Public Hearing Declared Open :
Chairperson Laurene Gilbert declared the public hearing open at 7 : 00 p .m. and read the following
Notice of Publication :
"PLEASE TAKE NOTICE, that a public hearing will be held by the Danby Planning Board of the
Town of Danby on Wednesday, January 26, 2000 at 7 : 00 P .M . , 1830 Danby Road, Ithaca, New York
to consider granting a Special Permit and Site Plan Approval for a convenience store/restaurant with
gas station proposed to be located in a commercial Zone "C" on the east side of Danby Road north
of Hornbrook Road, on Danby Tax Parcels 7 . - 1 -78 , 7 . - 1 -79 , 7 . - 1 -80, and 7 . - 1 -81 . Todd McGill and
Joseph Salino , owners/applicants .
All interested persons will be given the opportunity to be heard either in person or in writing .

Memo to Planning Board - Robert S . Strichartz - Re : Insurance Coverage for the project.
Chairperson Gilbert read a memo addressed to the Planning Board from the Applicants, Todd McGill
and Joseph Salino dated December 27, 1999 . The memo described the design of the building siding,
lighting and planned typical landscaping of the proposed project.
Applicant Joseph Salino described the project plans for the proposed convenience store/restaurant/gas
station . Architectural Plans and the design for the site plan were displayed for the public to view .
Comments from the Public :
Edward Inman - 52 Bald Hill Road - Approves of a new business in Danby and thinks it will be a
complement to the community .
John Henderson - 441 Comfort Road - had questions regarding proximity of gas pipe line , possible
wetlands, hours of operation and lighting.
Naomi Strichartz - 708 Comfort Road - asked if there would be adequate liability insurance coverage
to cover possible leakage of the tanks or spillage .

Gay Huddle - 65 Gunderman Road - A consumer needs choices and approves of the project .
Leslie Shakespeare - 145 E. Miller Road - concerned about bright lighting.
Richard Schriner - 511 Comfort Road - is in support of project. Danby is in need of a gas station and
a place for residents to meet.
Toni McBride - owner of Danby General Store - of course is a little worried about a new convenience
store and hopes that they will be a complement to each other.
John Benjamin - 2190 Danby Road - past owner of Benjamin' s One Stop - thinks that competition
complements and does not hurt anybody.
John Shepardson, Sr. - 80 Muzzy Road - thinks a gas station is something we need and that the
applicants will do a good job .
Cindie Day - 1796 Danby Road - hopes a new business will provide jobs for teens from our
community .
Jim Herson - 2037 Danby Road - supports another responsible business in our community that will
complement the new owners of the Danby General Store and our community
Rick VanOstrand - 1707 Danby Road - owns land adjacent to the proposed project and is concerned
about adequate buffer to his home .
Howard Steiner - 1050 Coddington Road - would encourage the Planning Board to seriously consider
the application and act in an expeditious manner.
Ruth Evelien - 1691 Danby Road - is the most affected by this proposal and thinks it is going to be
very nice to have a place to go for a quick sandwich or snack without having to go to downtown
Ithaca.
Gordon Schonoman - 1680 Danby Road - sees no reason why this cannot move ahead and it is
something we need.
Walt Sczepanski - 54 East Miller Road - approves and thinks it is a good idea and a gas station is
really needed . He is looking forward to it .
Ted Merritt - 297 Jersey Hill Road - thinks the Town should be open to having more businesses in
town and this is a commercial property. It will add to the revenues coming into the Town. He hopes
the signage and lighting issue do not hold up the project.
Carol Benjamin - 2190 Danby Road - questioned how long since this project was first proposed to
the Town of Danby. She is concerned that her own experience with the Town is that it takes a long
time to get a project approved . Members of Boards need to work together.
Code Enforcement Officer Susan Beeners reported that it was the Spring of 1999 and that the project
was put on hold until November.
Answers to questions raised were as follows :
1 ) Joseph Salino reported that there was not a problem with the pipe line, the DEC , DoT and
County Health Department and County Planning have been consulted and site is not a wetland area
and hours of operation would be dependent on demand of the public .
2 ) Adequate insurance will be obtained and the tanks will be professionally installed according
to DEC , DoT and other regulations with required safeguard systems in place .
3 ) There are no guidelines for lighting but our ordinance states that lighting shall be designed to
minimize glaring and impact to surrounding properties .

