March 12 , 1997 PRESENT : Chairperson Ken Horst Planning Board Members : Gerald Catlin, William Farrell , Mary Lou Hardesty ABSENT : Arch Dotson (Excused) Nancy Weitzel (Excused) Others Present : Susan Beeners - Code Enforcement Officer Secretary - Carol Sczepanski Applicant - Scott Engelhart Members of the Public : Harold and Helen Baker, John and Marjorie VanDeMark, Dawn C . Parks, Larry Parlett, John Henderson, Margaret Shepard, Judith L . Bargher, Tom Gray Chairperson Horst declared the public hearing open at 7 : 07 P . M . and read the following Notice of Publication : "NOTICE IS HEREBY GIVEN, that a Public Hearing will be held by the Planning Board of the Town of Danby on Wednesday, March 12 , 1997 at 7 : 00 P .M. , Danby Town Hall, 1830 Danby Road, Ithaca, New York 14850 . Purpose of the hearing is to consider a recommendation to the Town Board with respect to an application for a Planned Development Zone , proposed to be located on a six (6) acre portion of the Town of Danby Tax Parcel No . 8 . - 1 - 12 . 12 on the west side of Comfort Road, north of Miller Road West. The Planned Development Zone as proposed would include a building and yard for the sale of masonry materials and equipment, an office for masonry installation services, a possible future residential lot, and an agricultural use/open space area. Scott Engelhart, Applicant, Carl and Barbara Mosher, Landowners . All interested parties will be given the opportunity to be heard either in writing or in person. Communications : 1I11 Phone Call to Code Enforcement Office - from Fred and Ivy Soyring opposed to the proposal and are worried about possible increased traffic, which is already bad from H & E employees, and recent increases in vandalism and littering in their area that the attribute to the H & E traffic . it I Proposal for Planned Development Zone : Applicant Scott Engelhart addressed the Planning Board and public and explained his proposal for the Planned Development Zone and the layout planned for the stock yard . The proposal is to construct a retail sales for masonry supplies and will be located on a six (6) acre site and is proposed to be on 1 - 1 /2 acres . A parking area is planned for six (6) vehicles and a 24 x 36 foot metal type structure for office space and storage of materials that are affected by weather. One section of 1 - 1 /2 acres is reserved for a residential lot and the remaining three (3 ) acres is vacant farm land . He reported that there is a need for this type of business in this area as the nearest supplier for masonry 421 2 Planning Board Minutes Public Hearing Scott Engelhart - 3/ 12/97 supplies is in Cortland . Susan Beeners explained that this proposal is for a mixed use Planned Development Zone and as proposed and the business section would always be restricted to the designated portion. The Town Board makes the final decision to approve of a Planned Development Zone . Scott Engelhart said that the majority of customers would be looking at materials and he would be delivering the products . He expects that maybe 15 -20 clients per day . Deliveries by tractor trailer are expected to occur possibly once a month . Members of the Public : Tom Gray - 158 West Miller Road - asked questions about the proposed landscaping around the facility, hours open for business and if he expected to generate sales from contractors . Judy Bargher - 158 West Miller Road - is concerned that a business will create more traffic and reported the bridge at the lower end of West Miller Road is deteriorating and in poor shape . Masonry materials are very heavy . The electric wires that service her home have been torn off her house by a tractor trailer. She asked the Planning Board if this was going to open the door for further businesses moving into the Comfort Road area residential neighborhood. There should be areas for commercial development and businesses . Chairperson Horst said that each proposal for rezoning is considered individually . It does not mean that it opens the door for more commercial development in the area. The Planning Board will soon be looking at revising the comprehensive plan for the Town of Danby and some of these issues will be addressed . Helen Baker - 8 West Miller Road - is concerned about the condition of West Miller Road Bridge and the condition of West Miller Road . Traffic encroaches in her yard from the already existing truck and other traffic . It is dangerous to cross the road to their mailbox because of the speed of vehicles coming around the corner . traffic comes around the corner. Margaret Shepard - 441 Comfort Road - lives directly across from Mr. Engelhart and heard of this proposal this evening. She is concerned that the entire yard will be visible from their home ; the dust and fumes from truck traffic while the area is under construction will contaminate her yard and vegetable garden. There is a a registered Oak Tree that may be damaged from the location of the proposed driveway to the facility . Larry Parlett - 22 West Miller Road - is concerned with traffic that there will be more litter along the road and in his yard . Lunch hour traffic from H & E drag race down the road to pick up lunch and then throw out their lunch garbage containers on the return trip . This may be a great business plan but may not be the best fit into this residential area . There is a day care center and after school center planned for the Comfort or West Miller Road area that will also increase traffic another 20-30 cars per day. ® Dawn Parks - 22 West Miller Road - she said that even in the winter there is continuous traffic and the sides of the road are deteriorated and the shoulders of the road are washed away . John VanDeMark - 411 Comfort Road - asked Mr. Engelhart details of the proposed business and where the boundaries for the proposed business section were located . John Henderson - 441 Comfort Road is concerned that this proposal may affect the resale value of his home and that this proposal may encourage more spot zoning in Danby. It would be nice to see a new comprehensive plan in place that provides an area for this type of development. Tom Gray - 158 West Miller Road - said that when the Comfort Road Bridge is rebuilt unless there is reconstruction of the steep grade and 90 degree turn that probably truck traffic will continue to use West Miller as the preferred route . 422 /9 3 Planning Board Minutes Public Hearing Scott Engelhart - 3/ 12/97 Susan reported that she has consulted with John Lampman, a Tompkins County Engineer, and that he reported to her that the bridge on Comfort Road is planned to be completed this year. The County has applied for a Industrial Access Grant to partially fund the cost of the bridge and work is expected to start this year. Bargher, Tom Gray The Special meeting of the Town of Danby Planning Board was called to order at 8 : 01 by Chairperson Horst to discuss the Scott Engelhart Proposal for a Planned Development Zone for a retail masonry supply business proposed to be located on Comfort Road. Chairperson Horst said that he would entertain a motion to postpone a decision on making a recommendation to the Town Board on the proposal until the Regular Meeting of the Planning Board on Wednesday, March 19, 1997 . Motion to Postpone Recommendation to Town Board on the Proposal for a Retail Masonry Supply Planned Development A motion was made by Gerald Catlin and seconded by William Farrell to postpone a decision on the Application of Scott Engelhart for a Planned Development Zone for Retail Masonry Supply Business to the March 19, 1997 Planning Board Meeting .
