Deputy Supervisor Naomi Strichartz called the meeting to order at 7 : 04 p . m . and led all present to
the Pledge of Allegiance to the American flag .
Privilege of the Floor:
Ames Brown - 1840 Danby Road - was disappointed that the public meeting with Senator Kuhl was
poorly attended and there were no Town Council present. Senator Kuhl has aided the Town in
obtaining a grant for the Community Council Playground and for the Town Hall Heating system and
he suggested that the Town send a letter of thanks .
Ken Horst - 318 Meadow Wood Terrace - reported to the Board that if we want to continue to
receive grands through our State representatives we should at least make an appropriate appearance
to extend our gratitude .

REPORTS :
EMC - Report
Robert Roe reported that the County Board has continued the study of the emergency communication
system and have now funded the study to look at all possible alternatives . The EMC has requested
from the County a list of updates of tall structures in the Town of Danby . A copy of the NYSTEC
(Proposal for the Tompkins County, New York Public Safety communications Wireless

Communications Consultant Scope of Services) was submitted to the Town . Bob urged the Town
Board to pass a resolution suggesting to Tompkins County to restore funds for the Aquifer Study .
Highway Report - October 2000
The Highway Department Report for October 2000 has been received .
Code Enforcement Office Report - October 2000
Susan Beeners said that their office is receiving real estate inquires , are dealing with a few landlord
tenant issues , safety issues in rental housing. She reported that she has received a letter from Mr.
• Simon Ungers attorney and he is willing to grant an easement on Makarainen Road but wants the
Town to act on the abandonment process and the turn-around . He would like an easement and a
variance to obtain a special permit.
Planning Board Report
Our new intern will soon be leaving as she has accepted a job in Schuyler County . She is trying to
complete the topics that were listed in our comprehensive plan guideline .
Water Resources Council
Linda Dorn reported that she has been seated on the Water Resources Council and enjoys being on
the council .
Senior Citizens Report
Carol Sczepanski reported that the Seniors Annual Christmas Dinner will be at the Common Ground
on December 7 , 2000 . There will be a senior trip to the Fly Creek Cider Mill on Tuesday November
28 , 2000 with lunch and shopping in Cooperstown .
Dog Control - SPCA September Report - received
Noise Ordinance Committee
Ted Lazcano said that he attended the public hearing for the proposed Noise Ordinance and spoke
up against the proposal as he supports the State laws . He has worked with the committee and drafted
a resolution that he feels will address the concerns of the persons who are disturbed by unreasonable
noise and people the people who are opposed to the ordinance .

RESOLUTION NO. 75 OF 2000
SUPPORT FOR FORMATION AND OPERATION OF VOLUNTEER BASED
ORGANIZATION
By Councilperson Gagnon : Seconded by Gladys Varona-Lacey
WHEREAS, the Danby Town Board recognizes that every resident of the Town of Danby has the
right to fully, safely, healthfully, comfortably and peacefully use and enjoy their property in a manner
which similarly respects the right of their neighbors to also use and enjoy their property in an identical
manner; now it is
• RESOLVED , that the Danby Town Board will facilitate and support the formation and operation
of a community based volunteer organization which will assist those residents who might from time
to time request aid with the identification, documentation and prosecution of any person or business
who by the violation of any New York State law deprives or diminishes their ability to fully, safely,
healthfully, comfortably or peacefully use and enjoy any or all of their property which is owned or
rented within the Town of Danby.
Discussion :
Councilperson Norbert said that there is a group in Tompkins County (Community Dispute
Resolution Center) and asked if the committee would be interfacing with that organization
specifically.

Communication Towers Project - additional funds have been secured for a needs survey and the
placement of a tower on State lands and is still possible .
County Office Space - the County is looking into long term needs
Danby School Meeting - there will be a meeting in November and we have received a commitment
from Senator Kuhl ' s office for two $ 50 ,000 . 00 items (one this year and one next year) so that the
planning on the use of the Danby School can continue .
Community Council Report :
President Willard Daetsch reported that there is a concert coming up on Saturday, December 2 , 2000
at 8 : 00 p . m . here at the Town Hall .
Pat Woodworth reported that there would be a Holiday Party on Saturday, December 9 , 2000 at the
Town Hall from 3 : 00 - 4 : 30 p .m . and a family ice skating party on December 22 , 2000 .
Local Law to Conduct Bingo Games in the Town of Danby
Richard Freeman of the American Legion has requested the Town of Danby to consider a local law
to conduct bingo games in the Town.

AUTHORIZATION OF EXECUTION OF CONTRACT FOR REPAIRS TO TOWN HALL

WHEREAS, by reason of the condition of the Town Hall heating system an emergency exists , and
as a result the Town has solicited estimates for repair and remediation of the heating system
deficiencies ; and

heating suppliers who indeed submitted written proposals , at a cost less than $20 ,000 . 00

WHEREAS, requests for proposal based on specifications for insulating the floor of the Town Hall
crawlspace , prepared by a licensed professional engineer under consultation with the Town were
solicited from four insulation contractors, with proposals received from two of said contractors, now,
therefore , it is
RESOLVED , that the Town Board of the Town of Danby hereby authorizes the Danby Town
Supervisor, upon consultation with the Town Hall Building Committee, to execute a contract with
one of the said contractors for insulating the floor of the Town Hall crawlspace, at a cost not to
exceed $ 5 , 000 . 00 .