4) The applicants are not trying to be in competition with Danby General Store and plans to
work with them to complement each other and to keep business in Danby .
5 ) They are considering a full service gas pump
6) Will work directly with the adjacent land owner regarding the type of buffer that will be
planted to minimize impact.

Chairperson Laurene Gilbert called the Special Meeting of the Planning Board was called to order
at 7 : 50 p .m. following a public hearing for the McGill/Salino proposal for a proposed Convenience
Store/Restaurant/Gas Station.
RESOLUTION NO. 2 OF 2000
SEAR - NEGATIVE DETERMINATION OF SIGNIFICANCE FOR PROPOSED DANBY
ROAD CONVENIENCE STORE/RESTAURANT/GAS STATION

WHEREAS, Todd McGill and Joseph Salino have requested a Special Permit and site Plan Approval
for a proposed convenience store/restaurant with gas station, to be located in an Commercial Zone
"C" on the east side of Danby Road north of Hornbrook Road, on Danby Tax Parcels 7 . - 1 - 78 ,
7 . 1 -79 , 7 . - 1 -80 , and 7 . - 1 - 81 , and
WHEREAS, this is an Unlisted Action for which the Planning Board is acting as lead agency in
environmental review, and for which the Tompkins County Department of Planning, Tompkins
County Division of Environmental Health, and New York State Departments of Environmental
Conservation and Department of Transportation as involved or interested agencies have been notified ;
and
WHEREAS, the Planning Board has reviewed the application materials, the draft Short
Environmental Assessment Form, and the recommendation from the Code Enforcement Officer that
a negative determination of environmental significance be made for this action; now, therefore, it is
RESOLVED , that the Planning Board, acting as Lead Agency in environmental review of this
Unlisted Action, make and hereby does make a negative determination of environmental significance
subject to subsequent requirements for final site plan approval and subsequent permits related to site
development and building construction .
A roll call vote on the resolution resulted as follows :

WHEREAS, Todd McGill and Joseph Salino have requested a Special Permit and Site Plan Approval
for a proposed convenience store/restaurant with gas station, to be located in a Commercial Zone "C"
on the east side of Danby Road north of Hornbrook Road, on Danby Tax Parcels 7 . - 1 -78 ,
7 . - 1 -79 , 7 . - 1 - 80, and 7 . - 1 - 81 , and
WHEREAS, this is an Unlisted Action for which the Planning Board on January 26 ,2000 , acting as
lead agency in environmental review, has made a negative determination of environmental
significance ; and
WHEREAS, the Planning Board at the following public hearing on January 26 ,2000 , has reviewed
the application materials for this action ; now, therefore, it is
RESOLVED, that the Planning Board hereby grants a Special Permit and Preliminary Site Plan
Approval for the project as proposed, subject to the following conditions for Final Site Plan
Approval ;
Approval of final signage design, lighting design, and final landscape plans by the Planning
Board .
Discussion :
Chairperson Gilbert asked the Code Enforcement Officer when the final site plan would be available
for consideration.
Code Enforcement Officer Susan Beeners reported that the landscaping and lighting for the final site
plan will be presented at the February Planning Board Meeting .
Olivia Vent asked if the insurance coverage for the project would be clarified at any point as to what
the insurance provides coverage if there is damage to other people ' s properties .
If the project is approved tonight then the applicants can proceed with application to the County
Health Department for a permit, have a perc . test performed and move along with the Department
of
Code Enforcement Officer Susan Beeners suggested to the Board that they get the applicants
agreement that there will be a clarification of what the insurance for the project includes .
Transportation permit process so that there was not a holdup in the start of the project.
