Supervisor Kenneth Horst called the meeting to order at 7 : 00 P .M . and led all present to the Pledge
of Allegiance to the American flag .

PRIVILEGE OF THE FLOOR:
Carol Sczepanski reported that she has added to communications a notice of the Tompkins County
Municipal Officials Meeting and proposed agenda. Items on the Agenda related to the Tompkins
County Assessment Department is a request from the Tompkins County Town Clerk' s Association.
Richard Charsky - NYSEG Representative - reported that NYSEG has completed the inventory
of street lighting and billing reconciliation in the Town of Danby. NYSEG has a Y2K disclosure
and must be in compliance by July 1 , 1999 . They believe they will be compliant for gas and electric
service . Their disclosure statement can be viewed on a web site at nyseg . com .
Members of the Public :
Ames Brown - 1840 Danby Road - reported that the flag on the building is not properly displayed .
REPORTS :
County Representative Report
Representative Proto reported on the following :
1 ) Library Coordination Committee will visit all the rural libraries to find out what services
are available in the County .
2) Cayuga Medical Center now accepts Blue Cross/Blue Shield insurance .
3 ) Board of Health Committee will be considering a vote on fluoridation for the public water
supply.
4) Sales Tax allocation for college text books from the sales of text books represents 2% of
sales tax collection and the County has asked the State to leave the sales tax on text books .
5 ) 911 System fee will be increased to $ 1 . 00 .
6) Bus shelter that was promised for the Park & Ride at the Danby Fire Station on 96B should
arrive soon.

7) Water Quality Council will hold a public information session on May 26, 1999 on the Water
Quality Strategy Plan.
8) Hillview Road Landfill Advisory Committee voted to send a resolution to the Public Works
Committee asking for a review and permission to drill additional wells at the Hillview Road
Site .
9) The Town will receive a letter reminding them that the County passed a resolution regarding
POWMIA flags and are asking all municipalities for cooperation.
10) State Archives Program -- every fire company in every town has been encouraged to apply
for funding under SARA.
Historic Ithaca - Report
Ed Franqauemout the Executive Director of Historic Ithaca complimented the Town for the Historic
Resource Survey and photo album of the Town of Danby. This survey is an essential tool for making
future plans for growth and preserving the important aspects of Danby . There is a law in New York
State that makes a New York State tax credit available for residents who want to work on
agricultural buildings or any building that was fundamentally designed to be a part of a farm .
Alphonse Pieper, Director of Preservation Services at Historic Ithaca said that in doing the survey
the help of the Town was essential . The Town Clerk and Code Enforcement Officer helped to
identify structures for the photo album. The survey was funded and made possible by a grant from
the Preservation League of New York State .
Office of the State Comptrollers Teleconference - Y2K
Lorraine Bard attended the Office of the State Comptrollers Teleconference "Final Countdown to
the Year 2000 " held at Cooperative Extension on March 18 , 1999 . The program dealt with
governmental concerns for the planning and issues surrounding Y2K and officials responsibilities .
The teleconference was televised and a tape is available at the Tompkins County Cooperative
Extension office and may be borrowed . Lorraine also read a report from the Danby Fire Department
-- Danby Fire Department Disaster Planning Committee The Danby Volunteer Fire Department has
an active committee working on a disaster plan for the community of Danby .
Supervisor Horst reported that the Town is in the process of checking Town equipment. Computers
and computer systems have been checked . He is meeting with the Fire Department on April 26 ,
1999 on the Y2K and Emergency Preparedness .
External Audit
Supervisor Horst reported that there was concern regarding the external audit and read the following
statement into the record : "The question was raised concerning the desirability of an external audit
at regular Board meetings in February and March. However no action was taken by the Town Board .
I learned in March that should we wish an audit this year it could be done the week of March 22nd .
I decided to contact each member of the Town Board and felt that if at least four (4) of the Town
Board members were favorable for an audit, we would request that one be done . I spoke individually
by phone with Ed Inman, Howard Steiner, and Naomi Strichartz and was unable to contact Joel
Gagnon after trying three times at different times of the day . I gave the following reasons for the
desirability for an external audit. It assures residents of the Town of Danby that the Town ' s 1 . 27
million dollar budget is being handled appropriately by the Town Board . The Towns relationships
with its bank is strengthened . The Towns insurance company will favorably view its financial
situation. Our Town Attorney has indicated to me that most Towns have external audits and an audit
thus reflects favorably in the eyes of our attorney. The State Auditors Office is less likely to audit
the Town of Danby . Members of the Town Board and residents occasionally raise questions about
the use of Town ' s funds and the audit provides answers to these questions . An audit on 1998 fund
management is important since we had three (3 ) new board members with very little budget
experience. The three members of the Town board with whom I spoke gave me a favorable response
to have an external audit which was in agreement with my feeling and the audit was started on March
22 and completed March 26 . Those were the reasons I gave and I felt that even though I was unable
to get hold of one of the members of the Board I did have three members who gave me a favorable
response, and thus the audit was carried out .

