Sczepanski - Secretary Susan Beeners - Code Enforcement Officer Donald & Pricilla Barber - Applicants Members of the Public : Esther Dotson, Paul Moore, Peter Moore, Steve Barber, Beth Miller Chairperson Arch Dotson called the Planning Board Meeting to order at 7 : 20 p . m . following a public hearing for a proposed subdivision of an 11 . 7+/- acre lot from Town of Danby Tax Parcel No . 8 . - 1 - 1 . 2 , near Hilltop Road . Donald and Pricilla Barber, Owners . Barber Subdivision RESOLUTION NO . 1 OF 1999 DETERMINATION OF ENVIRONMENTAL SIGNIFICANCE - BARBER SUBDIVISION By Nancy Weitzel : Seconded by William Farrell WHEREAS , this action is the Consideration of Subdivision Approval for the proposed subdivision of an 11 . 7+/- acre lot from Town of Danby Tax parcel No . 8 .- 1 - 1 .2 , near Hilltop Road , with said lot having been granted a variance from the minimum frontage requirements , with certain provisions , by the town of Danby Zoning Board of Appeals on December 10 , 1998 , and WHEREAS , this is an Unlisted action for which the Townof Danby Planning Board is lead agency for environmental review, and WHEREAS , the Planning Board has reviewed the draft environmental assessment prepared by the Code Enforcement Officer for this action, now, therefore, it is RESOLVED , that the Town of Danby Planning Board , acting as Lead Agency in environmental review of this Unlisted Action, makes a negative determination of environmental significance . A roll call vote on the resolution resulted as follows : Farrell Aye Gilbert Aye Hansen Aye Roe Aye Vent Aye Weitzel Aye Dotson Aye Carried Unanimously RESOLUTION NO. 2 OF 1999 1 SUBDIVISION APPROVAL - BARBER SUBDIVISION By Chariperson Dotson: Seconded by Robert Roe WHEREAS, this action is the Consideration of Subdivision Approval for the proposed subdivision of an 11 . 7+/- acre lot from Town of Danby Tax parcel No . 8 . - 1 - 1 . 2 , near Hilltop Road, with said lot having been granted a variance from the minimum frontage requirements , with certain provisions , by the Town of Danby Zoning Board of Appeals on December 10, 1998 , and WHEREAS , this is an Unlisted action for which the Town of Danby Planning Board, acting as 56 c Lead Agency for environmental review, has on January 20 , 1999 made a negative determination of environmental significance, and WHEREAS , this is an unlisted action for which the Townof Danby Planning Board, acting as Lead Agency for environmental review, has on January 20, 1999 made a negative determination of environmental significance, and WHEREAS , a public hearing was held on this action on January 20, 1999 , now therefore, it is RESOLVED, that the Town of Danby Planning Board grants preliminary and Final Subdivision Approval to the proposed subdivision as presented, subject to the condition that it shall be the responsibility of the users of the private right of way abbuting said lot to maintain said right of way for appropriate safety access .
