Public Hearing Declared Open :
Chairperson Laurene Gilbert declared the public hearing open at 7 : 04 p . m . and read the following
Notice of Publication :
" PLEASE 'TAKE NOTICE, that the Planning Board of the Town of Danby will hold a public
hearing on Wednesday, September 20 , 2000 at 7 : 00 p . m . , 1830 Danby Road, Ithaca, New York to
Consider a Request for a Special Permit for the proposed construction of a second detached dwelling
on Town of Danby Tax Parcel No . 4 . - 1 - 83 . 01 acres total , on the north side of Makarainen road .
Simon Ungers, Applicant, Lisolette Ungers, Owner
All interested persons will be given the opportunity to be heard either in person or in writing .

Members of the Public :
Earl Ekdall reported that his property borders the Ungers property and was here to receive
information related to the proposal . He said that a neighboring property would essentially landlocked
once the road is abandoned unless they have a right-of-way .
JoAnn Ekdall said she was here to view the proposal for information .
The proposal was viewed by the Board and public and questions related to the status of Makarainen
Road abandonment could not be answered .
Public Hearing Declared Closed :
Chairperson Laurene Gilbert declared the public hearing closed at 7 : 30 P . M .

Chairperson Gilbert called the meeting to order at 7 : 30 p . m . following a public hearing on the Simon
Ungers Proposal for a Special Permit for a second detached dwelling on the same lot on M.akarainen
Road .
Simon Ungers Request for Special Permit :
Motion to Defer Decision on Ungers Request for Special Permit:
A motion was made by Robert Roe and seconded by Nancy Weitzel that the Planning Board defer
a decision on the proposed resolution presented by the Zoning Officer pending clarification of the
status of the existing dwelling and its compliance with all of the zoning criteria.
Discussion :
The Planning Board discussed the proposed resolution and raised questions as to whether this
property had received a variance to bring it into compliance and did this new proposal need a
variance .
Motion Withdrawn :
Bob Roe withdrew his motion.
Motion to Refer Ungers Request to Board of Zoning Appeals
A motion was made by Robert Roe and seconded by Nancy Weitzel that the Planning Board refers
the request from Simon Ungers for a Special Permit to the Board of Zoning Appeals for variance
clarification before the Planning Board proceeds with the request for a Special Permit.
Discussion :
Olivia Vent said that the BZA should review the proposal and make the determination .
Nancy Weitzel said that anyone coming up over the hill would need a right of way to get to their
parcels and people shouldn ' t build in the abandoned road right of way .
A vote on the motion resulted as follows :

PRIVILEGE OF THE FLOOR:
Ryan Cummings - A student who lives on Michigan Hollow Road - asked the Board about a
petition being circulated regarding a 35 mile per hour speed limit request on NYS Route 96B through
Danby. He would not like to see the speed limit reduces through Town but would like to see more
enforcement.

