Consolidated Plan Application for the Town or Danby for 1999 . The application and funding

requirements are basically unchanged from 199 i . Upgrades for the West Danby water District
discussed at the first public hearing will not be part of this application but will be considered for
future applications. This application will be very similar to the application or last year ( 1997) .

Applications are due on February 3 , 1999 and residents were urged to Hie application as soon as
possible. Forms are available in the Town Clerk ' s office.
Karl neck reported that there were thirteen ( 13 ) applications from Danby residents selected to receive
funding through 1- _ r - . Housing nT - - - . 1 - - County through the Better Housing or Tompkins County last year.

JANUARY 11 , 1999

Supervisor Kenneth Horst called the meeting to order at 7 : 08 and led all present to the Pledge of
Allegiance to the American flag .

PRIVILEGE OF THE FLOOR:
Councilperson Steiner reported that he has met with a person interested in being the coordinator of
the Jennings Pond Program for 1999 . An interview will be scheduled to take place at the February
Agenda meeting of the Board .
Councilperson Strichartz reported that persons from the Community Service program have been
contacted to clean the pond and beach area for the summer program at Jennings Pond .
Supervisor Horst reported that the bookkeeper position has been advertised in the Journal and
interviews are in process .
Town Clerk Carol Sczepanski asked the Board to develop guidelines and a policy for the use of the
Town Hall Meeting Room especially for non municipal meetings .
Councilperson Steiner asked the Supervisor to obtain information on the receipt of sales tax revenue
as a direct payment instead of as a credit on the Town and County Tax Roll .
Supervisor Horst reported that there is a meeting of the Cayuga Lake Management Plan
Intermunicipal Organization and we have not appointed a person to that position. He requested that
names of persons who are interested in serving as a member of that organization be submitted to the
Town Clerk or members of the Board .
Members of the Public:
Code Enforcement Officer asked that consideration for approval of the submittal of the HUD
Application be added to the agenda.

REPORTS :
EMC (Environmental Management Council) - Report
Robert Roe reported the organizational meeting of the EMC is scheduled for January 13 , 1999. The
first meeting of the year will be the seating of new members, revisions of the by-laws, and revisions
of the standing committees . The EMC is looking at establishing a standing committee to deal with
telecommunication towers .
Community Council Report
Esther Dotson reported that the council will hold their organizational meeting and election of officers
on Thursday, January 14 , 1999 at 7 : 00 P . M .
Senior Citizens - Report
Mary Oltz reported that at the January Senior Citizens Meeting, she and Esther Dotson were
appointed to look into a contract for the Danby Senior Citizens Council to present to the Town.
Code Enforcement Officer - Report
Susan Beeners reported that she has submitted a December 1999 written report to the Board and
that activity was increased in 1998 . An application has been filed for a construction project for a
relocation of approximately 280 feet of Buttermilk Creek south of Comfort Road Bridge . The
purpose for the relocation is to cover up an exposed portion of a gas pipeline .
Planning Board Report:
Chairperson Arch Dotson reported that the Planning Board has received the final report on the Danby
Residents Survey from Rolf Pendall ' s class. We now need to move forward with our comprehensive
planning. Reports will be made regularly to the board and we will invite the Town Board to the
Planning Board ' s deliberations .
Water Resources Council Report
Robert Roe reported that as a member of the County Resources Board it is his understanding that
there will be flood mitigation funds available to municipalities . He urged the Board to look at the
potential areas of flooding or water management problems within the Town .
COUNTY REPRESENTATIVE REPORT :
Representative Frank Proto reported he will continue on the Health Committee, Ag Economic
Development Committee, and will chair a special committee on Libraries .
1 ) Revitalization Grants - the County has awarded two revitalization project grants of
matching funds to Town of Danby . The Bicentennial Committee Grant submitted by our
Town Historian for funds to erect a bandstand, and a grant submitted by our Code
Enforcement Officer for the Town Hall property. He congratulated Susan Beeners for her
dedicated efforts in obtaining the grants .
2) Aquifer Study - The requests from the Town of Caroline and Danby that the Aquifer Study
will be pursued .
3) Funds for Playground - The request from Dan Klein for funds to erect a playground in
Danby at the Danby School has been sent to a committee .
4) West Danby Fire Department - The grant request has been submitted for the West Danby
Fire Company for their disaster aid preparation.
5) Youth Board - The recommendation for appointment of Judy VanDermark to the County
Youth Board was approved.
6) County Foreclosures - Properties listed on the County foreclosure list were submitted to the
Town Clerk and she will will contact the County Budget & Finance to check the status of the
properties and report back to Representative Proto .
7) Hillview Road Landfill Advisory Committee - Representative Proto stated that he is
interested in reappointment to the Hillview Road Landfill Community Advisory Committee .

