PUBLIC HEARING
Proposed Subdivision 6 : 00 P .M. August 7, 1996

Public Hearing Declared Open :
Supervisor Mary Oltz declared the public hearing open at 6 : 00 P . M . and read the following "Notice
of Publication" :
"PLEASE TAKE NOTICE, that a public hearing will be held by the Town Board of the Town of
Danby on Wednesday, August 7 , 1996 at 6 : 00 P . M . , Danby Town Hall , 1830 Danby Road, Ithaca,
New York, to consider the adoption of a Local Law of the Town of Danby "AMENDING THE
SUBDIVISION REGULATIONS OF THE TOWN OF DANBY , NEW YORK" .
Any resident of the Town of Danby is entitled to be heard upon said proposed Local Law at such q.
public hearing either in person or in writing . Copies of said proposed Local Law are available for '
review at the Town Clerk' s Office, Danby Town. Hall , 1830 Danby Road, Ithaca, New York during
regular office hours .

Code Enforcement Officer Susan. Beeners addressed the Board and reported that she has submitted
a revised draft of the Proposed Local Law No . 2 of 1996 . The new draft contains miner technical
changes to the proposal and is shown as excerpts on the comparative draft version of the proposed
revisions . There have been no changes on the SEQR Review. A Certificate of Necessity has been
added to allow the Board to Adopt the regulations with the minor changes . There is a revised permit
application for granting of minor land divisions and a resolution attached for you to consider a
twenty-five ($25 . 00) fee for minor land division permits . The minor land division is to eliminate
public hearing by the Planning Board to grant minor land division of lots of less than five ( 5 ) acres
and minor boundary transfers .
Comments from the Public :
Mary Lou Hardesty - 50 South Danby Road and Planning Board Member hopes that this will be
approved and easier for applicants who want to split off a small piece of land .
Joel Gagnon - 2353 Spencer Road - supports the Revised Subdivision Regulations as the changes
are reasonable and to accommodate the applicants .
William Farrell - 581 East Miller Road - supports the revised Subdivision Regulations Proposal .

Proposed Subdivision Regulations
Councilperson Steiner - responded and asked if there were provisions under Section 3 for approval
by the Town Board for major subdivision.
Susan Beeners said that the Town Board would be involved if a subdivision involved a public road
or a water and sewer utility . A major subdivision would be over five ( 5 ) lots .
Councilperson Schwartz asked if the Town Board could overturn a Planning Board decision to
approve a subdivision .
Susan Beeners responded that the only mechanism for anyone to appeal a Planning Board decision
on a subdivision is to file an Article 78 proceeding. If it is a special use permit the Town Board can
hear an appeal .
Councilperson Steiner - asked if there was a the procedure for "Neighbor Notification" to property
owners within 500 feet of a proposed subdivision if it is not coming before the Board .
Susan Beeners said that "Neighbor Notification" procedure applies when a public hearing is
necessary .
Public Hearing Declared Closed :
Supervisor Oltz declared the Public Hearing closed at 6 : 25 P . M .
