PUBLIC HEARING PROPOSED LOCAL LAW
ADULT ENTERTAINMENT MORATORIUM
APRIL 8, 1998 - 7 : 00 p.m .

Public Hearing Declared Open :
Supervisor Horst declared the public hearing open at 7 : 10 P .M . and read the following "Notice of
Publication" :
PLEASE TAKE NOTICE that a Public Hearing will be held by the Town Board of the Town of
Danby on Wednesday, April 8 , 1998 at 7 : 00 p . m . at the Danby School Building, 54A Gunderman
Road, Ithaca, New York to consider the adoption of a local law of the Town of Danby entitled "A
LOCAL LAW PROVIDING FOR A MORATORIUM FOR THE ESTABLISHMENT OF ADULT
ENTERTAINMENT BUSINESSES FOR A PERIOD OF ONE HUNDRED EIGHTY ( 180) DAYS" .
Any resident of the Town of Danby is entitled to heard upon said proposed local law at such public
hearing either in person or in writing. Copies of said proposed local law are available for review at
the Town Clerk' s Office during regular office hours .

Chairperson Horst reported that a moratorium for 180 days will allow us time to review information
and to decide what we want to do relative to our town ordinances in regard to adult entertainment
businesses . We cannot restrict adult entertainment from coming into the Town of Danby but can

place restrictions in our ordinances as to where they are located .
Comments from the Public :
Mary Oltz - 1873 Danby Road - thinks establishing moratoria is a good idea for both adult
entertainment facilities and cellular towers .
Pat Woodworth - 305 Gunderman Road - thinks a moratorium is a good idea.
Discussion on the time limit of 180 days
h Code Enforcement Officer reported that she has consulted with the Town Attorney and that one
hundred eighty ( 180) days is a reasonable length of time for a moratorium . Time is necessary to get
legislation through the Planning Board and Town Board process of creating the ordinance for final
adoption.

Code Enforcement Officer Susan Beeners reported to the Board that there is a revised Draft
Local Law dated 4/7/98 of the proposed local law with minor changes in wording. The
modifications are in pencil on the revised draft and are modifications for any previously granted
approval as long as it does not increase the height of any facility or involve the construction of
additional towers . The Town has received an application from Nextell to add an antenna to the
existing cellular tower located on Durfee Hill Road . Susan presented the blue prints of the
proposed addition to the tower for the Board and public to view. The existing tower was
constructed by Frontier Communications is proposed to be shared by Nextell . The application
will be referred to the Board of Zoning Appeals . She recommended that the Board consider the
revised draft Local Law.
Comments from the Public :
Mary Oltz - 1873 Danby Road - approves of the local law.
Pat Woodworth - 305 Gunderman Road - approves of the local law .
i' Bill Farrell - 581 East Miller Road - thinks that shared towers are a good idea.

Chairperson Horst said that this area through Danby is a particularly diffuclt area for reception
for cellular phones .

Supervisor Horst called the Special Meeting of the Board to order at 8 : 30 P . M .
Councilperson Inman reported that it is necessary for the Board to consider a change order in the
heating contract for the heating plans of the meeting room at the Town Hall . The heating system
plans need to include the lobby, bathrooms and kitchen area with the office section of the facility so
that they are heated during regular office hours . The meeting room will be heated separately and
with a separate furnace . The original bid had the number 1 furnace heating the meeting room and
the other areas .
Proposal from Airtech Heating and Air Conditioning Systems to the Town of Danby for a change
order to the original approved plan as follows :
Proposed cost to supply air defuses to the lobby, bathrooms and stairs to the supply air ducts from
the furnace unit two(2) :
Materials - $200 . 00
Labor - $960 . 00
Total Cost $ 1 , 160 . 00 .

CHANGE ORDER FOR HEATING SYSTEM- Approved

WHEREAS, Councilperson Inman has received a proposal from Airtech Heating and Air
Conditioning Systems for the heating system at the Town Hall Facility, and
WHEREAS, the request is to supply heat to the lobby, bathroom and kitchen area during regular
office hours, now be it
p' RESOLVED, that the Town Board of the Town of Danby approve the change order proposal from
Airtech Heating and Air Conditioning Systems to provide heat to the bathrooms, lobby and kitchen
area with the office facilities system at the Town Hall for a total of $ 1 , 160 . 00 .
A roll call vote on the resolution resulted as follows :