Community Center Building Committee Report:
Supervisor Horst reported that he has met with the Community Center Building Committee and their
request for support for purchase of land and building project was discussed . There is a 50 -acre
parcel that can be purchased and they now have $ 5 , 000 to initiate the purchase of the land . The
committee is not asking for money at this time only for verbal support from the Town to move ahead
with negotiations .
Supervisor Horst reported that the Board will meet with the Community Center Building Committee
following the February 3 , 1999 Agenda Meeting of the Board .
Financial Statement - Danby Area News
Councilperson Gagnon reported that the Town Board has received the 1998 Annual Financial
Statement for the Danby Area News .
Supervisor Horst reported he has received a formal request from Charles Tilton for a financial
statement of the Danby Area News be added to the Agenda for the next Town Board Meeting .
OLD BUSINESS :
Municipal Equipment and Shared Services Agreement
A request for a Municipal Equipment and Shared Services Agreement between the Tompkins County
Highway Department and the Town of Danby Highway Department was introduced for
consideration .
Motion to ReferTompkins County Agreement to Town Attorney for Review
A motion was made by Councilperson Inman and seconded by Councilperson Steiner to send the
Tompkins County Municipal Equipment and Shared Services Agreement to the Town Attorney for
review .

Motion to Extend County Agreement to March 31 , 1999
A motion was made by Councilperson Steiner and seconded by Councilperson Gagnon to extend the
1998 Municipal Equipment and Shared Services Agreement if one exists between Tompkins County
and the Town of Danby to March 31 , 1999 or until the request for 1999 is approved.

NEW BUSINESS :
TOWN SUPERVISOR' S STATEMENT TO THE BOARD
Supervisor' s Statement to the Board
Supervisor Kenneth Horst read the following Supervisor ' s Statement to the Board :
Roberts Rules of order will be followed at all Town Board Meetings except when special roll call
vote is necessary. Roll call will be alphabetical with the Supervisor voting last. All meetings will
begin at 7 : 00 P .M . and terminate no later that 9 : 00 P . M . Method of claims for payment of all bills
will be by voucher. Vouchers and items for the agenda must be submitted no later that Thursday
preceding Town Board Meeting. Vouchers and items for the agenda must be submitted no later than
Thursday preceding may be submitted to the Supervisor or the Town Clerk . The Town Board in
accordance with Town Law AT103 will audit all bills . All personnel matters will be discussed in
executive session .

Board accept the Town Supervisor' s Statement to the Board .

PAYMENT OF BILLS

authorize the Town Supervisor to pay utility bills , freight, postage , contracts and to conduct other
normal proceedings such as payroll in advance of audit in order to keep affairs moving on a timely
basis, and be it further
RESOLVED , that a contract is not a bid award .

RESOLVED, That the firm of Barney, Grossman, Dubow and Markus be named as the law firm to
represent the Town of Danby in all Zoning, Planning Board, and general Town of Danby business .

WATER COMMISSIONER APPOINTMENT

RESOLVED, that the Town of Danby Town Board approves the reappointment of John Sill as
Water Commissioner for the West Danby Water District for a five year term to begin January 1 , 1999
and to expire December 31 , 2003 , and John Finley of 72 Station Road for a one year appointment
to fill a vacancy that will expire on December 31 , 1999 .

REAPPOINTMENT TO BOARD OF ZONING APPEALS
By Councilperson Steiner: Seconded by Councilperson Gagnon

REAFFIRMATION OF TOWN OF DANBY PROCUREMENT POLICIES AND
PROCEDURES AS APPROVED IN RESOLUTION NO. 24 OF 1993

RESOLVED, that the Town Board of the Town of Danby reaffirm the Town of Danby Procurement
Policies and Procedures as established in Resolution No . 24 of 1993 .

AUTHORIZE TOWN SUPERVISOR TO SUBMIT HUD APPLICATION

RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to submit
an application for a 1999 HUD Small Cities Community Development Block Grant for Housing
Rehabilitation in the Town of Danby and to provide such additional information as may be required
in conjunction with that application.

Other Business :
Danby Theater Arts Program
Councilperson Gagnon reported that there is a group in West Danby who are working to come up
with viable ongoing uses of the former West Danby Church Building . He was approached with a
program through Cornell University that does outreach to local communities . An application and
a letter of support was been submitted on behalf of the West Danby Community Association. There
is prospect that this program may be approved by Cornell provided that the building can be made
available and usable . The Methodist church is in charge of the building and the community can use
the building if they are willing to cover the costs . There are costs for utilities and to make the
building usable as the furnace is not in working order. Councilperson Gagnon proposed to the Board
that they make $ 1 ,000. 00 available to enable this programming take place .
Brandon Miller and Jim Self addressed the Board with information on the programming that is
proposed for the use of the West Danby Methodist Church building . Brandon Miller reported that
he has funds available through the Cornell Council of the Arts to bring Cornell students and
members of the community such as West Danby into context with each other.

Highway Agreement - Signed
The Annual Highway Agreement to spend funds on Town of Danby Town roads for 1999 was
submitted and signed by the Supervisor and the majority of the Town Board .
Councilperson Steiner reported that he thinks that the Town Board should have more control about
what roads in the Town of Danby are worked on .
