TOWN BOARD MINUTES
OCTOBER 9, 2000
PRESENT :

Supervisor Edward Inman called the meeting to order at 7 : 30 P . M . and led all present to the Pledge
of Allegiance to the American Flag .
ADDITIONS TO THE AGENDA :
1 ) Lawn mowing contract for 2001
2) Comprehensive Plan Update - time permitting .
3 ) Clerk ' s purchase of computer
4) Miller Roads/NYS Rte 96B Intersections
NYS Preservation League Presentation to Town - Tania Werbizky
Tania Werbizky from the New York State Preservation League congratulated the Town of Danby
on the success with a grant application for a survey of approximately 53 farm buildings in the Town .
It is hoped that the information from this survey will be used by town officials, County Planning, and
anyone interested in Danby ' s past and future . The grant to the Town of Danby is one of fourteen
( 14) projects awarded this year. Tania presented the Town with a check in the amount of $ 6 , 100 . 00
toward the cost of conducting a farmstead survey as part of the broader effort in planning .
Supervisor Inman thanked Olivia Vent and Sue Beeners for their efforts in putting together the grant
application.
PRIVILEGE OF THE FLOOR
Councilperson Strichartz reported that the community appears to have some objections to the
proposed noise ordinance that was presented at the public hearing on September 11 , 2000 . The
committee has met with some of the people who had objections and some of the people who had
noise issues and problems . They are going to try to find some solutions that don' t feel like our loss
of freedom but address the fact that some people have problems where they can ' t sleep and their rest
is being disturbed. They are looking for alternatives and welcome input from everyone .
Carol Sczepanski , Town Clerk reported that she has received two (2) requests from residents that
would like to be on the Danby Community Park Committee .
Members of the Public :
Genevieve Sanford - attended the meeting in Danby with Senator Kuhl and presented him with her
interest in having something done at the East Miller Road and West Miller Road intersection on N .
Y. S . Rte . 96B . He was kind enough to send a letter to her saying that he has forwarded her
communication to the DoT Regional Director requesting a safety study at the intersection.
Ames Brown reported that he is still in the process of obtaining signatures regarding reducing the
speed limit through the Town of Danby on N . Y . S . Route 96B . He has obtained letters of support
from the Village Clerk in Candor and the Tioga County Clerk. He said he was disappointed that not

one member of our Town Board was present for the public meeting with Senator Kuhl .
Susan Beeners reported that the Planning Board has forwarded several chapters of the comprehensive
plan drafts as progress maps to the Town Board for review. She suggested that any in-depth
discussion of the material should be done with the Planning Board. The material is only a few of the
chapters for the plan.
County Representative Report;
Representative Proto reported that the County Board approved a new contract with NYSEG
• Solutions and residents may sign up with a group for the purchase of natural gas . Information may
be obtained through the Board of Representatives Clerk.
Representative Proto reported on the following items before the Board :
1 ) Budget public hearing - November 14 , 2000
2) Board of Health - Fluoridation
3 ) Recreation Partnership - proposal for funding
4) Proposed location for a bus station
5 ) Water Resources Council - three vacant positions available
6) Revitalization Grant deadlines due soon .
REPORTS :
Highway Supervisor' s Report - September 2000 received
Code Enforcement Office Report - September Received
Dog Control Report - The Dog Enumeration is nearly completed .
Planning Board Report - September -Planning Board Resolution No . 15 of 2000 entitled
"Recommendation to the Town Board - Proposed Zoning Changes", was transmitted to the Board .
The resolution is requesting written information from the Board on the proposed local laws amending
the zoning ordinance .
Town Historian :
Supervisor Inman reported that he has received a letter of resignation from our Town of Danby
Historian Susan Hautala. The resignation is effective November 1 , 2000 .
Noise Ordinance Committee
Councilperson Strichartz reported that there is a group meeting as a committee to draft a Noise
Ordinance for the Town of Danby.
Water Resources Council
Linda Dorn reported that she will attend a meeting on Thursday, October 12 , 2000 of the Cayuga
Watershed Group to get background information on programs and programs in the area.
• Community Council
Willard Daetsch announced the following activities of the Community Council :
1 ) Dedication of the playground will be on October 15 , 2000 from 2 : 00 to 4 : 00 p . m. at the
playground on Gunderman Road .
2) The Community Council Board will meet at the Danby Fire Station on October 18 , 2000 .
3 ) A Jazz Quartet will be featured in a concert at the Town Hall on Sunday afternoon October
22 , 2000 .
4) There will be Halloween party at the Danby Fire Station on October 28 , 2000 from 2 : 00 to
4 : 00 p .m .
West Danby Community Association Halloween Party
The West Danby Community Association Halloween Party will be at the West Danby fire Station on
Sylvan Drive on October 28 , 2000 at 7 : 00 p . m .

Senior Citizens
The Danby Senior Citizens met on Thursday, October 5 , 2000 for their monthly dish-to-pass supper.
The entertainment was provided by the Kids Kwire and was thoroughly enjoyed by all . The next
meeting of the Danby Senior' s will be at 12 : 30 p . m. on November 2 , 2000 .
Miscellaneous Reports :
Danby School Update :
Ken Horst reported that a committee working on the proposed project of an agricultural type school
is still active . They are seeking funds from the state for assistance .
OLD BUSINESS :
East Miller Road - West Miller Road Intersection
Supervisor Inman said that the he would advertize for residents interested in working on a committee
to obtain information to help extend the 45 m .p .h . speed limit on of N . Y . S . Route 96B to north of
the East and West Miller Road intersection .
NEW BUSINESS :
CSEA - Contract
RESOLUTION NO . 68 of 2000
CONTRACT BETWEEN THE CSEA UNION AND THE TOWN OF DANBY HIGHWAY
DEPARTMENT
By Councilperson Strichartz : Seconded by Councilperson Gagnon
RESOLVED , that the Town Board of the Town of Danby approves the provisions in the draft
contract proposal between the Town of Danby Highway Department and the CSEA of Tompkins
County Local 855 Unit 8900 -00 for the contract period of January 1 , 2000 through December 31 ,
2003 .
Discussion :
Councilperson Gagnon reported that there may need to be some adjustment in the language regarding
personal leave to make it more clear .
Supervisor Inman said that he did not think that a minor change in the language was a material change
in the contract .

