider a request for Special Permit, to develop a campground, and construct a building
containing bathing facilities and a dining hall addition at Ithaca Zen Center, 56 Lieb Road, Town of
Danby Tax parcel No . 10 . - 1 - 57 . 32 , David and Marcia Radin, owners/applicants .
All interested persons will be given the opportunity to be heard either in person or in writing .

Communications ;
Affidavit of Service By Mail of Notice of Hearing - November 22 , 2000
Chairperson Gilbert asked the Code Enforcement Officer Susan Beeners to review with the Board
the additions submitted tonight on the revised site plan and explain the changes . The proposed
project is now proposed to have one smaller bath building and the dining hall addition has been
enlarged .
Marcia Radin reported that the dining hall addition was originally going to be 8 feet wide but was
inadequate for what is necessary . The addition now is proposed to be 10 feet wide . The two
campground shower rooms were proposed for 12' by 16' . The proposal is now for one 12' x 28 '
building. An addition to the plan are revisions to the facility are to make them more assessable for
the handicapped . Marcia explained that most of the activity at the facility is meditation and they do
have occasional retreats and some of the guests stay at the facility.
Public Comment :
Jim Holley - 66 Lieb Road - a neighbor of the Zen Center. He has talked with Marcia Radin and was
assured that it is not the intent of the proposal to increase the number of participants in their programs
but to make better accommodations . He does not have a problem with the proposal as long as the
property values are not impacted in a negative way .

Chairperson Laurene Gilbert opened the regular meeting of the Planning Board at 7 : 26 p . m .
COMMUNICATIONS :
1 ) Ithaca Journal Article of 11 /27/00 - Most Towns See Tax Rates Slip
2) Memo to Town Board and Planning Board - Application for consideration of re-appointment
to the Planning Board . ( 11 /29/00)
Radin Proposal :
The Planning Board discussed the request for a Special Permit from David and Marcia Radin for
improvements at the Ithaca Zen Center located on Lieb Road.
Marcia Radin reported that she believes the property values have improved because of the retreats
held at the Zen Center. They have not had any complaints that any of the activities being
inappropriate or disruptive in any way.
Susan Beeners said that half of the site is zoned medium density residential and half is low density
residential . She does not see that any zoning variances would be needed for a the special permit. If
there is any change in the proposal it would be necessary for the applicants to come back to the
Planning Board . Traffic is not considered a problem and there is no parking along the roadway .
There is adequate parking on site . The construction of a handicapped assessable cabin on the site
plan was submitted as a future item .
The following resolutions were presented to the Board for consideration and approved as follows :

SEAR APPROVAL FOR SPECIAL PERMIT - RADIN

WHEREAS, this action is to consider a request for a Special Permit to construct a building
containing bathing facilities, a dining hall addition, a handicapped assessable cabin and to improve an
existing campground at the Ithaca Zen Center, 56 Lieb Road, Town of Danby Tax parcel No . 10 . - 1 -
57 . 32 , David and Marcia Radin, Owners/Applicants ; and
WHEREAS, this is an Unlisted Action for which the Town of Danby Planning Board is Lead Agency
in environmental review; and
WHEREAS, the Planning Board has reviewed the recommendation by the Code Enforcement Officer
that a negative determination of environmental significance be made for this action ; NOW,
THEREFORE, IT IS
RESOLVED, that the Town of Danby Planning Board makes a negative determination of
environmental significance for this Unlisted action .

RESOLUTION NO. 16 of 2000
APPROVAL OF SPECIAL PERMIT - RADIN

WHEREAS, this action is to consider a request for a Special Permit to construct a building
containing bathing facilities, a dining hall addition, a handicapped assessable cabin, and to improve
an existing campground at the Ithaca Zen Center, 56 Lieb Road, Town of Danby Tax parcel No . 10 . -
1 - 57 . 32, David and Marcia Radin, Owners/Applicants ; and
WHEREAS, this is an Unlisted Action for which the Town of Danby Planning board, acting as Lead
Agency in environmental review, has on November 29, 2000 made a negative determination of
environmental significance ; and
WHEREAS, the Planning Board has held a public hearing on the matter on November 29 , 2000 ;
and
WHEREAS , the Planning Board has reviewed the General Considerations for Special Permits
provided in the Town of Danby Zoning Ordinance ; NOW, THEREFORE IT IS
RESOLVED, that the Planning Board finds that the proposal is in general conformance with the
General Considerations for Special Permits ; and it is further

RESOLVED, that the Town of Danby Planning Board grants a Special Permit to David and Marcia
Radin to construct a building containing bathing facilities, a dining hall addition and a handicapped
assessable cabin to improve an existing campground at the Ithaca Zen Center, 56 Lieb Road ; and it

RESOLVED, that the Special Permit is subject to the following :
1 . All parking needs shall be met on site ;
2 . Applicants shall work diligently to minimize noise and visual impacts to adjoining
neighbors .

MISCELLANEOUS REPORTS :
Tompkins County Planning Federation
Linda Hansen reported that County Planning will be holding a SEQR training workshops . There will
be an additional planning workshop where they will be working in groups again and with different
categories related to planning issues .
Recommendation for Planning Board Appointment
Chairperson Laurene Gilbert reported that she has received a memo from Linda Hansen as a formal
application for re-appointment to the Planning Board . Linda' s term expires on December 31 , 2000

and she would like to be re-appointed for another term .
RESOLUTION NO. 17 of 2000
RECOMMENDATION TO TOWN BOARD FOR APPOINTMENT TO PLANNING BOARD

WHEREAS, the term of Linda Hansen on the Town of Danby Planning Board expires on December
31 , 2000, and
WHEREAS, on November 29, 2000 Linda Hansen submitted a letter to the Planning Board and the
Town Board for formal consideration of reappointment to a consecutive term on the Town of Danby
Planning Board, now be it
RESOLVED, that the Town of Danby Planning Board recommends to the Town Board of the Town
of Danby the appointment of Linda Hansen to a consecutive term on the Town of Danby Planning
Board for a term to begin on January 1 , 2000 and to expire on December 31 , 2007 .

Ithaca Journal Article - Tax Rates
Robert Roe presented the Board with a copy of an article in the Ithaca Journal entitled "Most towns
see tax rates slip" . It appears that Danby has the highest tax rate in the County.
The Board discussed many possibilities as to why the rate is high, i . e . State Forest Lands, miles of
roads for road maintenance . They would like to know how our lands are assessed and why our •
assessments are high for vacant rural land .
Special Meeting - Panel Discussion
Chairperson Laurene Gilbert reported that she has contacted persons to serve on the panel discussion
on February 1 , 2001 at 7 : 00 p .m . The title of the panel discussion is "Sensible Land Use in Rural
Towns". Plans for the meeting will be finalized and advertisement will be sent to other towns .
January Planning Board Meeting:
A tentative date for the January meeting was scheduled for Thursday, January 18 , 2001 at 7 : 00 . The
date was not finalized at this time due to members needing to rearrange their schedules .
Approval of October 25, 2000 Planning Board Minutes :
A motion was made by Robert Roe and seconded by Nancy Weitzel to approve the October 25 , 2000
Planning Board Minutes as submitted .
A vote on the motion resulted as follows :
Carried Unanimously
ADJOURNMENT :
The Board adjourned their regular meeting at 9 : 00 p.m. to continue work on the comprehensive plan .
