TOWN BOARD MINUTES
JUNE 9, 2008

Supervisor Dietrich called the meeting to order at 6:40 p.m. and led all present to the Pledge of
Allegiance to the American Flag.
Additions to Agenda
Under new business - motion for Supervisor to dispose of old electronic equipment.
Under old business - Cooperative correspondence between fire district and highway department.
Under new business -permission to use building for Eagle Scout Recognition.
Under new business - changing format for agenda meeting and town board meetings.
Under new business - creation of a position for MEO/Water Sewer Maintenance
REPORTS
County Representative Report
T-Cat - short approximately $280,000 for 2008 due to cost of fuel. He has asked residents in
Caroline and Danby about increasing route extensions i.e. running later busses. Service may be
extended to Ithaca College if schedule can be arranged. They may consider possibly lowering
fees.
Water Resources Council - Lake Source Monitoring Plant - there are sixty(60) sites to be
monitored. They do not monitor all sixty(60) sites.
Roads - reported on the County Roads that they proposed to do in 2008. Bald Hill Road and
Station Road are in poor condition. With the cost of gas and oil he does not know how many
roads they will be able to complete.
County Budget- Committee looking at department requests for 2009.

WIC -NYS has extended all counties for one year.
Assessments Persons will be receiving letters after final review by the county.
SPCA- County has extended arrangement so that she can give information to TCCOG.
Highway Report
Highway Superintendent Carl Seamon reported on the activities of the road maintenance for May
2008. Laura Shawley and he attended the Local Roads Program at Ithaca College and the
highway personnel have completed the IC 100 and IC700 series and are now in compliance with
the NIMS requirements. A resolution will be requested to approve the pay schedule for two
new highway employees to comply with the CSEA pay regulation.
Fire District Report
Pat Caveney gave an update on the Fire Department building project. They are behind schedule
and will be sending out bids in July. Ground breaking should be in July. They have received
$300,000 NYS emergency service loan at a low interest rate for a portion of the expansion. A
grant of $15,000 for equipment has been received from Senator Seward's office. They are
seeing an increase for materials of 10-15 percent. He sent a letter from the Fire Commissioners
requesting temporary use of the highway department fuel tanks during the construction period.
Zoning Report - Susan submitted monthly report for May and reported that the department
addressed some junk complaints and attended several meetings and a pipeline safety class. The
fire alarm system installation in the building is progressing.
Community Council
Joel Gagnon reported that the committee focused on two items. Danby Area News and concern
of items that were not included. The committee would like to have more items in the Danby
Area News rather than less. The editor made a decision not to increase the DAN to six(6)
pages.
Senior Sitizens:
Carol Sczepanski reported that the seniors met for their monthly dis-to-pass supper on June 5th
and was attended by more than 40 seniors. Entertainment was provided by the "Cayuga
Chimes". They will be going to the Merry-go-Round Theater in Auburn to see "All Shook
Up".
Dog Control-
Supervisor Dietrich said that he has met with most of the Tompkins County Town Clerks.
Comments have been sent back for information to be forwarded to TCCOG.
DEMPC
Councilperson Beavers reported that he had a meeting with John Gaden and Wayne Holden
regarding a resolution that is before the board and fuel usage. They will be meeting to complete
the Mutual Aid Package and to discuss cross training possibilities.
Susan Beeners reported that the DEMPC tent will have items on how to plan for a disaster. The

Highway Department is going to work on an activity for children of road safety.
OLD BUSINESS
Councilperson Beavers submitted a resolution regarding additional responsibilities for the
highway department in emergencies.
RESOLUTION NO. 51 OF 2008
ADDITIONAL RESPONSIBILITIES FOR TOWN OF DANBY HIGHWAY
DEPARTMENT RELATED TO EMERGENCIES
By Councilperson Beavers: Seconded by Supervisor Dietrich
WHEREAS, the Town of Danby and its highway superintendent have resources at their
discretion that may prove useful in serving the public outside the strict applications of the New
York State Town Law, therefore be it
RESOLVED, that the Town Board of the Town of Danby, by request of the town highway
superintendent and by such authority as extended by applicable sections of the town law of the
State of New York, do hereby permit, authorize, and direct the town highway superintendent to
fulfill such additional responsibilities from time to time as circumstance necessitate, although
such activities may not relate directly to the specific responsibilities of the highway department
of the Town of Danby as specified by the highway law. This includes:
* The removal of snow, as required, from all municipal properties and the
maintenance of outdoor safety conditions thereon;
* Emergency assistance as may be requested by the chief or other responsible
officer of a local fire company, in support of fire and EMS-related emergencies;
* The rendering of such assistance as may be requested from time to time to cope
with related emergency situations of any special district within the Town
including West Danby Water district;
* The use of town highway department resources as may be determined by the
highway superintendent to be necessary and in the best interests of the general
population of the Town of Danby.
It is understood that there are reciprocal activities provided to the highway department by the fire
and EMS agencies in certain emergencies.
This resolution is hereby submitted in the interest of and for the protection of the Town of
Danby, its highway department, and its full complement of personnel.
Discussion:
Supervisor Dietrich asked that a copy of the resolution be sent to CSEA and to our Attorney.
Councilperson Beavers said that if there is a problem with the resolution the board can resind it
and that this will help us move along.

Fire Department and Highway Department Fuel Tanks
Councilperson Beavers asked permission from the town board to coordinate with the fire district
and the highway department for sharing fuel tanks while the expansion of the fire department
building on NYS Rte.96B and town board to be the liaison to the highway department
Motion Approving Discussions Concerning a Gas Option
A motion was made by Supervisor Dietrich and seconded by Councilperson Klein that the Town
Board of the Town of Danby authorize Councilperson Beavers to enter into discussions with the
highway department and the Danby fire department on mutual shared agreements concerning a
gas tank sharing agreement.
Request to Use Building for Eagle Scout Award Event
A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers that the
Town Board of the Town of Danby gives permission to Ramona Ehrhardt to use the town hall
for an eagle scout award event on June 27, 2008 at 5:00 p.m.