Surface Site Testing - 93 Hornbrook Road
Supervisor Inman reported that he has received a proposal from Maxim Technologies , Inc . for
conducting a Subsurface Investigation of the proposed site for the Town Highway Salt Shed at 93
Hornbrook Road . The estimated cost of the testing is $ 3 ,263 . 00 . The testing is to evaluate the
extent of potential salt release that may have occurred at the site .
RESOLUTION NO . 69 of 2000
AUTHORIZATION FOR TOWN SUPERVISOR TO CONTRACT FOR SUBSURFACE
TESTING AT THE PROPOSED SALT SHED SITE

RESOLVED , that the Town Board of the Town of Danby authorizes Supervisor Inman to contract
with Maxim Technologies of New York Inc . , to conduct a subsurface investigation on the proposed
salt shed site at 93 Hornbrook Road, once the land has been acquired, and be it further
RESOLVED , that the expense for the testing is to be charged to the Capital Reserve Fund .

RESOLUTION NO. 70 of 2000
RESOLUTION AMENDING RESOLUTION NO 60 OF 1999 AUTHORIZING THE ITEMS
LISTED BELOW PURSUANT TO THE CLEAN WATER/CLEAN AIR BOND ACT OF
1996.
By Councilperson Gagnon : Seconded by Councilperson Varona-Lacey
WHEREAS, the Town of Danby herein called the "Municipality" , after thorough consideration of
the various aspects of the problem and study of available data, has hereby determined that the
construction of a salt storage facility, as described in its application and attachments, herein called the
"Project" , is desirable, is in the public interest, and that State assistance is required in order to
implement the Project; and
WHEREAS, Article 56 of the Environmental Conservation Law authorizes State assistance to
municipalities for water quality improvement projects by means of a contract and the Municipality
deems it to be in the public interest and benefit under this law to enter into a contract therewith; and
WHEREAS, the Project is classified as an unlisted action and the Town Board of the Town of Danby
is acting as Lead Agency .
NOW, THEREFORE BE IT
RESOLVED , by the Town Board of the Town of Danby
1 That subject to relevant budgetary procedures as required by law, Edward L . Inman
Supervisor of the Town of Danby or such person' s successor in office is the representative
authorized to act in behalf of the Municipality ' s governing body in all matters related to State
assistance under ECL Article 56 , Title 3 . The representative is also authorized to make
application, execute the State Assistance Contract, submit Project documentation, and
otherwise act for the Assistance contract, submit project documentation, and otherwise act
for the Municipality ' s governing body in all matters related to the Project and to State
assistance ;
2 . That the Municipality agrees that it will fund its portion of the cost of the Project and that
funds will be available to initiate the Project' s field work within twelve ( 12) months of written
approval of its application by the Department of Environmental Conservation;
• 3 . That one ( 1 ) certified copy of this Resolution be prepared and sent to the Albany office of the
New York State Department of Environmental Conservation together with the Application
for State Assistance Payments ;
4 . That this resolution will take effect immediately .

Motion - Authorization for Town Supervisor to Sign Mowing Contract for Year 2001
A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey that
the Town Board of the Town of Danby authorizes the Town Supervisor to sign a contract with
Forest City Landscaping for the year 2001 for the mowing of the Town of Danby properties, Jennings
Pond and Town Cemeteries .

Request for a Bingo Local Law From the American Legion
Joe Freedman, Chairman of the Board of the Local American Legion Post #221 addressed the Board
on behalf of the American Legion asked the Town to consider a Local Law to make bingo legal in
the Town of Danby. Bingo in the Town would provide revenue to the Town and would allow the
Legion to promote veterans benefits and community service .
The Town Clerk will research the costs to the Town associated with a bingo local law and the
required referendum .
Proposed Traffic Ordinance
The Highway Superintendent has submitted a request to the Town Board to consider a traffic
ordinance permitting the Highway Superintendent to set weight limits on Town of Danby Roads .
RESOLUTION NO . 71 of 2000
PUBLIC HEARING DATE - PROPOSED TRAFFIC ORDINANCE FOR TOWN OF DANBY

RESOLVED, that the Town Board of the Town of Danby sets the date of Wednesday, November
8 , 2000 at 7 : 00 p . m . for a public hearing on a proposed traffic ordinance for the Town of Danby .

The Town Clerk presented the Town Board with cost estimates for the purchase of a computer for
the Clerk' s office . The price includes a networking system, backup , and transfer of records for the
new system. The price of $ 1675 . 00 includes setup, one year parts and labor warranty. Funds for the
purchase of a new computer were encumbered from 1999 .

A motion was made by Councilperson Strichartz and seconded by that the Town Board of the Town
of Danby approve the purchase a computer for the Town Clerk ' s office as submitted.

voucher numbers 34 - 39 in the amount of $ 1 , 365 . 19 .
Comprehensive Plan Discussion
The Code Enforcement Officer transmitted comprehensive plan drafts to the Town Board for review
and comment. The Planning Board Chair has suggested that the Town Board and the Planning Board
meet together to review the comprehensive plan materials that have been completed to date .
