TOWN BOARD MINUTES
JUNE 12 , 2000
Regular Meeting

Supervisor Edward Inman

Supervisor Inman called the meeting to order and led all present to the Pledge of Allegiance to the
American flag .
ADDITIONS TO THE AGENDA :
1 ) Privilege of the Floor for public : Bill Keokosky
2) Approval of funds for intern for comprehensive plan - New Business
3 ) Town Hall Facility Use Policy - report
Code Enforcement Officer Susan Beeners requested that the Board consider a brief Executive
Session to discuss an enforcement matter that involves information that if disclosed would hamper
current and future investigations of matters related to a pending litigation and potential criminal
offence .
No Board Member objected .
PRIVILEGE OF THE FLOOR :
Supervisor Inman reported that at the July 5 Agenda Meeting of the Board that Tompkins County
Sheriff Peter Meskill will be here to address the Town to answer any questions or concerns regarding
traffic, speeding, etc .
Councilperson Strichartz reported that there is some activity in the community to start a farmers
market in the Town possibly at the Danby Fire Station .
The Town Clerk reported that Glenn Grossman (a wildlife control person) has been hired to do a
dog enumeration for the Town and the enumeration is in progress .
Robert Roe - 1820 Danby Road - addressed the Board and read a letter for the record addressed to
Ithaca Journal as a Letter to the Editor regarding Local Law No . 4 of 2000 entitled "A Local Law
providing for the Repair or Removal of Unsafe Buildings and Collapsed Structures" .
Edw. M. Roberts - 47 Bald Hill Rd . - Local Sheriff and NYS Police have been patrolling Bald Hill
Road and issuing tickets to speeders on Bald Hill Road . Questions what the status of Benjamin ' s
One Stop as it is very degrading to the neighborhood . Ed reported that he is now a member of the
Tompkins County Senior Citizens Board .
Ken Horst - 318 Meadow Wood Terrace - requested that the Board use the microphones as the
audience cannot hear the Board .
Bill Keokosky - 638 East Miller Road - stated that he was representing 21 neighborhood residents
and presented the Board with a statement that a hazardous condition exists on East Miller Road
between Nelson Road and Coddington Road . They believe this condition is a threat to the health

and safety of our community . Mr . Keokosky gave a presentation with pictures and described the
problem areas on the Road . A list of neighborhood residents was attached to the notice and a
project proposal submitted by the Highway Supervisor dated April 24 , 2000 . He would like the
Town Board to consider posting the Road with weight limits to discourage heavy truck traffic .
Highway Superintendent William Hall explained that the he has plans to put new drainage on the
Road and will patch the real bad spots on East Miller Road . The drainage should be in place and set
for a year before the Road is resurfaced .
• Communications :
Supervisor Inman reported on a communication from Senator Kuhl acknowledging the receipt of
funding in the amount of 525 ,000 . 00 has been allocated in a recent approval of the New York State
Budget for the Town of Danby for renovations to the Town Hall .
REPORTS :
EMC - Report
Robert Roe reported that the UNA inventory is complete . The EMC will be contacting the town to
arrange a joint session with the Planning Board and the Town Board for a presentation on the
inventory . The Final Generic Impact Statement (FGEIS ) on Southwest Park is available for the
public to view .
County Representative Report
County Representative Proto reported on the following :
County Health Committee : The County Board of Health is in the process of reviewing the Sanitary
Codes
Census 2000 : The Census is nearing completion and many Danby residents have participated .
Tobacco Money : There will be a full report at the next County Board Meeting .
Towers Meeting : - The State lands do not lend themselves well to various site locations . There may
be some configuration changes for the placement of the proposed towers for emergency
telecommunications . There is concern with the Townships throughout the County of the cost to the
Towns for the proposed system .
Feasibility Study - approval for a feasibility study for joint jail facility with Cortland County
Water Resources Board - At the first meeting of the newly formed Board , Representative Proto was
elected as Chair to the committee . The Town of Danby has made a recommendation to the County
Board for representation .
Highway Report :
Highway Superintendent William Hall reported that the I-Iighway Department has received their new
truck . A monthly report for June was received .
Code Enforcement Report - June 2000 report received .
Planning Board Report :
Planning Board Chair reported that the Planning Board has a summer intern helping with the editing
• of the comprehensive plan documents . The Board is the process of firming up the section economic
development and will be soon moving on the transportation and utilities sections of the document .
Recreation Partnership Report :
Councilperson Gagnon reported that the at the last Recreation Partnership Committee meeting that
the City of Ithaca had problems with their proposal . They are the current provider of services and
the City wants some assurance that they would have a primary role in the partnership to provide a
stability and continuity . The committee will try to address their concern and at the same time create
language that would apply to any provider.
Community Council
The regular meeting of Community Council Board will be on Wednesday, June 14 , 2000 . The last
concert series here at the Town Hall was very well appreciated and very well attended . There is an
English Country Dance Saturday , June 17 , 2000 at 6 : 30 for dinner and the dance will start at 8 : 00

