Chairperson Ken Horst opened the meeting at 7 : 30 P . M .
Corrections to October 16, 1996 Public Hearing Minutes
1 ) Page 1 - delete (Family Group Center) and replace with Group Family Day Care Home ;
2) Page 2 - first sentence - insert the words it presently appears that after the word "that"
Approval of October 16 , 1996 Public Hearing Minutes
A motion was made by Nancy Weitzel and seconded by Mary Lou Hardesty to approve the October
16 , 1996 Planning Board Public Hearing Minutes (Iacovelli) as corrected .
A vote on the motion resulted as follows :
Carried Unanimously

A motion was made by Mary Lou Hardesty and seconded by William Farrell to approve the October
16, 1996 Planning Board Meeting as published .

Other Business :
Chairperson Horst said that he would like the Planning Board to discuss tonight is the demographic
materials that the Code Enforcement Officer has prepared and persons for a recommendation to the
Town Board to fill a vacancy on the Planning Board.
Angelheart Designs, Inc. - Request for Amendment to Local Law No. 1 of 1996
Susan Beeners summarized the Local Law No . 1 of 1996 that requires Angelheart Designs, Inc . to
obtain a variance from the Board of Zoning Appeals by October 1 , 1996 or remove the deck and 311

sewing room that are nonconforming parts of their structures . The BZA denied the variance request
and a letter was sent from the Code Enforcement Officer to tear down those items by December 23 ,
1996 or go to Town Court. She reported that she has received communications requesting an
extension to May 15 , 1996 to comply with the Local Law on the basis that it is a construction
difficulty . Matthew Engelheart is negotiating with a neighbor to obtain land so that it will not be
necessary to tear down the structures .
Chairperson Horst said that if additional land is purchased by Angelheart Designs, Inc . that would
bring them into compliance and the sewing room and deck would not be in violation. He does not
see where that would rectify the existing violation at this time .
Mary Lou Hardesty said that she thinks that we need to work with the businesses that are here and

that our goal is to encourage businesses come here . She does not think they should ignore this but
Matthew Engelheard of Angelheart Designs, Inc . needs time to straighten out the problem .
Bill Farrell said that he thinks there is a flaw in our zoning when your are required to tear down a
building this quick when you are in the process of remodeling. This structure encroaches less on the
right-of-way that the original silo structure that was there when the property was purchased .
Chairperson Horst said he has reservations of leaving a loop hole that if they do not meet the May
15 , 1997 date then we will extend it. When he made a visit to the facility before a proposal was
• submitted for the expansion they knew that they were not in noncompliance with the Town' s
regulations .
Susan reported to the Board that Angelheart Designs , Inc . Is a business that is growing very fast and
it is difficult for them to project space needs .
Nancy Weitzel said that it appears that the lot lines were divided poorly along a pasture or a field
without thought of setbacks and side yard requirements for the future .
RESOLUTION NO 27 OF 1996
A RECOMMENDATION TO THE TOWN BOARD
THE ZONING ORDINANCE RELTED
AMENDING LOCAL LAW NO. 1 OF 1996 AND
TO ANGELHEART DESIGNS , INC .

WHEREAS, Angelheart Designs, Inc . , located at 303 Gunderman Road in the Town of Danby has
requested the Enactment of a Local Law to Modify Local Law No . 1 of 1996 , in particular to extend
the deadline for bringing certain building features which have a nonconforming side yard setback
1 into compliance from October 1 , 1996 to May 15 , 1997 ; and
� WHEREAS, this is a Type II action for which no further environmental review is required; and
WHEREAS, the Town Board on November 11 , 1996 referred the matter to the Planning Board for
a recommendation; now, therefore, it is
RESOLVED , that the Town of Danby Planning Board hereby recommends to the town Board that
Local Law No . 1 of 1996 entitled "A LOCAL LAW TO
ESTABLISH MODIFIED GENERAL SITE
TO MODIFY THE BOUNDARIES AND
RTION OF
PLAN FOR PLANNED DEVELOPMENT ZONE NO.OCATEDPONSTHE SOUTH SIDE OF
TOWN OF DANBY TAX PARCEL NO . 9.- 1 9 ,
GUNDERMAN ROAD WEST OF COMFORT ROAD ' be amended as follows :
L That Section 1 , Paragraph 3 , Subparagraph (c )be amended by deleting the words
"October 1 , 1996 " in the second sentence thereof, and inserting instead "May 15 , 1997 " ; and;
2 . That Section 1 , Paragraph 3 , Subparagraph (f) be amended by deleting the words
"October 1 , 1996 in the second sentence thereof, and inserting instead "May 15 , 1997 " .

Other Business :
Susan presented a report showing building activity in the Town for 1996 to date and reported that
building in Danby shows a slight increase compared to the past three (3 ) years .

Planning Board Vacancy
Chairperson Horst asked the Board to think about persons who may be interested filling a vacancy
that exists on the Planning Board for a recommendation to the Town Board. Ken reported that he
has talked with two (2) business persons in the area and asked them to consider serving on the
Planning Board .
The Board discussed how to encourage persons from the business community to become involved
in Planning in the Town of Danby and the development of a new Comprehensive Plan.
Demographics :
The Board reviewed and discussed the 1980 and 1990 Census information that was distributed to
the Board in October by the Code Enforcement Officer.
The following concerns were discussed by the Planning Board :
1 ) How many residents use the public transportation (non-Cornelians) ;
2) Length of transit time to place of employment ;
3 ) Breakdown of age/sex pyramids showing how Danby compares with the County populations;
4) Trend for the aging of population in the 55 + range ;
5) Number and ages of children ;
Chairperson Horst said in the planning process the Board should look at the trends of the aging
population and their needs .
Susan suggested that the Board invite Barbara Blanchard to a meeting and that they review her report
on Affordable Housing in Tompkins County.