Comments from the Board Regarding External Audit
Councilperson Inman stated that he indicated to the Supervisor that he would agree to an external
audit and was not in favor of the expense for this year . If other members were agreeable to an
external audit he said that he would approve but expected that there would be vote for approval
before the audit was done .
Councilperson Strichartz stated that she was wavering and did not want to spend the money this year
as there were audits in 1997 . She did expect that the request for an external audit would be brought
up at a meeting and that she would have a chance to vote on it before it was done .
Councilperson Gagnon said his concern is he isn ' t sure that this would not have been supported by
the Board if it had been brought up before the Board . Process is important .
Councilperson Steiner brought up the issue of an audit for this year and felt that it would be a good
idea to incorporate an audit as the Supervisor suggested and did support an external audit. He did
agree with the Supervisor that some things need to be expedited . Perhaps it would have been
appropriate to have a held a special meeting for approval of an external audit .
Motion to Approve Authorization Payment for Audit
A motion was made by Councilperson Steiner and seconded by Supervisor Horst that the Town
Board of the Town of Danby authorize an amount not to exceed $4,000 . 00 for an external audit and
submission to the Town of the audit report and that the cost of the audit be transferred from General
Fund Account No . A1990 . 400 for payment .

Councilperson Gagnon introduced the following resolution he would like the Board to consider .
RESOLUTION No. 33A of 1999
RESOLUTION OF CENSURE
By Councilperson Gagnon : Seconded by Naomi Strichartz
WHEREAS , it has come to the Town Boards attention the Town Supervisor, Kenneth Horst has
contracted with the firm of Ciaschi , Dietershagen Little, & Mickelson for an audit of the 1998
financial records , and
WHEREAS, the Town Board resolution authorizing such a contract was neither sought nor obtained
prior to the supervisor ' s action, and
WHEREAS, the Town Board in its fall 1998 budget deliberations deleted funding for an audit, and
WHEREAS , Town Law (section 64-6) explicitly provides that only the Town Board has the
authority to bind the Town contractually, and
WHEREAS , there was not emergency that might have justified seeking Board approval after the
fact, now therefore , be it
RESOLVED , that the Board censures the action of the Town Supervisor and warns him that
contracts are not to be entered into without the express approval of the Town Board or stronger
action will result, and be it further
RESOLVED, that a copy of this resolution be transmitted to the auditors by the Town Clerk and

serve as notice thereto that this Board will not pay for future audits without proper Town Board
authorization.

REPORTS :
Environmental Management Council - EMC
Robert Roe reported that the Environmental Management Council met on March 10, 1999 . Items
discussed and reviewed were :
1 ) purchase on 96B for a community center. It received qualified endorsement of the EMC , final
endorsement will be when they have a chance to conduct one more floral inventory during the
growing season .
2) EMC ' s role and operations for the Tompkins County Hazardous Waste Management Facility has
been received and reviewed . SEQR documents are currently under review by a committee of the
Tompkins Board of Representatives .
3 ) Community Cell Towers - EMC and the Systems Advisory Committee have requested that
independent consultants be brought it to review the County ' s Emergency Communication upgrade
project
4) Cornell ' s Radiation Disposal Site -- proposed remediation projects are in hand and under review.
Motion to Recess :
A motion was made by Councilperson Steiner and seconded by Councilperson Strichartz at 9 : 10
P . M . that the Board recess for a 10 minute break and to extend the meeting to 10 : 00 p . m .

