Supervisor Oltz called the meeting to order at 6 : 03 P .M . and led all present to the Pledge of
Allegiance to the American flag .
Approval of Minutes :
Approval of the July 9, 1996 Town Board Minutes was deferred until the September 9 , 1996 Town
Board Meeting .
Additions or Deletions to Agenda :
Supervisor Oltz requested an addition to the Agenda of a resolution to transfer funds .
No Board Member objected .
Approval of Warrants :
West Danb Water District Fund Warrant No . 8 1996 - A s roved
A motion was made by Councilperson Steiner and seconded by Councilperson Inman to approve the
West Danby Water District Fund Warrant No . 8 of 1996 , voucher numbers 17 - 30 in the amount of
$647 . 30 .
A roll call vote on the motion resulted as follows :

Highway Department Fund Warrant No . 8 of 1996 - Approved
A motion was made by Councilperson Inman and seconded by Councilperson Steiner to approve the
Highway Department Fund Warrant No . 8 of 1996, voucher numbers 108 - 123 , in the amount of
$28 , 268 . 93 .

A motion was made by Councilperson Steiner and seconded by Councilperson Inman to approve the
General Fund Warrant No . 8 of 1996 , voucher numbers 212 -245 , in the amount of $7, 124 . 80 .

A motion was made by Councilperson Inman and seconded by Councilperson Steiner to approve the
Town Clerk ' s July 1996 Report as submitted .

Approval of Town Supervisor' s July 1996 Report
A motion was made by Councilperson Steiner and seconded by Councilperson Inman to approve the
Town Supervisor' s July 1996 Report as submitted .

PRIVILEGE OF THE FLOOR
Councilperson Steiner reported that the proposed Town of Danby Easement for NYSEG on Town
of Danby Highway Department property may have a significant impact . The Town Attorney has sent
a letter to NYSEG asking for clarification and a better understanding of how this will impact the use
of the property for storage of supplies and equipment . . There is also concern for the existing water
well, telephone and electric lines . The Town is not ready to sign an easement for the pipeline at this
time .
Supervisor Oltz reported on the following :
1 ) Initiative Grants for Town Hall Project - neither Assemblyman Luster nor Senator Randy
Kuhl were able to obtain local initiative grants for our Town Hall Project .

2) Fiscal Year 1997 Budget - request forms have been sent to all departments to be completed
and returned as soon as possible .
3 ) Town Insurance - Torn Corey will meet with Supervisor Oltz and Councilperson Schwartz
this week to discuss application specifications for supplying the Town Insurance package .
4) Gunderman Road Property - the owners of the property have withdrawn their offer of a gift
to the Town .
Town Clerk Carol Sczepanski asked the Town Board to volunteer to help serve ice cream at the Ice
Cream Social on Sunday, September 8 , 1996 at the Town Hall . The Ice Cream Social is an event
to celebrate the settling and bicentennial of the Town of Danby .

Joel Gagnon reported that the Tompkins County Land Trust is holding a fund raiser in West Danby
on Saturday, September 7 , 1996 . The West Danby Fire Department is having a chicken barbecue
the same day . There will be horse rides, interactive circus for children, and musicians .
Elizabeth Owens-Roe - Chair of the BZA reported that due to her teaching schedule this semester
she must resign from the BZA in October 1996 . She said she would continue through October and
recommended to the Board that they consider Joel Gagnon to replace her as Chair of the BZA and
Robert Roe as a prospective BZA member . If her schedule permits she would consider serving on
the Tompkins County Environmental Council this fall if the position has not been filled .

Petition for Submission of Town of Danby Resolution No . 41 of 1996 to Permissive
Referendum
The following Petition for Submission of Resolution to Permissive Referendum was filed in the
Office of the Town Clerk on August 7 , 1996 containing 98 signatures of local residents :
TO THE TOWN BOARD OF THE TOWN OF DANBY
WHEREAS , on the 8th day of July, 1996 , the Town Board did adopt a
TOWN
"RESOLUTION AUTHORIZING THE RENOVATION AND EXPANSION
HALL AUTHORIZING THE EXPENDITURES OF FUNDS FROM THE TOWN BUILDING
RESERVE FUND FOR SUCH PURPOSE, AND AUTHORIZING THE ISSUANCE AND
SALE OF SERIAL BONDS FOR THE BALANCE OF THE COSTS OF SUCH PROJECT" ,
and providing for the renovation and expansion of the Town Hall and providing for the financing
of same all as more particularly set forth in said resolution; and
WHEREAS, said resolution is subject to a permissive referendum;
NOW , THEREFORE, the undersigned being electors of the Town of Danby do protest against such
Resolution and hereby petition and request the taking of a referendum vote upon said Resolution as
provided for by statute" .
Motion to Accept Petition for Submission of Resolution to Permissive Referendum
A motion was made by Supervisor Oltz and seconded by Councilperson Johnson to accept the
petition entitled "Petition for Submission of Resolution to Permissive Resolution" , filed in the
Office of the Town Clerk .

