OCTOBER 11 , 1999
PRESENT :

Supervisor Kenneth Horst called the meeting to order at 7 : 00 p . m . and led all present to the Pledge of
Allegiance to the American flag .
ADDITIONS TO THE AGENDA:
1 ) Councilperson Strichartz asked that permission for a English Folk Dance be added to the Agenda
under new business .
2) President of Community Council, Dan Klein has requested a resolution to transfer funds received from
a NYS Member Grant to Community Council .
PRIVILEGE OF THE FLOOR:
Town Clerk Carol Sczepanski reported :
1 ) that we have received a response from NYS Department of Transportation that they have
received our request .
2) Senator Randy Kuhl will be here at the Town Hall on October 13 , 1999 from 4 : 00 - 4 : 30 p .m .
to meet with interested residents .
3 ) A rabies clinic will be held at the Danby Fire Station on October 19 , 1999 from 7 : 00 - 9 : 00 p . m.
4) A Health Department Flue Clinic will be held at the Danby Federated Church on October 22 , 1999 ,
9 : 00 to 12 : 00 Noon.
Members of the Public :
Willard Daetsch - 1344 Danby Road reported that on November 6 , 1999 there will be a " Speak Out on
Health Care" information meeting at the Department of Social Services, 320 West State Street at 1 : 00
p . m .
Margaret Shepard - 441 Comfort Road reported that Community Council is sponsoring a square dance
on Sunday, October 17 , 1999 at the Montessori School on East King Road from 2 : 30 - 5 : 30 p . m.
Edward M. Roberts - 47 Bald Hill Road - would like to see the speed limit enforced on Bald Hill Road .
Ames Brown - 1840 Danby Road - is interested in the status of the heating system at the Town Hall .
COMMUNICATIONS :
1 ) Confirmation of "Request for Speed Test - Comfort Road"
2) Petition from residents of Olde Towne Village requesting a street light at the intersection of
Buttermilk Lane and NYS Rte . 96B .
EMC Report: Robert Roe reported that the Fire Committee of the Board of Representatives has come
up with suggestions for restructuring the EMC . The project manager for the Cornell University Radiation
Disposal Site gave the EMC a presentation on the engineering reports and feasibility studies to remediate
the site . Bob is willing to continue on the EMC as representative for the Town of Danby should the Board
recommend him to the Tompkins County Board of Representatives .
Highway Department Report - Received
Code Enforcement Office Report - Written report for September 1999 received tonight.

Senior Citizens - The Senior Citizens meetings from November through April will be held on the first
Thursday monthly 12 : 30 p . m . with a dish to pass luncheon.
Dog Control - July 1999 report received
Recreation Partnership- Councilperson Gagnon reported that they are examining alternative scenarios
for how to continue the programs at a reasonable cost to municipalities .
Planning Board Report - A public hearing has been scheduled for Wednesday, October 20 , 1999 to hear
public comment on the Fort Locks proposal for additional storage buildings . Fort Locks is located
adjacent to Bailey Homes on NYS Rte. 96B .
OLD BUSINESS
Comprehensive Plan - Extension of County Contract
The contract has been deferred to November so the Planning Board can review the contract. There is
concern that the project cannot be completed with a three (3 ) month extension due to the lack of County
Circuit Rider support .
Town Hall Heating System
Councilperson Gagnon reported that the Building Committee met with a representative from Wheaton' s
Sheet Metal and an engineer. The committee received options to address the inadequacies in the heating
and ventilation of the Town Hall meeting room . Options for remediation are being explored at this time
for the meeting room heating system and getting heat to the restrooms .
Councilperson Steiner suggested that the Town solicit proposals from three reputable heating contractors
such as Agway, HFC Associates , and Lennox, Burris Heating and Plumbing in addition to Wheaton ' s .
We should explain to them what our situation is at this time and ask them to submit proposals to
remediate the heating system in the Town Hall . He reported that an evaluation of what the problem is
and it appears to be inadequate radiation.
Code Enforcement Officer Susan Beeners said that there are two (2) options : 1 ) have the engineers and
the heating consultants come to a meeting with the entire board as soon as possible ; or, 2) have them
prepare more technical data and specifications of what kind of work is proposed . She said that before
we solicit proposals from anybody we need to have a general description of what the problem is .
Supervisor Horst asked the Code Enforcement Officer to have the heating engineers give the Town some
degree or prediction of success associated with the three (3 ) options that have been presented to the
Board .
Motion to Approve Resolution No. 66 of 1999 (green copy) Approved
RESOLUTION NO . 66 OF 1999
ACTIONS RELATED TO TOWN HALL HEATING SYSTEM
By Councilperson Gagnon : Seconded by Councilperson Inman
WHEREAS, the Town Board of the Town of Danby by resolution on May 10 , 1999 authorized the Town
supervisor to retain a heating consultant to review the Town Hall heating system and to prepare
recommendations and a cost estimate for correction of deficiencies ; and
WHEREAS, the Town Board of the Town of Danby has heard the recommendation of the Town Hall
Building Committee related to a general work scope for remediation of heating and ventilation problems
in the Town Hall, and
WHEREAS, said remediation is a Type II action under SEQRA, so that no further environmental review
is required ; now, therefore, it is
RESOLVED, that the Town Board authorizes the following :
1 . Preparation of a scope of work and equipment specifications for the work as
recommended;
2 . Seeking of quotations as provided in the Town of Danby Procurement Policy;
3 . Recommendation by the Building Committee of a responsible provider; and
4) Recommendation for action by the Town Board, leading to the signing of a contract
by the Town Supervisor with the selected provider for execution of the work as soon as
is reasonably possible .