Acquisition of Land for Expansion of Highway Department
Additional land is needed to expand the land for the Highway Department to build a salt shed .
The Code Enforcement Officer reported that a long form SEQR was done on this project as this is
adjacent to wet lands . The review was done strictly on the acquisition itself If we do proceed with
the project a new SEQR form must be done as it does not include the building.

RESOLUTION NO 78 FOR THE YEAR 2000

Danby has found WHEREAS , the Town Bo found that the present Town highway
facility is not adequate for the needs of the citizens of the community , the highway department and
the Town ; and
WHEREAS, the Town Board has determined the acquisition of such property is a "Type I Action"
pursuant to the regulations of the New York State Department Act and Environmental andornservation
promulgated pursuant to the State Environmental Quality Review
of the Town of Danby, and as Lead Agency has further determined such acquisition will not result
in any significant environmental effects ; and
WHEREAS, the Town Supervisor, to alleviate the need to provide into a space fr a salt s or gt f tithe
and other facilities for the Highway Department has entered purchase
acquisition of certain lands contingent upon, among the other matters , the Town Board' s approval ;
and
WHEREAS, it is now desired to authorize the acquisition of such property and the expenditure of
funds from the Building Reserve Fund for such purpose ;
NOW , THEREFORE , BE IT RESOLVED by the Town Board of the Town of Danby as

the date of the adoption of this resolution and contain an abstract of this resolution, concisely stating
the purpose and effect thereof. Such notice shall specify that such resolution was adopted subject
to a permissive referendum .
Section 5 . This resolution shall take effect 30 days after its adoption, unless a referendum I
• s requested, in which event it shall take effect, if approved at such referendum, upon such approval .
Section 6 . This resolution is adopted subject to a permissive referendum pursuant to Town
Law Section 220 and General Municipal Law Section 6-c .

Town of Danby Insurance Policies :
Motion to Authorize Supervisor to Renew Town Insurance Policies
A motion was made by Councilperson Gagnon and seconded by Deputy Supervisor Strichartz that
the Town Board of the Town of Danby authorizes the Town Supervisor to renew the Town of Danby
Insurance Policies .

Proposed Traffic Ordinance
Deputy Supervisor Strichartz reported that the Town Board held a public hearing on November 8 ,
2000 for a proposed traffic ordinance . She said that the Code Enforcement Officer had consulted
with the Town Attorney and we can make amendments to the proposed local law .
Susan Beeners reported that there was a question regarding the reference to language dealing with
gross weight verses axel weight and under section 4 the gross weight amount should read five (5) ton.
Councilperson Gagnon said that he has concern that the proposed local law may be constraining the
Highway Superintendent more with this additional legislation. He already has the authority to post
roads temporarily with lower weight limits .
The Highway Department secretary reported that this proposed ordinance was not at the request of
the Highway Superintendent but was requested by the Town Supervisor . The Highway
Superintendent has consulted with the Town Attorney and is aware of the proposed changes in the
draft ordinance .
Councilperson Strichartz suggested excluding section 4 of the proposed local law.
The Board deferred further discussion until the Town Attorney can be consulted .

RESOLUTION NO. 79 of 2000
YOUTH PARTNERSHIP BOARD REPRESENTATIVE APPOINTED
By Councilperson Gagnon : Seconded by Councilperson Varona-Lacey
RESOLVED , that the Town Board of the Town of Danby appoints Supervisor Edward Inman as
the Town of Danby Representative to the new Youth Partnership Board .

Deputy Supervisor Strichartz thanked Councilperson Gagnon for his representation on the Youth
Partnership Committee meeting. He did a very good job in helping to negotiate the Youth
Partnership Contract .
CSEA Contract - Discussion
The Board reviewed the Agreement by and between the Town of Danby and the Civil Service
Employees Association, Inc . Local 1000 , AFSCME, AFL-CIO of the Tompkins County Local 855
Unit 8911 -00 for January 1 , 2001 - December 31 , 2000 .
Amendment to CSEA Agreement
On Page 10 - Article 6 Section 3 was amended as follows : - (means delete) underline new material
(Used on a partial basis) taken as partial days .
Motion to Approve CSEA Agreement
A motion was made by Councilperson Varona-Lacey and seconded by Councilperson Nolte that the
Town Board of the Town of Danby authorizes Supervisor Inman to sign the Agreement by and
between the Town of Danby and the Civil Service Employees Association, Inc . Local 1000 ,
AFSCME, AFL-CIO of the Tompkins County Local 855 Unit 8911 - 00 for January 1 , 2001 -
December 31 , 2003 as amended .

Draft Indemnification Agreement from Town of Caroline
The Town of Caroline sent a Draft Indemnification Agreement for use and sharing of Town Highway
Equipment and manpower for the Board to review. The Caroline Highway Superintendent would
like to have our Board comment on the draft.
The Board reviewed the form and agreed that this was an acceptable form .

RESOLUTION NO. 83 OF 2000
SUPPORT FOR FUNDING OF THE CONTINUATION OF AQUIFER STUDY

WHEREAS , water is a critical strategic resource for both the maintenance and development of
communities , and
WHEREAS, effective and realistic planning at the town and county level require an understanding
of the type, the extent, the depth, and the porosity of existing aquifers as well as an understanding of
their relationship and leakages to surface water, now therefore be it
RESOLVED , that the Town Board of the Town of Danby strongly urges that the Tompkins County
Board of Representatives, restore to the 2001 County Budget at minimum the $ 10 ,000 . 00 needed
to initiate the next phase of the County Aquifer Study .
