PUBLIC HEARINGS DECLARED OPEN :
Supervisor Edward Inman declared the public hearings open at 7 : 02 p . m . and read the following
"Notice of Publication" :
"Please Take Notice that the following public hearings will be held by the Town Board of the Town
of Danby on Wednesday, March 29 , 2000 at 1830 Danby Road, Ithaca, New York.
7 : 00 p . m. Public Hearing to Consider changing, pursuant to Town Law Section 273 , the Town of
Danby Official Map to change the name of Miller Road West to West Miller Road and to change the
name of Miller Road East to East Miller Road, with such proposed changes also being pursuant to
Town Law Section 64 , Subdivision 9 " . and
7 : 10 p. m. the public hearing to consider the enactment of a proposed local law entitled "A LOCAL
LAW TO AMEND THE ZONING ORDINANCE TO ADD COTTAGE INDUSTRY TO
COMMERCIAL ZONE "A" PERMITTED USES BY SPECIAL PERMIT, AND TO ADD THE
DEFINITION OF COTTAGE INDUSTRY", and
7 : 25 p. m . - a public hearing to consider the enactment of a local law entitled "LOCAL LAW TO
AMEND THE ZONING ORDINANCE TO ESTABLISH A COMMERCIAL ZONE "A- 1 " which
would consist of the Town of Danby tax parcels No . 17 .- 1 -48 located on the west side of New York
State Route 34/96 south of Maple Avenue and Valley View Road being also known as the present
or former West Danby Methodist Church building property.
Published March 17 , 2000 .
Supervisor Inman reported that changing the name of Miller Road East to East Miller Road and
Miller Road West to West Miller Road was a request from Tompkins County . The change is
necessary for the County data base for 911 listings .
Public Hearing No . 1 Declared Closed :
Supervisor Inman declared the public hearing closed at 7 : 08 p .m.
PUBLIC HEARING NO. 2 - PROPOSED LOCAL LAW NO. 1 OF 2000 DECLARED OPEN :,
Supervisor Inman Public Hearing No . 2 - Proposed Local Law No . 1 of the year 2000 entitled : "A
LOCAL LAW TO AMEND THE ZONING ORDINANCE TO ADD COTTAGE INDUSTRY TO
COMMERCIAL ZONE "A" PERMITTED USES BY SPECIAL PERMIT, AND TO ADD THE
DEFINITION OF COTTAGE INDUSTRY" was declared open at 7 : 08 p .m .

Comments From the Public :
Joseph Schwartz - 85 Durfee Hill Road - He would be against this law if this opened up a
precedence for re-zoning .
Code Enforcement Officer Susan Beeners said that this law applies to medium and high density zones.
All cottage industries would require a re-zoning of the property. There is always the opportunity
to customize a re-zoning.
Eric Miller - 67 Hornbrook Road - Asked if this local law was for a specific project .
Verna Little - 1758 Danby Road - If this is passed it appears that everything anywhere could be a
cottage industry. We have small little business that became real neighborhood problems .
Inappropriate development should be discouraged.
Jim Houghton - 1560 Coddington Road - Is concerned about the speed that this is going through .
Edw. M. Roberts - 47 Bald Hill Road - Each case would be considered on its own merit .
John Henderson - 441 Comfort Road - Is concerned that parking near a cottage industry could be
a problem .
Kathy Halton - would a re-zoning be by request?
Pat Woodworth - 305 Gunderman Road - Sees this as being spot zoning. She is concerned that this
could set a precedence .

PUBLIC HEARING NO. 3 PROPOSED LOCAL LAW NO 2 OF 2000 DECLARED OPEN :
Supervisor Inman declared the public hearing No . 3 - Proposed Local Law entitled : "LOCAL LAW
TO AMEND THE ZONING ORDINANCE TO ESTABLISH A COMMERCIAL ZONE "A - I "
open at 8 : 03 p . m . and read the proposed local law.
Comments From the Public :
Pat Woodworth - 305 Gunderman Road - Understands that this to re-zone one piece of property .
Edw. M. Roberts - 47 Bald Hill Road - did not realize that the exterior of the building was in bad
shape . Approves of the applicant saving the building .
Joseph Schwartz - 85 Durfee Hill Road - understands that this is to preserve a historic building and
it should be emphasized more .
Reverend Earl Adams - 601 Turner Place - This building can be restored to its original condition
and be put on the registry as a historic building. It has been looked at by the Historical Society .
Code Enforcement Officer Susan Beeners said that the only change in the use of the building is that
this local law would permit a cottage industry there .

