Supervisor Mary Oltz called the meeting to order at 6 : 00 P . M . and led all present to the Pledge of
Allegiance to the American Flag.
APPROVAL OF MINUTES :

A motion was made by Councilperson Johnson and seconded by Councilperson Inman to approve
the November 11 , 1996 Public Hearing Minutes - Preliminary 1997 Budget and the November 11 ,
1996 Town Board Minutes as published .

ADDITIONS TO AGENDA
1 ) Supervisor Oltz requested the addition of a possible resolution for approval of an Insurance
Carrier for Town Insurance;

into the County Drug and Alcohol Consortium;
No Board member objected.

General Fund Warrant No. 12 of 1996 - Approved
A motion was made by Councilperson Steiner and seconded by Councilperson Inman to approve the
General Fund Warrant No . 12 of 1996 , Voucher No . ' s . 336-368 in the amount of $6,757. 23 .

Highway Department Fund Warrant No. 12 of 1996 - Approved
A motion was made by Councilperson Inman and seconded by Councilperson Johnson to approve
the Highway Fund Warrant No . 12 of 1996, Voucher No . ' s 166- 180, in the amount of $ 16, 353 . 63 .

West Danby Water District Fund Warrant No. 12 of 1996- Approved
A motion was made by Councilperson Inman and seconded by Councilperson Steiner to approve the
West Danby Water District Fund Warrant No . 12 of 1996 , voucher No . ' s 43 - 49 , in the amount of
$2 ,024 . 08 .

Town Clerk' s November 1996 Report
A motion was made by Councilperson Steiner and seconded by Supervisor Oltz to approve the Town
Clerk ' s November 1996 monthly report.

Supervisor' s November 1996 Report Deferred
Supervisor Oltz reported that the Town Supervisor' s November 1996 report will be presented to the
Board at the Year-end meeting of the Board,
PRIVILEGE OF THE FLOOR
Councilperson Inman reported that he has consulted with NYSEG about the possibility of natural
gas being provided to the Highway Department through a Farm Tap on the new NYSEG Pipeline .
He is seeking information related to the costs for installation and possible savings by switching from
propane to natural gas .
Supervisor Oltz reported that there are neighbors who may be interested in installing natural gas from
the Farm Tap to help share the $ 3 ,000 . 00 cost of the tap .
Councilperson Johnson requested that the record show that in the public hearing minutes Amy
Cussimano reported the approximate attendance of 2000 at Jennings Pond is an unconfirmed figure .
Councilperson Johnson reported that she called Mr. Lindenbaum to obtain the status of the Danby
School building . She reported that no children can be taught in that building as it is not approved
by New York State and does not qualify to meet school codes .
Councilperson Steiner consulted with Bill Brown, Manager of the Alan H Treman State Marine Park
about Jennings Pond and costs for lifeguards. He asked if the State could take over the responsibility
of the Pond program and provide lifeguards for the swimming program . Mr. Brown said he would
not rule that out but was concerned with the number of geese that frequently are at the park, the type