Highway Department Report
Sue Howe submitted the written Highway Department Report and reported that the Highway
Department is scheduled to attend a drug and alcohol training session in May . The department
copier needs to be replaced and at least three quotes have been obtained for a replacement. The
desired copier can be purchased for $ 1 , 195 . 00 with trade in of old copier.
Motion to Approve Purchase of Copier
A motion was made by Councilperson Inman and seconded by Councilperson Gagnon to approve
the purchase of a copy machine in the amount of $ 1 , 195 . 00 with trade of old copier and that the
majority of the cost be charged to account A5010 . 200 and the remaining funds needed to cover the
balance of the cost be transferred to A5010 . 200 from A5132 . 400 on the request of the Highway
Superintendent at the May Board meeting .

Community Council Report
Judy VanDermark reported that Community Council has active sub-committees this year that are
working extremely hard . The Council along with Cooperative Extension have hired David Hall as
the Youth Program Manager and is employed for 20 hours per week . The Danby Community
Council is investigating moving a piano into the Town Hall . The cost for moving, tuning, and a lock

is approximately $200 . 00 . They can provide $ 100 and are asking the Town Board to provide the
additional $ 100 . 00 . Gnomon copy brought to her attention that the December issue of the Danby
Area News was not paid for and is overdue . She presented the bill to the Town that was addressed
to the Danby Area News for the January statement . The bill must be researched as the bill was
mailed to 467 Troy Road and the bill was dated January 1998 .
Senior Citizen ' s Report
The Senior Citizen ' s met on Thursday, April 1 , 1999 for their monthly meeting. The May 6th
meeting will be held at 12 : 30 for a dish to pass . Beginning in June the monthly meetings will be
held at 6 : 00 p . m .
Dog Control Report :
The Town Clerk reported that the SPCA is now following up on the dog enumeration that was done
in 1997 and 1998 . Tickets will be issued to dog owners who still have not registered their dogs .
Planning Board Report
Robert Roe reported that the Planning Board met on March 17 , 1999 and the meeting was an open
meeting and residents involved in various types of agriculture were invited . The meeting was for
public participation for input focused around different themes related to the comprehensive plan .
The residents cited several problems and concerns with agriculture in Danby in its future . A major
concern is the lack of infrastructure in Tompkins County with no suppliers for equipment, repairs
and other needs . Other concerns are the potential creation of farming only areas, the idea of a
proposed noise ordinance and the fire tax placed on full 100% assessed land value .
Water Resources Council
Robert Roe reported that the Flood Hazard Mitigation Oversight Committee is in the process of
reviewing the application materials for 1999 . The deadline for applications has been extended to
May 14 to allow six weeks for project submittal . Communities and individuals may apply for flood
mitigation funds on a matching basis and it does not include in-kind payment . Funding priority will
be given to projects that can be completed within the funding year.
Recreation Partnership Report
Councilperson Gagnon reported that the Recreation Partnership Board had recommended that the
partnership be broadened to include not just youth but recreational opportunities for the entire
population . This idea has received favorable response from the planning group and it may not
increase costs significantly to provide the facilities to be made available and to include adults .
Medical Center Annual Report
Councilperson Inman reported that he attended the Annual Cayuga Medical Center meeting . The
medical center is working with health programs in the area schools . Copies of the Annual Report
are available in the Danby Reading Room .
Comi Telecommunications
Supervisor Horst has been in contact with Comi Telecommunications and the proposed local law
legislation is progressing. The Draft Local Law with suggested corrections has been received from
Comi Telecommunications .
Motion to Refer to Planning Board
A motion was made by Councilperson Gagnon and seconded by Councilperson Inman that the Town
Board review the Draft Telecommunications Local Law with the Town Attorney ' s comments, make
suggested comments and changes for review at the May 5 , 1999 Agenda Meeting .