p . m . The major event that the Community Council is assisting the Danby Fire Department with
preparation for the Danby Fair to be held July 15 , 2000 . The planning of the installation of the
playground preparation is moving along .
Senior Citizens
Ed Roberts reported that the Senior Citizens will be taking a trip to see "Nunsense" at the Auburn
Merry-go -round Theater on June 11 , 2000 .
Dog Control
May 2000 S . P . C . A . report has been received . The Dog Enumeration is underway and is
approximately one third completed at this time .
Telecommunication Towers
Councilperson Norbert Nolte attended a County meeting on the proposed Telecommunication
System for emergency services . He reported that some persons in attendance felt that the County
had was leaning in the direction of their proposed system and the placement of the towers before they
had explored all options available . There have not been any other options presented to the public
and the proposal from Motorola has been the only one presented for public comment .
RESOLUTION NO . 56 OF 2000
POSTING OF WEIGHT LIMIT - EAST MILLER ROAD

RESOLVED , that the Town Board of the Town of Danby based on the Danby Highway
Superintendents recommendation that due to the current conditions and the grade of the hill and the
structure of East Miller Road that this Road be permanently posted for a five ( 5 ) ton weight limit
from Coddington Road to New York State Route 96B except for local deliveries .

RESOLUTION NO . 57 OF 2000
TRANSFER OF FUNDS FOR HIGHWAY TRUCK

WHEREAS , the Town of Danby has received a new highway truck , and
WHEREAS , funds for payment of the new highway truck is in an account the Capitol Reserve
Equipment Account No . HR2 , now be it
RESOLVED , that the Town of Danby Town Board approves of the transfer of funds in the amount
of $ 107 ,209 . 00 from the Capitol Reserve Equipment Account No . HR2 to account No . DA5130 . 200
for payment of the highway truck .

RESOLUTION NO. 58 OF 2000
RECOMMENDATION OF APPOINTMENT TO TOMPKINS COUNTY YOUTH BOARD
By Councilperson Gagnon : Seconded by Councilperson Strichartz
RESOLVED , that the Town Board of the Town of Danby recommends the appointment of Timothy
Devoogd to the Tompkins County Youth Board as a representative from the Town of Danby .

RESOLUTION NO 59 OF 2000
PERMISSION TO SCRAP HIGHWAY TRUCK NO . 31 TO AUCTION

WHEREAS , highway truck No . 31 is no longer of use to the Town of Danby , now be it
RESOLVED , that the Town Board of the Town of Danby grants the Highway Superintendent
permission to sent highway truck No . 31 to auction with proceeds to be deposited in the Highway
Equipment Capitol Reserve Account No . HR2 .

Tompkins County Community Service
The Town Clerk has requested permission from the Town Board to contact the Tompkins County

A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey to

Fieldstone Circle
The Code Enforcement Officer has received a request from the owners of Fieldstone Circle for a
modification of the Agreement with respect to the bus stop provision .
RESOLUTION NO. 60 OF 2000
MODIFICATION OF FIELDSTONE CIRCLE AGREEMENT WITH RESPECT TO BUS
STOP PROVISION
By Councilperson Strichartz : Seconded by Councilperson Varona- Lacey
WHEREAS , Scott Hoffay, acting on behalf of Shelter-Tech , Inc . , which is the present sponsor and