Supervisor Oltz presented a draft article to the Board that she would like to have published in the
September 1996 Danby Area News related to the Projected Town Hall Renovation\Addition Project .
The Board revised the article and their suggestions will be included in the September issue of Danby
Area News .
RESOLUTION NO . 42 of 1996- Adopted
PERMISSIVE REFERENDUM DATE SET
By Supervisor Oltz : Seconded by Councilperson Johnson
WHEREAS, the Town of Danby Town Board has received a Petition for Submission of Resolution
to Permissive Referendum , and
WHEREAS, this petition contains the signatures of ninety-eight (98) electors of the Town and has
been filed in the Office of the Town Clerk on August 7 , 1996 , now be it resolved

RESOLVED, that the Town of Danby Town Board accepts the petition " Submission of Resolution
Permissive Referendum" , and be it further
RESOLVED, that the Town Board of the Town of Danby sets the date of Monday, October 7, 1996
for the Town Hall Referendum for Monday, from 12 Noon to 8 : 00 P . M . , Danby Town. Hall, 1830
Danby Road , Ithaca, New York .

PROPOSED LOCAL LAW NO. 2 OF 1996 "REVISED SUBDIVISION REGULATIONS " -
Postponed
A motion was made by Councilperson Steiner and seconded by Councilperson Inman to postpone
the Proposed Resolution for Local Law No. 2 of 1996 "Revised Subdivision Regulations" for further
review.
A vote on the motion resulted as follows :

RESOLUTION NO . 43 OF 1996 - Adopted
EXTENT OF DEADLINE FOR COMPLETION OF IMPROVEMENTS AND
CONVEYANCE - FIELDSTONE CIRCLE SUBDIVISION - Adopted
By Councilperson Inman : Seconded by Councilperson Johnson
WHEREAS , the developers of "Fieldstone Circle Subdivision" have requested that the Town of
Danby Town Board extend the deadline for completion and documentation of the roads and
associated Public Improvements in said subdivision from August 1 , 1996 to August 1 , 1997, and
have also requested that the Letter of Credit for completion and conveyance of the roads and
associated public improvements in said subdivision be reduced ; and
WHEREAS , the Town Highway Superintendent and the Town Code Enforcement Officer have
recommended that the deadline for road completion in said subdivision be extended from August
1 , 1996 to June 1 , 1997 ; and have recommended that no reduction in said Letter of Credit be
approved until more information is available as to any drainage improvements that may be required
by the N . Y . State Department of Transportation ; now, therefore, it is
RESOLVED, that the Town of Danby Town Board hereby approves the extension of the deadline
for completion, documentation, and conveyance of the roads and associated public improvements
until June 1. , 1997, conditional upon the Letter of Credit Number 51326 issued to the Town of
Danby' s benefit by Snyder County Trust. Company, in the amount of $ 62, 769 . 00, being extended to
August 1 , 1997 to reflect the extended deadline of June 1 , 1997 for completion, documentation, and
conveyance of the roads and associated public improvements ; and it is further
RESOLVED, that this resolution modifies only the August 1 , 1995 deadline for completion,
documentation, and conveyance of the roads and associated public improvements originally set forth
in the July 18 , 1994 Agreement between the developer (Northeast Homes, Inc . ) and the Town of
Danby, as such deadline and related terms were modified by Town Board Resolution No . 32 of 1995 ,

RESOLUTION NO . 44 of 1996-. Adopted.
ARCHIVES WEEK RESOLUTION/PROCLAMATION - Adopted
By Councilperson Steiner : Seconded by Councilperson Johnson
WHEREAS, archives help us anchor our rapidly changing society in the stream of time, document
our stewardship of the present, and remind us of our accountability to future generations, and
WHEREAS, archives are central to research and education, both now and in the future, and
WHEREAS, the archives of our governments protect the rights of citizens, support the effective •
operation of government and document the evolution of our democracy, and
WHEREAS, archives are essential to understanding the diversity of our society and the development
of our private and non profit organizations, and
WHEREAS, the sound selection, preservation, accessibility, and broad use of archival records vital
to the present and future citizens of the Town of Danby, and
WHEREAS , greater public awareness of archival conditions and increased support for archival
programs in the Town of Danby is urgently needed, and
WHEREAS, the second week in October is being celebrated statewide as NEW YORK ARCHIVES
WEEK,
NOW THEREFORE the Town of Danby Town Board, do hereby proclaim October 8 - 14 , 1996 as
ARCHIVES WEEK in the Town of Danby .

RESOLUTION NO . 45 of 1996
APPROVAL FOR HIGHWAY SUPERINTENDENT TO ADVERTIZE FOR BIDS FOR THE
PURCHASE OF A STRUCTURAL ALUMINUM BOX CULVERT - Adopted
By Councilperson Johnson: Seconded by Councilperson Steiner
RESOLVED , that the Town Board of the Town of Danby authorizes the Town Highway
Superintendent to advertize for bids for the purchase of a structural aluminum box culvert to be
placed on Valley View Road .