of certification of the lifeguards and liability. Councilperson Steiner said that there needs to be close
communication with Community Council, the Pond Committee and the Town Board regarding the
operation of the Pond Program .
Councilperson Steiner said that he attended the Tompkins County Builders Association luncheon
last week with Senator Seward. Senator Seward discussed what the legislative priorities are for
111 1997 . One of the priorities for the legislature is property tax reduction. Councilperson Steiner said
that he asked Senator Seward to consider the WICKS Law roll back elimination . Senator Seward
said that the WICKS Law roll back elimination is already being considered .
Town Clerk, Carol Sczepanski reported that there was an error on the General Fund Warrant No . 11 ,
1996 and asked the Board to amend the warrant by reducing the amount by $231 . 57 for a total of
$ 3 , 791 . 80 .
Town Clerk, Carol Sczepanski reported that beginning January 2 , 1997 through March 31 , 1997, the
Town Clerk/Tax Collector ' s office will be open Tuesday - Friday from 9 : 00 A . M . - 4 : 00 P . M. and
Saturday 9 : 00 A . M. - 12 : 00 Noon .
Highway Department Report:
Supervisor Oltz read the Highway Department report for November 1996. The Department repaired
damage from the flooding of November 8 , 1996, installed a pipe on Marsh Road and one on East
Miller Road west of Troy Road, added a snow plow turn-around on Curtis Road beyond Hill Road
and one on the lower end of Marsh Road south of Hornbrook Road . Spreaders, plows and trucks
have been made ready for winter and sand has been stocked for deicing.
Superintendent Hall reported that he has applied for CHIPS fund reimbursement and we should
receive payment soon. Reimbursement of CHIPS f funds could not be submitted until the projects
are completed and proof of expenses have been received .
Bi-Centennial Committee Childrens ' Christmas Party
Carol Sczepanski reported that the Bi-Centennial Committee hosted a Christmas Party for the Danby
Children on Saturday, November 7, 1996 . The party was attended by more than fifty (50) children
and was a great success
Better Housing of Tompkins County - Report
Becky Bilderback from Better Housing of Tompkins County reported that the Town of Danby HUD
grant application for housing improvement was not successful in 1995 . She reported that there are
State funds available through HOMES that can be applied for through Better Housing with
application deadline January 16, 1997 . Their office can prepare an application using many of the
client applications that were included in the HUD application. Better Housing has matching monies
through Rural Development Funding. The application would be for approximately $200, 000 . 00 .
Becky asked the Town Board for approval to submit an application on behalf of the Town of Danby
for a HOMES Grant.
County Representative Report:
County Representative Frank Proto reported that the County Board of Representatives are wrapping
up 1996 and have one more meeting this year and on the following :
1 ) The County Budget for 1997 was approved for 92,000,000 with a tax increase of under 2% ;
2) Solid Waste Fee - will be on the 1997 Town and County Tax Bills;
3 ) Youth Fees - the Board approved to give the City, Towns, and Youth Bureau $40,000 to do
a study for youth programing during the first six (6) months of 1997;
4) Comfort Road Bridge - The replacement of Comfort Road Bridge is scheduled for 1997 and
the County Board has received many letters of support from the Danby community.

5 ) Setting County Goals - meeting scheduled for Tuesday, December 10, 1996 for setting long
term County goals .
6) Economic Advisory Board - will hold a final meeting for 1996 on Thursday, December 12,
1996 and are going to recommend that the Tompkins County Economic Development
Corporation be the lead economic group for the County. Money has been allocated for
assistance to rural areas in their economic development planning .
7) Rural Affairs Committee Meeting - A Rural Affairs Committee Meeting meeting was held
in on Monday, December 2 , 1996 in Newfield, New York. The general tenure in Newfield
was on infractor repairs and maintenance, solidification of Emergency Services, and police
protection. Residents expressed their concerns on the emphasis placed on the City of Ithaca
verses the rural areas of Tompkins County.
8) Budget Committee - How the County generates fees and what they are used for will be
discussed at the next meeting.
9) Charter Committee Final Report - The Tompkins County Charter Committee ' s Final
Report for 1996 has been completed . The recommendation to make the County Sheriff and
County Clerk appointed positions will go to referendum November 1997 .
10) County Health Insurance - reported that the County received notice that their health
insurance premium was over the budgeted amount by $600 ,000 . The increase in the
premium and is based on high medical claims . Nine (9) cases represent 20% of the $600,000
deficit.
Councilperson Steiner asked Representative Proto to ask our State Legislators to support the
abolishment of the WICKS Law. This would save 25 % on construction costs for capitol projects
for townships and school districts .
COMMUNICATIONS :
1 ) Recommendation from the Planning Board to consider amending Local Law No . 1 of 1996 .
2) Supervisor Oltz reported that the Town has received ten ( 10) proposals from architects for
the Town Hall Renovation/Addition Project.
3 ) Letter to Town Board from Daniel Klein of interest in serving on the Environmental
Management Council dated November 19 , 1996 .

Highway Superintendent' s Report
Highway Superintendent William Hall reported that there is a vacancy in Highway Department due
to the resignation of an employee . He has received information for seeking bids for a one ( 1 ) ton
four wheel drive dump truck with snow-plow and that a dual-wheel would best serve the needs of
the department

A motion was made by Councilperson Inman and seconded by Supervisor Oltz to raise
Resolution No . 63 of 1996 from the table for discussion .

RESOLUTION NO. 63 of 1996 - TRANSFER OF FUNDS
WHEREAS, the Highway Superintendent has requested that funds be transferred as
follows :
$ 5053 . 24 from Account No . DA5110 .4 to DA5112 . 2
$ 4, 000 . 00 from Account No . DA5120 . 4 to DA5110 . 4
$ 3 ,400 . 00 from Account No . DA5120 . 1 to DA5142 . 1
and funds from sale of equipment in the amount of $219 . 80 be placed in the DA5130 . 4

Discussion of Resolution No . 63 of 1996
Supervisor Oltz reported that she has discussed this request to transfer funds with the Highway
Superintendent and that they are in agreement that they are close to the end of the year and the
appropriations will balance against the revenues for the year. There is no need to transfer funds at
this time.