Following public hearings at 7 : 00 p .m . the Town Board moved the following motion :
Motion to Hold Special Meeting:
A motion was made by Councilperson Norbert and seconded by Councilperson Gagnon to enter
into a special meeting of the board at 8 : 20 p.m .
A roll call vote on the motion resulted as follows :

Strichartz Aye
Varona-Lacey Aye
Inman Aye Carried Unanimously
Supervisor Inman called the meeting to order at 8 : 20 p . m . and asked the Board to approve the
following resolution :
RESOLUTION NO. 38 OF 2000
CHANGING THE NAME OF MILLER ROAD WEST TO WEST MILLER ROAD, AND
TO CHANGE THE NAME OF MILLER ROAD EAST TO EAST MILLER ROAD
By Councilperson Gagnon : Seconded by Councilperson Strichartz
WHEREAS , the Town of Danby Official Map, Adopted by the Town Board on September 11 ,
1978 , identifies two (2) roads as Miller Road West and Miller Road East, respectively; and
WHEREAS, it has come to the attention of the Town that the renaming of these roads to West
Miller Road and East Miller Road would help to eliminate confusion and would benefit the
operations of the Tompkins County E-911 Emergency Dispatch System ; and
WHEREAS, the proposed renaming of these roads is a Type II action under SEQR for which no
further environmental review is required ; and
WHEREAS, the Planning Board of the Town of Danby on February 16 , 2000 recommended to
the Town Board that the subject roads be renamed as proposed herein; and
WHEREAS , the Town Board of the Town of Danby on March, 2000 has held a public hearing to
consider such road name changes, which hearing was duly noticed in the official newspaper of the
Town ; now, therefore , it is
RESOLVED, that the Town Board of the Town of Danby hereby changes the name of Miller

Special Meeting

Road West to West Miller Road, and hereby changes the name of Miller Road East to East Miller
Road, with such name changes to be indicated, pursuant to Town Law Section 273 , on the Town
of Danby Official Map, adopted by the Town Board on September 11 , 1978 ; and with such name
changes also being pursuant to Town Law Section 64 , Subdivision 9 ; and it is
FURTHER RESOLVED , that pursuant to Section 64 , Subdivision 9 of the Town Law, the
Town Clerk is requested, within ten days of the adoption of this resolution, to notify the
Tompkins County Division of Assessment, the Town of Danby Planning Board, the Tompkins
County Clerk, the Tompkins County Engineer, if any, and the United States Postal Services, of
such changes of road names .
A roll call vote on the resolution resulted as follows :

Inman Aye Carried Unanimously
Supervisor Inman asked the Board to entertain a resolution adopting the proposed Local Law No .
1 of the year 2000 .entitled "A RESOLUTION ADOPTING THE LOCAL LAW AMENDING
THE ZONING ORDINANCE TO ADD COTTAGE INDUSTRY TO COMMERCIAL ZONE
"A" PERMITTED USES BY SPECIAL PERMIT, AND TO ADD DEFINITION OF
COTTAGE INDUSTRY" .
Councilperson Strichartz requested that the Board adjourn the vote on the proposed resolution
for the above mentioned proposed local law.
Motion to Discuss Proposed Local Laws :
A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the
Town Board discuss the two (2) proposed local laws and defer voting until the April 10th
meeting of the Board .
A roll call vote on the motion resulted as follows :

Nolte Aye
Strichartz Aye
Varona-Lacey Aye
Inman Aye Carried Unanimously
The Town Board discussed the proposed local laws and the effect on neighborhoods when there
are re-zoning changes in residential zones .

On a motion the special meeting of the Board adjourned at 9 : 20 p . m .