RESOLUTION NO . 46 of 1996
AUTHORIZATION TO SEND USED HIGHWAY EQUIPMENT TO AUCTION - Approved
By Supervisor Oltz : Seconded by Councilperson. Inman
WHEREAS , the Town of Danby Highway Superintendent has requested permission to send the
some old used equipment to the Used Equipment Auction, and
WHEREAS , miscellaneous scrap parts and equipment are stored at the Old Town Barns, the

Highway Superintendent would like to dispose of and send to the scrap yard, now be it
RESOLVED, that the Town Board of the Town of Danby authorizes the Highway Superintendent
to send the following used equipment to the County auction :

1962 Anthony Dump Trailer No . 218134
1962 Heil Tank Trailer No . 911039
• 1969 Brockway Tractor No . 61061
and be it further
RESOLVED , that the Highway Superintendent is authorized to send the scrap items from the old
Town Barn and the Highway barns to the scrap yard .

FUEL SUPPLIER FOR HIGHWAY DEPARTMENT - Approved
Highway Superintendent Hall reported that he would like to continue with Agway Petroleum as the
fuel supplier for the Highway Department as they provide adequate service .
RESOLUTION NO . 47 of 1996

WHEREAS, the Highway Superintendent reported that the current supplier of fuel for the Highway
Department is Agway Petroleum, now be it
RESOLVED, that the Town of Danby Town Board approves Agway Petroleum as the supplier of
fuel FOR the Highway Department.

RESOLUTION NO. 48 OF 1996 - TRANSFER OF FUNDS - Adopted
• By Supervisor Oltz : Seconded by Councilperson Steiner
WHEREAS , Sequoia Pacific Voting Equipment, Inc . reconditioned and repaired our voting
machines at a cost to the town of $2 , 490 . 00, and
WHEREAS, Tompkins County allowed an additional amount of $ 1 , 500 . 00 be reimbursed to the
Town through the Municipal Jobs Program, and
WHEREAS, these items of expense were not included in the 1996 budget, now therefore be it
RESOLVED, that $3 , 990 . 00 be transferred from contingency account number 1990 . 4 . An amount
of $2, 490 . 00 be added to elections account number 1450 . 4, $ 1 , 000 . 00 be added to youth program
account number 7310 . 4 and $ 500 . 00 be added to Danby Pond account no 7150 . 4 .

County Representative Report:
Representative Proto reported on the following : •
1 ) SARA Grants - Deadline for grant application is February 1 , 1997 .
2) Recreation Partnership Program - asked the Board to consider passing a resolution urging
the County Board of Representatives to support the County Youth Partnership Program. The
Danby youth participation was very high in numbers of participants .
3 ) Rural Affairs meeting in Groton and was well attended and many concerns of Tompkins
County rural communities were were discussed .
Downtown Business District - There is lack of support on behalf of the County for
funding of the Downtown Business District for the City of Ithaca .
Transit Planning for County - David Boyd from the County Planning presented a
plan that involved access to bicycle paths and recreational access to State Forest
Lands .
4) Cable 13 Access Channel - County Board may take action on some of the recent programing
that has appeared on the Public Access Channel related to County activities .
5 ) Public Budget Meetings - September 11 , 1997 at Boynton Cafeteria . Representatives can
submit names of persons who would like to be notified of meetings .
6) Properties in County for Foreclosure - Six (6) properties in Danby have been submitted
for foreclosure in 1996 and eight ( 8) properties from prior years .
7) Sales Tax Revenue - County revenues are up for the second quarter of 1996 and is slightly
ahead of 1995 .
8) Tompkins County Highway Expenditures in the Town of Danby - total expense to the
County Highway on roads in the Town of Danby was $201 , 000 . 00 for materials and
$ 150 , 000 . 00 for labor and equipment
9) Department of Social Services Building - eight buildings have been purchased and
demolished to make room for the new building . Many members of the Board are concerned •
with tax exempt properties .
Danby Youth Commission Report :
Kathy Lind reported that the Youth Commission will be meeting on Wednesday, August 14, 1996 .
County Youth Partnership Program :
Kathy Lind reported that the participation of Town of Danby Youths has increased from 29 in 1994
to 261 in 1995 and served 159 children at summer camp programs . The County Youth Partnership
program are asking the County for $35 , 000 . 00 for 1997 . The Town of Danby share to participate
may
increase $4, 000 . 00 in 1997 . Kathy asked the Town Board if it possible to use the Town Hall for a
Red Cross training program for teenagers .

No Board Member objected if the training sessions could be worked around other meetings in the
building .
Earl Hicks - East Miller Road - reported that the neighborhood is concerned with the unposted
speed limit in the East Miller Road area and is seeking information on how to get the speed limit
reduced .
Supervisor Oltz referred Mr . Hicks to Tompkins County Department of Public Works .