NEW BUSINESS
RESOLUTION NO. 52 OF 2008
AUTHORIZATION FOR TOWN SUPERVISOR TO EXECUTE CONTRACT WITH
PLANNING CONSULTANT -HAMLET PLANNING PROJECT
By Councilperson Beavers: Seconded by Councilperson Connors
RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to
execute a contract with Bergmann Associates and with Trowbridge and Wolf Landscape
Architects, for professional services related to the Hamlet Planning Project, with the source of
funding for those services to be the grant awarded to the Town by the NYS Office for Small
Cities, and Comprehensive Plan Account A8020.401; and be it further
RESOLVED, that the Town Board of the Town of Danby designates Susan Beeners as owners
representative.

Change in Format for Board Meetings
Councilperson Beavers asked the board to consider a change in format for board meeting
agendas and have committee reports and public information to the agenda meeting. County
Representative Frank Proto's will report at the regular meeting schedule.
Councilperson Beavers suggested that committee representatives may submit written reports at
the agenda meeting and that copies will be available at the board meeting for residents to view. If
no report has been submitted for the agenda meeting they can report at the regular meeting.
Councilperson Connors suggested that we allow five(5) minutes for committee reports.
Motion to Change Format for Board Meetings
A motion was made by Councilperson Beavers and seconded by Councilperson Connors that the
Town Board of the Town of Danby change the meeting structure to allow committee reports to
be submitted in a written format by noon of the agenda meeting date for the board to review and
if no written report is received they report at the regular meeting of the board. Copies of the
written reports will be available for the public, letters will be sent to committee chairs notifying
them of the change and the public will be notified.

Motion to Extend Meeting
A motion was made by Councilperson Beavers and seconded by Councilperson Connors that
the Town Board of the Town of Danby extends the meeting one hour to 9:30 p.m.

Motion to Dispose of Old Office Equipment
A motion was made by Councilperson Beavers and seconded by Councilperson Connors that the
Town Board of the Town of Danby gives permission to the town supervisor dispose of old
broken equipment and that a list (including serial numbers) be submitted to the town clerk to
report to the town board.

Creation of a New Position
Supervisor Dietrich reported that the position created last year for Water District Assistant
Superintendent was for one year only.
Councilperson Beavers said that we need to make this position permanent as it requires two
people to provide the service.

CREATION A POSITION-MEO,WATER SEWER MAINTENANCE WORKER

RESOLVED, that the Town Board of the Town of Danby creates a position entitled "MEO,
Water Sewer Maintenance Worker.

for the West Danby Water District

Motion to Approve Highway Department Personnel Salaries
A motion was made by Councilperson Beavers and seconded by Councilperson Connors that the
Town Board of the Town of Danby that the permanent hourly rate of pay be approved for
$18.03
per hour for highway department employees Bradley Berggren and Dave Thomas.

Proposed Local Laws
The Board reviewed the proposed local laws.
1. Emergency Towing of Vehicles
This proposed local law is an amendment in Section 5. Fees by increasing the payment of a
towing charge to $125.00 and a storage charge not to exceed $30.00 per day and shall be payable
by the owner or operator of the vehicle to the company responsible for towing and/or storing such
vehicle
2. Fees for the Licensing of Dogs in the Town of Danby
The proposed local law proposes that the annual fee for licensing dogs in the Town of Danby.
The total fee for Unspayed/ Unneutered fee $20.00 and the total fee for spayed/neutered dogs
$12.00.
Motion to Approve Advertising for Proposed Local Law-Emergency Towing of Vehicles
Proposed Local Law No. 1 of 2008
A motion was made by Councilperson Beavers and seconded by Supervisor Dietrich that the
Town Board of the Town of Danby authorizes the town clerk to advertise a public hearing for the
proposed Local Law - Emergency Towing of Vehicles. to be held on Monday, July 14, 2008 at
6:30 p.m. at 1830 Danby Road, Ithaca,New York

Proposed Local Law-Fees for the Licensing of Dogs in the Town of Danby
Discussion:
Supervisor Dietrich said that the costs should be incurred by the persons who use the services not
necessarily the tax payers.
Councilperson Klein said that he would vote against it as he is not sure that every dog needs to be
licensed. Dogs running free is a town wide problem. He would support a collar with the owners
name and information.
Councilperson Connors said that these fees need to be collected and the fees go for the control of
dogs.
Motion to Approve Advertising for Proposed Local Law - Fees for the Licensing of Dogs in
the Town of Danby
Proposed Local Law No. 2 of 2008
A motion was made by Supervisor Dietrich and seconded by Councilperson Connors that the
Town Board of the Town of Danby authorizes the town clerk to advertise a public hearing for the
proposed local law - Fees for the Licensing of Dogs in the Town of Danby for Monday, July 14,
2008 following the proposed public hearing No.1 of 2008 at 1830 Danby Road, Ithaca,NY.

A motion was made by Councilperson Beavers and seconded by Councilperson Klein that the
Town Board of the Town of Danby approves the General Fund Warrant No. 6 of 2008 in the
amount of$17,317.20 -voucher numbers 216-251.

Other Business
Councilperson Beavers asked to be excused from the July 7, 2008 Agenda Meeting.
Motion to Move to Executive Session
A motion was made by Councilperson Klein and seconded by Councilperson Connors at 9:05
p.m. that the Town Board of the Town of Danby move into an executive session to discuss a
possible appointment for a Webmaster.