Councilperson Steiner said that we should have the heating system done the way it was supposed to be
done . Since the main objective in the building was to eliminate the space heaters in the meeting room
and electric space heaters . It appears we are now going back to that and does not think that this is the
right solution for the taxpayers he is going to vote against this resolution.
Supervisor Horst said that he will vote against the resolution due to the uncertainty of the workability of
the systems that are being suggested .
Councilperson Inman said that he feels that this is the lowest over-all cost to any taxpayers in the Town
of Danby to heat the meeting room satisfactorily .

Noise Ordinance Committee Formed
Councilperson Strichartz reported that she has heard from some persons who are interested in serving on
a noise ordinance committee . She would like to hear from people who are interested in helping develop
a noise ordinance . Councilperson Gagnon will serve with Councilperson Strichartz on a noise ordinance
committee . A notice to solicit interest for persons to serve on the committee will be placed in the Danby
Area News .
RESOLUTION NO. 67 of 1999
AWARD OF BID STREAMBANK STABILIZATION PROJECT
By Councilperson Inman : Seconded by Councilperson Steiner
WHEREAS, the Town of Danby has advertised for bids for the Streambank Stabilization Project in the
Ithaca Journal on September 23 , 1999 , and
WHEREAS,on Wednesday, October 6 , 1999 P .M . bids received by the Town were opened by the Town
of Danby Town Board, and
WHEREAS, all bids received were reviewed by the Town Board and the Highway Superintendent and
found to be complete, now be it
RESOLVED, that the Town Board of the Town of Danby awards the bid for the Streambank
Stabilization Project to JB ' s Excavation Service, Inc . , 2213 Long Creek Road Apalachin, New York
13737 for their bid for their total bid price of $ 13 ,399 . 00 (Alternate bid price using slope stone in place
of stacking stone is $ 8 ,280 . 00) and be it further
RESOLVED, that the total cost of the project is not to exceed $ 10 ,000 . 00 based upon a possible
combination of slope or stacking stone , and further
RESOLVED, that the approval of this bid is subject to the extension of a permit from DEC (Department
of Environmental Conservation) .

PUBLIC HEARING DATE SET - PRELIMINARY BUDGET 2000

at 6 : 45 P .M . for a public hearing on the Town of Danby Preliminary Budget for Fiscal Year 2000 .

RESOLUTION NO. 70 OF 1999
CONTRACTUAL SERVICES BETWEEN THE TOWNS OF DANBY AND NEWFIELD
AGREEMENT - Approved
By Councilperson Steiner: Seconded by Councilperson Inman
WHEREAS , the Town of Danby Highway Superintendent and the Town of Newfield Highway
Superintendent have agreed to a contractual services for VanBuskirk Gulf Road , Tupper Road to NYS
Rte . 34/96 , and Townline Road to Layen Road to West Jersey Hill Road, and
WHEREAS, the Town of Danby Attorney recommends this agreement for VanBuskirk Gulf Road, and
Townline Road, now be it
RESOLVED, that the Town Board of the Town of Danby authorize the Town of Danby Attorney to draw
up a reciprocal agreement between the Towns of Danby and Newfield which will delineate the swap of
services on VanBuskirk Gulf Road and Townline Road, and be it further
RESOLVED, the Town Board of the Town of Danby authorizes the Town of Danby Supervisor to sign
said agreement.

various work on the Town Hall property; and

WHEREAS, the Town Hall Building committee has recommended that the gutters and down spouts
installation component of the grant work scope not be done, and that outdoor lighting improvements are
important to make, especially before any improvements to the Town Hall driveways and parking lot; now,
therefore, it is
RESOLVED , that the Town Board of the Town of Danby hereby authorizes the Town Hall Building
Committee to request a modification of the grant work scope to delete the gutters and down spouts
installation component and to substitute lighting improvements , provided that the cost of said lighting
improvements does not exceed the $ 5500 total estimated cost of the gutters and down spouts installation.
Discussion :
Councilperson Steiner is concerned that the County could not agree to extend the contract.
Code Enforcement Officer Susan Beeners said that if the County does not extend the contract you will
have to recoup 50% of the $ 5 ,500 . 00 . The County suggested that the Town prepare a modified grant for
the next grant cycle .

Motion to Approve Use of Building - Community Council Folk Dance
A motion was made by Councilperson Strichartz and seconded by Councilperson Inman that the Town
Board of the Town of Danby approves the use of the Town Hall Meeting Room by Community Council
on November 20 , 2000 from 6 - 11 for an English Country Folk Dance .

Purchase Offer for Additional Land for Highway Department
Additional land is needed to build a salt storage shed for the Highway Department . The Board reviewed
a draft proposed purchase offer for the purchase of additional land adjacent to the Town Highway Barns
The draft proposed purchase offer was amended by the board and the following resolution was adopted
by the Board.
RESOLUTION NO. 72 OF 1999
AUTHORIZATION FOR SUPERVISOR TO SIGN PURCHASE AGREEMENT FOR TO
OBTAIN PROPERTY ON HORNBROOK ROAD
By Councilperson Steiner : Seconded by Councilperson Strichartz
WHEREAS, the Town of Danby is in the process of negotiations for the purchase of property adjacent
to the Town of Danby Highway Barns located on Hornbrook Road, and
WHEREAS, a Proposed Purchase Offer for the acquiring the property has been received, and
WHEREAS, the Town of Danby Town Board has reviewed and amended the proposed purchase offer,
now be it
RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to sign the
Purchase Agreement for the land acquisition adjacent directly behind the Town Highway Barns on
Hornbrook Road as modified by the Board on October 11 , 1999 .