RESOLUTION NO. 67 OF 1996
AUTHORIZATION FOR HIGHWAY SUPERINTENDENT TO ADVERTISE FOR BIDS
FOR A ONE TON FOUR WHEEL DRIVE DUMP TRUCK WITH SNOW-PLOW
By Councilperson Stiener: Seconded by Councilperson Inman
WHEREAS, the Highway Superintendent has submitted to the Board a request to purchase a new
one ( 1 ) ton four wheel drive dump truck with snow-plow; and
WHEREAS, the Highway Superintendent has asked the Town of Danby Town Board for approval
to advertise for bids for a new one ( 1 ) ton four wheel drive dump truck with snow-plow, now be it
• RESOLVED, that the Town of Danby Town Board authorizes the Highway Superintendent to
advertise for bids for the purchase of one ( 1 ) new 1996 or newer one ( 1 ) ton four wheel drive dump
truck with snow-plow.

Environmental Management Council Appointment
Supervisor Oltz reported that the Town has received a letter and resume from Daniel Klein of

interest in serving on the Tompkins County Management Council as a representative from the Town
of Danby.
Supervisor Oltz said that she will set up appointments for the Board to interview applicants to fill
the vacancies on the Environmental Management Council and the Town of Danby Planning Board .
Town Hall Building Renovation/Addition Project
Supervisor Oltz reported that she has received ten ( 10) proposals from architects for the Town Hall
Building Renovation/Addition Project.

She reported that she and the Code Enforcement Officer have reviewed the proposals and met with
six (6) of the architects . She would like the Board to set up appointments to meet with some of the
architects to review their proposals .
Motion to Review Proposals With Architects
A motion was made by Councilperson Steiner and seconded by Councilperson Inman that
Supervisor Oltz be authorized to set up meetings with 1 ) The Crissey Architectural Group, 2) Peter
Demjanic of Demjanec & Associates , 3 ) Wolff Garritano Architects, and 4) Huber, Hares , and
Glavin to review their proposals for the Town of Danby Town Hall Project as soon as possible .

Proposed Local Law to Amend the Zoning Ordinance
Supervisor Oltz reported that the Board has received a recommendation from the Planning Board
to consider an amendment to Local Law No . 1 of 1996 , "A Local Law to Amend the Zoning
Ordinance to Modify the Boundaries and Establish a Modified General Site Plan for Planned
Development Zone No . 10 , Comprised of a Portion of Town of Danby Tax Parcel No . 9 . - 1 -9 . 12
located on the south side of Gunderman Road west of Comfort Road" . The request is to amend the
date in the Local Law No . 1 of 1996 - Section (s) 3 ( c) and 3 (f)from October 1 , 1996 to May 15 ,
1997 .
Public Hearing Date Set - Proposed Local Law to Amend the Zoning Ordinance
A motion was made by Supervisor Oltz and seconded by Councilperson Steiner that the Town
Board of the Town of Danby will hold a public hearing at 6 : 00 P . M . on Monday, January 13 , 1997 ,
Danby Town Hall, 1830 Danby Road, Ithaca, New York to consider a Proposed Local Law to
entitled : "A LOCAL LAW AMENDING LOCAL LAW NO . 1 OF 1996 RELATED TO
ANGELHEART DESIGNS , INC . "

Year-end Meeting of the Town Board
A motion was made by Councilperson Steiner and seconded by Supervisor Oltz to hold a Special
Year-end Meeting of the Town Board at 6 : 00 P . M. on Monday, December 30, 1996, Town Hall,
1830 Danby Road, Ithaca, New York.

Town of Danby Insurance Carrier for 1997
Supervisor Oltz reported that the Town received only a proposal from one ( 1 ) insurance company
to provide the Town of Danby with an insurance package for 1997 . Mr. Charles LaComb of Ithaca
Agency presented an insurance package with three options for the Board to consider at the Town
Board on Wednesday, December at their Agenda Meeting held on Wednesday, December 4, 1996
The Board has reviewed the proposals and have chosen the Titan Perma Package that was presented
for $38,354 . 30.
Motion to Accept Insurance Proposal
A motion was made by Supervisor Oltz and seconded by Councilperson Johnson to accept the Titan
Perma Insurance Package option as suggested by the Ithaca Agency for the Town of Danby 1997
insurance coverage for $36, 650 . 30 plus the Perma entrance fee of $434 . 00 .