owner of Fieldstone Circle Subdivision, has requested that Paragraph No . 8 of the "Agreement
between Elizabeth Grisanzio , Sponsor and Owner of Fieldstone Circle , and the Town of Danby" ,
approved by the Town of Danby Town Board on May 11 , 1992 and filed in the office of the
Tompkins County Clerk on May 10 , 1994 , be modified ; and
WHEREAS, said paragraph No . 8 provides that the sponsor agrees to cooperate with TOMTRAN
or any other municipal bus service should such bus desire to place a bus stop or bus shelter on Lot
A, and that the location and design of such bus stop shall be agreed between the sponsor and the bus
service ; and
WHEREAS , the requested modification is that , if an alternative location for such bus stop or bus
shelter, close proximity to Fieldstone Circle Subdivision , is found , that the Town substitute that
property and release the Sponsor of Fieldstone Circle from its obligation under said Paragraph No .
8 ; now, therefore , it is
RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to accept
the revision of a suitable alternative location for such possible future bus stop or bus shelter, to
release the Sponsor of Fieldstone Circle from its obligation under the Paragraph N . 8 of said
Agreement, and to execute a modification to paragraph Nol . 8 of said Agreement, subject to the
following conditions :
1 . Approval of the alternative location by the Town Highway Superintendent and town
Code Enforcement Officer ; and
2 . Approval by the Town Attorney of the form and substance of the requested
modification to Paragraph No . 8 of said Agreement ; and
3 . Approval by the Town Attorney of the form and substance of a suitable Agreement
related to possible future bus stop or bus shelter designation or installation on alternative l 1.
location .

Proposed Noise Ordinance - discussion
Councilperson Strichartz reported that the Noise Ordinance Committee has been looking at
comments from our Town Justices and regulations for approval of permits for large parties . Other
regulations relating to who gives approval for gatherings and parties and regulations for dogs , etc .
may be revised . A rough draft was distributed to the Board for comment . it
RESOLUTION NO . 61 OF 2000 ; ;.
AUTHORIZATION GRANTED FOR OF THE TOWN FROM
RELATED TO PROCESSING OF
AND FROM THE TOWN ATTORNEY
AN ENFORCEMENT MATTER
By Councilperson Strichartz : Seconded by Councilperson Gagnon 1 ,
WHEREAS, the Town of Danby Town Board on May 22 , 2000 enacted Town of Danby Local Law
No . 4 , 2000 , "A Local Law Providing for the Repair or Removal of Unsafe Buildings and Collapsed
Structures" , and
WHEREAS, the Town Code Enforcement Officer has requested that the Town board authorize the
retention of a qualified engineer to assist in identifying the degree to which a particular building and
property may be unsafe and subject to the provisions of said local law ; and

WHEREAS , the Town code Enforcement Officer has also requested that the Town Board authorize
research by the Attorney of the Town on ownership and on other parties with interest in said
particular building and property ; now, therefore , it is
RESOLVED , that the Town board of the Town of Danby authorizes the Code Enforcement Officer
to retain a qualified structural engineer to assist in identifying the degree to which a particular
building and property may be unsafe and subject to the provisions of the Town of Danby Local Law
No . 4 , 2000 , and it is further
• RESOLVED , that the Town Board authorizes the Attorney for the Town to conduct research on
ownership and on other parties with interest in said particular building and property .

Term Limits for Town Boards - discussion
Councilperson Strichartz reported to the Board that she would like the Board to consider setting a
limit to the number of terms a person can serve on the Town Planning Boards and Board of Zoning
Appeals .
The Board discussed term limits for appoinments to Boards and there was no action taken .
Use of Town Hall Facility Policy
Councilperson Gagnon reported that the Town may want to limit the use of the Town Hall Facility
to organizations with which we contract. We could limit it to events that are pursuant to a contract
with the Town if they are the implementing our policy and serving as our agent . The Town needs
to make a decision as to whether we are going to keep the use of the building governmental use and
use pursuant to general governmental purposes or close the door . We do not need a policy if we are
going to limit the use of the building for Town use and Town sponsored things and activities by
others that are pursuant to a contract with the Town .
After discussion the Board did not adopt a Facilities Use Policy and the use of the building will be
limited to general governmental purposes .
Motion to Move to Executive Session :
A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz at 9 : 40
p . m . to move to Executive Session of the Board to discuss a matter of enforcement where public
discussion might compromise the investigations of matters related to potential criminal investigation
and possible litigation .