NEW BUSINESS :
Proposed Contract - Award for Improvements at the Town Hall
Supervisor Horst reported that he has received the contract for Improvements at the Town Hall
between Tompkins County and the Town of Danby . He needs Board approval to execute the
contract .
Motion to Authorize Supervisor to Sign Contract
A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon that the
Town Board of the Town of Danby authorizes the supervisor to sign the contract between Tompkins
County and the Town of Danby for the Town Hall Improvements Project subject to the amendment
of the contract that the Town can execute the contract in part.

Councilperson Steiner stated that he cannot support approval of a contract with the statement that
we are entering into a contract that we know we are not going to fulfill .

WHEREAS, the Town of Danby Town Board must appoint two (2) representatives to serve on the
Local Advisory Board of Assessment Review, now be it

RESOLUTION NO . 35 OF 1999
APPROVAL OF PRODUCING A COPY OF THE 1998 DANBY HISTORIC RESOURCE
SURVEY
By Councilperson Inman : Seconded by Councilperson Strichartz
WHEREAS , the Town of Danby, with a grant from the New York State Council on the Arts and
the preservation League of New York State , contracted in 1998 with Historic Ithaca for a
Reconnaissance Level Survey of Historic Resources in the Town of Danby; and
WHEREAS, the grant application originally included that copies be distributed to various locations
including the Tompkins County Library ; and
WHEREAS , it would be beneficial to have a copy in the Danby Reading Room , to be used as a
reference by Danby residents and others ; now, therefore , it is
RESOLVED, that the Town of Danby Town Board approves the production of a copy of the 1998
Danby Historic Resource Survey, with an estimated cost of no more than $ 100 . 00 , to be paid from

RESOLUTION NO. 36 OF 1999
APPROVAL OF SUBMISSION OF A GRANT APPLICATION FOR AN INTENSIVE
LEVEL SURVEY OF HISTORIC AGRICULTURAL RESOURCES
By Councilperson Strichartz : Seconded by Councilperson Gagnon
WHEREAS, Olivia Vent, a Danby resident, has, upon consultation with Historic Ithaca, requested
that the Town of Danby Town Board approve the submission of an application for a grant from the
New York State Council on the Arts and the Preservation League of New York State, with such grant
funds to be used to conduct an Intensive Level Survey of Historic Agricultural Resources in the
Town; and
WHEREAS , the Town of Danby Town Board has reviewed the draft proposal for such grant
application, along with the preliminary budget for the project; now, therefore, it is
RESOLVED , that the Town of Danby Town Board approves the submission of said grant
application, and approves the proposed Town share of up to 3400 . 00 , and it is further
RESOLVED, that if said grant is approved, the Town of Danby Town Board will make available
up to $400 . 00 from General Account No . A1990 . 400 .

RESOLUTION NO . 37 OF 1999
AUTHORIZATION TO PARTICIPATE IN COOPERATIVE PURCHASING OF
HIGHWAY SERVICE WITH TOMPKINS COUNTY
By Councilperson Inman : Seconded by Councilperson Strichartz
WHEREAS , the Office of the State Comptroller has ruled that counties may no longer extend their
bids for public work (service) to political subdivision, and
WHEREAS , General Municipal Law Section 119-0 provides for municipalities entering into
cooperative purchasing agreements to jointly bid needed services, and
WHEREAS ,General Municipal Law, Article 5 -G, Section 119-0 states that "any agreement entered
into hereunder shall be approved by each participating municipal corporation or district by a majority
vote of its governing body," now therefore be it
RESOLVED, that the Town of Danby be hereby authorized to participate with Tompkins County
in the cooperative purchasing of the following highway services :
1 ) ROAD MATERIALS :
Gabions, traffic signs-complete, traffic sign faces and sign materials , traffic control sign
panels, guider all , icing sand, bituminous material, gravel , limestone, calcium chloride flake,
corrugated steel pipe, polyethylene drainage pipe, sign posts .
2) Liquid Bituminous Materials
3 ) Installation of Perforated Tubing for Subsurface Drainage
4) Calcium Chloride Solution
5 ) Recycling of Existing Bituminous Pavement, and, be it fitrther
RESOLVED, that the Town of Danby reserves the right to reject any and all bids , and further
RESOLVED, that the Highway Superintendent will identify on vouchers those items under County
Contract .