Chairperson Gilbert responded that the Town would like to see the 45 mile per hour speed limit
extended through the East Miller and West Miller intersections .
Miscellaneous Items :
Olivia Vent reported that the Town has received a letter stating that the Town has been awarded a
grant from the New York State Council on the Arts through the Preservation League of New York
State. The grant is for an inventory/survey of historic agricultural resources in the Town of Danby .
John Lewis will be performing the survey and the goal is to identify the agricultural history of Danby.
County Planning Federation
Linda Hansen reported that at the last County Planning Federation Meeting. Supervisor Don Barber
from Caroline sent a letter asking the Federation for help with developing subdivision regulations . She
reported that there would be a SEQR training in December and she encouraged the Board members
to respond to the request for input for the session .
Bob Roe reported that Tompkins County will hold it ' s "Household Hazardous Waste" recycling
project and it will be 50% funded by the DEC . The hours are highly restrictive and you must fill out
forms before using the service . It is rumored that the schedule has been filled up for the next three
years . Bob has a copy of the "NYS Intended Use Plan Drinking Water State Revolving Fund" which
is the revolving fund that the State has set up to finance projects that project or enhance water
supplies along with a copy of the intended use plan project priority system and project priority list .
Proposed Zoning Changes :
Chairperson Gilbert reported that the Code Enforcement Officer has added a proposed resolution to
consider proposed zoning changes on the Planning Board Agenda.
Bob Roe reported that at our last Planning Board meeting this request was referred back to the Town
Board that this should wait until after the comprehensive plan was approved .
Chairperson Gilbert said that in terms of how it would relate to the comprehensive plan she spoke
with Roth Pendall . What the Town is proposing about the minimum density residential zones and
making lot sizes bigger for low density housing just didn ' t feel right. He substantiated that it not only
doesn' t prevent sprawl but can encourage it. Instead of houses every three acres or two acres apart,
you have them every 5 acres and they are still basically lined up in the same configuration along the
road . It is not the solution to sprawl . Ralph Pendall said that he agrees that we should not move on
any zoning changes until the comprehensive plan is completed as that is where the changes should
come from .
Chairperson Gilbert said that she would recommend to the Board that they not move on any zoning
changes until the comprehensive plan is in place .
Olivia Vent said that maybe we should hold off zoning changes pending organization from round
table and input from Mr. Pendall and others to stimulate more discussion to gather more information .
Olivia Vent said that we might want to explore the effect on property assessment in low density zones
if you expand the road frontage requirement .
The Board discussed options of how land could be developed with various clusters and surrounding
open space .
Dan Klein said that he understands the reasons behind waiting for the comprehensive plan to be done
to make zoning changes , however the comprehensive plan is two or two and one half years in
progress .
Chairperson Gilbert said that she wasn ' t here four years ago but she knows that in the last year the
Planning Board has accomplished a lot.
Olivia Vent said that Dan ' s point is that things move slower than we would like and the fact is that

if we are lucky we might have by the end of the year a full draft of everything . By the time we
actually have a document it may be another two years .
Linda Hansen said that she does not think that we should make a zoning change just because there
are some people complaining . It is a valid point and something we should look at but not a reason
to jump right in and change the rules .
Bill Farrell said that complaints have not been in writing or anything to back up complaints or
concerns about sprawl .
Nancy Weitzel suggested that we should respond to the Board that we do not recommend any
changes at this time and list the reasons why .
RESOLUTION NO 15 , 2000
RECOMMENDATION TO TOWN BOARD - PROPOSED ZONING CHANGES

WHEREAS , the Town Board has referred two (2) proposed local laws related to the Town of
Danby Zoning Ordinance to the Planning Board for their review and comment, and
WHEREAS , the Planning Board has discussed at length the necessity of making changes to the
Town of Danby Zoning Ordinance at this time ; now, be it
RESOLVED, that the Town of Danby Planning Board cannot make a recommendation at this time,
and, be it
FURTHER RESOLVED, that the Planning Board is requesting in writing that the Town submit
following information.
1 . Reasons why these suggested changes should be considered ;
2 . Who is requesting the changes ;
3 . Impacts to the Town in taxes ;
4 . Impacts on property values ;
5 . Analysis on taxes, land value , and community diversity, for large lot sizes ;
6 . Are these changes urgent?
A roll call vote on the resolution resulted as follows :

The Board also would like building permit data and lot sizes from the building department.
Chairperson Gilbert and Bob Roe will attend the Board Meeting and report the concerns and views
of the Planning Board .
Olivia Vent said that we have not received any request from the Town Board in writing for these
proposed zoning changes .
Comprehensive Plan Update :
Our Intern Danelle reported on the progress on the editing and revision of the comprehensive plan
draft. The Agricultural section is waiting to be referred to Monica Roth at Cooperative Extension .
The sections - Streets , Utilities and Services, and Public Facilities and Infrastructure need to be

developed more thoroughly. She said she may need Planning Board help on the Streets, Utilities and
Services section for background information. She and Sue have been working on the agriculture and
transportation sections . She just received the information on natural resources today .
The Board reviewed the drafts of the comprehensive plan and Board members suggested changes to
the draft information presented .