Agreement to Spend Highway Funds
The Agreement between the Town and Highway Department to spend highway funds was deferred
to May 1999 .
Motion to Approve Band Concert May 15, 1999
A motion was made by Councilperson Strichartz and seconded by Councilperson Inman that the
Town Board of the Town of Danby grant permission for Danby Community Council to hold a band
concert with the Devon String Quartet performing on May 15 , 1999 at 7 : 00 P . M . and that there is
to be no admission charged for the performance .

The Board discussed insurance coverage and who was liable if some of the furnishings were
damaged or stolen, occupancy limit for the building, and where to put store small items that are in
the meeting room .
Supervisor Horst said that the insurance certificate must be submitted and must state that the Town
insurance is an additional insured .

Piano for the Town Hall
Councilperson Strichartz reported that she has a piano and is willing to put it on loan to Community
Council . Community Council has offered to pay for moving a piano here for future concerts and
also for the purpose of giving piano lessons to children who do not have pianos at home .
Community Council would like the Town to consider providing $ 100 of the $200 necessary to pay
for moving the piano to the Town Hall and tuning fee .
Highway Department Purchase of Pickup Truck Discussion
The Highway Superintendent has requested permission to purchase a pickup truck through State bid
for the Town . The Board discussed the existing inventory of highway vehicles and whether an
additional one ton pickup was needed .
Motion to Set Date for Open House for the Town Hall Facility
A motion was made by Councilperson Strichartz and seconded by Councilperson Inman to set the
date of Saturday, June 26 , 1999 from 4 : 00 to 6 : 00 p . m . for an open house for the newly renovated
Town Hall and addition .

Scrap Metal Drop off - Old Town Barns
The Community Council Building Committee is planning a clean up day for a scrap metal drive and
have proposed that residents be allowed to drop off small scrap metal items at the Old Town Barns
site . Large items such as refrigerators , stoves, washing machines, etc . can be picked up roadside
upon advance request. The cost of a dumpster on site will be deducted from the sale of the scrap
metal . The request from the committee is for permission to place a dumpster at the old town barns
site for drop off of scrap metal .
Discussion followed on the cost to use Highway Department equipment and employees to pick up
large items .
Motion Allow Dumpster at Old Town Barn for Scrap Metal Drop off
A motion was made by Councilperson Inman and seconded by Councilperson Strichartz to allow the
Community Council Building Committee to place a dumpster at the Old Town Barns for the scrap
metal drop off.

Proposed Purchase of Property for Community Center
Mary Oltz reported that the Community Council n Hall .Committee
letter has been considered

of a property located on 96B across from th e Town
owners asking if they are willing to sell the property located on Route 96B across from the Town
Hall . There has been no purchase offer at this time .
Heating System - Town Hall
Councilperson Gagnon reported that the Town Hall Building Committee has received information
that the heating system in the Town Hall is not functioning as designed . The contractor who
installed the system and the architect have been contacted with no solution. He asked the Board to
authorize the Town Supervisor to send a letter to the contractor and the architect indicating that
unless someone makes contact and takes responsibility to remedy the problem it will be necessary
for the Town to take further steps .
Motion to Authorize Supervisor to Sign Letter
A motion was made by Councilperson Gagnon and seconded by Councilperson Steiner to authorize
the Town Supervisor to contact the architect and the contractor responsible for the design and
installation of the Town Hall heating system indicating that the system has problems and is not
working properly .

Councilperson Gagnon reported that the Town Clerk is responsible for submitting information for
publication to the Danby Area News and requested that she not report the action taken regarding the
censure of the Supervisor.

General Fund Warrant No. 4 of 1999
A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz to approve
the General Fund Warrant No . 4 of 1999 , voucher numbers 145 - 195 in the amount of $ 13 , 312 . 22 .
